Senate resolution, unnecessary and inappropriate
The Senate resolution condemning China for its “continued harassment” of Filipino fishermen and “incursions” into Philippine waters in the contested China Sea, and urging the government to raise the issue of Beijing’s intrusive actions before the United Nations General Assembly as being violative of the 2016 arbitral ruling in favor of the Philippines, was passed unanimously last Tuesday. The Senate resolution is both unnecessary and inappropriate. Unnecessary because most, if not all, of the members of the Senate, have on various occasions and platforms expressed individually each position on the matter. Each senator has expressed his/her opposition and condemnation of China’s continued coercive actions against our fisher folks and coast guards. Every one of them at one time or another made his/her assertion of the Philippines’ sovereignty and territorial integrity. Each of them has expressed outrage at China’s refusal to honor the Permanent Arbitration Court’s decision nullifying China’s expansive claims and validating the country’s sovereign rights over its exclusive economic zone or EEZ and continental shelf. Since their individual positions on the matter of China’s coast guards and militia bullying our fishermen and coast guards in the country’s waters have been made known, why do they have to make a resolution expressing their sense as a body? It’s an act of redundancy. Inappropriate, for the reason that the President of the Philippines has invariably declared at different times his unequivocal assertion of the country’s independence and enforcement of the arbitral award, as well as filed diplomatic protests, against the unlawful and unwelcome intrusions by China in the West Philippine Sea and therefore being the Chief Architect of foreign policy, it behooves the members of the Senate to respect it — and not to intrude into the former’s domain. The senators must remember that the Constitution has allocated — and demarcated — the functions and duties of the three branches of government. The executive branch enforces the law, the legislative branch passes laws, and the judicial branch interprets the laws and imposes penalties for those violating them, and rules on conflicting claims. The President is the Head of State, and the head of government is composed of the aforesaid three branches. When the President speaks officially on matters of national security and national interest, and makes a pronouncement on a particular policy, in this particular case vis-a-vis the disputed waters in the South China Sea, the two branches cannot go against it, nor undermine it, by issuing contradicting statements or making it appear that it is wanting and ineffective, unless the presidential pronouncement is blatantly and evidently in violation of the Constitution. President Ferdinand Marcos, Jr.’s stand on China’s intrusions into Philippine waters is correct. He said his presidency will not surrender any square inch of the Philippine territory. It will continue to assert its sovereignty and will pursue the enforcement of the arbitral ruling even as it continuously protests Beijing’s intrusions. There is no need therefore for the legislative branch to make a separate position apart from the President’s. It cannot also dictate or teach the President in the matter of ways to enforce the ruling like bringing it to the attention of the United Nations, as if the latter is unaware of it. They forget that two Presidents, former President Rodrigo Roa Duterte and President Ferdinand Marcos Jr., have already addressed the general assembly of the United Nations articulating, among others, the country’s affirmation of its independence and sovereignty and invocation of the validity and immutability of the arbitral award. The United Nations and the rest of the world know the conflict involving China and the Philippines. Many countries, like the United States, Japan, Australia, and the European Union, have already expressed support for the Philippines’ stand. The Senate resolution, wittingly or intentionally, makes it appear that the President’s position is weak, or his defense of our sovereignty is insufficient, hence they need to goad him to do better or embarrass him when the truth is — the said resolution makes for an impertinent and insulting narrative. If they could not yield to the temptation of a public outcry, and they feel the need to unleash their sentiments for the President to hear them, with the sincere intention of helping him, why didn’t they write him instead or whisper to him in confidence? Japan, U.S.: ‘We got your back’
