VAWC cases in Davao City rise
The number of reported Violence Against Women and their Children (VAWC) cases in Davao City has increased in 2022 compared to the previous year, according to Lorna Mandin, head of the City Mayor's Office-Integrated Gender and Development Division (CMO-IGDD). Mandin revealed that the cases have risen to approximately 2,000, attributing the previous reduction during the pandemic to limited access and fear of going out. Most cases are from Talomo District, with victims aged 18 to 35 and 36 to 64. The increase in reported cases can be linked to more people reporting incidents compared to 2020 and 2021 when fear of Covid-19 deterred reporting. The IGDD handles cases falling under Republic Act 9262, involving perpetrators with an intimate relationship, not necessarily married. About 20 to 25 percent of these cases opt for psychological intervention. From January to December 2022, CMO-IGDD served approximately 1,206 clients, with 1,191 being women and 15 children. The department provides legal assistance, representation, and follow-up on cases, especially for those in remote areas. DOLE lauds outstanding Public Employment Service Offices across nation
The Department of Labor and Employment urged collective action to address the Philippines’ job problems on 25 October during the 23rd National PESO Congress in Palo, Leyte. DOLE Secretary Bienvenido E. Laguesma stressed in his speech the vital role of Public Employment Service Offices or PESO and DOLE’s frontline partners in promoting productive employment at the local level. “The responsibility of realizing the objectives of the Philippine Labor and Employment Plan and the Trabaho para sa Bayan Act is not the DOLE’s responsibility alone. It is jointly shared with our social partners, especially our PESOs. The challenges we face in our employment landscape demand collective action and innovative solutions,” Laguesma said. Laguesma also emphasized the need for open and constructive dialogue with PESO managers across the nation as he bared the department's five-point agenda, which includes strengthening its core functions, fortifying partnerships with employers and educational institutions and digitalizing public employment services. Crypto crackdown intensifies on Hamas finance
Cryptocurrency has become the latest front in the conflict between Israel and Hamas, analysts say. Israeli and US authorities have intensified their financial hunt into Hamas in recent days as they track illicit funds via digital currencies. Ari Redbord, global policy head at crypto tracking specialist TRM Labs, said there is now less crypto transfer activity on pro-Hamas support networks as a result. "We are seeing a lot less activity in some respects since the war began," Redbord told AFP. This is "primarily because Israel has been very aggressive and successful in taking down these fundraising efforts", he added. Israel has bombed Gaza in response to an unprecedented cross-border attack by Hamas militants who, while firing a massive rocket barrage, killed more than 1,400 people and took 222 hostages on 7 October, according to Israeli authorities. Israeli strikes have now killed more than 6,500 people in Gaza, according to the Hamas-run health ministry. Shadowy world Cryptocurrency is regarded as a speedy way to move cash that is unregulated by any central bank and is less traceable than a traditional bank transfer. How nations allow or restrict legal gender change
A small number of countries have made it easier for transgender people to change their legal gender, while other nations have restricted such changes, notably Russia and Pakistan. Here is a snapshot of the situation around the world. Exception, not the rule According to the International Lesbian and Gay Association (ILGA), 24 UN member states have legally allowed people to change their gender on the basis of self-identification. In about 40 other countries, the legal and administrative process can take years and may include requirements such as psychiatric diagnosis, hormone treatment, gender confirmation surgery, or even sterilization. Making it easier Argentina has led the way on transgender rights, allowing a change of gender on national ID cards with a simple declaration since 2012. Several Latin American countries have followed suit. Denmark was the first European country in 2014 to allow adults to apply for a gender change without undergoing medical or psychological assessments, with Belgium, Ireland, Malta, Norway, Portugal, and most recently Spain following suit. Since 2017, France has allowed transgender people to change their status on their ID documents without treatment, surgery, or sterilization but they must receive court approval. The issue of trans rights sparked a fierce row in 2022 in Scotland, where parliament passed a bill making it easier for people to self-identify their gender that was sensationally vetoed by London. The German cabinet in August 2023 signed off plans under which Germans will be able to change their name or legal gender by making a simple application to their local registry office. The law still has to go to parliament. Hesitating Sweden, one of the world's most liberal countries, was the first in the world to authorize physical and legal gender reassignment for adults in 1972. But last year it began restricting hormone therapy available for children diagnosed with gender dysphoria, such as puberty blockers, citing the need for caution following a strong increase in demand. It also restricted access to mastectomies for teenage girls wanting to transition. Finland in 2020 had already restricted hormone treatment for minors. Making it harder Russia adopted new legislation in July 2023 banning "medical interventions aimed at changing the sex of a person" and "the state registration of a change of gender without an operation". President Vladimir Putin has repeatedly railed against transgender rights in his speeches. Pakistan's religious judiciary ruled in May that landmark transgender legal protections from 2018 are un-Islamic and therefore void. An appeal is being sought with the Supreme Court. Pakistan continues to recognize the existence of a third gender, neither masculine nor feminine, as do India and Nepal. Restricting gender-affirming treatment, such as puberty blockers for minors, has become a major campaign of US conservatives. Arkansas in 2021 became the first US state to ban physicians and health workers from offering transition-related treatment to transgender minors. A federal judge in June overturned the ban. SC denies Senate certiorari petition
