NBI clarifies role in interception
The Bureau of Immigration on Wednesday clarified its role in the interception of Filipinos with arrest warrants at ports of entry and exit. Commissioner Norman Tansingco said arresting Filipinos is not within the immigration’s mandate, pointing out that BI officers cannot serve warrants of arrest against Filipinos. Tansingco made this clarification in response to a query made by Senator Robin Padilla on 5 September during his privilege speech, citing the case of Mohammad Said, a 61-year-old man who allegedly attempted to depart the country for Malaysia on 10 August but was stopped by the BI. The BI chief added that it is the local law enforcement agencies — the NBI and the PNP — who are authorized to conduct arrests. He also clarified that they implement derogatory records as received from courts, Interpol, foreign governments and other competent authorities. If encountered, those with criminal records are turned over to the NBI or the PNP, who in turn, affect the investigation and arrest. Tansingco further clarified that Said was intercepted for being the subject of an Interpol red notice issued in 2017. NTF-ELCAC gives Church a seat
The Catholic Church will play a more significant role in the anti-insurgency effort through a recalibrated National Task Force to End Local Communist Armed Conflict, or NTF-ELCAC, National Security Adviser Eduardo Año said yesterday. The task force will now have the Catholic Bishops’ Conference of the Philippines’ Episcopal Commission on Public Affairs as a member. “We welcome the CBCP through its Episcopal Commission on Public Affairs to the NTF-ELCAC Executive Committee and we look forward to working with them in pursuing peace and development in all parts of the country, especially in conflict-affected areas,” Año said. The task force indicated an openness to suggestions from the Church in adopting “moral and ethical approaches in addressing the communist insurgency,” as cited by CBCP president and Kalookan Bishop Pablo Virgilio David in a recent statement. “We are opening the door of NTF-ELCAC to the Church because it has an important role to play in ending violence and terrorism in the country,” Año said. “For more than 50 years, we have lived with the scourge of the communist armed conflict. With peace now in sight, the Church has an important role to play in ensuring peace and development in the long term,” he added. With the CBCP in the NTF-ELCAC, Año believes that concerns raised by the Church or by cause-oriented groups supported by them could be immediately addressed. “Because of this development, the Church will have more opportunity to relay its concerns, since its mandate is to act as a liaison of the CBCP to the government,” he said, citing the attendance of Fr. Jerome Secillano at the NTF-ELCAC executive committee meeting with President Ferdinand Marcos Jr. in Malacañang on Friday. Año reiterated that the task force’s main mandate is to formulate “whole-of-nation” policies to end armed conflict in the country. “CBCP’s membership in the task force ensures a whole-of-nation’s participation because the religious sector is an important component of the nation,” he said. Intervention in influenced areas Año sees the CBCP making significant contributions to the development of areas previously under the influence of the New People’s Army, as well as facilitating social inclusivity in the pursuit of peace. “Given that we are now on the road to total victory, it’s necessary that we recalibrate the way we do things and the entry of the CBCP to the NTF-ELCAC is one of the changes we have implemented under the Marcos administration,” he said. More rebels rejoin society NTF-ELCAC also expressed optimism the government can sustain its peace-building effort to encourage more rebels to reintegrate into mainstream society. At a forum on Saturday, NTF-ELCAC director Alexander Umpar said that in 2023, a total of 959 villages cleared of the insurgency were included in the Barangay Development Program or BDP, an initiative that aims to bring sustainable development programs to conflict-prone and conflict-affected communities. Under the BDP, each village recipient receives a package of programs, activities, and projects worth a maximum of P20 million. BDP beneficiaries in 2021 and 2022 numbered 822 and 1,406, respectively, he said. Umpar said the NTF-ELCAC is confident that by 2028, it would have attained its goal of achieving lasting peace and development in areas that are vulnerable to armed conflict. “‘By 2028, it is about sustaining the momentum of NTF-ELCAC gains with regard to the dismantling of guerrilla fronts, the reintegration of former rebels, and most of all, building resiliency for our communities under the ambit of good governance toward unity, peace and development,” he said. The government, he said, has dismantled 69 of 89 guerrilla fronts since the creation of the task force in 2018. One of the 20 remaining guerrilla fronts, he said, is active while 19 others had weakened. “‘When we say strategic victory, this (because) of the 19 weakened guerrilla fronts and only one is left to be confronted by the Armed Forces of the Philippines,” he said. “There are still concerns about the armed groups but they are no longer able to initiate an armed struggle or to topple our government. So, that’s the strategic victory,” Umpar said. On the other hand, NTF-ELCAC director Jose Descallar urged rebels to give up and join the government in its goal of transforming the country into a “new Philippines.” He said the military could shift its focus to “external threats,” once the government is able to address the local insurgency. Meanwhile, Director Emmanuel Santos of the Office of the Presidential Adviser on Peace, Reconciliation and Unity said the conduct of localized peace engagements has been proven to be the “most effective” approach in addressing the communist insurgency. “We’re localizing the engagement so we will be closer to the people to make them feel that the government is really here,” Santos said. Man detained for same-sex act may face death penalty
A 20-year-old Ugandan man detained for alleged unlawful sex with a 41-year-old male may face the death penalty, according to the charge sheet against him. Prosecutors have charged the man with aggravated homosexuality under the Anti-Homosexuality Act 2023, the charge sheet stated. The draconian legislation, which was signed into law in May, contains provisions that make “aggravated homosexuality” punishable by death and includes penalties for consensual same-sex relations of up to life in prison. The legislation has broad support in the conservative, predominantly Christian country, where lawmakers have defended the measures as a necessary bulwark against perceived Western immorality. However, it has been condemned by the United Nations, foreign governments including the United States, and global rights groups. This month the World Bank announced it was suspending new loans to the East African nation, saying the law “fundamentally contradicts” the values espoused by the US-based lender. Ugandan President Yoweri Museveni has accused the World Bank of using money to try to “coerce” the government to drop the controversial legislation. Adrian Jjuuko, executive director of the Human Rights Awareness and Promotion Forum, said his organization had “documented 17 arrests” in June and July following the adoption of the law. Former Bataan gov off the hook