Key allies of the country expressed their unwavering support after a Chinese Coast Guard ship intentionally collided with a Philippine Navy boat to stop a resupply mission to the grounded BRP Sierra Madre on Ayungin Shoal. Defense Secretary Gilbert Teodoro Jr. described the maneuver as an escalation of China’s aggression within the exclusive economic zone of the Philippines. Japan issued a statement expressing support after the incident. “Japan expresses serious concern for actions which increase regional tensions, including a dangerous action that caused a collision between Chinese and Filipino ships on 22 October,” the Japanese Foreign Ministry said. Citing the Japan-Philippines Joint Statement last February, the Foreign Ministry said the “government of Japan concurs with the Philippines’ long-standing objections to unlawful maritime claims, militarization, coercive activities, and threat or use of force in the South China Sea.” “Furthermore, Japan highly appreciates the government of the Philippines for having consistently complied with the arbitral tribunal’s award as to the disputes between the Republic of the Philippines and the People’s Republic of China regarding the South China Sea, and has shown its commitment to the peaceful settlement of disputes in the (West Philippine Sea), as stated in the statement by the Foreign Minister of Japan issued on the occasion of the seventh anniversary of the issuance of the award,” it said. Japan said it would continue to cooperate with the international community, such as the members of the Association of Southeast Asian Nations and the United States, to “protect free, open and peaceful seas.” ‘Ironclad’ vow The United States, meanwhile, reiterated its “ironclad” commitment to the Philippines. According to a White House statement, US National Security Adviser Jake Sullivan assured National Security Adviser Eduardo Año of US support in safeguarding its sovereign rights in the WPS under the Mutual Defense Treaty between both nations. “Sullivan reiterated US support for our Philippine allies following the PRC Coast Guard and maritime militia’s dangerous and unlawful actions on 22 October, obstructing a routine Philippine resupply mission to Second Thomas Shoal,” the statement read. “Sullivan emphasized the ironclad US commitments to the Philippines under theUS-Philippines Mutual Defense Treaty, which extends to armed attacks on Philippine public vessels, aircraft and armed forces — to include those of its Coast Guard — in the Pacific, including in the West Philippine Sea,” it added. Signed in 1951, the Philippines and the United States agreed that an armed attack in the Pacific area on either of the parties would be dangerous to its own peace and safety and declared that it would act to meet the common dangers by its constitutional processes. The White House said Sullivan and Año “reaffirmed the enduring alliance and friendship between our nations and discussed upcoming US-Philippine engagements and ways to further strengthen our close partnership.” Manila vs Beijing Both Manila and Beijing condemned the incident, which they said violated their sovereign rights over Ayungin Shoal, a low-tide elevation in the WPS. The two countries traded blame for the incident, which also sparked concern from Australia, Canada and South Korea. In 2016, the Permanent Court of Arbitration rejected Beijing’s historical nine-dash line claim to the WPS. In a television interview, Malaya said these vessels were spotted “not only in the vicinity of Ayungin Shoal and Bajo de Masinloc but also in other features, including (Scarborough Shoal) and Sabina (Escoda) Shoal.” “We are alarmed by the environmental degradation our Coast Guard ships were able to monitor in these areas,” he told the ANC. Malaya noted that environmental degradation or coral destruction would directly impact the livelihood of the fishermen in the WPS. “Sometimes we forget the reasons why we are pushing our rights in the WPS. Some critics say this is just posturing on the part of the Philippines or a tug-of-war between China and the Philippines. No, this is not,” he stressed. “This is a battle for the resources of our country, particularly for our fishermen, so that when we monitor coral destruction in parts of the WPS, it alarms the government because it directly impacts the livelihood of our fishermen,” he said. Manila says Chinese vessels ‘intentionally’ hit Philippine boats
Manila said Monday that Chinese vessels "intentionally hit" Philippine boats at the weekend, escalating a diplomatic row over two collisions in the South China Sea. The countries have traded blame over Sunday's incidents near Second Thomas Shoal in the Spratly Islands, with both sides filing diplomatic protests and releasing videos to support their accusations. The two collisions happened during a Philippine resupply mission to troops stationed on a navy vessel that was grounded on the shoal in 1999 to assert Manila's territorial claims. Philippine officials accused a Chinese coastguard ship and a "militia" vessel of "dangerous maneuvering" that resulted in collisions with a Philippine resupply boat and a Philippine Coast Guard vessel. Chinese foreign ministry spokesman Mao Ning on Monday accused the Philippines of "continuing to spread false information and hype things up". Earlier Monday, the Philippine foreign ministry summoned China's ambassador to Manila and lodged a diplomatic protest over the incident. Spokeswoman Teresita Daza said the ambassador was unavailable and was represented by his deputy chief of mission. "Ayungin Shoal is part of our exclusive economic zone and continental shelf and we have sovereign rights and jurisdiction over it," Daza said, using the Philippine name for the shoal. The Chinese foreign ministry and embassy in Manila also issued "stern representations to the Philippines" over its "infringements" at