To maintain the separation of powers between the three departments of the government, the Court cannot exercise a power that belongs to the Senate Blue Ribbon Committee. This was stated in an SC en banc decision penned by Associate Justice Amy C. Lazaro-Javier, denying the petition for certiorari and prohibition filed by the Senate of the Philippines challenging the constitutionality of a memorandum issued by then President Rodrigo Duterte. In 2021, the SBRC started an investigation on the budget utilization of the Department of Health following a report from the Commission on Audit that there was a deficiency of P67,322,186,570.57 in public funds intended for the government’s Covid-19 response. The committee then conducted hearings on the following matters: the DoH’s underutilization of its 2020 budget; the procurement of Covid-19 vaccines by local government units; unspent funds, misstatements, irregularities, and deficiencies of the DoH, as found by CoA; and payment claims issues between the Philippine Health Insurance Corporation and private hospitals. Concerned officials from the executive department, including then DoH Secretary Francisco Duque lll, attended the hearings. But then Pesident Duterte, through Executive Secretary Salvador C. Medialdea, stopped the executive officials from attending the hearings, by issuing a memorandum dated 4 October 2021 directing all officials and employees of the Executive Department to cease attending the SBRC hearings on the government’s disbursement of the Covid-19 funds. The Memorandum also asserted that the SBRC inquiry has turned into a preliminary investigation of sorts meant to identify the persons allegedly liable for irregularities that existing statutes already defined and punish. It claimed that the SBRC has stepped into the mandates of other branches of government. Viewing the memorandum as an obstruction to the Senate’s constitutional function to conduct inquiries in aid of legislation, Senate Resolution 131 was passed, authorizing the filing of the present petition before the Court. PDEA: Drug-related deaths decrease
The Philippine Drug Enforcement Agency announced on Sunday that a 52-percent decrease in illegal drug fatalities was logged under the administration of President Ferdinand R. Marcos Jr. PDEA director general Moro Virgilio Lazo stressed that the renewed drug approach the PDEA’s strategy — in line with Marcos’ anti-drug campaign thrust — is geared towards community rehabilitation, going after drug syndicates and getting rid of unscrupulous officials. “There was a 52 percent decrease in the number of drug-related fatalities during operations initiated by the PDEA, dropping from 40 deaths in the previous period of 2020-2021 to only 19 deaths recorded from July 2022 to September 2023,” the PDEA said in a statement. However, the agency disclosed that the volume of confiscated shabu experienced a substantial rise, going from 2,349 kilograms of shabu in 2020-2021 to 3,795 kilograms in 2022 to 2023, marking a remarkable 1,446-kilogram increase, equivalent to 61.58 percent, under the Marcos administration. On top of these, the recent bulk seizures of 532 kilograms of shabu in Pampanga, 274 kilograms of shabu at the Manila International Container Port and the 990 kilograms of shabu in the possession of PMSgt Rodolfo Mayo last year are indeed indicative of the continued efforts of the anti-drug campaign to target and combat large drug syndicates operating in the country. From July 2022 to September 2023, a total of 47,076 anti-illegal drug operations were conducted, reflecting a 2.56 percent increase compared to the 45,902 operations carried out for the same period from 1 July 2020 to 30 September 2021. Russia is using its spy network, state-run media and social media to undermine public trust in elections around the world, according to a United States intelligence report released Friday that was shared with around 100 countries. “Russia is focused on carrying out operations to degrade public confidence in election integrity,” the report said, citing findings from the US intelligence community. “This is a global phenomenon. Our information indicates that senior Russian government officials, including in the Kremlin, see value in this type of influence operation and perceive it to be effective.” The assessment, which was sent in a cable to the embassies of around 100 countries in Europe, Asia, Africa and North America, comes amid heightened tensions between Washington and Moscow over Russia’s full-scale invasion of Ukraine. Russia engaged in a “concerted effort” between 2020 and 2022 to undermine public confidence in at least 11 elections across nine democracies, including the US, the report said. An additional 17 democracies were targeted through “less pronounced” methods involving Russian messaging and social media activity that sought to amplify domestic narratives related to election integrity, it added. Without naming the targeted countries, the report said the US government had shared with them information about the Russian operations. It alleged Russia utilizes both “covert and overt mechanisms” to influence elections. That includes influence networks managed by its security agency, the Federal Security Service or FSB, which covertly attempted to intimidate campaign workers in an unspecified European country’s 2020 election, it said. Russian state media amplified “false claims of voting fraud” in multiple elections in Asia, Europe, the