US, Iran release prisoners in $6 billion swap deal
The United States and Iran on Monday swapped five prisoners each in one of the arch-foes' first deals in years as Tehran gained access to $6 billion in frozen funds. The five Americans freed by Iran, including one held for eight years, flew out of Tehran in a Qatari jet, hours after the unblocked funds were deposited in accounts also managed by Qatar. The White House said it was "pleased to confirm" the plane carrying the freed Americans had left Doha, Qatar for the United States, and that President Joe Biden had spoken with the families of the Americans in an "emotional call". The five had walked in the setting sun on the tarmac in Doha, three of them with arms around one another's shoulders. One of them praised Biden for ignoring the political backlash and taking the "incredibly difficult decisions" that freed them. "Thank you, President Biden, for ultimately putting the lives of American citizens above politics," Siamak Namazi, a businessman held since 2015, said in a statement. Secretary of State Antony Blinken, who spoke to the released Americans by telephone after they landed in Doha, insisted the Biden administration had "no higher priority" than freeing US citizens. "It's very good to be able to say that our fellow citizens are free," Blinken told reporters in New York, where he and Biden are taking part in UN meetings. Two of the Iranian detainees arrived in Qatar, Iranian media said. The other three released by the United States have opted to remain there or in a third country. After quiet discussions led in part by Qatar, the two countries completed the exchange after the transfer of $6 billion in funds, frozen by US ally South Korea. The Biden administration has rejected criticism at home that it is paying "ransom," insisting the money will be used only humanitarian purposes, with a threat to re-freeze the funds if not. But Iranian foreign ministry spokesman Nasser Kanani, speaking earlier in Tehran, said the clerical state will have "total access" to the assets. Political risks for Biden Biden's Republican rivals have roundly denounced the deal. Republican Senator Mitt Romney said it would lead to "kidnappings". "The idea of basically paying to release, in this effect, a hostage is a terrible idea," he said. Mindful of political risks, Biden in a statement said he would "continue to impose costs" on Iran and announced sanctions against former president Mahmoud Ahmadinejad and the country's intelligence ministry. The sanctions were imposed over alleged deceit in the disappearance of Bob Levinson, a former FBI agent who disappeared in Iran in mysterious circumstance and is presumed dead. Biden in his statement did not mention that he granted clemency to five Iranians. A US official said that all were convicted or changed with non-violent crimes, with one already set to be released soon. Iran had generated the revenue through oil sales. South Korea froze the funds after Biden's Republican predecessor Donald Trump withdrew from a landmark nuclear accord and imposed unilateral US sanctions on buying oil from Iran. Iran's central bank governor said Iran would seek damages from South Korea. "We're making a complaint on behalf of Iran against South Korea for not giving access to these funds and the reduction in value of these funds in order to receive damages," Mohammadreza Farzin said on state television. The five Americans of Iranian descent -- all considered Iranian nationals by Tehran, which rejects dual nationality -- were released to house arrest when the deal was agreed last month. Besides Namazi, they include wildlife conservationist Morad Tahbaz, venture capitalist Emad Sharqi and two others who wished to remain anonymous. All were accused of spying or other crimes that they strongly reject. Tahbaz also holds UK nationality. Prime Minister Rishi Sunak said Britain was not involved in the deal but that he was "extremely pleased" he was free. A US official said that two more US citizens flew out of Tehran -- Namazi's mother and Sharqi's wife, who were not in prison but had ont been allowed to leave. According to Tehran, the freed Iranians include Reza Sarhangpour and Kambiz Attar Kashani, both accused of violating US sanctions against Tehran. A third prisoner, Kaveh Lotfolah Afrasiabi, was detained at his home near Boston in 2021 and charged with being an Iranian government agent, according to US officials. The two others, Mehrdad Moein Ansari and Amin Hasanzadeh, were said to have links to Iranian security forces. Nudge on nuclear? The swap was the first deal sealed by Biden with Iran's clerical rulers, who toppled the pro-Western shah in 1979 and are deeply hostile to the United States. Biden took office with hopes of restoring the 2015 nuclear agreement, under which Iran promised to constrain its contested nuclear work in return for sanctions relief. But months of talks failed to produce a breakthrough. Prospects to restore the deal sank further after protests broke out almost exactly a year ago in Iran following the death in custody of Mahsa Amini, who had been arrested for allegedly violating the country's Islamic dress code for women. Blinken said that the release of the prisoners "doesn't speak to anything else in the relationship," with the nuclear issue "a different track." Case of missing sabungeros now has directions- PNP Chief