Ren'ai Reef, Mao said, using China's name for Second Thomas Shoal. China has said a "slight collision" happened after the Philippine resupply boat ignored "multiple warnings and deliberately passed through law enforcement in an unprofessional and dangerous manner". In the other incident, China accused the Philippine Coast Guard of reversing in a "premeditated manner" into a Chinese fishing vessel. No Filipino crew member was injured, but the supply boat was damaged and forced to turn back, Philippine officials said. A second supply boat reached the tiny garrison on the grounded BRP Sierra Madre and unloaded its cargo. Manila's longtime ally Washington has led a chorus of international criticism of China's alleged interference in the resupply mission. The US State Department on Sunday reiterated its mutual defence pact with the Philippines "extends to armed attacks on Philippine armed forces, public vessels, and aircraft –- including those of its Coast Guard –- anywhere in the South China Sea". 'Arbitral ruling is binding' China claims almost the entire South China Sea, through which trillions of dollars in trade passes annually, and has ignored a 2016 international ruling that its assertion has no legal basis. Second Thomas Shoal is about 200 kilometers (124 miles) from the western Philippine island of Palawan, and more than 1,000 kilometers from China's nearest major landmass, Hainan island. Previously warm ties between Manila and Beijing have cooled since Marcos took power in June 2022, as he seeks stronger relations with the United States. The Marcos administration has publicly criticized Chinese actions in the South China Sea, publishing photos and videos to support its claims of Chinese harassment and the blocking of its vessels. Beijing has released its own images of the incidents. Despite the challenges, the Philippines would "continue to do what is necessary" to supply its troops on the BRP Sierra Madre with provisions, said Jonathan Malaya, assistant director general of the National Security Council. Attack on Phl would elicit U.S. response — State Dep’t
The United States warned on Monday that any armed attack on Philippine armed forces and Philippine Coast Guard civilian vessels could trigger its 72-year-old Mutual Defense Treaty with the Philippines. “The United States reaffirms that Article IV of the 1951 US-Philippines Mutual Defense Treaty extends to armed attacks on Philippine armed forces, public vessels, and aircraft — including those of its Coast Guard — anywhere in the South China Sea,” the US Department of State said in a statement. The statement came a day after a China Coast Guard ship collided with a Philippine resupply vessel that was conducting a routine resupply mission at Ayungin Shoal. During the same resupply mission, a Chinese maritime militia vessel also bumped the BRP Cabra, one of the PCG ships that were escorting the boat contracted by the AFP. Defense Secretary Gilbert Teodoro Jr. said the collisions, which President Ferdinand Marcos Jr. ordered investigated by the PCG, were “intentional.” For its part, the Philippines’ Department of Foreign Affairs said further study is needed to invoke the MDT due to the incident. “The matter of filing another case is something that is still being studied by the government. But, of course, all incidents like these will actually bolster the case that it is not the Philippines that is the aggressor but the other party, which is China,” DFA spokesperson Teresita Daza said. “It’s a provocation on the side of China but at this point, whether it will constitute an armed attack that would allow the invoking of the MDT is something that needs to be studied,” she added. The Philippines and the US agreed under the MDT, signed in 1951, that an armed attack on either of the parties would be considered an attack on the other, necessitating common or joint actions. Ambassador summoned The Philippines on Monday summoned China’s Ambassador to the Philippines, Huang Xilian, to explain the “blocking maneuvers” conducted by its vessels. China has insisted on its territorial rights over the Ayungin Shoal, also known as Second Thomas Shoal, which is in the Philippines’ exclusive economic zone. Swarms of CCG ships and Chinese maritime militia vessels had been monitored in the WPS, which Philippine officials said was a blatant disrespect of the 2016 Arbitral Award on the South China Sea. In July 2016, the Philippines won the arbitral case it lodged against China in the Permanent Court of Arbitration. Citing the 2016 arbitral ruling on the South China Sea, the US noted that China’s territorial claims to Ayungin Shoal, a low-tide elevation outside the territorial sea of another high tide feature, were unfounded. Unsafe moves “The unsafe maneuvers on 22 October and the PRC water cannoning of a Philippine vessel on 5 August are the latest examples of provocative PRC measures in the South China Sea to enforce its expansive and unlawful maritime claims, reflecting disregard for other states lawfully operating in the region,” the State Department stressed. Aside from the US, Japan, France, Canada, Australia and Germany also condemned China’s aggressive actions in the West Philippine Sea. In a separate statement, Canada