Mandaue City plans to remove fish pens and desilt wetland to prevent flooding
MANDAUE CITY, Philippines – Mandaue City will be distributing notices to vacate to the owners of the fish pens at the city’s wetland in barangays Banilad and Cabancalan to start desilting the wetland to prevent flooding. Lawyer John Eddu Ibañez, City Legal Officer and head of the city’s Task Force APAS (Atoang Problema, Atoang Sulbaron), said that they are currently in communication with the owners. READ: Mandaue launches Task Force APAS to help solve flooding concerns Ibañez said that Mayor Jonas Cortes also asked to prepare the financial assistance to be given to the affected families whose livelihood lies in selling aquarium fish and other kinds of fish, like tilapia. The City Legal Officer said that they are determining the number of beneficiaries. “Paghinabi ta sa fish pens owners atoa sad timbang-timbangon kay panginabuhian man sad nila pero welfare manggud sa kadaghanan atoa gitan-aw,” said Ibañez. The city wants to clear the fish pens to dredge the silted wetland in hopes of helping solve the city’s flooding problem. READ: Cortes, Rama sign pact for rehab of 2 rivers The wetland with an area of 146,270 square meters, functions as a catch basin, that holds rain and run-off water coming from Mandaue City’s neighbors such as Cebu City. But because it was already silted and with the presence of water lilies, the water tended to backflow to Sto. Niño Village which is located at the back of the wetland. The area is being monitored by the City Disaster Risk Reduction Management Office and Housing Urban and Development Office, he said. “Dili mataro’ng og limpyo ang wetland area tungod sa mga fish pens,” said Ibañez. It can be recalled that the village which serves as a boundary between Mandaue and Cebu City experienced massive flooding last September 13 after the retaining wall of the fish pond collapsed. Drainage Clean-Up Aside from clearing the fish pond, other initiatives were also undertaken to address the flooding problem. Currently, the Task Force APAS continues to conduct the desilting and declogging of drainages and manholes choked with garbage. When there is heavy rain, they immediately position submersible pumps, to help drain the flood. Domestic aviation rebounds this year
The local aviation industry, which was badly hit by the global health crisis, is seen to achieve full recovery this year. This was according to the International Air Transport Association in a recent forum organized by the European Chamber of Commerce of the Philippines. During the Aviation Forum last week, Yuli Thompson, area manager for the IATA in Southeast Asia, said the Philippines and the rest of the Asia Pacific region’s aviation market is swiftly recovering and seeing a consistent rise in terms of growth in international and domestic travel. Thompson said passenger traffic trends for international flights in the Philippines were logged at 75 percent of 2019 levels as of June 2023. As for the Asia Pacific passenger forecast, Yuli maintained that domestic travel will fully recover in 2023, while international travel will occur sometime in 2026. Further, Asia Pacific will be seen to lead in traffic growth in the next 20 years. “However, overcoming current challenges riding on the current momentum, and meeting full recovery will require strong interventions from all players in the aviation sector,” he said. Infra investments For his part, Cebu Pacific Air chief executive officer Michael Szucs emphasized the need to invest in infrastructure, citing that “Philippine carriers will need to quadruple in size to cater to growing demand.” In her keynote speech, Secretary Grace Poe urged stakeholders to support necessary infrastructure investments, especially following the air system glitch incident earlier this year. The senator called for the acquisition of a new Communication, Navigation, and Surveillance/Air Traffic Management. Poe also recommended the hiring of a third-party maintenance provider for the CNS/ATM system. “It is my hope that the government, the private sector, and other stakeholders can work together and collaborate on air transport projects which will not only generate economic growth but also provide our people with excellent and affordable public services that can improve the quality of life for all,” she said. Also filed by Poe is Senate Bill 1121 which proposes the creation of a Philippine Transportation Safety Board. Under the directive of the current Marcos administration, Department of Transportation Undersecretary for Aviation and Airports Roberto Lim highlighted the government’s key priorities, including aviation safety and strengthening of learning institutions. Lim further noted the agency’s priority of strengthening the Civil Aviation Training Center and engaging with the private sector as close partners for Air Transport Skills Training and Development. “If we are able to train our air traffic controllers, we would not only meet our own requirements, but the requirements of other countries. We can develop this on an institutional basis,” said Lim. Open up the industry Kurt Edwards, director general of the International Business Aviation Council, also raised the fact that much could be gained “by opening the industry and making it more known to people.” In terms of managing safety risks, Captain Manuel Antonio Tamayo, director general of the Civil Aviation Authority of the Philippines, shared initiatives to advance safety capabilities in the aviation sector through the State Safety Program. The program employs a risk-based approach to regulations, capacity building and integration of a new organizational structure for monitoring and evaluation. Korea Export-Import Bank support to propel Phl’s transpo projects
