Three days from now, Filipinos will troop to the polling precincts once again to elect their Barangay and Sangguniang Kabataan officials in what is supposed to be an integral component of the country’s democratic system. The elections, postponed many times before, allow for the representation and participation of local communities and the youth. However, these elections have not been without controversy, with allegations of vote buying and the distribution of illegal campaign materials tarnishing the democratic process. Held every three years, the Barangay and SK Elections, also known as BSKE, play a critical role in the Philippine political landscape. Barangays are the smallest administrative units in the country, serving as the frontline of government service delivery. The SK, on the other hand, specifically represents the youth, offering them an opportunity to engage in the political process from a young age. Barangay elections ensure that the grassroots communities are represented in local governance. Residents can choose leaders directly responsible for addressing their immediate concerns, such as public safety, health, and education. SK elections aim to involve the youth in decision-making processes. By participating in these elections, young people can gain valuable experience in leadership, advocacy, and community service, setting the stage for their future involvement in national politics. These elections serve as a training ground for democracy, allowing citizens to exercise their right to vote and make informed choices. The principles of accountability, transparency, and participation are nurtured at the community level. Barangay elections can be particularly empowering for marginalized groups, including women and indigenous communities, who have the opportunity to run for office and make their voices heard. However, despite the importance of the BSKE, they have been marred by allegations of vote buying and the distribution of illegal campaign materials. These practices raise concerns about the integrity of the electoral process and whether they indicate an early introduction to corrupt political practices. Vote buying, whereby candidates offer money, goods, or services in exchange for votes, is a long-standing issue in Philippine politics. While it is not exclusive to Barangay and SK elections, the fact that such allegations surface even in these local-level contests is troubling. It begs the question of whether young people are witnessing and, to some extent, participating in a system that normalizes the exchange of votes for material gain. One possible explanation for the prevalence of vote buying is the socio-economic conditions in many barangays. Poverty and inequality can create an environment where voters may be more susceptible to monetary incentives. This underscores the need for broader efforts to alleviate poverty and promote education and awareness about the value of their vote. Another issue is the widespread use of illegal campaign materials, such as posters, banners, and pamphlets that do not conform to electoral regulations. While this may seem like a relatively minor infraction, it contributes to a culture of disregard for the rule of law and electoral integrity. Starting young in politics should ideally involve nurturing values of ethics and civic responsibility. Instead, when young people are exposed to campaigns that flout the rules, it may inadvertently teach them that bending or breaking rules is an acceptable strategy to achieve political goals. This sends a damaging message about the importance of playing by the rules in a democracy. Addressing the issues of vote buying and illegal campaign materials in barangay and SK elections is crucial to preserving the democratic process and instilling positive values in young people. Schools and community organizations should conduct programs to educate young people about the significance of their vote, ethical campaigning, and the consequences of vote buying. Such programs can help instill a sense of civic responsibility. The Commission on Elections, on the other hand, should vigorously enforce campaign finance and election laws, penalizing candidates who engage in illegal practices. It is crucial, therefore, to address these issues by emphasizing education, enforcement of election laws, transparency, and community involvement. In doing so, these elections can better serve as platforms for shaping the future leaders of the nation who are committed to the principles of democracy, integrity, and ethical governance. DTI pushes for AI research hub; P300-M for consumer protection programs