condemned what it described as “unlawful and dangerous conduct” of the People’s Republic of China in the WPS, which “provoked two collisions with Philippine vessels engaged in routine operations inside the Philippine exclusive economic zone, in the vicinity of Ayungin Shoal.” “The PRC’s actions are unjustified. China has no lawful claim to the West Philippine Sea. Its actions are incompatible with the obligations of a signatory to the UN Convention on the Law of the Sea,” the Canadian Embassy in Manila said. “Continuing acts of intimidation and coercion undermine safety, stability, and security across the region, and increase the risk of miscalculation,” it added. France, Japan, Germany, too France expressed its “deep concern” over the dangerous maneuvers of the CCG against Philippine vessels “engaged in the Philippine exclusive economic zone.” “France calls for respect of the freedom of navigation guaranteed by international law and recalls its attachment to the United Nations Convention on the Law of the Sea and the decision rendered by the Arbitral Court on 12 July 2016,” the Embassy of France to the Philippines said. Japan, likewise, stressed that it was “seriously concerned” and “alarmed” about the collision of Chinese vessels with Philippine vessels. “Seriously concerned about and alarmed by the collision between Chinese and Philippines vessels,” Japanese Ambassador to the Philippines Koshikawa Kazuhiko said in a tweet. More senators condemn China’s ‘bullying’ in WPS
More senators on Monday condemned China’s aggressive actions in the West Philippine Sea which resulted in a collision with Philippine vessels en route to a resupply mission to the Ayungin Shoal. For Senate Deputy Majority Leader Joseph Victor “JV” Ejercito, China “has gone too far in disrespecting the Philippines” when it performed “dangerous blocking maneuvers” that resulted in a collision with the Unaiza May 2, an indigenous boat contracted by the Armed Forces of the Philippines for a resupply mission to the BRP Sierra Madre. “I strongly condemn the recent aggression of the Chinese Coast Guard against our Philippine Coast Guard,” Ejercito said in a statement. “The reckless maneuvers executed by the CCG, which resulted in a collision with the Armed Forces of the Philippines-contracted resupply vessel, were not only provocative but also a blatant act of bullying that must be denounced, not only by us but by the international community,” he added. Ejercito said the act of harassment of China within the Philippines' exclusive economic zone “obviously violates our sovereignty and territorial integrity.” “We must strongly assert the 2016 arbitral ruling, which clearly affirms that the Philippines has the exclusive rights over the West Philippine Sea,” he said. “This ruling is not only legally binding but a reflection of the principles of international law,” he added. China claims the vast South China Sea, including the West Philippine Sea. However, on 12 July 2016, the Permanent Court of Arbitration favored the Philippines’ arbitral case against China. Seven years after the Tribunal favored the Philippines’ arbitral case against China, the ruling remains on paper as China continues to disregard it by keeping its illegal activities in the West Philippine Sea. Ejercito said it is “essential to note that this is not the first time the CCG has engaged in such provocative actions against our coastal guards and fisherfolks.” “Moreover, it is the government's duty to ensure the safety of our waters for all Filipinos. We cannot and will not allow such incidents to jeopardize the safety of our people, particularly those who serve in our armed forces and the PCG,” he said. “At the same time, I personally believe that it is high time to expedite the modernization of our Armed Forces in the coming years to protect our sovereignty, safeguard our maritime interests, and ensure the safety and security of our people,” he added. ‘Potential flashpoint’ Senator Grace Poe, likewise, expressed concern over the “dangerous blocking maneuver” carried out by CCG against Philippine vessels. “China's latest act of aggression poses a credible concern that could heighten the tension not only between Philippines and China, but could also be a potential flashpoint in the region,” Poe said in a separate statement. “While an immediate diplomatic protest is anticipated, the recent incident calls for a serious rethinking of our strategies in dealing with these acts,” she added. She continued: “As we firmly assert our rights in our waters, fortifying our relations with like-minded states must continue to thwart similar belligerent actions.” On Sunday, Senate President Juan Miguel “Migz” Zubiri, Senators Risa Hontiveros, and Francis Tolentino expressed their anger over the collision that put the safety of the Filipino crew at risk. “I am one with peace-loving Filipinos in strongly condemning this latest abhorrent actions of the China Coast Guard and Chinese maritime militia that put in danger the lives of our brave countrymen who were on a routine resupply mission to our troops in Ayungin Shoal,” Zubiri said. “Let me salute our personnel from the Philippine Coast Guard (PCG) and the Armed Forces of the Philippines (AFP) for displaying courage and restraint in continuing their resupply missions despite the hostile and treacherous acts of China Coast Guard and their maritime militia,” he added. Hontiveros echoed Zubiri’s call on China to “stop” its activities in the West Philippine Sea which she said clearly violates international law. “This latest collision is squarely the China Coast Guard’s fault,” she said in a separate statement. “The 2016 Arbitral Award has resolutely invalidated China’s claims in the West Philippine Sea, making this incident a clear violation of international law,” she added. For his part, Tolentino said the recent confrontation between the Philippines and China clearly shows China’s continuous disregard for international law. U.S., Canada lambast PRC