The Export-Import Bank of Korea's (KEXIM) support to fund several Department of Transportation (DOTr) infrastructure projects will create exponential socio-economic growth by developing the country’s transportation landscape. This as the DOTr and KEXIM on Thursday held a coordination meeting to discuss and assess current projects funded by the latter such as the new Dumaguete Airport Development Project, the Philippine Coast Guard’s (PCG) Maritime Safety Enhancement Project, New Cebu International Container Port Project, and the LRT-2 Cogeo Extension in Rizal. MIAA demonstrates NAIA’s emergency response preparedness at CREX 2023
PASAY CITY — The Manila International Airport Authority (MIAA) showcased its emergency response capability and preparedness during the Crash and Rescue Exercise (CREX) 2023 at the airside premises of Ninoy Aquino International Airport (NAIA) on Friday, 4 August. The successful demonstration of this year’s full-scale simulated emergency CREX allows MIAA to ensure that the prescribed plans, guidelines, and organizational setup of the 8th edition of the NAIA Airport Emergency Plan 2023 adequately and effectively address emergencies occurring at or within the immediate vicinity of the country’s main gateway. “A dependable communication and coordination system is essential for a responsive Airport Emergency Plan (AEP). This exercise puts our communication and coordination system to the test, not only among MIAA offices but also with our external partner agencies,” said MIAA officer-in-charge Bryan Co. “We want to assess primary and secondary responders’ ability to respond to an aircraft crash and the resulting mass casualty event, including rescue and fire suppression, treatment and transport of survivors, and crash site security. The exercise also validates the methods for shifting from an emergency situation to normal airport operations following a potential major incident,” Co added. The scenario for CREX 2023 involved a commercial aircraft bound for Subic, CREX flight #0000, carrying 76 passengers and four crew members, that suffered a left engine malfunction during the take-off run after a flock of domestic pigeons crossing the runway was ingested into the aircraft's number one (left) engine, causing the aircraft to crash. The aircraft lost thrust on its number one engine during take-off. The pilot attempted to abort the take-off, but the aircraft veered off the runway and came to a stop on the western portion. A fire broke out on the left wing. In this mock incident, there were 80 casualties, with 72 survivors and eight deceased. In addition to the standard fire suppression, medical, emergency response, and search and rescue activities, this year's CREX edition featured the activation of Cebu Pacific's Accident Site Go Team, marking the first time MIAA partnered with an airline. “Cebu Pacific prioritizes safety and has established processes when it comes to emergency response. We thank the MIAA for the opportunity for us to train together to help ensure that communication systems are in place in the event of a multi-agency response,” Cebu Pacific President and Chief Commercial Officer Xander Lao said as the airline demonstrated its emergency response, particularly in providing support to victims as well as processing and cross-matching victims and family members. The CREX is held to continuously meet security standards set by the International Civil Aviation Organization (ICAO). In compliance with ICAO’s Suggested and Recommended Practices, the CREX is held every two years, but the full-scale exercise may not be conducted if the airport’s emergency plan was activated. The last full-scale CREX was on 19 October 2017. Several actual aircraft incidents in the succeeding years then brought to the fore MIAA’s emergency response capabilities. In August 2018, a Plan 1 emergency under its Airport Emergency Plan was activated when a Xiamen Air aircraft veered off the main runway while attempting to land during a heavy downpour. Barely two years after, another Plan 1 emergency occurred in March 2020, when a Lion Air medivac flight caught fire while it was rolling for take-off. The most recent involved a Saudia Airlines flight that went off the taxiway onto the grassy portion when its six right landing gears malfunctioned in June 2022. All passengers and crew were immediately evacuated and brought to NAIA Terminal 1. No one was hurt as a result