The latest arrests of the six suspects in the case of missing sabungeros will give the Philippine National Police investigation a direction to its mastermind. This was how PNP Chief P/General Benjamin Acorda viewed the latest development to an almost three-year case that somehow would lead to the identification of the mastermind and others responsible for the crime. “With this development, the investigation will have a direction and hopefully this will convince, or this would encourage other witnesses to be dedicated to providing information,” Acorda said when he guested at the Saturday News Forum in Quezon City. Acorda was referring to the arrest of security guards Julie Patidongan, Gleer Codilla, Mark Carlo Zabala, Virgilio Bayog, Johnry Consolacion, and Roberto Matillano Jr. in two safe houses in Parañaque City. He added said they are also hopeful that the arrest of six suspects will convince, or encourage other witnesses to provide information. The Chief PNP also hinted that some of the six arrested suspects are willing to divulge further information on the matter. Acorda said they are hoping that the suspects would cooperate in the investigation for the PNP to finally identify the file charges against the mastermind and other suspects. “The most effective way to connect the mastermind is the suspects themselves. So I am hoping that they will talk,” Acorda said. “There are some indications that they would talk but we just want to wait and anything that they will say is of course needs the assistance of a lawyer,” he added. The suspects were arrested on Friday in Parañaque City after the PNP Criminal Investigation and Detection Group located their whereabouts through an informant and following a two-month surveillance operation. The six suspects were former security guards of the Manila Arena and we're listed as respondents for six counts of kidnapping and serious illegal detention in connection with the abduction of six cockfighting players. Acorda said two other people were collared and are now facing obstruction of justice for providing shelter to the six suspects. The abduction at the Manila Arena was among the series of cases of kidnapping of 34 cockfighting players. Police earlier said the kidnapping was related to allegations of game-fixing for online sabong during the Covid-19 pandemic. On the other end, the families of missing saunders John Claude Inonog, Rondel Cristorum, Mark Joseph Velasco, Rowel Gomez, and brothers James Baccay and Marlon Baccay filed formal complaints against the six security officers at the Manila Arena over their disappearance in January 2022. Complaints for six counts of kidnapping and serious illegal detention were filed on March 18, 2022, against the six suspects before the Department of Justice. The CIDG also filed a separate case for kidnapping and serious illegal detention in connection with the disappearance of the missing online sabong master agent Ricardo Lasco, who was reportedly abducted on August 30, 2021, in San Pablo, Laguna. Three former policemen linked to the kidnapping of Lasco have already surrendered. The DOJ in January 2023 filed kidnapping and serious illegal detention charges against six individuals allegedly involved in the disappearance of six sabungeros before the Manila Regional Trial Court. The families, however, withdrew from the cases last month, prompting the kin of other victims to express disappointment. CIDG nabs 6 suspects in missing cockfighters case
The Criminal Investigation and Detection Group on Friday arrested six suspects in the case of missing 'sabungeros' (cockfighting enthusiasts) in Parañaque City, Philippine National Police chief Gen. Benjamin Acorda Jr. said on Friday. According to CIDG chief Maj. Gen. Brig. Gen. Romeo Caramat Jr., the CIDG Region 4A arrested Julie Patidongan alias Dondon, Mark Carlo Zabala, Roberto Matillano Jr., Johnny Consolacion, Virgilio Bayog and Gleer Codilla at around 1:45 p.m. at Jackielou Village and Fortunata Village, both in Parañaque City, based on the arrest warrant for kidnapping and serious illegal detention issued by Regional Trial Court NCJR Branch 40, Manila, dated 24 January 2023, with no bail recommended. Acorda said aside from the six suspects, two companions of the suspects identified as Melchor Neri and Victorino