The United States on Sunday denounced China’s actions in the West Philippine Sea that led to the collision of its ships with Philippine boats en route to a resupply mission to the Ayungin Shoal. In a tweet, US Ambassador to the Philippines MaryKay Carlson described China Coast Guard’s actions as a “disruption” of a “legal” resupply mission of the Philippines to the BRP Sierra Madre, its permanent military post in the West Philippine Sea. She tweeted on X that the US “condemns” China’s “latest disruption of a legal Philippine resupply mission to Ayungin Shoal, putting the lives of Filipino service members at risk. One of two boats contracted by the Philippines to bring supplies to the BRP Sierra Madre was bumped by a China Coast Guard Ship before a Chinese militia vessel did the same to a Philippine Coast Guard escort ship. Carlson said Washington “stands” with Manila in “protecting Philippine sovereignty and in support of a #FreeAndOpenIndoPacific.” Over the past months, the US had reiterated its “ironclad” alliance commitment to the Philippines amid the escalating tension in the WPS, a portion of the South China Sea claimed by the Philippines and China. In August, US Defense Secretary Lloyd Austin III stressed that the Mutual Defense Treaty between Washington and Manila extends to the latter’s public vessels. Unlawful conduct Canada also condemned what it described as “unlawful and dangerous conduct” of the People’s Republic of China in the WPS, which “provoked two collisions with Philippine vessels engaged in routine operations inside the Philippine Exclusive Economic Zone, in the vicinity of Ayungin Shoal.” “The PRC’s actions are unjustified. China has no lawful claim to the West Philippine Sea. Canada said it welcomed the news that no injuries resulted from the collisions and commended the “professionalism and restraint exercised” by the Philippine Coast Guard. “Canada affirms its support for a rules-based order in the South China Sea consistent with international law, including UNCLOS and the 2016 Arbitral decision, which is final and binding on the parties,” it said. Ayungin Shoal, also known as Second Thomas Shoal, is 105 nautical miles west of Palawan and is part of the Philippines’ exclusive economic zone. On 12 July 2016, the Philippines won its arbitral case against China in the Permanent Court of Arbitration — a landmark decision that China continues to reject. Germany also expressed concern over the incident in the WPS. AFP: China’s ‘irresponsible actions’ in WPS leading to ‘global isolation’
China is leading itself to “global isolation” as it continues “irresponsible actions in the West Philippine Sea, Armed Forces of the Philippines spokesperson Col. Medel Aguilar said Saturday. Aguilar said China’s claims over the disputed waters have already been declared invalid as he cited the ruling of The Hague-based Permanent Court of Arbitration on 12 July 2016. “There is an arbitral award that says that their claim over it is not valid, including the activities that they are doing there,” he added, stressing that China has no claims over the territorial waters based on the rulings of the United Nations Convention on the Law of the Sea. “Several countries have already expressed openly their support for our position and not a single country is brave enough to say that they are right,” Aguilar emphasized. “So I think this should be an enlightenment on their part, a kind of information that they should know because their actions are actually leading to their own global isolation,” he added. China interferes anew in WPS resupply mission, accuses Phl of ‘intruding’
The National Task Force on the West Philippine Sea reported the country’s successful rotation and resupply mission to BRP Sierra Madre in Ayungin Shoal last 4 October. But the task force said the fresh provisions to military personnel stationed in the Philippine Navy’s grounded ship in the Ayugin Shoal, delivered by the Armed Forces of the Philippines’ Western Command and the Philippine Coast Guard, were again blocked by the China Coast Guard and Chinese maritime militia vessels while traversing the Philippine waters off WPS. The Chinese ships harassed and interfered with the routine mission of the Philippine supply ships Unaizah May 1 and Unaizah May 2, escorted by PCG vessels BRP Cabra (MRRV-4409) and BRP Sindangan (MRRV 4407), while they were en route to BRP Sierra Madre, a warship-turned-military outpost of Filipinos in WPS. China has condemned the Philippines’ resupply mission, accusing