DQ case filed vs Lin
A disqualification complaint was filed against Jeanly Lin, a candidate running for Sangguniang Kabataan chairperson in Barangay San Bartolome, Novaliches, Quezon City. The complaint, which was lodged with the local Commission on Elections office in Quezon City by Andrea Lazaro, alleged that Lin, also known as “JLin,” is not a Filipino citizen but a Chinese national. In the 11-page complaint, Lazaro claimed that Lin’s proficiency in Tagalog is limited, and that she allegedly relied on interpreters, while keeping a group of bodyguards during her campaign in their village. However, Lin’s Certificate of Candidacy indicated that she is a Filipino citizen. Jeanly is the daughter of Rose Lin, a Pharmally Pharmaceutical executive tagged in the allegedly questionable government supply contract worth billions of pesos during the pandemic. PNP logs suspected election-related incidents
The Philippine National Police on Tuesday announced that it has already logged eight suspected election-related incidents ahead of the Barangay and Sangguniang Kabataan Elections slated on 30 October. PNP spokesperson Col. Jean Fajardo said that the cases — including shootings and stabbings — were recorded in the Bicol Region, Eastern Visayas, Zamboanga Peninsula and Soccskargen. She added that the incidents will be validated within 10 days by the Joint Peace and Security Coordinating Council using its parameters to determine if these can be considered as ERIs. “First, we have to determine whether the victim or the suspect is an incumbent official running in the BSKE. We also check whether these are Commission on Elections officers or family members of candidates or identified political supporters of a candidate. Another thing is we would check if these would affect the electoral process,” Fajardo said. “In the past, there were incidents that qualified as ERI because these happened during the election period. Another parameter is if the incident may somehow create a form of political tension that may eventually affect the electoral proceedings,” she added. Fajardo disclosed that out of the eight incidents, one has been validated which happened in Libon, Albay where the victim Alex Repato, reelectionist captain of Barangay San Jose, was shot dead by still unidentified assailants in his house during the first day filing of Certificate of Candidacy last 28 August 2023. Meanwhile, police are looking into another incident where a candidate was allegedly prevented from filing his CoC in Malabang, Lanao del Sur. “We have to understand this area under the Bangsamoro Autonomous Region in Muslim Mindanao. There are special geographic areas we also have to monitor the presence of some threat groups. Task force formed on Albay village chief slay
LEGAZPI CITY — The Philippine National Police in Bicol Region disclosed that it has created a special investigation task group to probe the killing of a barangay official in Libon town last Monday. The PNP — through its Albay Provincial Police Office — said that the task force is set to dig deeper on the death of San Jose Barangay Captain Alex Enriquez Repato after filing his certificate of candidacy. APPO spokesperson Capt. Kharren Formales said that the “SITG Repato” has already conducted two meetings and that the investigation is already ongoing, adding that closed-circuit television footage of the incident is now being included in the investigation. “Based on the CCTV footage, two persons were seen riding a motorcycle which matches the testimony of the witness who was with barangay captain Repato before the incident,” Formales said. She added that a continuous probe is being conducted to establish the identity of the suspects. “We are still looking for possible witnesses who can point out who those people are. We are not ruling out that those two people may not be the only ones behind the shooting of barangay Captain Repato,” Formales said. She also stressed that the creation of SITG Repato was in line with the directive of Police Regional Office-Bicol director Brig. Gen. Westrimundo Obinque to conduct a thorough probe into the incident and to relentlessly pursue the perpetrators. “The SITG Repato is under the supervision of the deputy regional director for operation Col. Jesus A. Rebua and the lead and chairman is our provincial director Col. Fernando Cunanan Jr.,” she said. Formales added that Albay PPO, PRO-5 and other units are helping in the investigation by pursuing leads and gathering testimonies from possible witnesses who might shed light on the killing. “PNP-PRO5 strongly condemns the heinous incident. 600 checkpoints net over 15 Comelec gun ban violators: PNP