Diocoso were also arrested for obstruction of justice. “I hope that with the arrest of these suspects, those who were reportedly backing out as witnesses may reconsider their position, and I do believe the case is still strong. We have enough evidence to continue with the case,” Acorda said in a press briefing held at Camp Crame. Acorda said the CIDG created Special Investigation Task Group “Sabungero” on 24 January 2022 to focus on the reported missing sabungeros. Based on the agency's investigation, at least 34 sabungeros have been reported missing as of this date. “I would like to commend the CIDG for their unrelenting efforts that led to the arrest of the six suspects. We hope that their arrest will give assurance to the families that the PNP have not reneged on their commitment to pursue this case until justice is served,” said Acorda. The Department of Justice has offered a P6 million reward for any information on the arrest of the six suspects. Acorda said that because police officers are not allowed to receive rewards and this goes to the action agents, the informants who are instrumental in their arrest will receive the reward, with the hope that this will convince others to support the PNP in manhunt operations against other wanted persons. A separate case for kidnapping and serious illegal detention was also filed by CIDG in relation to the case of the missing master agent of online "sabong" Ricardo Lasco, who was reportedly abducted on 30 August 2021 in San Pablo, Laguna. So far, the criminal complaints filed by the CIDG in the Manila Arena case and the case of Lasco have been found by the courts to have probable cause, resulting in the indictment of respondents through the issuance of arrest warrants. Lawyers seek De Lemos head for NBI blunder
A group of lawyers who requested anonymity for fear of reprisal blamed the recent significant mistakes of the National Bureau of Investigation on overstaying Director Medardo de Lemos and called for his immediate resignation. The Department of Justice confirmed that Jose Adrian “Jad” Dera, a co-accused of former senator Leila de Lima in her remaining drug case, was arrested by authorities on Wednesday, 21 June, after he allegedly went out from and came back to the NBI Detention Center. Dera’s lawyer says his medical condition necessitates his leaving the NBI premises, even as the NBI has its medical doctor. DoJ Assistant Secretary Mico Clavano said that “firearms, cash, and other contraband” were confiscated from Dera. Six NBI security personnel were arrested together with Dera. Dera is also implicated in the slaying of Negros Oriental Governor Roel Degamo last 4 March 2023. Lawyer Levito Baligod, legal counsel for the Degamo family, said that aside from Jad Dera, alleged co-mastermind Marvin Miranda also enjoys furlough from corrupt NBI officials, leaving the NBI Detention Center as he pleases. A reliable source inside the bureau revealed that the Degamo witnesses’ recantation started with the arrest of Marvin Miranda, the alleged recruiter of the killers of Gov. Degamo. The same source said that he is an asset/informant of a newly-appointed Chief of a District Office of a province near Metro Manila, promoted by the NBI Director De Lemos himself. The same source said that unknown to the public, it was kept from the Department of Justice officials’ knowledge that Miranda is an asset/informant of a newly-installed Chief of a District Office of a province near Metro Manila. The same Chief of the District Office is married to a lady agent who also was a newly-installed Bureau Chief. The same person is rumored to be the paramour of the NBI Director. She was reported to have been with the latter during a foreign trip. “Miranda is a Trojan horse who has a connection with the top officials of the Bureau. And this is just one of the many things that are eroding the morale of the career officers and personnel of the NBI,” the source said in dismay. The widow of Governor Degamo, Pamplona, Negros Oriental Mayor Janice Degamo, in her Facebook post, said; “I have lost my trust in the NBI… It is in this facility that all gunmen recanted (their testimonies). Paano nangyari yun?” She added that “as if the Bureau has no IDEA at all how things like this could happen. Tapos nangyari ito na nahuli si Dera??? Tapos wala itong kinalaman sa recantation? Hanggang saan sa NBI umabot ang P25 million?” “We would request another agency of the government to handle the Degamo case, wag na sa NBI (expletive),” Mayor Janice emphatically said. An NBI source said the recantation of testimonies of all 10 gunmen in the Degamo case is a first in the history of the Bureau. The same group of lawyers said De Lemos might as well resign. He should have retired weeks ago as he reached the age of compulsory retirement last 8 June having reached the age of 