The Department of Trade and Industry is pushing for the establishment of the Center for Artificial Intelligence Research, however, it remains "unfunded” under the proposed 2024 National Expenditures Program. During the hearing of Senate Committee on Finance’s Subcommittee “M” on DTI’s proposed P7.909 billion budget for the fiscal year 2024 on Tuesday, Trade Secretary Alfredo Pascual emphasized the idea would help the country's Micro, Small, and Medium Enterprises to effectively adopt “artificial intelligence in their business operations. “This is a research [and development] center. The model is the AStar of Singapore…It’s industry-oriented, it's not academic research. It’s a way to help MSMEs to adopt AI in their operations,” Pascual said, citing that large companies in the country “can take of themselves” to implement AI solutions in their businesses. “But this SMES would need assistance and this is the center that could do that plus the continuing research in the impact of AI on employment which jobs will be affected,” he said. The issue of AI ethics will also be addressed through CAIR, he added. “We are working this out, actually with some business groups that can donate…In fact, we have been offered already a place,” the DTI chief said. Pascual explained that the CAIR has been included in the DTI’s plan for revitalizing Philippine industries under the Philippine Development Plan. Meanwhile, DTI’s Competitiveness and Innovation Group, Undersecretary Rafaelita Aldaba said the agency has been requesting funds, amounting to P200 million, for the CAIR since two years ago. Aldana did not give further details as to why the Department of Budget and Management disapproved their requests. Stressing the importance of the AI program, Senate President Pro Tempore Loren Legarda lamented there must be a reason why the CAIR did not get a budget. Legarda asked Aldaba to further provide details on CAIR as the latter noted the DTI doesn’t have enough space in their existing building, “It’s a physical center and its goal is for us to become an AI center of excellence in the region in the near future. It’s going to house our data scientists, researchers, engineers who will be conducting AI [research and development] to support the needs of the industries, including MSMEs, start-ups, large companies, and multi-nationals,” Aldaba said. The CAIR is also eyed to provide capacity building and training and workshops on AI, she added “so that new products and services could come out from the idea. However, Legarda said DTI should not wait for the physical CAIR to be set up before it starts building the capacity of Filipinos concerning AI, adding that developing a physical infrastructure may take at least two years. “And knowing government, that’s so slow. That means all the resources on AI will not ensue until the structure is done,” Legarda lamented. “What I’m saying is that while the infrastructure is not yet set up, we should continue with AI capacity buildings and research.” Senator Mark Villar, who presided over the budget hearing, backed Legarda’s position, noting that DTI should ensure that AI benefits the country. “Other countries are very concerned also about what AI might mean for the labor industry and what the implications are. I think it’s important that we learn how we can leverage it to help our industries,” he said. On the other hand, Pascual appealed to the Senate for an additional P300 million in funding to strengthen the DTI’s consumer protection programs. “We want to reorganize our consumer protection activity by centralizing it because you cannot expect a junior person running after hoarders or profiteers in an area where there are a lot of people of influence that are operating in the region,” he said. “So the plan that we have done, this planning, after the budget submission, is to centralize the consumer protection activity in the head office and have a quick response task force,” said Pascual. “That would require a funding of P300 million to strengthen our consumer protection activities," he added. Villar supported the DTI’s plan citing its significance amid the ongoing inflation being experienced in the country “It is very relevant that the DTI takes a stronger role in monitoring these hoarders and manipulators,” he said. DTI Assistant Secretary Jean Pacheco said the P300 million would fund an inter-DTI strike team to increase their enforcement activities, consumer education and advocacy, complaints handling, and procurement of equipment for the certification and testing of vapes, among others. At least P130 million of the total request will be utilized for the procurement of equipment for DTI’s certification and testing of vape products, which is in line with their implementation of the law regulating e-cigarettes. Former OTS chief lambasts cultural decay at airports
The former Office for Transportation Security chief lambasted the cultural decay in the airport security teams that allows negligent screeners to continue working there, this before he could begin an internal purge. Ma. O Ranada Aplasca, who resigned from his post over the airport screener caught on closed-circuit television swallowing $300 bills taken from an outbound Chinese national, said the problem with airport security is “more than systemic, it is cultural.” “There was the problem with ‘tanim-bala.’ Maybe the problems were not highlighted in the past because no one was caught. Based on our records, for the past several years, no one was dismissed in the OTS for violations of our disciplinary policies,” he said. Aplasca said when he was the director of the PNP Aviation Security Group, his initial task was to clear the country’s airports of the “tanim-bala” scheme, in which airport inspectors hid bullets in travelers’ luggage to extort money. “That tanim-bala was the first marching order to me by former President Duterte, and that’s where I felt his 100-percent support; that’s why, in less than one month, we were able to solve the problem,” he said. Aplasca said that before his resignation Tuesday, the OTS had initiated 68 cases against erring personnel, with at least 11 people dismissed. Found guilty Meanwhile, DoTr Secretary Jaime Bautista said the female Security Screening Officer and three other OTS screeners involved in the cash swallowing incident last 8 September were “found guilty of stealing.” Bautista said the guilty verdict was included in the investigation report handed to him by the OTS group of investigators, which included the CCTV footage that showed the lady scanner stuffing the money into her mouth at Terminal 1’s final security checkpoint at the Ninoy Aquino International Airport. The four SSO screeners face administrative and criminal cases. “The investigation showed that she was guilty and swallowed the money. However, what she said in an affidavit was that it was chocolates. But the investigators saw that she was guilty,” Bautista said in Filipino in an interview with the media after a Senate hearing on Tuesday. The CCTV footage showed that at around 8:20 p.m. on 8 September, a Chinese passenger, identified only as Mr. Cai, placed his shoulder bag on the inspection tray at the final security checkpoint. After trying to promote the gateway to potential foreign investors who may want to operate the NAIA, Bautista expressed frustration and dismay at the incident. He authorized the imposition of the maximum penalty on those found guilty to demonstrate the Department of Transportation’s determined push to rid the NAIA and attached agencies of scalawags. The resignation of Office for Transportation Security Administrator Ma.O Aplasca would not be enough to stop criminal activities in the country’s airports, Senator Grace Poe said Wednesday. “A resignation at the top does not clean up its ranks,” said Poe, who chairs the Senate Committee on Public Services. “More than ever, the Office of Transportation Security needs steady leadership to implement much-needed reforms,” she added. Aplasca on Tuesday night submitted his courtesy resignation to Transport Secretary Jaime Bautista, days after lawmakers pressured him to resign from his post. The OTS has been on the receiving end of criticisms after one of its personnel was caught in a viral video swallowing $300 that she allegedly stole from a Chinese passenger at the Ninoy Aquino International Airport-Terminal 1. Poe noted that actions should not be taken after the incident. “There should be zero tolerance for criminal acts and unprofessional behavior,” she said. “While a witch hunt might put a syndicate on pause, the OTS urgently needs to review and tighten its security program,” she added. Over 10K Bar examinees on 2nd day
The Supreme Court said the number of examinees in the 2023 online and regionalized Bar examinations continued to dwindle on its second day yesterday. The SC Public Information Office said that as of 12 noon, only 10,392 of the 10,400 who completed the first day of the examinations last 17 September were taking the exams. Subjects covered in the 20 September examinations were Civil Law from 8 a.m. to 12 noon, and Labor Law and Social Legislation from 2 p.m. to 6 p.m. On Sunday, 24 September, the last day of the exams, Criminal Law and Remedial Law will be in the morning and Legal and Judicial Ethics with Practical Exercises in the afternoon. As in previous examinations it is expected that the number of examinees would further decrease on 24 September. The high bench had earlier announced that the results of the 2023 Bar exams would be release early December and the oath-taking and signing of the Rolls of Attorneys for the successful examinees to become full-fledged lawyers would be done before Christmas. SC to release results of 2023 Bar exams before Christmas
The Supreme Court disclosed that the results of the 2023 online Bar examinations will be released before Christmas while the oath-taking of new lawyers will be held before New Year. Yesterday, the three-day Bar exams started in 14 local testing centers (LTCs) nationwide. The SC said the last two days of the exams are on 20 and 24 of September. Associate Justice Ramon Paul L. Hernando, chairperson of the 2023 Bar exams committee, said: “For the longest time, Bar examinees have had to endure several months of perceived agony of waiting before the results of the professional licensure exams for future lawyers are released. “This year, however, following the examples of my recent predecessors as Bar Chair, the time spent by the examinees waiting in agony for the results of the exams will be cut short: my team and I are eyeing the release of the results of the 2023 Bar Examinations in early December before Christmas day. “Moreover, there will be simultaneous oath-taking and signing of the Roll of Attorneys in December also before Christmas day so that we will have our new batch of full-fledged lawyers before the year ends. “It will be an additional reason for those who will hurdle the Bar Exams to celebrate the Holiday Season.” Hernando added that as of 17 September, a total of 10,791, instead of 10,816 as earlier announced, will take the six-subject examinations