Filipinos of “intruding [into] Chinese territory.” In a China Military website post, China Coast Guard spokesperson Gan Yu said the China forces issued warnings and conducted necessary control of four Filipino vessels that “illegally entered waters near the Ren'ai Reef" — the Chinese name for Ayungin Shoal, on Wednesday. Plucky 54-year-old Filipino fisherman Arnel Satam best characterizes where we should be following last week’s significant incidents at a disputed atoll variously called Scarborough Shoal, Bajo de Masinloc and Panatag Shoal. Bucking a tense standoff between Filipino and Chinese government vessels at the shoal’s southeast last 22 September, Satam, aboard a tiny wooden light blue “bangka” (outrigger boat), sped towards the shallow, fish-rich waters of the atoll’s inner lagoon. He just wanted to fish. Responding speedboat-riding Chinese coast guardsmen hotly pursued Satam for several thrilling minutes before Satam willingly turned back. But Satam, whose daring act was caught on video, had already made his indelible mark in one of the tensest areas in the South China Sea. “Hindi ako natatakot (I wasn’t scared),” said Satam, who told reporters he often baits the Chinese to chase him. “Pinagtatawan-tawanan ko lang sila. Inaasar ko lang sila eh (I just laugh at them. I only pique them).” Earlier that same Friday, the China Coast Guard was caught in the act of installing a 300-meter floating barrier around Panatag’s inner lagoon by a Bureau of Fisheries and Aquatic Resources boat on routine patrol. Like Satam, Filipino coast guard divers the following Monday afternoon did the unthinkable, vividly executing a first-ever underwater operation, also dramatically captured on video, against Chinese bullying in the West Philippine Sea. Using only knives, the divers cut the rope connecting the buoys that held up the barrier and hauled up an anchor holding the floating barrier in place. Filipino fishermen said the Chinese frequently put up barriers to keep them from Panatag, a traditional rich fishing ground of fishermen mostly sailing out of Zambales. Some 50 Filipino fishing boats, in fact, were near the shoal when the Chinese installed the floating barrier. Filipino fishermen could only fish outside the shoal because Chinese vessels had blocked the inner lagoon since the 2012 standoff between the Philippines and China over the shoal. After the successful “special operation,” authorized by President Marcos himself, the PCG reported that China Coast Guard vessels, probably awed by the Filipinos’ audacity, were seen calmly picking up pieces of the torn barrier. Still, that same calm demeanor could also mean the Chinese “might still return the floating barrier,” said PCG spokesperson Jay Tarriela, particularly since last Tuesday China tersely warned the Philippines not “to provoke and cause trouble.” But the PCG and the military establishment have vowed to make the Filipino presence felt at the shoal, even permanently, with Tarriela expressly saying, “We have shown the world the Filipino people will not back down, and we’re still going to consistently carry out whatever is necessary for us to maintain our presence.” Emphasizing our “presence” at Panatag is a crucial and careful distinction. The 2016 arbitral award ruled that Chinese, Vietnamese, and Filipino fishermen had traditional fishing rights at Panatag Shoal. Our maritime authorities, therefore, are in the right insofar as asserting that Filipino fishermen have the same rights as the Chinese to safely navigate around Panatag to fish, and that China has no right whatsoever to drive them away or bar them. Frustratingly, however, some imprudent Filipinos toe China’s self-interested and false sovereignty claims despite the due care with which Filipino maritime authorities qualify their actions. Oddly enough, too, these same imprudent Filipinos quickly blame the victims of China’s abusive actions. It is as if these imprudent Filipinos are so invested in their fear of China that they are now losing their willingness to defend Filipino fishermen and their livelihood bit by bit, without even noticing. Manalo: Removal of floating barrier installed by China ‘consistent’ with Phl position
The Philippine government’s move to remove the floating barrier installed by the China Coast Guard around the southeastern portion of Scarborough Shoal is “consistent” with the country’s position, Foreign Affairs Secretary Enrique Manalo said Tuesday. “Technically, we have a right to practice our sovereignty and our sovereign rights. So, it would have been consistent with our position but we're still waiting for the full report," Manalo said in a chance interview at the Senate. He issued the remarks after the Philippine Coast Guard confirmed that the floating barrier that prevented Filipino fishermen from accessing the shore had been removed in accordance with a presidential order. Over the weekend, the PCG reported the presence of the floating barrier around Scarborough Shoal, also known as Bajo de Masinloc. On Monday night (Manila time), Chinese Foreign Ministry spokesperson Wang Wenbin defended China’s move to install the floating barrier in the southeastern portion of Scarborough Shoal, which they referred to as Huangyan Dao. “Huangyan Dao has always been China’s territory. PCG eyes entry of Filipino fishermen in Scarborough Shoal