The Sandiganbayan announced on Sunday that it has cleared former Bataan Governor Leonardo Roman of a P3.66-million graft charge stemming from the anomalous construction of a mini-theater at the Bataan State College in 2004. Citing the prosecution’s failure to prove his guilt beyond a reasonable doubt, the anti-graft court’s Second Division acquitted Roman of violating the Anti-Graft and Corrupt Practices Act or RA 3019 in a 41-page ruling. “As the prosecution, in this case, failed to prove beyond reasonable doubt all the elements of Section 3(e) of RA 3019 under which the accused was charged, accused Roman should be entitled to an acquittal,” said the Sandiganbayan. To recall, the case against Roman involved the alleged awarding of a P3.66-million mini-theater project of the Bataan State College in 2004 in favor of V.F. Construction despite no allocated budget or appropriation for the project. He was also accused of colluding with his co-accused executive assistant Romeo Mendiola, treasurer Pastor Vichauco, budget officer Aurora Tiambeng, and accountant Numeriano Medina by giving unwarranted benefits to V.F. Construction for the release of the sum. Filed before the Ombudsman, the case stemmed from a complaint-affidavit dated 1 September 2004 accusing Roman and his cohorts of the crime of malversation of public funds through falsification of public documents. Roman served as the governor of Bataan from 1986 to 2004. In 2006, the Ombudsman dismissed the complaint for lack of probable cause. The Supreme Court affirmed the Ombudsman’s decision to drop the criminal charge. The Ombudsman, however, filed the case before the Sandiganbayan in 2015 following the SC’s ruling to reverse the criminal charge of graft. Based on the prosecution’s probe, Roman entered a contract with V.F. Construction to construct a mini-theater and rendered his authorizations, approvals, and certifications for the P3.66-million payment. Investigation revealed that Roman certified the project as fully completed and issued the payment to the construction firm in two installments. However, more than five months after the final payment was made to the construction company, the CoA discovered that the mini-theater, contrary to Roman’s declaration, was incomplete. The structure, it said, was only 50.7 percent complete. In clearing Roman, the Sandiganbayan stressed that it was “not convinced” by the prosecution’s theory that the erstwhile governor’s execution of a contract and approval of the payment with the V.F. Construction despite the lapses was tantamount to graft. “The evidence on record is insufficient to prove beyond reasonable doubt that there was bad faith, manifest partially, or gross inexcusable negligence on the part of the accused when he committed the questioned acts,” the Sandiganbayan said. According to the Sandiganbayan, while Roman may have committed mistakes in the performance of his duty, the fact remains that the evidence is insufficient to prove a serious breach of duty that was committed flagrantly, palpably, and with willful indifference or blatant and extremely careless manner. DBM, DepEd respect Ombudsman’s suspension order
The Department of Budget and Management on Saturday said it will adhere to the Office of the Ombudsman’s suspension order against officials involved in the purchase of alleged overpriced laptops for public school teachers in 2021. “The Department of Budget and Management, under the leadership of Secretary Amenah F. Pangandaman, assures the public of its utmost compliance with the decision set by the Office of the Ombudsman against former Procurement Service and DBM officials due to their alleged involvement in the purchase of reportedly overpriced laptops for the Department of Education,” it said in a statement. It added that Pangandaman has already directed concerned officials to implement the suspension order against former and present PS-DBM officials and employees involved in the controversial procurement deal of DepEd laptops. In a resolution, Ombudsman Samuel Martires issued a six-month preventive suspension without pay against education and budget officials, pending the investigation into the P2.4-billion laptop procurement for the DepEd Computerization Program. Citing reports from the Commission on Audit, the Ombudsman found sufficient grounds to preventively suspend the officials for grave misconduct, serious dishonesty and gross neglect of duty. The DBM has already requested an independent investigation from the National Bureau of Investigation in August 2022. The DepEd also assured that the suspension of its officials won’t affect the education services of the department, especially the preparations for the opening of School Year 2023-2024. “DepEd adheres to due process and shall abide by the said Order. Meanwhile, the Department reassures the public of its unhampered services as we prepare for a safe and orderly opening of School Year 2023-2024,” DepEd spokesperson Michael Poa said. Among the education officials ordered to be placed under six-month suspensions are former PS-DBM officers-in-charge Lloyd Christopher Lao and Jasonmer Uayan; and procurement management officers Ulysses Mora, Marwin Amil, and Paul Armand Estrada as well as Alec Ladanga, former Executive Assistant IV of the Office of Usec. Sevilla; Marcelo Bragado, Director IV of DepEd’s Procurement Management Service; and Selwyn Briones, DepEd’s Supervising Administrative Officer. Meanwhile, Senate Minority Leader Aquilino “Koko” Pimentel III on Saturday urged the Ombudsman to go after the contractors involved in the alleged overpriced laptop procurement deals. Pimentel said the anti-corruption body should undertake “vigorous efforts” in reclaiming public funds used in the anomalous purchasing deals. “The Ombudsman’s decision to impose preventive suspension sends a strong signal that any alleged wrongdoing will be treated seriously. It is equally vital to thoroughly examine the role of the contractor in this anomalous transaction, from its background to how it secured the contract,” he said. It is imperative for the Ombudsman “to regain taxpayers’ money, expended on items that did not align with the government’s actual needs.” The PS-DBM awarded the contract to Sunwest Construction and Development Corp., LDLA Marketing and Trading Inc. and VST ECS Philippines Inc. Pimentel earlier authored the Senate Resolution 120, which called for a comprehensive investigation into the laptop procurement carried out by DepEd through PS-DBM. In previous hearings, the Senate Blue Ribbon Committee found out that the joint-venture companies failed to meet the technical specifications required for the laptops, rendering them unsuitable for the teachers’ needs. The companies were also unable to complete the delivery within the agreed target dates outlined in the procurement contract. “Our citizens deserve to know the exact circumstances that led to the selection of the joint venture comprising Sunwest Construction and Development Corp., LDLA Marketing and Trading Inc. and VST ECS Philippines Inc. for this significant procurement,” Pimentel said. He criticized the PS-DBM over its failure to promptly blacklist the suppliers involved in the anomalous laptop deals by the recommendation of the Commission on Audit. Police hauls 1,245 e-sabong suspects