Middle East and South America in 2020 and 2021, it added. Russia also exploited social media platforms and “proxy websites” to cast doubt about the integrity of elections in one South American country last year, the report said. “For Russia, the benefits of these operations are twofold: To sow instability within democratic societies, and to portray democratic elections as dysfunctional and the resulting governments as illegitimate,” the report said. The US recognizes its “own vulnerability to this threat,” the report said, reiterating that Russian actors sought to undermine public confidence in the 2020 election which President Joe Biden won against Donald Trump. In a media briefing, a US State Department official said Russia was encouraged to press ahead with election influence operations after its perceived success in spreading disinformation about the 2020 US election and the Covid-19 pandemic. “Russia is capitalizing on what it perceives as a relatively inexpensive success in 2020 in the United States to take this more broadly, globally,” the official said on condition of anonymity. Prosecutors reject Trump claim of ‘absolute immunity’
Federal prosecutors on Thursday rejected Donald Trump's attempt to have election conspiracy charges dismissed on the grounds that he enjoys immunity for actions he took while in the White House. "No one in this country, not even the president, is above the law," special counsel Jack Smith's team wrote in a 54-page motion filed with the judge presiding over the landmark case. Trump, the frontrunner for the 2024 Republican presidential nomination, is to go on trial in Washington in March of next year for allegedly conspiring to subvert the results of the November 2020 election won by Democrat Joe Biden. The former president's lawyers, in a motion two weeks ago to US District Judge Tanya Chutkan, argued that the charges should be thrown out because Trump is "absolutely immune from criminal prosecution." Prosecutors in the special counsel's office dismissed that argument and urged Chutkan to deny Trump's request. "He is subject to the federal criminal laws like more than 330 million other Americans," they said. "No court has ever alluded to the existence of absolute criminal immunity for former presidents. "The implications of the defendant's unbounded immunity theory are startling," they added. "It would grant absolute immunity from criminal prosecution to a president who accepts a bribe in exchange for a lucrative government contract for a family member," they said, or "a president who sells nuclear secrets to a foreign adversary." Trump's bid to invoke the presidential immunity defense is seen as a long shot by legal observers but it could result in a delay to the start of the trial as the argument potentially winds its way up to the conservative-dominated Supreme Court. Trump's attempts to use the "absolute immunity" defense in other cases have been rebuffed by judges, but the nation's highest court has never ruled directly on whether a former chief executive is immune from criminal prosecution. Trump is the first former US president to face criminal charges. 'Unsettled question' Trump's attorneys, citing a Supreme Court case involving former president Richard Nixon, said the law provides "absolute immunity" to the president "for acts within the 'outer perimeter' of his official responsibility." As chief executive, they argued, Trump had a responsibility to "ensure election integrity" and was within his rights to challenge the results of the 2020 vote. "As President Trump is absolutely immune from criminal prosecution for such acts, the Court should dismiss the indictment," they said. While making the argument that Trump cannot be prosecuted, his lawyers acknowledged the Nixon case they cited involved the civil liability of a former president and not alleged criminal conduct. "The question remains a 'serious and unsettled question' of law," they said. The case before Chutkan accuses Trump of conspiracy to defraud the United States and conspiracy to obstruct an official proceeding -- the January 6, 2021 joint session of Congress that was attacked by a mob of Trump supporters. Other criminal cases against Trump include racketeering charges in Georgia for allegedly conspiring to upend the election results in the southern state and a trial in Florida in May 2024 on charges of mishandling top-secret government documents. Trump and his two eldest sons are also currently involved in a civil fraud trial in New York for allegedly inflating the value of their real estate assets to receive more favorable bank loans and insurance terms. Youth backsliding on tobacco use feared
Public health advocates in the Philippines expressed growing concern on Thursday over the escalation of influence by the tobacco industry, which they say threatens the health and welfare of young Filipinos. At the launch of the 2022 and 2023 Tobacco Industry Interference Index Country Reports, the advocates warned that the downward trend of smoking in the country could be reversed, and more young people could become addicted to nicotine products if the situation is not addressed. “The tobacco industry has proven just how relentless they are in using their political and marketing machinery to assert their interests via interactions with the government,” said Rom Dongeto, convenor of the Child Rights Network and executive director of the Philippine Legislators’ Committee on Population and Development. “We need to stop tobacco companies from targeting children and youth, especially through online platforms, in the propagation of their deadly vapes and cigarettes,” he added. The 2022 and 2023 TII Index Reports found that the Philippines’ score has consistently increased over the years, indicating the increasing influence of the tobacco industry and the government’s failure to combat interference. The country’s score rose from 45 in 2017 to 54 in 2018 and 57 in 2019. At the height of the Covid-19 pandemic, scores rose to 54 in 2020 and 58 in 2021.
