SMNI suspension urged for alleged violations

Terrorist forces have proven themselves adept in the art of deception that it lured the eminent The New York Times, or NYT, with its lies. Among the most prominent American newspapers, NYT, to its credit, issued an unprecedented “editorial note” admitting that a story it ran on the bombing of a Gaza hospital “left readers with an ‘incorrect impression,’” saying that its staff should have been more careful in the initial presentation of information and in explaining what could be verified. NYT had prominently and repeatedly featured Hamas’s claim that an Israeli airstrike caused last week’s blast at Gaza City’s al-Ahli Baptist Hospital. The note it issued on Monday acknowledged that its coverage should have been more journalistically rigorous. The Hamas-run health ministry in Gaza immediately blamed the 17 October explosion on an Israeli airstrike amid the war that erupted when the Palestinian terror group killed over 1,400 people in Israel in its assault on 7 October. Hamas provided no evidence to back up its false claim or for its claim that hundreds had been killed, but international media, including the NYT, swallowed the claims hook, line, and sinker. Shortly after, Israel produced evidence showing the explosion was caused by a failed rocket launch from Gaza by the Palestinian Islamic Jihad terror group, an assessment endorsed by the United States, which has said it has data that supports this. NYT admitted that its initial reports “relied too heavily on claims by Hamas and did not make clear that those claims could not immediately be verified. The report left readers with an incorrect impression about what was known and how credible the account was.” In Britain, the BBC and other media outlets were also criticized by government lawmakers for rushing to report the Hamas version of events. Prime Minister Rishi Sunak told the House of Commons last week, “We don’t treat what comes out of the Kremlin as the gospel truth; we should not do the same with Hamas.” In the war coverage, it must be clear there is no moral equivalence between Israel, a legitimate democracy, and Hamas, a terrorist organization that employs lies as a weapon. Media reports often frame both sides as being equivalent and engaged in a tit-for-tat. Hamas is the de facto ruler of the Gaza Strip, but major democracies consider it a terror organization. Israel, as a free and democratic sovereign state, does everything to minimize civilian casualties, while Hamas is an Iran-backed terrorist group that openly seeks the destruction of Israel and actively hunts Israeli civilians to murder or abduct. It deliberately fires projectiles into civilian areas to kill as many Israelis as possible. Israel’s military specifically targets Hamas infrastructure, such as rocket launchers and production facilities, terrorist headquarters, terror tunnels, weapons warehouses, and senior terror leaders. Israel employs a tactic known as “roof knocking,” which warns civilians to evacuate a building through text messages and phone calls before targeting it for destruction. In contrast, the American Jewish Committee said Hamas deliberately puts Palestinian civilians in harm’s way. Hamas fires rockets and stores weapons in civilian areas, including around homes, schools, offices, mosques and hospitals. Hamas staged a large-scale incursion into southern Israel on 7 October during the Jewish holiday of Simchat Torah, where over 600 Israelis were murdered. Often, the conflict with Hamas and other terrorist groups, such as the Palestinian Islamic Jihad, is framed as a dispute between Israelis and Palestinians. Any coverage of Hamas and the Palestinian Islamic Jihad must mention that both terror groups are armed, trained, and financially supported by Iran. While its origins are with the Muslim Brotherhood, Hamas has been funded, armed, and trained by the Iranian Revolutionary Guard Corps since the early 1990s. Equating Israel with Hamas would provide legitimacy to the use of terror tactics, which most nations have vowed never to consider as a subject of negotiation. Fuel subsidy easing eyed
