Bills up amid P24-B recovery
Luzon customers may soon pay for additional charges in their monthly electricity bills as the Energy Regulatory Commission, or ERC, prepares to issue an order that will implement a high court-approved recovery of at least P24 billion in generation losses. In an interview with reporters last week, ERC chairperson lawyer Monalisa Dimalanta disclosed that the collection, which will likely be on a staggered basis within three years, takes effect next year. “We have calculated it, so the timing (of collection) is what we care about now. The cost is somehow hefty so we will spread the collection for three years,” Dimalanta said. ERC order According to her, the ERC will issue an order to allow the Independent Electricity Market Operator of the Philippines, or IEMOP, to start the Luzon-wide collection of generation charges. “It will be co-collected with the consumers, but not all generation companies have claims, there are others who will pay for it,” she noted. For Manila Electric Co., or Meralco alone, the development means that customers will collectively pay to recover as much as P22.64 billion in generation loss from way back in 2013. This is part of the Supreme Court, or SC, ruling released last year. SC voids ERC order It can be recalled that the SC — through a decision promulgated on 3 August 2021, a copy of which was only released online on 1 July 2022 — voided the ERC order that was supposed to regulate prices in the Wholesale Electricity Spot Market, or WESM for November to December 2013. The move, according to ERC, should have capped spot market prices for the period to cut rates and lessen the high prices impact on customers by more than a third, or to just P7 million from P24 billion. The SC pointed out that the ERC’s order cannot be implemented due to the possibility of market power abuse, which could affect electricity prices. Address abnormal spike However, in its order, the ERC argued that it only wanted to address the abnormal spike and unreasonable electricity costs imposed by generation companies, or gencos during the period. The regulatory body also investigated alleged collusion among gencos to manipulate prices of electricity in the spot market during the maintenance shutdown of the Malampaya gas facility for a similar period. Yet, the SC pointed out that the ERC failed to notify the affected parties about its probe, which violated the gencos’ right to due process. The Senate Committee on Finance on Thursday approved the proposed P311.3 billion budget of the Department of Health for the upcoming fiscal year without the attendance of Health Secretary Teodoro “Ted” Herbosa. Herbosa skipped the DOH’s budget deliberation, normally led by the agency’s head, days after he failed to secure the approval of the Commission on Appointment. During the budget deliberation, DOH senior officials led by Undersecretary Lilibeth David, former Officer-in-Charge Maria Rosario-Vergeire and Undersecretary Gloria Balboa presented the agency’s proposed budget. Senator Francis Tolentino specifically questioned Herbosa’s absence in the budget deliberation, fearing that the agency is now in an “auto-pilot mode”. Senator Pia Cayetano, who presided over the agency’s budget deliberation, quickly clarified that the DOH is not “headless”. “Actually, all of the senior members of the team approached me a while ago and they acknowledged that, of course, it is a bit of an awkward situation,” Cayetano said. “But as you all know, Usec Dr. Vergeire was the OIC for many years and was very actively exercising her leadership not just in the past year, but even during the time of President Duterte. Dr. Usec. David is the most senior undersecretary. So I’m quite confident in the presentation today that they can answer,” she added. Tolentino explained that he is asking for Herbosa’s presence because “budget presentations would require answers concerning accountability.” “And perhaps the head of the department should be the one doing that. Otherwise, it would be in an auto-pilot mode,” he said. For her part, Senator Loren Legarda also expressed confidence in the senior officials of the DOH. “Let me just say that I’m certain that our very competent Usecs. and Asecs. down the line would be able to communicate the policies of the Secretary who still has to be confirmed,” Legarda said. “I am very confident that they will be able to answer our questions. I do not think that they would divert from any policy of the Secretary or say anything that would be against his policies,” she added. Cyber-attack on PhilHealth Senators also touched on the recent cyber-attack on the Philippine Health Insurance Corporation or PhilHealth. Legarda quizzed PhilHealth officials about the effect of the cyber-attack on the state-run health insurer’s operation, as well as the steps being taken by the agency to prevent similar cases in the future. Responding to the lawmaker’s query, Atty. Eli Dino D. Santos, PhilHealth’s Executive Vice President and Chief Operating Officer, said the agency has yet to restore its online system. “All transactions are offline, and we've resume operations meaning membership, employer submission, and payment over the counter,” Santos said. “Our benefits availment continues. We have already informed our partner providers that while the system is turned off, they can still submit claims or prepare the submission of claims,” he added. “At present, to confirm the statement of our President, we are set to turn on our systems today, but we are still completing the preventive measures before we turn it on. We are targeting to turn on our PhilHealth website, member portal, as well as the e-claims.” Over the weekend, PhilHealth confirmed reports that there was an “information security incident” on its online system, which prompted them to turn it off as part of its “containment measures”. The Department of Information and Communications Technology previously stated that the agency’s system was attacked by Medusa ransomware. A multinational cyber security software company, Trend Micro, defines “ransomware” as a type of malware that prevents or limits users from accessing a system, either by locking the system’s screen or by locking the users’ files until a ransom is paid. The Medusa ransomware group was demanding $300,000 from PhilHealth in exchange for access to its system. The group threatened to leak the personal information of PhilHealth members if it did not pay the ransom. The state-run health insurer previously stated that it would not give in to the group’s demand. During Monday’s fourth marathon hearing of the Senate panel’s investigation into the alleged abuse of the couple to Vergara, lawmakers once again cited another member of the Ruiz family, this time their patriarch. Senator Raffy Tulfo made the motion to cite Pablo in contempt for allegedly lying to lawmakers. Tulfor made the motion after Pablo denied a new testimony that implicates them in the case. His motion was seconded by Senator Jinggoy Estrada. Pablo is detained inside the Senate premises along with his wife, France, who was cited in contempt last week for the exact reason. ‘New witnesses’ Meanwhile, three more witnesses namely Melinda Magno, ‘Alias Paopao,’ and Richard Pinto, floated to support Vergara’s claims that she was abused by the couple. Senator Francis Tolentino, who chairs the Senate panel, ensured the safety of the new witnesses. “Let us make sure that while we are conducting hearings and even after, no harm will happen to them. Accused of rape, Russell Brand speaks of ‘distressing’ week