of the incident. NAIA is rated as a Category IX airport, while MIAA’s current rescue and firefighting capability is Category X compliant, making it ready to respond to an airport emergency involving an Airbus A380. With the support of highly skilled fire and rescue personnel, a medical team well trained and experienced in aviation medicine, a fleet of modern firefighting and medical vehicles, pneumatic aircraft lifting systems, and various other rescue equipment, the MIAA Emergency Services department is on par with its counterparts in the region. “As this is a multi-agency response to a simulated emergency, assessment activities will be done after the exercise, where stakeholders are welcome to share their observations and raise comments and suggestions to improve our airport emergency plan and coordination system. The response is a community effort, and we appreciate everyone’s contribution in our quest to maintain the global standards of safety and security in NAIA,” Co said. “We would also like to thank our secondary responders for their support: Pasay City General Hospital, Ospital ng Parañaque, San Juan De Dios Hospital, Philippine Airforce, Las Piñas General Hospital, Philippine Coast Guard, Taguig City Fire Station, Manila Medical Center, Bureau of Fire Protection (BFP) – Makati, Philippine National Police Aviation Security Group, Las Piñas City Fire Station, BFP Parañaque, Philippine General Hospital, Philippine Red Cross – Pasay City Chapter, and the Metropolitan Manila Development Authority,” Co added. Dear Atty. Kathy, Our company recently changed management and I did not get along with my new department head. I got sick and even during my sick leave, my new head was bothering me with work. I could not take the harassment anymore, so when my sick leave ended, I filed a case for constructive dismissal. When my assistant was looking for me for the clients’ accounts that we were handling, I told her I am not going back to work anymore. A week after that, I received a memo from management directing me to explain my absence without leave and negligence of my job. I told HR that I will not reply to the memo since I already filed a labor case, but the HR Officer said they have not received a copy of my complaint. A relative advised me to answer the memo otherwise the company will think I just abandoned my job. Is my relative correct? Ariella Dear Ariella, According to the Supreme Court, abandonment, as a just and valid cause for termination of employment, is defined as the deliberate and unjustified refusal of an employee to resume employment, and constitutes neglect of duty under the Labor Code. To constitute abandonment, however, there must be a clear and deliberate intent to discontinue one’s employment without any intention of returning. In this regard, two elements must concur: (1) failure to report for work or absence without valid or justifiable reason, and (2) a clear intention to sever the employer-employee relationship, with the second element as the more determinative factor and being manifested by some overt acts. Otherwise stated, absence must be accompanied by overt acts unerringly pointing to the fact that the employee simply does not want to work anymore. Based on your narration, after your sick leave ended, you were absent without official leave, and the company sent you a memo to explain your absence and failure to do your job. However, you did not respond to the memo, and you have told your subordinate that you are not going back to work anymore. Your failure to respond to the directive in the company memo, taken together with your absence from work and communication to your subordinate that you are not going back to work anymore, may point to the conclusion that you abandoned your employment. Although your filing of a complaint for constructive dismissal has been repeatedly held by the Supreme Court to be inconsistent with a charge of abandonment (especially when such complaint is accompanied with a prayer for reinstatement), the act of filing does not foreclose the possibility of abandonment, as this is not the sole indicator in determining the employee’s intent. Fibernet Construkt Corp. along with Internet service provider Converge ICT Solutions Inc., have submitted to the local government an unsolicited proposal to build a fully underground fiber optic cable network for Cebu City along the city’s South Road Properties’ main road. FKC is in the business of building and maintaining broadband infrastructure facilities for telecommunication operators and internet service providers In their meeting with Cebu City Mayor Michael Rama, Converge chief executive officer and co-founder Dennis Anthony Uy, said he “could begin realizing Rama’s “dream of a city like Singapore for Cebu by placing all the lines of telecommunication companies (telcos) underground starting with those in the city’s main thoroughfares.” “He (Rama) asked me for my opinion. I told him it is too costly to put an underground cabling network for the whole of Cebu. It’s too expensive. Overhead expenses for underground cabling for power, for instance, is 10 to 15 times more. If you pass the costs on to consumers, they will raise a howl. So, I told him to start with telecommunications because that’s where you see a lot of ‘spaghetti wires.’ I think 50 percent of what you see are telecom wires which are no longer active,” said Uy in a media briefing during Converge’s official launch on Boracay Island recently. Bad experience “What happened during typhoon ‘Odette’ was a bad experience for Cebuanos. Utility posts were hit, and it took two months to put back on power,” he said. Thus, Uy is convinced that Cebu City badly needs to move all electricity and communication lines underground as part of its disaster resiliency strategy to prevent massive blackouts and connectivity losses during calamities like typhoons. For his part, FKC chief executive officer Jinho Kwon said FKC “intends to service the needs of the major telecommunications company and other service providers in Cebu City South Road Properties to enable them to provide full Telecommunication Broadband and Cable TV connectivity including Internet connectivity and other services in the said properties.” Unsolicited proposal Both Uy and Kwon personally went to Cebu City to present their unsolicited proposal to Rama. Kwon said the proposal is meant “ to support the Cebu City government’s direction to develop a Smart City with fully equipped and disaster resilient telecommunication network where information and communication technologies are utilized to increase operational efficiency and improve both quality of services and citizen welfare.” FKC is in the business of building and maintaining broadband infrastructure facilities for telecommunication operators and Internet providers. AFP seeks more EDCA sites
The Armed Forces of the Philippines said Sunday the establishment of additional Enhanced Defense Cooperation Agreement sites with the United States will provide the country with “360-degree protection” in the future. AFP spokesperson, Col. Medel Aguilar, said the expansion of EDCA sites will further help defend the country’s maritime territory so Filipinos can utilize its abundant resources within its exclusive economic zone. “If we are talking about the further expansion of the EDCA, I think this is possible [if] what we want is to protect because we are an archipelagic country and we have so many islands, we have a long shoreline,” Aguilar said, partly in Filipino, Sunday. “If we are to protect our sovereignty and territorial integrity including the protection of maritime resources that should be enjoyed by our people, we need a 360-degree protection capability for the Armed Forces of the Philippines,” he added. The Palace and the Department of National Defense earlier announced the establishment of four additional EDCA sites at the Naval Base Camilo Osias in Sta. Ana, Cagayan; Lal-lo Airport in Lal-lo, Cagayan; Camp Melchor Dela Cruz in Gamu, Isabela; and Balabac Island in Palawan. These are on top of five existing EDCA sites in the country, including the Bautista Air Base in Palawan; Basa Air Base in Pampanga; Fort Magsaysay in Nueva Ecija; Lumbia Airport in Cagayan de Oro City; and the Benito Ebuen Air Base in Mactan, Cebu. Defense only The DND and AFP said putting up more EDCA facilities primarily aims to boost the country’s defense capabilities and further protect the national interest of the Philippines. President Ferdinand Marcos Jr. has assured that the additional EDCA sites will not be utilized for offensive attacks amid the increasingly aggressive activities of China in the West Philippine Sea. On Saturday, Mr. Marcos said the Philippines and China have agreed to open more channels of communication to ensure that engagements between Chinese and Philippine forces do not escalate. Chinese Foreign Minister Qin Gang met this week in Manila with the President, Foreign Secretary Enrique Manalo, and other government officials. Qin’s visit was seen as China’s way of countering the growing influence of the United States in the Philippines, with the two nations holding their biggest Balikatan military exercises this year. Senate Committee on Foreign Relations Chairperson Senator Imee Marcos has questioned the selection of the new EDCA sites as they “seem to be random and no longer purposeful” for the modernization of the AFP. Selection process She also raised concerns that government seems to have given up the country’s territorial claims on the western and eastern Philippine seaboard. In response, Aguilar said the new EDCA locations have gone through a stringent and strategic selection process based on the country’s necessities and the need to improve the defense capabilities of the AFP. “In the selection, primarily we relied on the recommendation based on the AFP modernization roadmap,” he said, noting that the western and eastern seaboards of the country were also considered in locating the new EDCA sites. The DND earlier said EDCA will serve as a collaborative agreement between the Philippines and the US, enabling rotational activities to promote better disaster responses and humanitarian efforts.