An immediate release of government assistance to public utility vehicles will be achieved by shortening the trigger period from three months to one and simplifying the requirements, the Department of Energy said yesterday. The proposal, nonetheless, may need the amendment of the law for releasing fuel subsidies to the transport sector. In a press briefing, Energy Secretary Raphael Lotilla said this was one of President Ferdinand “Bongbong” Marcos Jr.’s proposed solutions to the oil price shock that is expected to worsen amid the spreading Middle East conflict. $80 per barrel long breached Under the current law, fuel subsidies are released to the transport sector whenever the Dubai crude oil price exceeds $80 per barrel for three consecutive months. Lotilla said shortening the trigger period will allow the government to release the subsidies faster to the transport sector, one of the sectors most affected by rising fuel prices. “With this simplification or shortening of the period, we will be able to release the subsidies in a shorter period,” Lotilla said. “Since Congress is now considering the General Appropriations Act, it will be included in that process. The amendment will take effect in 2024 immediately upon Congress’s approval of the GAA,” he added. The DoE chief also said the government will simplify the requirements for the release of the fuel subsidies. The release of the subsidies requires the approval of the DoE, the Department of Transportation, and the Department of Budget and Management. Lotilla said that under the new proposal, the release of the subsidies will only require the approval of the DBM, DoTr and the DoE. He said the DoTr will finalize the list of beneficiaries for those with franchises, the Department of the Interior and Local Government for tricycle drivers, and the Department of Trade and Industry for delivery service drivers. Even though there’s an effort to expedite assistance, Lotilla said the fuel subsidy in the 2024 national budget was decreased to P2.5 billion from P3 billion this year. The energy chief, however, believes that even with the reduced budget, the required funding will be met. “That’s based on the experience of the previous year. We don’t know what will be the final amount,” the official said. Other measures on table Lotilla added the government will implement a voluntary 20-percent ethanol blend for gasoline, which is targeted for approval by the end of 2023. He said the ethanol blend will help mitigate the rising fuel prices, as ethanol is cheaper than gasoline. Lotilla said the President also instructed him to continue the transport sector’s electrification, particularly for mass transport and light cargo vehicles. He said the government will put in place charging stations and ensure that the benefits to the transport sector, particularly the drivers, will be there. Lotilla said the President also emphasized the need to prepare the economy for the eventual manufacture of electric vehicles and to link this with the local mining sector that will produce the minerals needed to manufacture batteries and other components of electric vehicles. Rules out soon The DoE is also releasing the guidelines for the implementation of the long-delayed higher biofuels blend before the year ends. Lotilla said the current 10-percent ethanol blend, also known as E10, in gasoline would be increased to 20 percent or E20, although it would be a voluntary option for motorists. Lotilla added that the current two percent or B2 coco methyl ester or CME blend on diesel will be adjusted to three percent or B3. Based on the DoE calculation, implementing the E20 blend could slash gasoline prices by around P1.28 to P1.50 per liter. While ethanol is generally cheaper than gasoline, Lotilla noted that local ethanol at P79.49 a liter is still more expensive than the imported supply at P41.84 per liter. Lotilla said DoE will bank on the coconut industry, whose production reaches up to 15 billion nuts annually, to complement the B3 shift. “An additional 1 percent blend only needs 2.6 billion nuts. The increase in the blend can also drive down the cost of CME because there will be a bigger market for it. The Philippines has monitored "a large number of Chinese maritime militia vessels” swarming in the features of the West Philippine Sea, National Security Council spokesperson, Undersecretary Jonathan Malaya, said Tuesday. In a television interview, Malaya said these vessels were spotted “not only in the vicinity of Ayungin Shoal and Bajo de Masinloc but also in other features, including (Scarborough Shoal) and Sabina (Escoda) Shoal.” "We are alarmed by the environmental degradation our Coast Guard ships were able to monitor in these areas,” he told the ANC. Malaya noted that environmental degradation or coral destruction would have a direct impact on the livelihood of the fishermen in the WPS areas. “Sometimes we forget the reasons why we are pushing our rights in the WPS, some critics are saying this is just posturing on the part of the Philippines or a tug-of-war between China and the Philippines. No this is not,” he stressed. “This is a battle for the resources of our country, particularly those for our fishermen so when we monitor coral destruction in other parts of the WPS, it alarms the Philippine government because it directly impacts the livelihood of our fishermen in WPS upon their livelihood relies,” he added. SC denies Senate certiorari petition
