Dear Atty. Joji, Our Manager was charged with policy violations and fraud. Pending administrative investigation, he was placed under preventive suspension without pay for a period of 30 days. Later, it was discovered that he approved payments for work not done and involved unaccredited third parties, as such it is recommended by the management that his preventive extension be extended. May an extension of the period of preventive suspension be imposed for a separate or distinct offense upon an employee? Anthony *** Dear Anthony, Yes, a subsequent preventive suspension may be imposed for a separate or distinct offense upon an employee. Whilethe provisions regarding preventive suspensions found in Sections 9 of Rule XXIII, Book V of the Omnibus Rules, asamended by Department Order No. 9, Series of 1997, limits the period of preventive suspension to 30 days, such timeframe pertains only to one offense by the employee. In the case of Smart Communications Inc. v. Solidum,G.R. No. 19776; 7 December 2015, the Supreme Court ruled that: “The respondent was validly placed under second preventive suspension for the reason that pending investigation of separate and distinct set of offenses committed by therespondent, as contained in the second Notice to Explain, his continued presence in the company premises duringthe investigation poses serious and imminent threat to the life or property of the employer and co-workers. The Courtfurther ruled that these newly discovered transgressions would, thus, require an additional period to investigate.”By a preventive suspension, an employer protects itself from further harm or losses because of the erring employee.This concept was explained by the Court in Gatbonton v. National Labor Relations Commission: An employee may be placed under preventive suspension, when: The evidence of guilt is strong, and the employer or head of establishment is convinced that the continued stay of the employee during the period of investigation constitutes a distraction to the normal operations of the company; and His continued employment poses a serious and imminent threat to life or property of the employer or his co-workers As such, for an offense, the preventive suspension cannot go beyond 30 days. However, if the employee is charged with another offense, then the employer is entitled to impose a preventive suspension not to exceed 30 days specifically for the new infraction. Indeed, a fresh preventive suspension can be imposed for a separate or distinct offense. Thus, an employer is well within its rights to preventively suspend an employee for other wrongdoings that may be later discovered while the first investigation is ongoing. Hope this helps. Atty. Lee became a Commissioner at the Securities and Exchange Commission in 2019. While his position may be formidable, those who have met him in person can attest to his kind-hearted nature and willingness to devote his time generously. When expressing his views, he displays a remarkable level of candor, always taking the time to carefully consider his words before speaking. Aside from his sense of humor, Lee possesses a remarkable ability to engage in meaningful conversations. When he speaks, he has a way of looking directly into your eyes, underscoring the significance of his words. Even in intense situations, he maintains a calm demeanor and is known to offer a comforting smile, lightening the atmosphere. In his role as Commissioner at the SEC, Atty. Lee assumes the responsibility of overseeing various crucial departments and divisions. These include the markets and securities regulation department, the information and communications technology department, the PhiliFintech innovation office dedicated to Philippine financial technology, and the international affairs and protocol division. Moreover, he holds authority over capital markets, sustainable finance, Fintech and information technology, and international affairs, ensuring their effective management and implementation. While the enormity of those tasks might induce vertigo in most individuals, Atty. Lee remains unfazed. “It is perhaps the best job I have ever had,” he admitted. “I enjoy making a positive change in the sector I am handling. After completing his schooling in Davao, he ventured to Beijing, China, where he pursued studies in the Chinese language and gained work experience with a foreign company. However, after two years, he returned to the Philippines and enrolled in Ateneo de Manila University to pursue a law degree. This journey showcases his diverse experiences and the foundation of his educational and cultural background. “The Ateneo de Manila entrance exam was the only one I could take that year when I came back from China,” he said, adding that he never dreamed of becoming a lawyer. “I just wanted to give it a try. And found I was a surprisingly good fit for it.” As a lawyer, he has five ideal lawyers. Only one is a foreigner: Sir Thomas Moore, an English lawyer, social philosopher, author, and statesman whom Roman Catholics venerated as Saint Thomas More. “He stood by his faith and principles,” he said. Fresh from hurdling the Bar exam, he worked at the Siguion-Reyna Montecillo and Ongsiako law firm, where he learned the importance of being enterprising and putting in a diligent effort to succeed. However, despite his professional growth, he decided to quit and return to his hometown of Davao, placing the deeply rooted value on family and prioritizing personal and familial responsibilities above career pursuits. As a father to two daughters, Atty. Lee expressed that fatherhood has had a profound impact on him, bringing about significant changes. He considers it one of the greatest blessings he could ever receive. According to him, the love that his children show him is genuine and unmatched. He believes that the love of young children is unparalleled. Experiencing this level of love is indescribable, knowing someone loves you unconditionally. This extraordinary bond makes fatherhood one of the most precious and fulfilling aspects of his life. “The love your kids show you is real,” he said. “You will never be as loved as you are by your young children. Michelin to rate hotels as well as restaurants