The Philippine government will help Filipino fishermen to once again enter and go fishing in the lagoon of Scarborough Shoal, also known as Bajo de Masinloc, in the West Philippine Sea. Commodore Jay Tarriela, spokesperson of the Philippine Coast Guard for WPS, said they are collaborating with the Bureau of Fisheries and Aquatic Resources and Armed Forces of the Philippines to enter the area after it removed the floating barriers installed by the Chinese Coast Guard in the southeast entrance of shoal. “The PCG together with the BFAR, and of course with the support of our AFP, through the intelligence cooperation that we have already established, we will be able to sustain this patrol with the end goal of once again allowing fishermen to be able to go inside the lagoon,” Tarriela said in a television interview on Tuesday. “And also to open this, as you said it was already decided by the arbitral award that it is not just for Filipinos but this is a traditional fishing ground for Chinese, Vietnamese, and Filipinos. Tarriela said it was still possible for the Philippines to assert its rights over Scarborough Shoal, after the 2012 standoff—wherein Chinese vessels began guarding the lagoon and barred Filipino ships and fishing boats from entering the area. “As I have said, since the new administration took office, we have already strategized how can we be able to take control once again of Bajo de Masinloc, especially the lagoon,” he stressed. “For so many months, we were able to calibrate our deployment in such time that we can already anchor the distance of 300 meters,” he added. Tarriela said these efforts by the Philippines will continue. “This will be sustained in the next coming days but I don't want to detail in public how are we going to do that,” he noted. Dismantling the floating barrier that China installed at Scarborough Shoal or Bajo de Masinloc is a matter for President Ferdinand Marcos Jr. to decide, a Philippine Coast Guard official said yesterday. Commodore Jay Tarriela, PCG spokesperson for the West Philippine Sea, said they had reported the discovery of the 300-meter barrier to the National Task Force for the West Philippine Sea, or NTF-WPS. “Should the NTF-WPS recommend to the President the actions to be taken, the PCG, the Bureau of Fisheries and Aquatic Resources, and even the Armed Forces of the Philippines would comply,” Tarriela said. Tarriela was apparently reacting to the call made by Senate President Juan Miguel Zubiri for the PCG to remove the barrier as it poses a danger to Filipino fishermen and keeps them from the shoal’s rich fishing grounds. Tarriela, however, said the PCG had yet to consult with Mr. Marcos and other officials of the national government on what to do about the barrier. The PCG said three China Coast Guard inflatable boats backed by a Chinese maritime militia vessel installed the floating barrier. Also on Monday, the Department of Foreign Affairs vowed to press the Philippines’ sovereignty over Scarborough Shoal. “We will take all appropriate measures to protect our country’s sovereignty and the livelihood of our fisherfolk,” the DFA said. “Bajo de Masinloc is an integral part of the Philippines over which we have sovereignty and territorial jurisdiction according to UNCLOS (United Nations Convention on the Laws of the Sea),” the DFA said. In 2012, Chinese and Philippine vessels faced each other in a standoff at the shoal, which was defused when the Philippines withdrew its ships, which China did not do with its ships despite an agreement to do so. China has since maintained control of the shoal even after a 2016 ruling of the Permanent Court of Arbitration deemed the shoal to be part of the Philippines’ 200-nautical-mile exclusive economic zone in the West Philippine Sea. The landmark ruling, which also dismissed as illegal China’s claim to nearly the entire South China Sea, arose from a case filed by the Philippines before the arbitral court in 2013. China, however, has refused to abide by the ruling. “The 2016 Arbitral Award affirms it (Bajo de Masinloc) as a traditional fishing ground for Filipino fisherfolk,” the DFA pointed out. “China’s reported installation of barriers and its negative impact on the livelihood of Filipino fisherfolk or any other activity that infringes on the Philippines’ sovereignty and jurisdiction in Bajo de Masinloc are violations of international law, particularly UNCLOS and the Arbitral Award,” it added. EU envoy calls out China’s new floating barrier in Scarborough Shoal
“Deeply concerning.” This was how European Union Ambassador to the Philippines Luc Veron described China’s move to install a floating barrier around Scarborough Shoal Bajo, also known as Bajo de Masinloc. In a tweet, Veron flagged China’s newest actions in the West Philippine Sea, which now prevents Filipino fishermen from entering the shoal for their livelihood activities. He said that China’s action "disregards" the 1982 United Nations Convention on the Law of the Sea or UNCLOS. “The installation of the floating barrier is dangerous, detrimental to the livelihoods of Philippines fishermen, and disregards the peace-driven objectives of UNCLOS,” he said. Over the weekend, the Philippine Coast Guard reported the presence of the floating barrier in the southeastern portion of Bajo de Masinloc, allegedly installed by the China Coast Guard. Located 120 nautical miles from Zambales, Bajo de Masinloc is considered a traditional fishing ground for Filipinos in the West Philippine Sea. Phl to UN: Uphold int’l law to keep Indo-Pacific free, open