To maintain the separation of powers between the three departments of the government, the Court cannot exercise a power that belongs to the Senate Blue Ribbon Committee. This was stated in an SC en banc decision penned by Associate Justice Amy C. Lazaro-Javier, denying the petition for certiorari and prohibition filed by the Senate of the Philippines challenging the constitutionality of a memorandum issued by then President Rodrigo Duterte. In 2021, the SBRC started an investigation on the budget utilization of the Department of Health following a report from the Commission on Audit that there was a deficiency of P67,322,186,570.57 in public funds intended for the government’s Covid-19 response. The committee then conducted hearings on the following matters: the DoH’s underutilization of its 2020 budget; the procurement of Covid-19 vaccines by local government units; unspent funds, misstatements, irregularities, and deficiencies of the DoH, as found by CoA; and payment claims issues between the Philippine Health Insurance Corporation and private hospitals. Concerned officials from the executive department, including then DoH Secretary Francisco Duque lll, attended the hearings. But then Pesident Duterte, through Executive Secretary Salvador C. Medialdea, stopped the executive officials from attending the hearings, by issuing a memorandum dated 4 October 2021 directing all officials and employees of the Executive Department to cease attending the SBRC hearings on the government’s disbursement of the Covid-19 funds. The Memorandum also asserted that the SBRC inquiry has turned into a preliminary investigation of sorts meant to identify the persons allegedly liable for irregularities that existing statutes already defined and punish. It claimed that the SBRC has stepped into the mandates of other branches of government. Viewing the memorandum as an obstruction to the Senate’s constitutional function to conduct inquiries in aid of legislation, Senate Resolution 131 was passed, authorizing the filing of the present petition before the Court. Intentional, premeditated
In a prior editorial, this paper raised the possibility that the Chinese vessels hitting a Philippine Coast Guard ship and a resupply boat it was escorting to Ayungin Shoal in the West Philippine Sea might have been intentional. While we let readers read between the lines, factual narrations of the event tended to show how improbable it would have been for two separate collision incidents, involving several Chinese and Philippine vessels, to happen by accident in the wide expanse of ocean. The two collisions happened miles away from each other amid fair weather conditions with the sun shining brightly, thus neither poor visibility nor questionable seamanship could have been a factor in the incidents. As in most cases, the simplest explanations often prove to be the correct or accurate ones. In these incidents, the latest in China’s aggressive maneuvers in the WPS, the actions taken by the Chinese coast guard and militia vessels smacked of premeditation. On Monday, Defense Secretary Gilbert Teodoro confirmed in a press briefing that the Chinese vessels “intentionally” hit the Philippine boats trying to resupply troops stationed on the intentionally grounded navy vessel, the BRP Sierra Madre. “While conducting legitimate rotation and resupply operations within the exclusive economic zone of the Philippines, Chinese coast guard and maritime militia vessels, in blatant violation of international law, harassed and intentionally hit the Unaiza May 2 and Philippine Coast Guard vessel BRP Cabra,” Teodoro said. It was a conclusion that would not have required the title Defense Secretary to make. Video footage and photos of the first incident showed a China Coast Guard ship chasing the very small resupply boat. As if the David-versus-Goliath affair were not enough, a second CCG vessel then cut off the boat. All the pieces of evidence considered, the word “collision” does not apply to the actions China took because this would presuppose the possibility of their being mere accidents. The operative word should be “bumped” or, if the incident resulted in grave damage to the Philippine vessels, “rammed.” The stern of the smaller resupply vessel and the bow of the Chinese coast guard ship were seen briefly touching in the video released by the Philippine military. According to a statement from the National Security Council, the supply boat sustained damage. It added that a second resupply boat was able to complete its mission to the BRP Sierra Madre. With the United States and Canada condemning China over the incident, the collision may not be the last or it may just be a portent of more serious “interactions” to come between China and the Philippines as both assert their respective