QC court grants TRO on LTO’s plastic license card procurement
A preliminary injunction has been handed down by the Quezon City Regional Trial Court Branch 215 following the lapses of the temporary restraining order it issued over the Land Transportation Office's procurement of plastic cards for driver's licenses. QC-RTC Branch 215 Judge Rafael Hipolito granted the petition filed by AllCard Inc. that questioned the procurement contract awarded to Banner Plastic Card Inc., which submitted a bid of P219 million inclusive of taxes for procuring the license cards, higher than the P177 million bid of AllCard Inc. A post-qualification evaluation disqualified AllCard due to "delays" in another project involving the Bangko Sentral ng Pilipinas (BSP) and other government agencies. LTO chief Asst. Sec. Vigor Mendoza immediately expressed that it would be a big setback to the project which would stop the deliveries of the plastic cards which may add another two-month delay. "Once effective, mahihinto ang supplier natin. Hindi na siya pwedeng magdeliver... Dati goodbye papel, eto welcome back although the injunction is not yet effective," he said in a radio interview. Land Transportation Office chief Vigor Mendoza II on Friday said the temporary restraining order issued by a Quezon City court on the awarding of contract for the production of plastic cards that are being used in the printing of the physical driver’s license is just a temporary setback. Mendoza said the TRO issued was not a permanent injunction for the Banner Plasticard to refrain from producing and delivering plastic cards to the LTO. “This is just for 20 days, the hearing is already on August 22. By that time, we are confident that the court will see that there is no basis for permanent injunction, which means that the TRO could be lifted,” Mendoza said. “The bidding underwent a fair and transparent process. While I was not still the LTO chief when the bidding process was done, my initial review of the documents revealed that it went through a proper procedure,” he added. Mendoza who is a lawyer by profession also questioned the arguments raised by Allcards Inc., the losing bidder, on the issue of fair and transparent conduct of the bidding process. He, however, said that he will leave the legal discussion before the QC Regional Trial Court Branch 215 between the lawyers of Allcards Inc. and the Office of the Solicitor General that will represent the Department of Transportation and the LTO. “This is what the OSG would certainly do, for the early lifting of the TRO,” he said. Mendoza expressed confidence that the court will be able to appreciate the arguments that would be raised by government lawyers in refuting the allegations made by Allcards in the case it filed. In a bid to solve the issue of shortage of the plastic cards, the DoTr held a bidding process which was won by Banner Plasticard Inc. The first delivery of around 100,000 plastic cards was made in late July by Banner Plasticards. Mendoza said he does not see any reason that the awarding of the contract to the Banner Plasticard constitutes grave and irreparable damage. “What would Allcards Inc. lose in the awarding of the contract to Banner Plasticard? The contract is subject to pecuniary estimation, which means that the discussion focuses on the money,” Mendoza said. “So there is no grave and irreparable damage to that. And if there is no grave and irreparable damage, the public interest should prevail over the business interest of one or two,” he stressed. Cashless transactions are now prevalent with the use of e-wallets on mobile phones and smart cards. But this proved to be challenging for an ANZ bank depositor in Brisbane, Australia when she needed money to renovate her house. Taryn Compton recently went to a local branch of the bank to withdraw A$3,500 but she forgot to bring her automated teller machine card. Compton decided to withdraw the amount from her account over the counter. Still, it was not possible. The teller told Compton that the bank was a cashless branch and the only way depositors could withdraw their money was through the ATM, 9 Now reported. The teller helped Compton download and install an app on her phone so she could transfer money from her bank account to her e-wallet without the need for an ATM card. This also didn’t work, however, leaving her with one last option. “The teller told me that if I wanted to get my cash out if I needed it that day, to transfer it to another bank and try somewhere else so that’s what I did,” she said, according to 9 Now. “If you can’t get your own money from a branch, what’s the point of a bank?” she exasperatedly asked. Meanwhile, a Filipino money collector was faced with a somewhat similar dilemma when he also could not get his cash. The collector was on a motorcycle on the Cebu South Coastal Road in Cebu City last 4 July heading to Mandaue City to remit the cash payments he had collected from kiosks at the South Road Properties when a motorist signaled to him that he had dropped something, the TV news show 24 Oras reported. On turning around, he was shocked to see