The Philippine National Police on Tuesday announced that 1,245 suspects have been apprehended in a comprehensive anti-illegal gambling operation focused on the rampant issue of e-sabong. The operation, which spanned from 1 July 2022, to 15 August 2023, saw the collaborative efforts of various police regional offices and national support units across the country, PNP public affairs office chief Brig. Gen. Redrico Maranan said in a statement. Data from the PNP Crime Incident Reporting and Analysis System as of 17 August 2023, reveals a significant stride in the campaign against e-sabong activities. Among the apprehended suspects, 437 cases have been referred to prosecutors, while 808 cases have been directed to courts for further legal action. The same case records culled through CIRAS revealed 322 cases resulting in the conviction of the accused. Based on the report submitted by Police Regional Office 7, 348 suspects had already been taken into custody. Among these cases, 123 have been referred to prosecutors, and 225 cases have been forwarded to the courts for prosecution. Following closely behind, Police Regional Office 3 recorded 328 arrests. Of these cases, 170 were referred to prosecutors, and 158 are undergoing trial before the Courts. The Criminal Investigation and Detection Group played an instrumental role in this operation, apprehending 200 suspects. Out of these cases, 27 have been referred to prosecutors for further legal proceedings, while 187 cases are poised for court action. PNP chief Gen. A leftist party-list representative, one among those who foist their nationalistic pretense, who has been critical of the previous administration’s war on drugs but couldn’t for once slam the communist rebels for their terroristic activities, and always engaged in either wrong or misleading narratives, has once again unleashed a thoughtless and unstudied declaration, poking her finger in the West Philippine Sea dispute vis-a-vis China’s claim that the Philippines had committed to removing the BRP Sierra Madre which has been aground for a long time at the Ayungin Shoal. This time she has targeted former President Rodrigo Roa Duterte for the latter’s alleged silence on the issue in the face of former presidents Gloria Macapagal-Arroyo’s, Joseph Estrada’s and President Ferdinand Marcos Jr.’s denial of making such a commitment to China. She has cast suspicion on the former maverick President’s and the latter’s daughter’s (Vice President Sara Duterte) alleged non-issuing a denunciation statement against China’s attacking the resupply mission to BRP Sierra Madre and failing to deny having made the aforementioned pledge. In the first place, there is no need to dispute China’s claim because, for one, it has not submitted proof as to the identity of a government official who made such a commitment, and on what occasion and year it was made. For another, assuming a commitment was made by whomsoever, the same could not be undertaken given that the ship in question is in Ayungin Shoal, which is within the exclusive economic zone of the Philippines, over which place the latter has sovereign rights under international law and the United Nation Convention on the Law of the Sea or UNCLOS, and therefore it can do whatever it pleases. Moreover, the arbitral ruling handed by the Permanent Arbitration Court has affirmed the Philippines’ sovereign rights’ claim to it while it rejected China’s expansionist claim over the West Philippine Sea — hence, any contrary claim over the use of the same or invocation of whatever commitment made in regard thereto not only has become moot if not irrelevant but — and more importantly no basis in international law. There is no need for FPRRD to issue a statement to deny or dispute China’s claim simply because as aforestated, it has not validated its allegation with any semblance of proof. Moreover, it is irrelevant at this stage owing to the arbitral award. Even if it is relevant, the denial of the existence of such commitment by no less than the current head of state is more than sufficient. Unlike this impertinent lawmaker, FPRRD abhors calling attention to himself. To require the Vice-President to issue a similar denial and a denunciation against China’s assault on the Philippine Coast Guard is redundant, with PBBM having already an official statement on the matter. The lady solon nastily insinuates that FPRRD has been sleeping with the enemy citing instances that she did not particularize forgetting that even if he has developed a friendship with China’s President, his virtual speech before the United Nations, asserting our sovereignty over the West Philippine Sea and his raising the arbitral ruling in a face-to-face dialogue with President Xi Jinping on his first state visit to China spoke eloquently of his position that he is fiercely opposed to China’s unlawful incursions on Philippine waters. This member of the Lower House has also repeated the lie started by some anti-Duterte critics that the latter has described the arbitral ruling as a mere piece of paper. For her education and others. PRRD was describing how China is treating the favorable decision by not only ignoring it but committing repeated acts of aggression against the Philippines. China is demonstrating its rejection of the international arbitral court ruling by treating it as a worthless piece of paper. In other words, it is telling the world that the Philippines may have the decision (paper) but it has control over the territory it has won in the arbitration. China — a major source of outbound tourists — has left Canada off a list of countries now approved for travel by tour groups, its embassy in Ottawa said Wednesday, due to anti-Beijing rattling by Ottawa. Last week Beijing lifted a Covid-era ban on group tours to dozens of countries including the United States, Germany, Japan, and Australia, but not Canada. Travel agents turn to the list of approved destinations when promoting and arranging foreign vacations for Chinese nationals. There are currently 138 countries on the list. Teves claims persecution, wants House panel to back off