sovereign claims in the WPS. If only to ensure peace in the Indo-Pacific region, countries that have pledged to conduct freedom of navigation patrols in the South China Sea should start doing so. The burden of checking Beijing’s expansionist designs in the region should be shared not only by other claimant nations, but by governments that benefit from the trillions of dollars in trade that pass annually through the South China Sea. We cannot expect the Philippines’ summoning of the Chinese ambassador over the incidents to amount to anything, except to register the country’s strong and continuing opposition to Beijing’s aggressive acts in the WPS. China can never claim Ayungin to be part of its sovereign waters because it lies 1,000 kilometers from its nearest major landmass, Hainan Island, while the shoal is only 200 kilometers from the western Philippine island of Palawan. This proximity of Ayungin Shoal to Palawan, along with other proof presented by the Philippines to the Permanent Court of Arbitration in The Hague, was primarily considered by the court in ruling in favor of the Philippines in 2016. China had refused to recognize the arbitral ruling precisely because it did not go its way. In fact, the court declared as baseless China’s nine-dash line claim to nearly the entire South China Sea. CCG’s ramming of Philippine vessels is a calculated act of provocation. It is a message to the Philippines and the rest of the world that China is willing to use force to achieve its goals. Beijing’s actions are a threat to peace and stability in the South China Sea and the Asia-Pacific region. Nations must not allow China to succeed in its bullying tactics. The international community must take a stand and not allow China to undermine the rules-based order in the Asia-Pacific. U.S., Canada lambast PRC
The United States on Sunday denounced China’s actions in the West Philippine Sea that led to the collision of its ships with Philippine boats en route to a resupply mission to the Ayungin Shoal. In a tweet, US Ambassador to the Philippines MaryKay Carlson described China Coast Guard’s actions as a “disruption” of a “legal” resupply mission of the Philippines to the BRP Sierra Madre, its permanent military post in the West Philippine Sea. She tweeted on X that the US “condemns” China’s “latest disruption of a legal Philippine resupply mission to Ayungin Shoal, putting the lives of Filipino service members at risk. One of two boats contracted by the Philippines to bring supplies to the BRP Sierra Madre was bumped by a China Coast Guard Ship before a Chinese militia vessel did the same to a Philippine Coast Guard escort ship. Carlson said Washington “stands” with Manila in “protecting Philippine sovereignty and in support of a #FreeAndOpenIndoPacific.” Over the past months, the US had reiterated its “ironclad” alliance commitment to the Philippines amid the escalating tension in the WPS, a portion of the South China Sea claimed by the Philippines and China. In August, US Defense Secretary Lloyd Austin III stressed that the Mutual Defense Treaty between Washington and Manila extends to the latter’s public vessels. Unlawful conduct Canada also condemned what it described as “unlawful and dangerous conduct” of the People’s Republic of China in the WPS, which “provoked two collisions with Philippine vessels engaged in routine operations inside the Philippine Exclusive Economic Zone, in the vicinity of Ayungin Shoal.” “The PRC’s actions are unjustified. China has no lawful claim to the West Philippine Sea. Its actions are incompatible with the obligations of a signatory to the UN Convention on the Law of the Sea,” the Canadian Embassy in Manila said. “Continuing acts of intimidation and coercion undermine safety, stability, and security across the region and increase the risk of miscalculation,” it added. Canada said it welcomed the news that no injuries resulted from the collisions and commended the “professionalism and restraint exercised” by the Philippine Coast Guard. “Canada affirms its support for a rules-based order in the South China Sea consistent with international law, including UNCLOS and the 2016 Arbitral decision, which is final and binding on the parties,” it said. Ayungin Shoal, also known as Second Thomas Shoal, is 105 nautical miles west of Palawan and is part of the Philippines’ exclusive economic zone. On 12 July 2016, the Philippines won its arbitral case against China in the Permanent Court of Arbitration — a landmark decision that China continues to reject. Germany also expressed concern over the incident in the WPS. Senators enraged “Germany is very concerned about recent confrontations in the SCS involving Chinese coast guard ships and maritime militia vessels in the Exclusive economic zone of the Philippines,” German