65. “The compulsory retirement age of the NBI Director is sixty-five (65). Said position cannot be reappointed because the position is technical and not confidential,” as stated in the description of the position of the NBI Director. Extended term A copy of a memorandum from the Office of the President circulated on social media dated 9 June 2023, signed by Executive Secretary Lucas Bersamin to Secretary of Justice Crispin Remulla, states “… Mr. De Lemos, who holds a coterminous appointment as Director (Director VI) of the NBI, is considered automatically extended in the service upon reaching the compulsory retirement age of 65 years on 8 June 2023, until the expiry date of his appointment which is until the end of the term of the President, unless his services are earlier terminated”. Executive Order 136 series of 1999 or the law Requiring Presidential Approval of Requests for Extension of Services of Presidential Appointees Beyond the Compulsory Retirement Age, however, states: “That Officials or employees who have reached the compulsory retirement age of 65 years shall not be retained in the service, except for exemplary meritorious reasons.” “The blunders at the NBI is surely not a meritorious reason for De Lemos to be extended in office,” one of the lawyers said. Also cited was a memorandum from Executive Secretary Salvador Madialdea, under then-President Rodrigo Duterte, dated 18 February 2021, and addressed to the heads of departments, agencies, offices, and instrumentalities of government, including Government-Owned or Controlled Corporations or GOCCs. “To ensure the effective and efficient delivery of service, President Rodrigo Roa Duterte has instructed the strict adherence of all concerned to Republic Act 8921, otherwise known as the Government Service Insurance System Act 1997, which provides that the compulsory retirement age of government employees is sixty-five (65) years. As such, the extension of service of government officials and employees who have reached the compulsory retirement age will no longer be allowed,” the memorandum read. Pasay sting nets 2 druggies
Pasay City policemen arrested two individuals including a minor in a checkpoint along EDSA. A report from the Pasay City Police Substation showed the two were arrested on 19 June at around 4:45 a. m. Authorities were conducting Oplan Sita along along EDSA Extension corner Park Avenue Extension, Barangay 79, Zone 10, Pasay City when they flagged down the duo riding a motorcycle without protective helmets. Instead of yielding, they disregarded the authorities and while trying to escape collided with a taxi which led to their arrest. The suspects were identified by P/Brig. Gen. Kirby John Brion Kraft, District Director of the Southern Police District, as Ronniel Hermogeno, also known as “Ronnel,” 22 years old and alias @Dic, 17 years old. Recovered from the suspects were one black Yamaha Mio Scooter without plate number, small heat-sealed transparent plastic sachet containing white crystalline substance suspected to be shabu weighing approximately two grams with a value of P13,600, improvised handgun, magazine, six live ammunition and a black belt bag. Complaints for violation of Republic Act 10591 (Comprehensive Firearms and Ammunitions), Section 11 of RA 9165 (Possession of Dangerous Drugs), RA 4136 (Traffic Code of the Philippines), and Article 151 of the Revised Penal Code (Resistance and Disobedience to a Person in Authority or the Agent of Such Person), as well as reckless imprudence resulting in damage to property is being prepared against the arrested suspects. Korean fugitive Arrested at NAIA
The Bureau of Immigration (BI) at the Ninoy Aquino International Airport (NAIA) arrested a South Korean fugitive wanted for involvement in telecommunications fraud in South Korea. In a report given to BI Commissioner Norman Tansingco, the BI Border Control and Intelligence Unit (BI-BCIU) identified the arrested fugitive as Jeon Jihoon, 37, who was intercepted on June 2 at the NAIA 1 terminal upon his arrival via China Eastern Airways flight from Shanghai, China. BI-BCIU Deputy Chief for Operation Joseph Cueto said that his men arrested the Korean after the BI officer who processed him noticed that Jeon's name was on the Interpol hit list of wanted foreign fugitives. Cueto added that after conferring with the BI Interpol unit, the immigration supervisors on duty were able to confirm Jeon's identity as the same person whose name registered a hit in the Interpol database. Jeon was later brought to the BI Warden Facility in Camp Bagong Diwa, Taguig, pending deportation proceedings. Tansingco has reportedly ordered that the Korean immediately undergo deportation for being an undesirable alien, so he could be sent back to Korea to stand trial for his alleged crime. He will then be placed on the immigration