money flying all over the road and people scrambling to pick up all that cash. He looked at his money bag and quickly realized that the money had flown out of it after the zipper broke. He then called the police for help in recovering the money. While he got back P2,083,000 on the spot, this was far less than the total he had collected that day which was about P4 million. The collector faced the prospect of having to replace the lost money himself. He then aired an appeal to the people who had snatched up some of the money he had dropped to return it. If an anomaly was committed in a company, can the supervisor who knew about it even though she did not participate in it be punished for indifference? Can this cost her job? After all, she did not commit the act himself. Let us see how the Supreme Court decided the fate of Ruby del Rosario in Ruby del Rosario v. CW Marketing & Development Corp. et al. (GR 211105 promulgated on 20 February 2019). Ruby was the sales supervisor of CW Marketing at its Home Depot, Balintawak branch. As such, she was assigned a computer connected to a printer/scanner. She alone was taught by CW’s IT department how to operate the machine. In October 2010, the Hong Kong and Shanghai Banking Corp. reported to CW Marketing that it had received falsified pay slips and identification cards from CW employees applying to HSBC for credit cards. Upon investigation, it was discovered that the bogus documents were printed out of Ruby’s computer using the scanner/printer assigned to her. She was sent a notice to explain. She admitted to knowing the falsified documents submitted by her subordinates but denied participation in it. She said they had merely used her computer. After the administrative hearing, Ruby was terminated for violation of the Employee Handbook. She immediately filed for illegal termination with the National Labor Relations Commission or NLRC. In his decision, the Labor Arbiter found CW Marketing guilty of illegally terminating Ruby. He opined that CW Marketing failed to prove that Ruby committed the falsification of the documents. On appeal, the NLRC reversed the Labor Arbiter. It found that CW Marketing properly terminated Ruby for loss of trust and confidence. When the matter was brought to the Court of Appeals, said court sustained the valid termination on the ground cited by the NLRC. Thus, Ruby had no recourse but to go to the Supreme Court. The High Court ruled: “We are hard-pressed to reverse the NLRC’s and the CA’s uniform factual findings that as sales supervisor, Del Rosario held a fiduciary position. The NLRC’s finding was supported by substantial evidence, or such evidence as a reasonable mind might accept as adequate to support a conclusion. We have previously ruled that in the case of supervisors or personnel occupying positions of responsibility, loss of trust justifies termination. Loss of confidence as a just cause for termination of employment is premised on the fact that an employee concerned holds a position of trust and confidence. “Specifically in this instance, Del Rosario was entrusted with the custody, handling, or care and protection of the employer’s property. In fact, she was assigned the lone computer at the Home Depot branch, which was connected to the printer/scanner, and as a result, she was the only user taught by the company’s IT personnel how to operate the machine. “In this case, Del Rosario herself unwittingly provided proof of her infractions. At the outset and repeatedly thereafter, Del Rosario admitted to the assignment to her of the main computer connected to a shared network and a printer/scanner which became her accountability. She then admitted knowledge and awareness of others’ usage of her computer; the edited and falsified documents authored by her subordinates through the same computer; and even their submission of these falsified documents to HSBC in connection with their credit card applications. “Del Rosario attempted to extricate herself from liability by insisting that she never falsified any of the questioned documents and only her subordinates who used her computer effected the falsification thereof. Unfortunately for Del Rosario, the charge against her is not the criminal act of falsification but the totality of her acts as supervisor, including her negligence and want of care for company property entrusted to her. “Clearly, while the actions of Del Rosario do not point to her direct participation in the fraudulent scheme, which negatively bore on CW Marketing’s reputation and credit standing with banks, in general, and HSBC, in particular, her actions evinced that she knew fully well that some of her subordinates were falsifying documents using company property. “From this point on, Del Rosario deliberately kept silent over her subordinates’ actions resulting in damage to CW Marketing. Moreover, her awareness of the identities of the culprits and her insistence that she did not herself falsify the documents demonstrate her sheer apathy to CW Marketing not worthy of her position as sales supervisor.” The facts and citation are from the case above cited.