spread over three days. The change in the number was a result of the withdrawal of 25 examinees who had earlier registered. As in previous examinations, they may still withdraw from the exams after the first day. Hernando said the conduct of the examinations by the SC will be assisted by 2,571 Bar personnel deployed in the 14 LTCs. The SC headquarters for the exams is at the San Beda College Alabang in Muntinlupa City is the appointed SC headquarters for the exams. “The 2,571-strong 2023 Bar workforce—which includes court officials; judges; numerous personnel from the Supreme Court, the Court of Appeals, the Sandiganbayan, the Court of Tax Appeals, and First-and Second-Level Courts; and volunteer lawyers in the government and private practice—are fully committed to ensuring the integrity and orderly process of this year’s Examinations,” Hernando said. Six core subjects are covered in the examinations—Political and Public International Law, 15 percent; Commercial and Taxation Laws, 20 percent; Labor Law and Social Legislation, 10 percent; Criminal Law, 10 percent; and Remedial Law, Legal and Judicial Ethics with Practical Exercises, 25 percent. The subjects yesterday were Political and Public International Law in the morning, and Commercial and Taxation Laws in the afternoon, from 8:00 a.m. to 12:00 noon and from 2:00 p.m. to 6:00 p.m. On 20 September 2023, the subjects covered are Civil Law in the morning and Labor Law and Social Legislation in the afternoon. On 24 September 2023, Criminal Law and Remedial Law will be in the morning, and Legal and Judicial Ethics with Practical Exercises in the afternoon. In the National Capital Region, the LTCs are at the San Beda University, Manila; University of Santo Tomas, Manila; SBCA; University of the Philippines, Quezon City; Manila Adventist College, Pasay City; and University of the Philippines, Bonifacio Global City. In Luzon, the LTCs are at Saint Louis University in Baguio City; Cagayan State University, Tuguegarao City; and University of Nueva Caceres, Naga City. In the Visayas, the LTCs are at the University of San Jose-Recoletos in Cebu City, University of San Carlos also in Cebu City, and Dr. V. Orestes Romualdez Educational Foundation in Tacloban City. There are two LTCs in Mindanao—one at the Ateneo de Davao University in Davao City and the other at the Xavier University in Cagayan de Oro City. Courts within the areas of the 14 LTCs will be closed on 20 September. Several local governments in the 14 LTCs have announced traffic rerouting in areas where the examinations will be held. The Philippines should become the country that leads the world in how to use AI, in call centers, for instance,” Sarma told reporters. “Here in the Philippines, it has to be a national effort. The government needs to be cognizant that this is an epic moment. It's like, you know, climate change is going to damage the environment, it will hurt a lot of people. This is technology change is just like climate change,” he said. Unlike other technologies such as automated teller machines or ATMs, which took about 15 years to be widely accepted, AI is a development that needs urgent adoption. Like ATMs, which previously raised concerns about replacing the job of bank tellers, AI will help industries develop further. “Bank tellers did not lose their jobs. Bank tellers did something more advanced, which is selling mortgages and things like that. The job changed because of technology,” he explained. Thus, in blending in with the changes brought about by AI, Sarma proposed that local industries like the business process outsourcing sector should upgrade more into becoming a technology space. “At this level, you have to go up because the attack comes from below. It's like a tiger, you know, it's chasing you, You climb a tree, and the tiger learns to climb the first 10 feet, well, you have to climb higher. So you have to go higher up in the cognitive stock to go higher,” he said. To complement the benefits of AI, Sarma noted that the local service industry workers, for instance, have to do the things that technology cannot. “For example, this Chat GPT cannot negotiate with you, can't do any planning, can't do dispute resolution. It can't calm an angry customer. So you have to figure out what the technology can do and what humans can do, that the technology can't. And you're to develop human capital in those directions.” Sarma is a professor of mechanical engineering and the Sloan School of Management at the Massachusetts Institute of Technology. Filipino-Indian billionaire sought relief from DOJ