blacklist, which will ban him from entering the country in perpetuity. According to Interpol’s National Central Bureau (NCB) in Manila, Jeon was charged with telecom fraud before the Busan District Court in South Korea and issued a warrant of arrest on Feb. 24 last year against him. Jeon is accused of allegedly being a member of a voice phishing syndicate that impersonates himself as an agent of financial institutions by making random calls to other victims who are promised huge returns on their money. Hundreds of victims were reportedly lured into the scheme and enticed to deposit money, totaling more than 4.5 billion won, or roughly US$3.5 million, into the syndicates’ bank accounts. The story of the Waco siege — from the lawyer who got inside
Blood had already been spilled during the armed standoff between US agents and the Branch Davidian cult in Waco, Texas, when lawyer Dick DeGuerin got a phone call. The worried mother of cult leader David Koresh said her son needed legal help. She hired DeGuerin. He was the first outsider to pass through the security cordon and enter the Mount Carmel compound, where the Davidians were holed up. DeGuerin came face to face with a badly wounded Koresh, and was in position to try to broker an end to the stalemate. Three decades later, as the story pours forth from the 82-year-old lawyer, he remains convinced that the 51-day siege could have ended peacefully without the deaths of nearly 80 people. DeGuerin's account strikes a chord in today's deeply polarized United States, where some see Waco as a symbol of government overreach. Even now, a memorial at the scene of those killed draws hundreds of visitors a month. When DeGuerin got the call from Koresh's mother, he knew that the case was of a "magnitude" beyond anything he'd ever faced. "I had handled some big cases, but nothing like this," DeGuerin recalled from his office in Houston. "The world was watching." The Branch Davidians were founded in 1959 as a splinter from the Seventh Day Adventist church. They believed in the imminent return of Jesus, and Koresh emerged as their charismatic leader in the 1980s. In 1993, the Bureau of Alcohol, Tobacco and Firearms (ATF) accused the group of stockpiling weapons, and obtained an arrest warrant for Koresh and a search warrant for the compound, where there were also allegations of child abuse. On February 28, ATF agents raided the complex, a gun battle erupted, several people died, and a tense weeks-long standoff set in. As he prepared to enter the compound in late March, DeGuerin thought he had worked out a deal with Texas Rangers law enforcement officers to manage Koresh's surrender. FBI agents took the lawyer close to the compound in the back of a tank, stopping about 100 yards away. "My handler said, 'Would you like some body armor?' I said, 'No, I'm not afraid of the Davidians... I just don't want you FBI snipers shooting at me.'" DeGuerin didn't know what to expect, but said he found Koresh, 33, to be intelligent and articulate, and could see he had gunshot wounds to his torso and wrist. Koresh was "very angry" at the siege by the FBI and ATF agents. DeGuerin saw it as his mission to get Koresh out of the compound and into court "without anybody else dying." "I told him, of course, that the law is the law and he had to obey the law even though it might conflict with his religious beliefs. He understood that," he said. As negotiations ground on, DeGuerin returned to the compound with another lawyer, Jack Zimmerman, who represented one of the other cult members. Patience was wearing thin, particularly among federal agents. "There were the negotiators that wanted it to end peacefully. And then there were the tactical people that just wanted to rush in and kill anybody and arrest him," DeGuerin said. "The tactical people won." As a final showdown loomed, DeGuerin sought to go back and make a final appeal for Koresh to surrender to authorities. But he was turned away. "This FBI agent told me, 'We don't need you anymore.'" On that day -- April 19, 1993 -- FBI agents in armored vehicles smashed into the compound buildings and pumped in tear gas. The causes of the subsequent fires are still disputed, but the compound burnt to the ground, claiming more than 70 lives, including some 20 children. Investigations cleared law enforcement of wrongdoing, but Waco became a rallying cry for Americans accusing their government of abuse of authority, and it spurred growth of militias across the country. In 1995, on the second anniversary of the raid, Timothy McVeigh, who had driven to Waco to witness the siege, carried out the Oklahoma City bombing killing 168 people. For DeGuerin, 30 years on, the lessons of Waco are clear. The federal agents had grown convinced that Koresh "was fooling them again" and would not surrender, he said. "They didn't wait.