From stars to keys -- the Michelin Guide will start rating hotels in the same way as restaurants, it announced on Thursday. The editors say they want to create a "trusted reference" that helps travelers cut through the vast array of online hotel suggestions. Director Gwendal Poullennec said the original Michelin Guide, launched in 1900, "was created to enlighten travelers at a time when there was a lack of information. "Today, by contrast, they find themselves confronted by a mass of information. Our users spend on average 10 hours in front of screens to prepare a trip and consult more than 10 platforms -- it's an obstacle course," he said. Poullennec took over the guide in 2018, the same year it bought Tablet Hotels, a US-based site offering boutique hotel stays around the world. Their teams have been working together to create an initial selection of 5,300 hotels across 120 countries, with the best due to receive their awards in the first half of 2024. Rather than the stars awarded to the top restaurants, the best hotels will get keys based on several criteria including architecture, individuality, service, comfort and price. As with restaurants, these will be decided by teams of anonymous inspectors. These days, the Michelin Guide makes most of its money through referrals from its website, taking one euro per reservation. Thousands of rice farmers treated to PhilRice field day
Thousands of farmers across the country had been feted in the traditional Lakbay Palay field festival, where all eight stations of the Philippine Rice Research Institute (PhilRice) opened their doors for farmers to personally view the progress and benefits of the latest palay seeds technologies done in the premier rice research institute of the country. Department of Agriculture Undersecretary for Rice Industry Development Leocadio Sebastian said the dry season Lakbay Palay is held every March or April and the wet season every September or October. Sebastian said the participants toured the 140 hectares of PhilRice field in Science City, Nueva Ecija. The farmers also had the chance to look into the available seeds and soil nutrients of the private sector exhibitors during the two-day festival from 27 to 28 September. Farmers learn PhilRice-developed technologies which include Palayamanan system, a rice-based farming system they can adopt to lessen the economic effects of El Nino, high yielding varieties and farm machinery, according to DA official. He added that about 10 public and private agencies and cooperatives also pledged their support to the “BIDA RiceBIS, Be the rice’s best” movement, which aims to increase farmers’ market opportunities. The regular Lakbay Palay, which started in 1992 as Farmers’ Field Day, was changed into Lakbay Palay in 2012 under the administration of PhilRice Executive Director Eufemio T. Rasco Jr. It held before October each year or the start of the planting season for the dry season crop. The 2023 Lakbay Palay wet season festival was simultaneously held in all eight stations of PhilRice with the biggest festival held at the PhilRice Central Experiment Station in Munoz, Nueva Ecija. The other stations that held simultaneous Lakbay Palay were Batac, Isabela, Los Banos, Bicol, Negros, Agusan and Midsayap. The farmers that attended on both days of the Lakbay Palay in Nueva Ecija were from Zambales, Bulacan, Pangasinan, Nueva Ecija, Nueva Vizcaya, Tarlac and Aurora provinces. The farmers were divided into 500 persons a day but the number was exceeded on the second day as many walk-ins showed up. PhilRice Executive Director Dr. John de Leon said farmers are welcome to visit the 140-hectare research and development farm and the new Crop Protection Division for any of their inquiries and concerns. PhilRice Deputy Executive Director for Development Dr. Karen Barroga urged the farmers to work in clusters so they could meet the required rice volumes of potential private sector partners for their produce. She cited the case of Negros Occidental farmer-cooperative who is now selling 500 bags a week to Merzci, a famous palalubong and fastfood chain in the region for its business and corporate social responsibility activities. This was made possible through the Rice BIS (Business Innovation System) of PhilRice, which links farmers to private sector buyers so they can enjoy better market prices for their produce. Another partnership was forged by PhilRice between the farmers of Zambales and Bicol who are now supplying the Kiwanis International for their feeding programs for poor communities, she said. Dr. Val Perdido, who represented Undersecretary Leocadio Sebastian for Rice Industry Development, exhorted the farmers to improve their yields using both new technologies and better farming practices so the country can meet its food sufficiency and nutritional goals and improve the farmers’ incomes. He said Nueva Ecija farmers have proven yields of six tons a hectare but most other areas produce four tons or less. He mentioned that the Department of Agriculture is giving production assistance to farmers (in fertilizers and biofertilizers) in addition to the certified seeds, training and machineries provided under the Rice Competitiveness Enhancement Fund (RCEF) program. A farmer cooperative officer, Vincent Gonzales of St. Vincent Parish Multupurpose Cooperative in Dupax del Sur, Nueva Vizcaya narrated to the participants that their coop was founded in 1979 by a Belgian priest to help farmers– who borrow from loan sharks for their daily subsistence with a capital from 400 members of P4,000 has now grown to 5,600 members with a total material asset of P424 million. The coop is now able to support members through loans and social development activity, scholarship grants, medical assistance and food packs (for the disabled and the aged). It had received numerous awards including the Most Outstanding SIPAG award in 2022 from Senator Cynthia Villar. Appeal to Pope Francis: Restore the Mediatrix