Ambassador to the Philippines Ambassador Andreas Pfaffernoschke said in a separate tweet. Pfaffernoschke called on “all parties to act in accordance with UNCLOS-rules and to respect the 2016 arbitral award. Senators also condemned China’s actions. In separate statements, Senate President Juan Miguel “Migz” Zubiri, Senators Risa Hontiveros and Francis Tolentino expressed anger over the collisions that put the safety of the Filipino crew at risk. “I am one with peace-loving Filipinos in strongly condemning this latest abhorrent actions of the China Coast Guard and Chinese maritime militia that put in danger the lives of our brave countrymen who were on a routine resupply mission to our troops in Ayungin Shoal,” Zubiri said. US, Canada condemn China’s ‘disruption’ of Phl’s resupply mission to Ayungin Shoal
The United States on Sunday denounced China’s actions in the West Philippine Sea that led to a collision of its vessels with Philippine vessels en route to a resupply mission to the Ayungin Shoal. In a tweet, US Ambassador to the Philippines MaryKay Carlson described China Coast Guard’s actions as a “disruption” of a “legal” resupply mission of the Philippines to the BRP Sierra Madre, its permanent military post in the West Philippine Sea. “The United States condemns PRC’s latest disruption of a legal Philippine resupply mission to Ayungin Shoal, putting the lives of Filipino service members at risk,” Carlson said on X, formerly known as Twitter. Earlier today, the National Task Force for the West Philippine Sea accused the CCG of performing "dangerous blocking maneuvers" that resulted in a collision with the Unaiza May 2, an indigenous boat contracted by the Armed Forces of the Philippines for a resupply mission to the BRP Sierra Madre. The NTF-WPS condemned the “provocative, irresponsible, and illegal action” of the China Coast Guard ship which “imperiled the safety” of the Unaiza May 2 crew. It also flagged the “bumping” of the Chinese Maritime Militia vessel against the Philippine Coast Guard BRP Cabra’s port side while it was lying approximately 6.4 nautical miles northeast of Ayungin Shoal. Carlson said Washington “stands” with Manila in “protecting Philippine sovereignty and in support of a #FreeAndOpenIndoPacific.” Over the past months, the US reiterated its “ironclad” alliance commitment to the Philippines, amid the escalating tension in the WPS, a portion of the South China Sea both claimed by the Philippines and China. In August, US Defense Secretary Lloyd Austin III stressed that the Mutual Defense Treaty between Washington and Manila is extended to the latter’s public vessels. In a separate statement, Canada also condemned what it described as “unlawful and dangerous conduct” of the People's Republic of China in the WPS, which “provoked two collisions with Philippine vessels engaged in routine operations inside the Philippine Exclusive Economic Zone, in the vicinity of Ayungin Shoal.” “The PRC's actions are unjustified. China has no lawful claim to the West Philippine Sea. Its actions are incompatible with the obligations of a signatory to the UN Convention on the Law of the Sea,” the Canadian Embassy in Manila said. “Continuing acts of intimidation and coercion undermine safety, stability, and security across the region, and increase the risk of miscalculation,” it added. Canada said it welcomed the news that no injuries resulted from these collisions and commended the “professionalism and restraint exercised” by the Philippine Coast Guard. “Canada affirms its support for a rules-based order in the South China Sea consistent with international law, including UNCLOS and the 2016 Arbitral decision, which is final and binding on the parties,” it said. Senators denounce China’s ‘abhorrent’ actions in WPS
Senators on Sunday condemned China for performing “dangerous blocking maneuvers” that resulted in a collision with the Unaiza May 2, an indigenous boat contracted by the Armed Forces of the Philippines for a resupply mission to the BRP Sierra Madre. In separate statements, Senate President Juan Miguel “Migz” Zubiri, Senators Risa Hontiveros, and Francis Tolentino expressed their anger over the collision that put the safety of the Filipino crew at risk. “I am one with peace-loving Filipinos in strongly condemning this latest abhorrent actions of the China Coast Guard and Chinese maritime militia that put in danger the lives of our brave countrymen who were on a routine resupply mission to our troops in Ayungin Shoal,” Zubiri said. “Let me salute our personnel from the Philippine Coast Guard (PCG) and the Armed Forces of the Philippines (AFP) for displaying courage and restraint in continuing their resupply missions despite the hostile and treacherous acts of China Coast Guard and their maritime militia,” he added.