Adherence to international law by all nations would maintain a free and open Indo-Pacific region, the Philippines said Sunday. Speaking on behalf of President Ferdinand Marcos Jr. at the 78th session of the UN General Assembly in New York City, Foreign Affairs Secretary Enrique Manalo reiterated that all countries are accountable for maintaining a rules-based global order. “Its present and future rest on the predictability and stability of international law, which safeguards the rights of all states. If multilateralism is to endure, all states must adhere to the rule of law,” Manalo said. “Guided by an independent foreign policy, the Philippines actively works with nations to promote a rules-based international order,” he added. Quoting President Marcos, Manalo stressed that the Philippines is “a friend to all and enemy to none.” The DFA chief also said that the Philippines advocates the “peaceful settlement of disputes, in accordance with international law.” “This has always been our position with respect to the disputes in the West Philippine Sea, inasmuch as we are prepared to defend our sovereignty, sovereign rights and territorial integrity,” he said. “Our Constitution renounces war as an instrument of national policy, adopts the generally accepted principles of international law as part of the law of the land and adheres to a policy of peace, equality, justice, freedom, cooperation, and amity with all nations,” he added. DND chief: China charge ‘hypocritical’
China accusing the Philippines of being an environmental menace for allowing the rusting BRP Sierra Madre landing ship to remain moored at Ayungin Shoal is “hypocritical,” Defense Secretary Gilberto Teodoro Jr. said. “The statement of China that the grounded Sierra Madre is causing irrevocable harm is, to put it as politely as possible, hypocritical,” Teodoro, reacting to Mao’s statement, told reporters on Saturday. Teodoro was reacting to Chinese Ministry of Foreign Affairs spokesperson Mao Ning’s statement that the rusting BRP Sierra Madre ship was a pollutant and source of waste in the West Philippine Sea. The BRP Sierra Madre is a landing vessel deliberately grounded on Ayungin Shoal in 1995 to serve as an outpost manned by a platoon of Marines. Mao called the Philippines to tow the Sierra Madre away from the shoal. He urged to “stop polluting” the waters around it “if it really cares about the environment.” Philippine officials were not amused, however. The Office of the Solicitor General said it is considering filing a lawsuit against China before an international court for destroying corals in at least two key features in the WPS, namely, Rozul or Iroquois Reef and Escoda or Sabina Shoal. Pot calls kettle black “Talk about the pot calling the kettle black. China continues to damage the WPS with its illegal reclamation activities after it was found to be a violator of international law in the 2016 Arbitral Award when such activities damaged the marine environment,” Teodoro said. He described China’s remarks as mere “propaganda” to divert international attention from its illegal activities in the WPS. “Disingenuous propaganda lines such as this only serve to expose China’s insincerity and will only heighten the mistrust of the Filipino people and the rest of the world toward the Chinese government,” Teodoro said. China has repeatedly denied the Philippines’ sovereign right over the WPS based on the 2016 arbitral ruling of the Permanent Court of Arbitration at The Hague. Coral destruction, a crime The Chinese foreign ministry also recently criticized the Philippines for creating “political drama” when it alleged massive coral harvesting at Rozul Reef and Escoda Shoal. “The destruction of corals goes far beyond drama. It is a violent act and a serious crime against humanity,” said Commodore Jay Tarriela, PCG spokesperson for the West Philippine Sea, in a post on X (formerly Twitter). “Stop making (allegations) that the BRP Sierra Madre is polluting the waters, but blame it (on) your numerous Chinese maritime militia vessels swarming the Philippines’ EEZ,” Tarriela said. Tarriela noted that the PCG conducted extensive underwater surveys of the seabed at both Rozul Reef and Escoda Shoal. “The results of these surveys showed that the marine ecosystem in the subject features appeared to be lifeless, with minimal to no signs of life. Moreover, the surveys conducted at Escoda Shoal revealed visible discoloration of its seabed, strongly indicating that deliberate activities may have been undertaken to modify the natural topography of the underwater terrain,” he said. On Thursday, Justice Secretary Jesus Crispin Remulla said the government would file environmental cases against China for its destructive activities in the WPS before the Permanent Court of Arbitration as it has a lot of evidence to pursue a case.