Negros Oriental Rep. Arnies Teves, who has been the subject of the House committee on ethics and privileges for months now owing to "disorderly behavior" that has led to a double suspension, wants the House to terminate its proceedings against him. Ferdinand Topacio, the lead legal counsel of Teves, delivered before the panel chaired by Rep. Felimon Espares a letter dated 10 August from the lawmaker asking the committee to defer its further proceedings, claiming the accusations leveled against him are "clearly baseless" and "meant to "politically harass and persecute" him. Teves argued that the panel's continued proceedings breached its own rules, Section 2 of which states that "if the subject matter of the complaint against a Member of the House is pending before a judicial, quasi-judicial or administrative body, the Committee shall defer action on said complaint until final judgment has been rendered by such body." Citing the rules, Topacio said Teves' terrorist tag is currently pending before the Anti-Terrorism Council and may be raised to the court. Teves' letter countered the panel's letter on 1 August, relative to the lawmaker's alleged acts or omissions that supposedly constitute a violation of the Code of Conduct of the House of Representatives and for disorderly behavior. The embattled solon is being called to account for his recent designation as a terrorist, his supposed abandonment of office resulting from his prolonged absence in Congress and dancing in boxer shorts in a video uploaded on his social media account. Teves questioned why the panel, after the lapse of his second "questionable" 60-day suspension, wanted him to undergo the same process on the same matters, which he considered "clearly uncalled for as they are acts of persecution against me." "Honestly, it saddens me that this Committee is being used as a tool by this current administration to persecute me on my acts which are nothing but lawful," Teves said in the letter. "May I remind you that what you are doing can become a dangerous precedent to future innocent acts of any member of the House, including yourself and the Speaker," he added. He further noted that the panel's proceedings are being used as a vehicle to pressure him to return to the country, "knowing full well" that there are threats to his life and limb which recent events, including a publicized video of death threats, have validated. But despite the security concerns, no law enforcement authority has even investigated the perpetrator, according to the solon. "In similar fashion, the authorities have also deliberately ignored all evidence of another possible angle in the Degamo murder, since the same points to a political ally of the administration. This is the unfortunate reality that engulfs this nation at present, and which prevents me from repatriating myself," Teves added. Teves, whose second suspension lapsed earlier this August, is being implicated in the murder of his political foe, Negros Oriental governor Roel Degamo, and eight others on 4 March in the governor's residence in Pamplona town, for which he is being tagged as the mastermind. Right before the killing, Teves flew out of the country and has yet to return due to what he claims are serious threats to his life. His continued stay out of the country, notwithstanding an expired travel clearance, prompted the suspension. He, however, again insisted that he never abandoned his duty as a lawmaker and stressed that he has been clamoring to be allowed to participate in legislative proceedings, which he argued is permitted by House rules and that his colleagues "equally enjoy" and "exercise". Teves claimed he has evidence supporting his assertion that he attempted to participate in several hearings but was blocked from doing so. As to his physical absence, he said, "Again, I repeat: the principal reason why I have been unable to attend sessions is due to grave and serious threats to my life, threats which have persisted and even intensified, as just two days ago." QC cops nab 22 in anti-crime operations
Quezon City Police District operatives arrested 22 individuals for various offenses on Saturday, 12 August. The Batasan Police Station (PS 6) under P/Lt.Col. Paterno Domondon Jr. served a warrant of arrest to Andrew Toledo for violation of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002. The Holy Spirit Police Station (PS 14) under P/Lt.Col. May Genio arrested Nico Landicho for theft and the District Special Operations Unit (DSOU), under P/Maj. Djoanna Santos, arrested Jonathan Melendres for violation of R.A. 9165. The respective courts of origin of the warrants were already notified regarding the arrests of the accused. In its campaign against illegal drugs, six individuals were apprehended in a series of buy-bust operations. An aggregate value of shabu worth P57,900, buy-bust money, and several drug paraphernalia were confiscated from the suspects and they will be charged for violation of R.A. 9165. Colombians in spotlight over Ecuador, Haiti assassinations
Two years after a Colombian squad allegedly shot dead the president of Haiti, authorities in Ecuador have accused a group of Colombians of being behind the assassination of a top presidential candidate, pointing to the export of a culture of political hit jobs. Colombia has a long history of politicians being assassinated by opponents, drug traffickers, or paramilitaries, and even its president, Gustavo Petro, campaigned before his election from behind a wall of bulletproof shields. After the shock assassination of Ecuador journalist and anti-corruption crusader Fernando Villavicencio on Wednesday, authorities released pictures of six Columbian suspects, one of them splattered with blood. A seventh suspect was killed in a shootout at the scene of the crime. The country's main newspaper, El Universo, reported Villavicencio was assassinated "hitman-style and with three shots to the head." Police said the suspects were arrested in a series of raids in which they also found a rifle, a machine gun, grenades, and ammunition. In a message of support to Ecuador, Venezuela's President Nicolas Maduro drew a direct link to the murder of Haitian president Jovenel Moise in his home in July 2021 by a group of 17 Colombian mercenaries. "A gang of Colombian hitmen, mercenaries, went to Haiti to assassinate a president," he said during an official event. "These criminal gangs of hitmen are unfortunately taking this Colombian model of political assassinations outside of its borders." Jorge Mantilla, a Colombian investigator into organized crime, said that the arrests showed the "specialization among Colombian criminals in the use of violence" after six decades of armed conflict