Around 15 persons have been apprehended since the start of the Commission on Elections' gun ban on Monday during the first day of filing of the certificate of candidacy for the Barangay and Sangguniang Kabataan Elections, Philippine National Police chief Gen. Benjamin Acorda Jr. said on Tuesday. Acorda said since implementing the gun ban, 15 firearms have been confiscated from more than 600 checkpoints nationwide. The establishment of checkpoints was carried out under Comelec Resolution No. 10924 to effectively implement the ban on firearms and other deadly weapons during the 90-day election period from 28 August to 29 November. The resolution prohibits the bearing, carrying or transporting of firearms or other deadly weapons in public places, including any building, street, park, private vehicle or public conveyance, or even if licensed to possess or carry the same, unless authorized by the Comelec. Acorda also said he has ordered a probe and has a person of interest in the incident that happened in Libon town in Albay where the victim Alex Repato, reelectionist captain of Barangay San Jose, was shot dead by still unidentified assailants in his residence at around 5 p.m. Monday, just hours after he filed his candidacy. “It is unfortunate in Albay we have one case of shooting but we already have a person of interest there and tinututukan ng ating kapulisan. What happened in Albay is election-related but I want to get first 'yung talagang official result of the investigation,” Acorda said on the sidelines of the National Capital Region Police Office's commemoration of its 122nd Police Service anniversary at Camp Bagong Diwa, Bicutan Taguig City. Comelec warns vs premature campaigning in barangay, SK polls
The Commission on Elections yesterday repeated its warning to all candidates in the Barangay and Sangguniang Kabataan Elections to refrain from premature campaigning. The warning was aired by Comelec spokesperson Atty. John Rex Laudiangco during the Laging Handa press forum yesterday. Ladiangco said once the certificate of candidacy is filed, the person is already a candidate and all the prohibitions will apply, particularly those on premature campaigning. All tarpaulins or posters of a candidate, even without the “vote” exhortation, are not allowed and will be taken down, while the candidate may face sanctions. Ladiangco said that based on the 2004 Supreme Court decision Chavez versus Comelec, posters with a picture or face of the candidate, caricature, resemblance and name but with no "vote" printed is still an indirect solicitation of votes and is considered prohibited. Laudiangco also mentioned another SC ruling in the case of a subject who conducted a motorcade when he went to the poll body’s office to file his candidacy. At that time, he was not yet a candidate. But when he filed the document, he already became a candidate and thus the motorcade was prohibited because it falls under indirect campaigning under Section 18 of the Omnibus Election Code. BSKE candidates’cop relatives to be transferred
The Philippine National Police on Wednesday revealed that at least 327 members of the force whose family members and other relatives are planning to run for the Barangay and Sangguniang Kabataan Elections in October this year were already identified. In a press briefing held at Camp Crame, PNP spokesperson Col. Jean Fajardo said policemen whose family members and relatives will run for barangay elections may be re-assigned to other areas in order to isolate the police organization from partisan politics. “Based on the survey we conducted, there were 327 of our personnel whose relatives would possibly run for the barangay elections,” Fajardo said, adding that the rule covers relatives up to 4th degree of blood relations. However, she stressed that the re-assignment is not yet final since the PNP is still waiting for the end of the filing of certificate of candidacy which will start on 28 August, adding that temporary reassignments of policemen away from the areas where they have relatives seeking elective post is a normal practice in the PNP. Earlier, PNP chief Police General Benjamin Acorda Jr. said the identification of the policemen will serve as a major factor in the adjustment of assignments on the days leading to the elections. “We identified these police officers to really make sure that they will not become partisan in this forthcoming election,” Acorda said. Elections without politics
Contrary to what many foreign nationals and even Filipinos themselves believe, partisan politics is prohibited in the synchronized barangay and Sangguniang Kabataan elections in the Republic of the Philippines on 30 October 2023. No less than Filipino lawmakers themselves have advised the people against engaging in partisan politics during the barangay and SK elections, citing the prohibition against it under the Omnibus Election Code and Section 93 of the Local Government Code of the Philippines. Under Section 93 on Partisan Political Activity, it is stated that, “No local official or employee in the career civil service shall engage directly or indirectly in any partisan political activity or take part in any election, initiative, referendum, plebiscite, or recall, except to vote, nor shall he use his official authority or influence to cause the performance of any political activity by any person or body.” He may, however, express his views, on current issues, or mention the names of certain candidates for public office whom he supports. Elective local officials may take part in partisan