Devotees are appealing to Pope Francis to restore the Mediatrix because there is evidence that the 1951 Pope Pius XII decree, which declared the Mediatrix apparitions not “of supernatural origin,” has been proven invalid, including all subsequent Church decrees to suppress the Mediatrix devotion in the last 70 years. The Vatican allows Mediatrix devotion (prayers, novenas) but bans any Church activity in reference to the apparition. The 1951 Pius XII decree is invalid because it is not found in the Acta Apostolicae Sedis, a requirement for a decree to be binding, according to Canon Law. The decree is considered “non-existent” even though the Holy Office (the Congregation for the Doctrine of the Faith back in 1951) issued a similar decree, which was not binding. Only the Pope can issue such an official decree, according to Canon Law. On 11 December 2015, Gerhard Cardinal Muller, as head; and Archbishop Luis Ladaria, SJ, as the secretary of the CDF, the Vatican office in charge of investigating Marian apparitions, issued Protocol 226/1949 which hinted at the non-existence of the Pius XII decree. Archbishops of Lipa Mariano Gaviola and Ramon Arguelles, during their respective tenures, separately asked the CDF for the documents on the status of the 1951 disapproval of the Lipa apparitions. After the CDF failed to give this, Gaviola permitted public veneration of the original image of the Mediatrix, and Arguelles issued a decree lifting the ban on Mediatrix veneration, which they could do under Canon Law, and which resulted in the erroneous CDF Protocol 226/1949, quoted below. “11. Archbishop Ramon Arguelles, in a letter dated 7 October 2009, requested permission to examine the archives of the Congregation for the Doctrine of the Faith, regarding the phenomenon at Lipa. Shortly thereafter, on 12 November 2009, Archbishop Arguelles issued a decree by which he ordered that ‘all bans written or unwritten intended to curtail or diminish the devotion to Mary Mediatrix of all Grace be lifted’ and ‘ that a new commission be formed to review the documents on the alleged apparitions of 1948 as well as to compile additional documents from the period up to the present.’” “12. After examining its archives, and discovering the error in Archbishop Ramon Arguelles’s assumption that the matter of the phenomenon of Lipa was still open to discussion, the Congregation for the Doctrine of the Faith, in a letter dated 20 March 2010, responded to Archbishop Arguelles, informing him that the decision communicated by the Episcopal Commission in 1951 was, in fact, a decision approved by the Holy Father and, therefore, the matter no longer rested under the authority of the Archbishop.” Under Canon Law, Arguelles and Gaviola, as bishops of the Lipa diocese, had the right to be provided a copy of the Holy Office-Pius XII decree, if it existed at all. When it was not given, under Canon Law, Arguelles and Gaviola had the right to lift the ban on Mediatrix devotion. The CDF claim that the matter was no longer “open to discussion” is false and is a contravention of Canon Law, which states that, in the absence of a Vatican decree, local bishops had a right to act on their own authority. The CDF, in Protocol 226/1949, wrongly blamed Gaviola and Arguelles for violating Vatican protocol.Both the Holy Office of 1951 and the CDF of 2015 committed the “sin” of not reporting that the Pius XII decree was not registered in the Acta. Muller and Ladaria , who have retired from the CDF, should be investigated by Pope Francis. No one in the entire Church knew that the Pius XII decree was non-existent for seven decades up to this very day, except for a few who did not come out in fear of Vatican repercussions. The CDF claim that the “Episcopal Commission in 1951 was in fact a decision approved by the Holy Father” is completely baseless. The Episcopal Commission issued its decision on 11 April 1951, while the Holy Office-Pius XII issued its decision two weeks before on 28-29 March. How could the Holy Office issue a decision on a still non-existent future Episcopal Commission decision? Mediatrix devotees are appealing to Pope Francis to retract Protocol 226/1949, restore the images of Bishops Gaviola and Arguelles, and stop the suppression of the Philippine clergy and the Marian devotees, in the name of the Virgin Mary whom we all love. The community is brought together via traditional fabrics and inventive weaves, Adelaida Lim, the former president of HABI, stressed, demonstrating their diversity and expert craftsmanship. “The way textiles tie and bind us to each other,” Lim said. “The country’s traditional textiles and the innovative weaves various groups of Filipinos have come up with are truly wonderful,” she added. “The diversity and beauty of finished products, and the consummate skill it took to make them are something we can all be proud of!” Designer Len Cabili, a strong advocate for traditional textiles and the woman behind Filip+Inna, praised HABI’s efforts in “pushing weaving into the forefront of Philippine culture.” Cabili highlighted how these textiles are a profound expression of the country’s culture and a testament to the “true value of handcrafted textiles and the unique processes” of its artisans. Following the challenges posed by the pandemic, the fair will host an impressive 72 vendors, including Creative Definitions, Ditta Sandico, Gifts and Graces and Ruyag PH, who represent numerous regional and cultural groups around the Philippines. The vendors will display a wide array of hand-woven products, including textiles, ready-to-wear clothes, bags, shoes, home accessories and furniture made from materials like piña, abaca and cotton.