between the state and guerrillas, paramilitaries, and drug gangs. He said the two assassinations "show the capacity that these violence professionals have of connecting with transnational crime networks." Cross-border ties Villavicencio said last week he had received several threats from Los Choneros, one of Ecuador's most powerful criminal groups which the Insight Crime thinktank said became the armed wing of a Colombian drug cartel. It also has ties to Mexico's Sinaloa cartel. Late Friday Villavicencio was buried in Quito during a private ceremony after hundreds of people paid tribute at an exhibition center, where his coffin was draped with the flag and a symbolic presidential sash with the words "My power is in the constitution." While there has been no clear claim of responsibility, the murder has highlighted the once-peaceful nation's decline into a violent hotbed of drug trafficking and organized crime. Wedged between the major cocaine producers Colombia and Peru, Ecuador -- seen as having laxer controls -- has in recent years attracted foreign drug cartels that have linked up with local gangs to move drugs through the country to the United States and Europe. Mantilla explains that Ecuador's drug gangs "acquired their power from working with Colombian organizations and later became independent" and grew stronger. On Thursday, Ecuador's Interior Minister Juan Zapata referred to the detainees simply as "foreigners," saying they were "members of a criminal group" that assassinated Villavicencio in an "attempt to sabotage" snap presidential elections due on August 20. Colombian media said the suspects had criminal records in their home country, including for arms manufacturing and trafficking, drug trafficking, murder, or domestic violence. Colombia partly 'responsible' After the Haiti assassination, a US investigation revealed that two men at the head of a Miami security firm had devised a plan to kidnap Moise and replace him with a Haitian-American citizen. In March this year, dual Haitian-Chilean citizen Rodolphe Jaar pled guilty in the United States to housing the Colombian commando team and giving them weapons. That same month Colombia's president Petro said his country was partly responsible for Moise's assassination. "Colombia has a co-responsibility... it was Colombian mercenaries who went to kill the president of Haiti, unleashing a crisis even worse than the one they were already going through," he said. Gadon wants more funds for NTF-ELCAC, blasts SWS poverty survey
Presidential Adviser for Poverty Alleviation Lorenzo "Larry" Gadon on Monday said he will work with other government agencies to fulfill the mandate of his office, especially with the National Task Force to End Local Communist Armed Conflict which he said has done a lot in terms of curbing poverty and insurgency. In a virtual press briefing of the NTF-ELCAC called "TAGGED Debunking Lies by Telling the Truth," Gadon said the task force should even ask for a supplemental budget to carry on its task. "The NTF-ELCAC has been very successful [in] stabilizing areas formerly held by insurgents. The task force budget must be reconsidered. When it was conceptualized, it had an P18-billion budget which was slashed down to P10 billion. That was already spent half of this year," Gadon said. "They should ask for a supplemental budget to continue their program. How would you solve this problem that you say is now only confined in Norther Samar?," Gadon asked, referring to the insurgent group New People's Army. He added that if he had his way, he would recommend particular areas that need NTF-ELCAC intervention so that the task force's Barangay Development Program would get implemented in that area. "My position and office is not an implementing agency, so I would recommend if I assessed a particular area that needs the NTF-ELCAC," said Gadon. He will also do the same with the National Anti-Poverty Commission and the Presidential Commission for the Urban Poor, he added. "That's my role, to see to it that these agencies are really fulfilling their jobs for the benefit of our countrymen. Gadon blasted the recent survey reported by Social Weather Stations that over half of Filipino families considered themselves poor. "They (SWS) wanted to make poverty incident a matter of perception. They're more of propagandist than a real survey," Gadon said, citing also the SWS Senate survey in the last election that showed him at 36th place. "I was 19th placer in that race," Gadon said. Former Pakistan PM Khan arrested after court convicts him of graft
Former Pakistan prime minister Imran Khan was arrested at his home in Lahore on Saturday after a court in the capital found him guilty of graft and sentenced him to three years in jail. The former international cricket star has long warned he would be arrested to prevent him from participating in elections that are due to be held before the end of the year. "His dishonesty has been established beyond doubt," Judge Humayun Dilawar wrote in a ruling seen by AFP for a case centered on gifts he received and did not properly declare while he was premier. "He has been found guilty of corrupt practices by hiding the benefits he accrued from the national exchequer willfully and intentionally." In May, Khan was arrested and briefly detained in Islamabad for the same case, sparking deadly unrest during which supporters of his Pakistan Tehreek-e-Insaf (PTI) party poured onto the streets and clashed with police. In the aftermath of his release following three days in custody, PTI has been targeted by a crackdown with thousands of arrests, reports of intimidation, and muzzling of the press. After he was taken away by police Saturday, a video made before his arrest was posted to his X account. "My arrest was expected & I recorded this message before my arrest... I want my party workers to remain peaceful, steadfast, and strong," he said in the caption accompanying the video. Khan not in court Khan has faced a slew of court cases on charges he says are politically motivated since being ousted in a vote of no confidence last year, and was not present when he was sentenced Saturday. The judge also fined him 100,000 rupees (around $350). Soon after the ruling, police entered his home in Lahore and arrested him. "I have just received the information that Imran Khan has been arrested," Attaullah Tarar, Special Assistant to Prime Minister Shehbaz Sharif, told reporters. Party officials said Khan had been taken to the capital, while his legal team said they would be filing an immediate appeal. "It's important to mention there was no chance given to present witnesses, neither was the time allotted to round up arguments," a member of the team said. Parliament is likely to be dissolved after it completes its term in the next two weeks, with national elections to be held by mid-November or earlier. Tobacco on list of agri products in proposed economic sabotage law, says Villar