politics and electoral activities, but it shall be unlawful for them to solicit contributions from their subordinates or subject these subordinates to any of the prohibited acts under the Omnibus Election Code. To be elected on 30 October are 42,027 punong barangay or chairmen and 294,189 barangay councilors or kagawad, and the same numbers for the SK chairmen and councilors or kagawad. The barangay election shall be non-partisan and shall be conducted in an expeditious and inexpensive manner. No person who files a certificate of candidacy shall represent or allow himself to be represented as a candidate of any political party or any other organization and/or group. The barangay is the basic political unit that serves as the primary planning and implementing unit for government policies, plans, programs, projects and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicably settled. No person shall be eligible to be a barangay official unless he is a citizen of the Philippines, a registered voter, and an actual resident of the barangay for at least six months immediately preceding the election; able to read and write, and on the date of the election is at least twenty-one years of age. A German national asked: Is the barangay captain a politician? A barangay captain or barangay chairman is the highest elected official in a barangay, the smallest level of administrative division of the Philippines. Also within the barangay are sitios and puroks or sub-divisions of the barangay. The barangay captain does not belong to any political party, nor allow himself to belong to any of them to serve their interest. He works for and serves solely the interests of his constituents within the village. Another foreign national asked: Is a barangay political? A barangay is a political unit but the behavior, official actions and motivations of its leader are not partisan. The chief officials and officers of each barangay are the punong barangay, seven sangguniang barangay members, the SK chairman, a barangay secretary and a barangay treasurer. Are officials of the 42,027 barangays considered government employees of the Republic of the Philippines? Yes, absolutely. The punong barangay, sangguniang barangay members, the KB chairman, the barangay secretary and the barangay treasurer are regular government employees and, as such, are entitled to fixed salaries, alliances, insurance, medical and dental coverage, retirement and benefits. The SK was created in 1975 to train and develop the youth into a strong workforce to serve and protect the homeland. There are lingering voices of dislike for the KB. In fact, many barangay captains find them unnecessary, a nuisance, and a waste of huge amounts of money. Their abolition would be a boon to the thousands of villages in the entire country, they say. Comelec: Unqualified local aspirants will be rejected
The Commission on Elections on Monday announced that it will order its regional offices to outright reject the certificate of candidacies of unqualified aspirants for the Barangay and Sangguniang Kabataan elections, including overaged Sangguniang Kabataan bets and candidates for barangay posts who are not registered voters. Comelec chairperson George Erwin Garcia said that the move is to prevent a backlog of disqualification cases related to the upcoming polls as there are more than 4,000 petitions have been filed before the poll body. “We have decided that the local Comelec has the powers to reject and remove the CoCs of those unqualified. Why do we need to make things difficult? We’ll just not accept the candidacies of these people,” Garcia said. He added that Section 39 of Title Two, Chapter 1 of the Local Government Code of 1991 states that barangay aspirants must be at least 18 years old during election day on 30 October, must be a registered voter, as well as a resident of the barangay concerned for at least a year, and should be able to read or write. Meanwhile, Section 2 of Chapter 10 of Republic Act 10742 or the Sangguniang Kabataan Reform Act of 2015 states that candidates must be between 18 to 24 years of age on election day, able to read and write in English, Filipino or the dialect used in the barangay, must not be related to incumbent national and local officials at the “second civil degree of consanguinity or affinity,” and must not be convicted with finality on cases involving moral turpitude. However, Garcia clarified that disqualified aspirants could petition for their candidacy before the Comelec who will, in turn, decide whether their local poll boards were correct or not with their rejections. He also vowed to rule on all petitions, including disqualification petitions, before the 30 October polls. “We are committing ourselves to resolve these petitions before 30 October, for us to prove whether someone’s candidacy should be removed or not. If we affirmed the decision of the local Comelec, they could go to the Supreme Court,” Garcia said. The filing of CoCs is scheduled from 28 August to 2 September, with the first day marking the start of the election period for the Barangay and SK Elections.
