83 NBI detainees transferred to NBP
Bureau of Corrections Director General Gregorio Pio Catapang yesterday accepted from NBI Director Menardo de Lemos 83 NBI detainees that were being transferred to the National Bilibid Prison in Muntinlupa City. The detainees were transferred from the NBI detention center to Building 14 of the Maximum Security Compound of NBP. Catapang said persons deprived of liberty who testified against fugitive former BuCor Chief Gerald Bantag will be also be transferred to BuCor custody. Also transferred to NBP are PDLs who testified against former Sen. Leila de Lima, from the Marines detention facility in Fort Bonifacio, Taguig City and ISAFP Facility in Camp Aguinaldo. The transferred detainees will not be allowed to leave Building 14 unless there is coordination with the BuCor. The Bureau of Corrections will temporarily house the NBI detainees while the latter’s main building, including its detention facility in Manila, will be demolished and a new building constructed. Last March, the BuCor and the NBI signed a memorandum of agreement where the former would allow the use of its facilities as temporary lock-up facilities for individuals arrested by the NBI, with the latter providing its own personnel to guard and secure the facility and immediate premises. Under the MOA, all persons detained at said facility would be under the responsibility of the NBI, subject to existing rules and regulations of BuCor, which include visiting privileges to be granted by the NBI to the families, friends and lawyers of the detainees. Catapang said that that if there are NBI detainees who will attend hearings or will be brought out for medical check-up, proper coordination should be in place since they will go through their checkpoints. Under the MOA, the NBI shall be responsible for the custody of their detainees including their transfer to attend court hearings. The NBI will also provide sufficient manpower complement for the administration of the said facilities, including the necessary security escort personnel of the detainees. Bantag facing new charges
The Department of Justice yesterday said former Bureau of Corrections chief Gerald Bantag will be facing new charges, this time for physical torture and grave coercion. According to the DoJ, Bantag and former BuCor spokesperson Gabriel P. Chaclag will be charged before the Muntinlupa City metropolitan trial court with grave coercion for allegedly forcing prison personnel to sign a statement that no shooting incident took place at the Iwahig Prison and Penal Farm in 2020. Earlier, the former BuCor top official had been charged with two counts of murder for the deaths of broadcast journalist Percival “Percy Lapid” Mabasa on 3 Oct. 2022 and Cristito Villamor Palana, a person deprived of liberty at the New Bilibid Prison in Muntinlupa City, on 18 Oct. 2022. The Las Pinas Regional Trial court issued warrants of arrest against Bantag in the Percy Lapid case, and the Muntinlupa City RTC in Palana’s case. Bantag has yet to surrender and remains at large. The DoJ last Monday, 15 May, announced the filing of criminal charges against Bantag and BuCor’s former security officer Ricardo S. Zulueta for the stabbing in 2022 of two persons deprived of liberty at the NBP in Muntinlupa City. “In a resolution dated 02 May 2023, the DoJ State Prosecutors found probable cause to indict respondent Bantag for two counts of physical torture and mental/psychological torture under Section 4(a) and Section 4(b)(2) and/or (12) of Republic Act No. 9745, while respondent Zulueta is charged as an accessory thereof,” said the DoJ. Zulueta, who is also at large, is also a co-accused in the Percy Lapid and Palana killings. The DoJ said its new criminal case against Bantag is based on the preliminary investigation conducted into the criminal complaint filed by IPPF prison officers, namely Lazaro Rafols, Jr., Jer Sahid B. Mojado, Eddie Jimenez, Jr., Richie C. Ganja, Roy B. Gacasa and Asher B. Labrador. The incident of grave coercion allegedly took place at the NBP on 2 March 2020 when complainants were directed to report to Bantag when he was still director general. The DoJ said the complainants got admonished “for the alleged shooting incident that transpired at the IPPF on 1 March 2020, involving complainants and DG Bantag's men who were then detailed at the said facility.” During the incident on 2 March 2020, then DG Bantag, together with Chaclag, allegedly unlawfully coerced, through violence, threats and intimidation, complainant Canja into signing a document stating that there was no shooting incident at the IPPF on 1 March 2020 involving BuCor personnel. Department of Justice Secretary Jesus Crispin Remulla on Wednesday disclosed that the National Bureau of Investigation is closing in on former Bureau of Corrections chief Gerald Bantag and former deputy security officer Ricardo Zulueta and they can be found in a short time. The DoJ chief said law enforcement agencies, including the NBI, are already on the verge of finding Bantag, who has been accused of masterminding the death of broadcaster Percy Lapid and alleged middleman Jun Villamor. Remulla confirmed that tracker teams are pursuing Bantag and Zulueta and that the NBI is on top of the investigation. “We want to give them (Bantag and Zulueta) the presumption that they will obey the process,” Remulla said. “They have an idea of Bantag’s location and are on the right track. They can find Bantag in a short time.” He also disclosed that Bantag has sent a second surrender feeler and is “negotiating” for his detention and Zulueta’s. Bantag had expressed his intention to surrender six days ago while Remulla was in the United States with President Ferdinand Marcos Jr. Meantime, the training of personnel in the use of body cameras as part of the reform program of the Bureau of Corrections has started, according to BuCor OIC-deputy director general for Operations J/SInsp. Naglabas na ng kautusan ang Muntinlupa Regional Trial Court Branch 206 na arestuhin na sina dating Bureau of Corrections (BuCor) chief Gerald Bantag at dati niyang deputy officer na si Ricardo Zulueta, kaugnay sa pagkamatay ni Jun Villamor, ang umano’y middleman sa pananambang at pagpatay sa broadcaster na si Percy Lapid. Ang arrest warrant laban kina Bantag at Zulueta ay pirmado ni Muntinlupa RTC Branch 206 presiding judge Gener M. Gito at nakasaad sa arrest warrant walang piyansa na inirerekomenda sa dalawang dating opisyal para sa kinakaharap na kasong murder kaugnay sa pagkamatay ni Villamor. Sinabi naman ng abogado ni Zulueta na si Atty. Lauro Gacayan, na wala pa silang natatanggap na arrest warrant, at hindi pa niya nakakausap ang kaniyang kliyente. Noong Marso 14, isinampa sa korte ng panel of prosecutors ng Department of Justice ang kasong two counts of murder laban kina Bantag at Zulueta, kaugnay sa pagpatay kina Lapid at Villamor. Binaril at napatay si Lapid sa Las Piñas City noong October 3, 2022, habang pinaslang si Villamor sa New Bilibid Prison noong October 18, 2022. Sa isinagawang awtopsiya ni forensic pathologist Dr. Raquel Fortun sa mga labi ni Villamor, lumabas na pinatay ang biktima sa pamamagitan ng pagsuklob ng plastic sa ulo nito hanggang sa hindi makahinga. Nauna nang itinanggi nina Bantag at Zulueta ang mga alegasyon laban sa kanila. Samantala, sinabi naman ni Justice Secretary Jesus Crispin Remulla na dapat harapin na ni Bantag at Zulueta ang kanilang sitwasyon matapos nang maglabas ng arrest warrant laban sa kanila. “If you think you’re innocent, just come in and face the music. Ano naman yan e, the judges would be able to know if the truth is there. Alam naman nila yung totoo at hindi totoo,” saad ni Remulla sa isang pahayag. “That’s due process. The wheels of justice are turning. So that’s a welcome development. Law enforcement na yan. It’s already up to the prosecutors to do their job…we take custody of him. Hopefully we can arrest him or he will surrender, hopefully,” sabi ni Remulla. “The law has a protocol on how to handle persons who will be arrested.