Senator Cynthia Villar assured that tobacco is included in the list of agricultural products covered by her proposed Anti-Agricultural Economic Sabotage Act of 2023. She said the proposed measure would amend the Anti-Agricultural Smuggling Act to include hoarding, profiteering, and a cartel of agricultural products as "economic sabotage." “Tobacco will be included in the agricultural products covered by this law,” Villar, who is chairperson of the Senate Agriculture and Food Committee, made the assurance during the International Tobacco Agricultural Summit held at Shangri-La Hotel in Taguig City on Thursday, where she was the guest speaker. Citing a report from the National Tobacco Administration, Villar noted that the tobacco industry contributes to employment and revenue generation in the country, supporting around 2.2 million Filipinos directly or indirectly. The lawmaker added that tobacco has contributed nearly P16 billion to the country's gross domestic product in 2021. The Oxford Business Group's Economic Impact Report showed that tobacco cultivation was present in 23 provinces across 12 regions in the Philippines, with the Ilocos Region being the top producer at 69 percent, followed by Cagayan Valley at 23 percent, and Northern Mindanao ranking third, as of April 2022. Villar underscored the industry's significance to rural economies is highlighted by a 47.8 percent increase in the area planted for tobacco between 2019 and 2022. Since 2013, she said the implementation of sin taxes for tobacco and alcohol, resulted in additional funds for the national health budget, including Universal Health Care. The sin tax revenue, primarily from tobacco collections (mainly cigarettes), accounted for 58 percent of all sin tax collections and comprised 54 percent of the health budget in 2020. "Tobacco-producing provinces receive shares from tax collected to be used in funding livelihood programs, infrastructure projects, and promote economically viable alternative agricultural products for the farmers," she said. However, Villar noted that tobacco—like any other agricultural product— is not spared from criminal activities like smuggling and tax evasion. Such crimes, she said, undermine the livelihood of farmers by "saturating the market with cheap, adulterated, and untaxed products.” The Bureau of Customs earlier reported an estimated P3 billion loss in excise taxes from illicit cigarette operations between 2019 and 2022. As reported by Euromonitor, the incidence of illicit cigarette trade is projected to increase from 12.2 percent in 2020 to 18.5 percent in 2023. “This illicit competition leads to reduced prices and demand for locally grown tobacco, resulting in income loss among our farmers,” she lamented. Villar recalled the Anti-Agricultural Smuggling Act was passed in 2016, unfortunately, not a single smuggler has been imprisoned since then. Graft buster clears Cusi
Citing the presumption of regularity, the Office of the Ombudsman threw out the graft complaint of a New York-based billionaire against former Energy Secretary Alfonso Cusi, other Department of Energy officials, Davao City-based executive Dennis Uy, and several others over the sale of 90 percent of the shares of the Malampaya natural gas consortium. On 18 October 2021, US-based geologist Balgamel Domingo and Filipino-American anti-Duterte leaders Rodel Rodis and Loida Nicolas-Lewis filed charges against Cusi, Uy, and the others involved in the sale of the Malampaya stake to the Udenna group of Uy. In a copy of the ruling obtained by the Daily Tribune, the Ombudsman said it could not delve into the complaint on the legality of the transaction since “the authority to make such a determination belongs to the court.” “Seemingly, this complaint is in actuality a collateral attack on the validity of the Share Sale and Purchase Agreement,” it said. The decision declared that “matters of such tenor are not determinable in a preliminary investigation before the Ombudsman’s Office.” “Without any judicial determination decreeing the illegality of the Share Sale and Purchase Agreement, this Office is left with nothing but to acknowledge its validity,” the ruling said. The Ombudsman cited a precedent in the case of Teresita Buenaventura vs Metrobank, in a ruling that stated: “The burden of showing that a contract is simulated rests on the party impugning the contract.” “This is because of the presumed validity of the contract that has been duly executed,” the Ombudsman ruling read. “Wherefore, the criminal charges for violation of Section 3(e) and of Republic Act 3019 against the respondents are dismissed for lack of probable cause.” The ruling was signed by members of a Special Panel of Investigators composed of Ronald Allan Ramos, Josephine Mae Rosapapan, Francisco Alan Molina and Bonifacio Mandrilla. Prime takes control The operation of the Malampaya project was recently assumed by the Razon group’s Prime Energy which bought a 45-percent stake from Malampaya Energy XP, or MEXP, of the Udenna group. MEXP had bought the shares of Shell Philippines Exploration B.V., or SPEX, in the consortium. The Department of Energy had branded the complaint a political move since the two Fil-Am lawyers in the suit were prominent in the “Oust Duterte” movement in the United States. The complaint alleged that Cusi and other energy officials had granted “unwarranted benefits and advantage” to Uy’s UC Malampaya in the buyout of Chevron’s share in the consortium. Udenna, through spokesperson Raymond Zorilla, said there is “no law requiring approval of the transfer of shares of companies that have an interest in Malampaya.” Zorilla said the transfer of Chevron and Shell shares underwent strict bidding processes and due diligence by both multinational oil and gas players. “The share sales were above board and legal and had to pass scrutiny by Philippine regulators, international lenders, and the said private multinationals involved,” Zorilla added. Cusi, in an interview with Daily Tribune, had said the DoE was not involved in choosing the buyer of the shares of Shell and Chevron in the Malampaya project. “The DoE did not get involved in the sale (of shares). We don’t know that they are selling. Our question was what their standards are for choosing Udenna. Why didn’t you choose the big companies, and why Udenna?” he said. Industry experts said the sale of shares was a private transaction that the accusers, who are US lawyers, should have been very familiar with. Cusi said the DoE, during his watch, went beyond its mandate by reviewing the technical, legal, and financial aspects of the transactions, the results of which were provided to the public. Political agenda The complaint, he said, had an underlying political agenda connected to his being the head of President Rodrigo Duterte’s Partido Demokratiko Pilipino-Lakas ng Bayan