Filipino-Indian billionaire Rajiv Chandiramani has asked the Department of Justice to junk the complaint against him for multiple counts of falsification of public documents filed by his estranged brother for being “baseless, contrived, and manufactured.” Rajiv, in his 25-page counter-affidavit filed through his counsel, denied committing any falsification in order to take control of the more than P1 billion worth of properties left behind by their father Prem Chandiraman following his death in 2011. He claimed that the falsification complaint was merely resurrected by his brother to pressure him to give in to the latter’s demands for more money after their initial compromise agreement in 2022. “By re-filing the complaint for falsification of documents as against Rajiv, Amith has violated his waiver and quitclaim. In the regime of law and order, repudiation of an agreement validly entered into cannot be made without any ground or reason in law or in fact for such repudiation,” Rajiv said. Contrary to his brother’s claim, Rajiv recounted that because of his business ethics, he was able to establish a good business reputation in the business community, particularly in the Filipino-Indian community. Rajiv is the owner of Rheana’s Trading Inc., which is one of the leading domestic companies engaged in the business of buying, selling, distributing, and importing electronic products and accessories. While his older brother, according to Rajiv, got hooked on illegal drugs and was confined in several drug rehabilitation facilities. Rajiv said his brother, in 2020, was released from a drug facility and then stayed in Dubai. A year after, Rajiv claimed there were several defamatory messages against him that were being circulated among relatives, friends, and colleagues, particularly, that he had allegedly falsified several sale documents. With this, Rajiv conducted his own personal investigation and was convinced that these defamatory messages originated from Amith. “It eventually became apparent that Amith started these malicious rumors as he wanted additional monies from Rajiv and their mother,” Rajiv said. Rajiv initially sought redress before the courts by filing a complaint for damages with an injunction against Amith to prevent and dissuade him from continuously spreading malicious allegations against him. He also filed a criminal complaint for cyber libel against Amith. Meanwhile, Amith, in July 2022, filed a criminal complaint for falsification of public documents against Rajiv and their mother and several other respondents before the Office of the City Prosecutor of Makati City. He alleged that Rajiv conspired with their mother to falsify the signature of their deceased father as appearing on several sale documents. In order to end their rift and upon persuasion of family members, Rajiv said he agreed to a compromise with Amith, which led to the mutual withdrawal of the cases that were filed against each other at that time. The agreement also provides a waiver and quitclaim covering any and all potential claims or rights against each other arising from, or in connection with the cases, as well as the estate of their late father. Rajiv, as part of the consideration for the compromise agreement, bound himself to pay Amith the total amount of P150 million by way of support. Rajiv said he has been complying with his contractual undertakings in providing Amith with monthly support of Php600,000, including giving financial assistance for Amith to put up his own electronics trading business. But was surprised to learn that Amith violated their agreement by resurrecting the falsification complaint against him. Amith in his complaint, claimed that Rajiv, their mother Pushpa Chandiramani, and several others connived in depriving him of his inheritance from their father Prem, amounting to billions of pesos in the form of real estate properties and business interests. Among the properties that he claimed were illegally taken from him by Rajiv and his cohorts was a prime 1,559 square-meter lot in Cubao, Quezon City with Transfer Certificate of Title No.46459. But the camp of Rajiv maintained that the compromise agreement entered into by him and Amith is a valid and enforceable contract; thus, the latter is barred from filing a falsification of public documents complaint. “The act of Amith in re-filing or reviving the Complaint for Falsification of Documents with the NBI is a violation of the compromise agreement, and his desistance, waiver, and quitclaim undertakings,” Rajiv said. He disclosed that he has filed a formal complaint for specific performance and damages seeking to compel Amith to comply with the provisions of the compromise agreement and the waiver and quitclaim. Golden Globes to air January 7 under new ownership
Next year's Golden Globes will take place on 7 January, the organization that bestows the entertainment awards said Thursday, in the wake of intense scrutiny over accusations of corruption and racism in recent years. Nominations are set to be revealed on 11 December, the organization added in a statement. The combined film and television awards have long been considered among the most prestigious in Hollywood after the Oscars. But the Golden Globes have lost their luster among many in the industry after The Los Angeles Times in 2021 revealed the bleak backstage operations of the Hollywood Foreign Press Association, which made up the contest's jury. In particular, the report said the group did not have a single Black member at the time, and detailed accounts of HFPA voters receiving lavish gifts from entertainment studios whose products they were voting on. In 2022, the historically raucous ceremony was shunned by Hollywood's elite and was not broadcast on television. Since then, the Globes have launched several image reform measures, including involving a more diverse group of voters and instituting a crackdown on ethics violations.