or PDP Laban. “It is not only political propaganda against me, but it also has a destabilization background… because I’m the president of the PDP.” The complaints, in turn, stemmed from the unending Senate inquiries on the Malampaya deals. The DoE said the Senate probes and the controversies that resulted from them had caused costly delays in the review process that would ultimately affect the country’s energy security. To refute a recent remark by Senator Sherwin Gatchalian, the DoE, in a statement said: “The inquiries of Senator Gatchalian are causing undue delay to the timeline of the consortium corporations, and this may eventually take its toll and put our energy security at risk.” The DoE’s approval of the sale of shares of stock of Chevron Malampaya LLC, one of the three corporations in the Malampaya Gas Field Project Consortium, had been dubbed by Gatchalian, chairman of the Senate Committee on Energy, as “lutong Macau.” It also backed the Udenna assessment that the deals were above-board. “When the sales were made, both Chevron Philippines, which owned Chevron Malampaya, and Shell Petroleum NV, owner of SPEX, followed rigorous global standards,” the DoE said. Nicolas-Lewis was part of a 25-person delegation from the US-Philippines Society, a private group comprising business executives and diplomats, who met with Duterte a week before his inauguration as president in 2016. Nicolas-Lewis was then accompanied by former Philippine Ambassador to the US Jose Cuisia, PLDT chair Manuel V. Pangilinan, retired American diplomats, and executives of Coca-Cola, SGV, JP Morgan, and other top corporations. Nicolas-Lewis is the sister of former National Anti-Poverty Commission chairperson Imelda Nicolas, who was one of the “Hyatt 10” Cabinet members who turned against then-President Gloria Macapagal-Arroyo in 2005. Imelda and most of the Hyatt 10 members ended up getting key posts in the administration of President Benigno “Noynoy” Aquino III. Imelda was made head of the Commission on Filipinos Overseas. Nicolas-Lewis plot bared In February 2018, former President Duterte bared intercepted conversations that indicated Nicolas-Lewis was behind efforts to push the International Criminal Court, or ICC, to probe his war on drugs. Duterte revealed a recorded conversation between Lewis and another political opponent whom he did not name. “I was listening to the tapes of their conversation. It was provided to me by another country, but the conversation was somewhere in the Philippines and New York,” Duterte said. He said that among the recordings was one in which Lewis allegedly told another person: “See you in the headquarters when the case is filed.” Duterte then said in a public address that he was aware of developments on the ICC case and that lawyer Jude Sabio, the main complainant in the case, was a paid hack of Magdalo Senator Antonio Trillanes IV and Rep. Gary Alejano, both failed putschists. Sabio withdrew his complaint before the ICC and revealed that the case was the handiwork of the dirty tricks factory of Trillanes. In 2016, Duterte pointed to Lewis as the financier of an alleged destabilization plot against his administration. Teves could join legislative proceedings, but only if he asks
During a hearing on Tuesday, hours before Arnie Teves was designated as a terrorist by the Anti-Terrorism Council through Resolution 43, Manila Rep. Benny Abante, a panel member, said Teves could join proceedings in the House of Representatives via personal request. The House ethics and privileges panel, which jurisdiction includes administrative complaints and issues filed against House members, will let suspended lawmaker Teves participate in legislative proceedings via videoconferencing only if he would make a "personal request." "Because we have a rule here that must appear [in person]. The ruling here is this if any congressman would like to make use of the videoconferencing, he has to make a personal request on that and the reason why," Abante said. He underscored that Teves is not excluded from this privilege, which is afforded to all members of the House. "If he wants to participate with us through video conferencing, then he must make a personal request, not through his lawyers. He himself personally," Abante stressed. The lawmaker made the remark, notwithstanding that Teves has since pleaded that he be allowed to attend legislative proceedings via teleconference but has been denied. To recall, Teves lambasted the House leadership, questioning why colleagues were allowed to join meetings, sessions, and hearings through video teleconferencing while he was not. He had earlier cried over being considered absent--that later resulted in a twice suspension-- despite attending the legislative proceedings via teleconference, which he lamented was permitted by Congress. The lawmaker, who was being tagged as the "mastermind" behind the murder of his political foe, Negros Oriental Governor Roel Degamo, and nine others on 4 March, has been headstrong in his decision not to return home and physically attend the House ethics panel motu proporio, citing serious threats to his life. Ako Bicol Rep. Raul Angelo Bongalon, the panel's vice chairperson, in the same hearing, echoed Abante's comment, citing Speaker Martin Romualdez's recent order that "all the congressmen are required to attend physically or face to face all activities here in Congress" following the lifting of State of Public Health Emergency. President Ferdinand Marcos Jr., through Proclamation No. 297 issued on 21 July, ordered the lifting of the state of public health emergency that had previously been declared throughout the country owing to the Covid-19 pandemic, which had claimed thousands of lives. "That's why he (Teves) has to make a request personal to the Office of Speaker or to the Secretary-General to avail the videoconferencing," Bongalon said. The panel chairperson, Rep. Felimon Espares, meanwhile, stressed that "he needs to report [for work] here in the House," citing the lawmaker's expired travel clearance. "He left with an approved travel authority which already lapsed, so he needs to show up here,” Espares noted. Acorda: BBM’s second SoNA ‘peaceful’
About 5,000 protesters were allowed by the police to express their grievances along Commonwealth Avenue in Quezon City Monday as President Ferdinand Marcos Jr. delivered his second State of the Nation Address at the Batasang Pambansa before a joint session of the Senate and the House of Representatives. Philippine National Police chief Benjamin Acorda Jr. said he had ordered maximum tolerance to be employed by the cops in dealing with the protesters, who also held activities near Mendiola Bridge in Manila, within sight of Malacañang Palace, the seat of government power. Acorda said as he inspected police lines near the SoNA venue that, “we are professionals and we exercise [restraint] in all our dealings [with the people] while providing the proper security for the President.” “We talked with our personnel and we emphasized the observance of human rights and maximum tolerance,” he added, explaining that the police made sure that pro-administration and anti-Marcos groups did not get close to one another. He said they were allowed to hold their respective programs far from each other so as to prevent untowards incidents arising from misunderstanding and the taunting that attended encounters of rival groups in the past. The Quezon City government designated places where the groups could hold their respective programs. “Regardless of affiliation, whether pro or anti and whatever, our guidelines included maximum tolerance, and we appealed to them to stay in their designated areas,” the PNP chief said. The PNP deployed more than 20,000 policemen, who were augmented by personnel from various government agencies that included the Metropolitan Manila Development Authority, the military, the Bureau of Fire Protection and local government units. The anti-SoNA rally was staged along Commonwealth Avenue while pro-Marcos supporters held their own program near the Commission on Audit compound. Bongbong orders TB problem priority
President Ferdinand Marcos Jr. has given directives to the Department of Health to tackle the issue of tuberculosis in the Philippines as the country remains one of the top countries with the high burden of TB, Health Secretary Teodoro Herbosa said on Tuesday. Herbosa said this during the Malacañang Press Briefing as the TB cases in the country increased at the height of the Covid-19 pandemic amid strong protocols for outdoor masking. “One of the directives of the President to me, when he appointed me last month, was to address the problem of TB,” Herbosa said. “The Philippines continues to be one of the top countries with the high burden of tuberculosis, and we’re like number four in the world. We were already down to number 9, but we increased again,” he added. Herbosa, citing a study posted on The Lancet Global Health, said about one million Filipinos suffer from TB — which is quite a large number for the country’s population. The study mentioned that nearly 70 Filipinos die daily from this curable disease. He added that 650 out of 100,000 Filipinos had TB in 2021, higher than 533 per 100,000 Filipinos in 2020. The National Capital Region, Region IV-A, and Region VI have the highest TB cases. Based on the Department of Public Health records, there were 433,746 partial data on individuals with TB in 2022. According to the DoH chief, one of their new anti-TB thrusts for the next three months is shortening the treatment to just four months instead of six to nine months to encourage patients not to abandon therapy. Shortened treatment “So it’s shortened for the regular TB, and then six months for multiple drug-resistant patients. We’ve also started to implement other things like artificial intelligence diagnosis with radiology; through the X-ray, the computer already diagnoses the presence or absence of TB,” Herbosa explained. “So we’re improving our case detection, and we are also improving our delivery,” the DoH chief said. PEMC gets teeth vs WESM breach
The Supreme Court affirmed a Court of Appeals ruling declaring valid the memorandum of agreement between the Energy Regulatory Commission and the Philippine Electricity Market Corporation to probe irregularities at the Wholesale Electricity Spot Market or WESM. Associate Justice Marvic Leonen in a 12-page decision, said the Court’s Second Division denied the petition filed by the Power Sector Assets and Liabilities Management Corp. or PSALM seeking the nullification of the said agreement as well as its accompanying protocol. The ruling affirmed the 2009 CA findings which held that the PEMC has the power to investigate possible breaches of the rules governing WESM. The appellate court also held that the ERC did not unduly delegate its powers in the assailed memorandum and protocol with PEMC. It noted that under the rules and regulations of the Electric Power Industry Reform Act or EPIRA, the Department of Energy with the industry players, were mandated to formulate rules for WESM. Citing the rules promulgated for WESM, the CA found out that PEMC’s investigative powers came from its designation under EPIRA as the autonomous group tasked to implement the electricity spot market and formulate rules. Also, it noted that this was made clear in the assailed protocol, which delineates the actions that the ERC and the PEMC may take. “With the statutory basis for respondent Philippine Electricity Market Corporation’s power to investigate and sanction breaches of the Rules outlined and considering that petitioner failed to show how these acts encroach on the exclusive and original jurisdiction of respondent Energy Regulatory Commission, we deny the Petition,” the SC declared. In affirming the CA decision, the SC, pointed out that the power to investigate violations of the spot market ules is concurrently exercised by the ERC and EPMC. Basis is EPIRA It also explained that EPIRA provides for the establishment of spot market, whose rules are to be formulated by the DOE jointly with industry participants. The spot market would also be implemented by a group to be constituted by the DoE with representation from industry players. “Thus, EPIRA empowered the Department of Energy, together with the industry participants, to develop the governance structure of the Wholesale Electricity Spot Market. This structure, as laid down in the Rules, empowered the Philippine Electricity Market Corporation to investigate breaches of the Rules and act accordingly to ensure the members comply with them,” the SC noted. “The Philippine Electricity Market Corporation is likewise vested with the power to resolve disputes between market participants and the market operator and provide adequate sanctions in case of breaches of the Rules,” it added. The case stemmed from the request of PEMC to then Energy Secretary Angelo Reyes to approve the conduct of a formal investigation by its Enforcement and Compliance Office against petitioner for possible breach of WESM rules with respect to six power generating plants whose electricity output is being traded in WESM. PSALM argued that the agreement signed on 31 January 2008 and its protocol constituted undue delegation of authority by the ERC of its exclusive powers under EPIRA to enforce the rules and regulations of the electricity spot market, investigate and act against any participant or player in the industry for violation of any law, rule or regulation governing the same, including rules on cross-ownerships, anti-competitive behavior, abuse of market, positions and other similar acts. It further contended that the procedure adopted for investigation of breaches of the WESM rules under the protocol is violative of due process.