British comedian and actor Russell Brand on Friday spoke of an "extraordinary and distressing week" in his first public comments since rape and assault allegations were aired against him, but did not address the claims. "Obviously it's been an extraordinary and distressing week and I thank you very much for your support and for questioning the information you are being presented with," he said on a video posted to his YouTube channel, which has 6.64 million subscribers. "I need your support now more than ever, more than I ever imagined I would," he added. But he did not comment on the joint investigation by The Times, Sunday Times and Channel 4 television in which four women made claims of rape, sexual assaults and emotional abuse against him. Then on Thursday, a woman accused Brand of exposing himself to her in 2008. Brand criticized the British government for asking tech companies to take action against him. Denouncing what he described as "deep state and corporate collusion" and "media corruption and censorship", he said he would post a longer video on Monday. In a video released last week, just before the story broke, Brand, 48, denied the allegations against him, which are said to have taken place between 2006 and 2013. He said his relationships had always been "consensual", even during a period when he admitted he was "very, very promiscuous". Prime Minister Rishi Sunak's official spokesman called the allegations "very serious and concerning". Sunak "has been clear there should never be any space for harassment, regardless of where it is found", he added. Brand's publisher Bluebird announced that "all future publishing" with the comedian had been put on hold. UK media investigate sex assault claims against comedian Brand
The BBC and Channel 4, former employers of British actor and comedian Russell Brand, said Sunday they were investigating claims of rape, sexual assaults and emotional abuse over a seven-year period, which the 48-year-old has denied. Four women have alleged sexual assaults between 2006 and 2013 when Brand was at the height of his fame working as a presenter for BBC Radio 2, Channel 4 and acting in Hollywood movies, a joint media investigation said Saturday. The broadcasters BBC and Channel 4, along with the production company Banijay UK, said Sunday that they would open internal inquiries into the claims. "We are urgently looking into the issues raised," a BBC spokesperson told AFP. The allegations were made in a joint investigation by The Sunday Times, the Times, and Channel 4 Dispatches. "Banijay UK has launched an urgent internal investigation and will cooperate with any requests for information from broadcast partners and external agencies," the production firm said. According to the Times investigation, several women have made a range of accusations about Brand's alleged controlling, abusive and predatory behavior. In a video released Friday, Brand denied the "very serious criminal allegations". He said he had received letters from a TV company and a newspaper listing "a litany of extremely egregious and aggressive attacks". "Amidst this litany of astonishing rather baroque attacks are some very serious allegations that I absolutely refute," he said in the video clip posted online. According to the media reports, one woman alleged that Brand raped her in his Los Angeles home, while another claims he assaulted her during a three-month relationship while she was 16 and still at school. Known internationally as the former husband of pop star Katy Perry, Brand began his career as a stand-up comedian in the early 2000s. He was the host of the chat show Big Brother's Big Mouth, a spin-off of the popular reality series, for three years from 2004. He also played rock star Aldous Snow in the 2008 film "Forgetting Sarah Marshall" and its 2010 sequel "Get Him To The Greek". London's Metropolitan Police told AFP that while it was aware of the allegations, "At this time, we have not received any reports in relation to this". 2015 Vatican decree on Mediatrix not binding!
The claims of the Catholic Bishops Conference of the Philippines and the Vatican that Pope Pius XII had officially decreed that the Mediatrix apparitions were of “no supernatural character or origin” is not exactly true. If it is proven not true, the Papal “decree” is not binding and the faithful are allowed not to follow the decree, based on Canon Law. The CBCP released Circular 23-04 dated 14 July 2023 — quoting the official Dicastery document Protocol 226/1949 — stating that “in 1951, the Dicastery, the Supreme Sacred Congregation of the Holy See, after due examination of the documents made available, declared the alleged apparitions in Lipa (of Our Lady Mediatrix of All Grace) to have no supernatural character or origin, a decision directly approved by Pope Pius XII.” There has been no document in the Acta Apostolicae Sedis, the official Vatican publication, that said that Pope Pius XII had indeed approved the decree. It was never formalized into an official “promulgation,” which is a requirement of Canon Law, to be binding. In other words, the Dicastery Decree is official, but not the Papal Decree. Protocol 226/1949, authored by the Dicastery, did not clarify that the Pope Pius XII Decree had not yet been official and binding in a formal promulgation. Then apostolic administrator Bishop Rufino Santos said, in his decree of 12 April 1951, that he was still awaiting the Vatican decision regarding Lipa, contradicting Protocol 226/1949 that said a decision had been made. I, therefore, challenge the CBCP and the current Dicastery to produce documentary evidence that there was indeed an existing official Papal Decree of Pope Pius XII in fulfillment of the Canon Law ruling. The decree of Pope Pius XII is important because it was the basis for the recent order of Lipa Archbishop Gilbert Garcera to suppress Mediatrix activities in all churches in Lipa. “Vatican directs CBCP to cease 75th celebration of Lipa apparition” (CNN Philippines 28 July 2023). The CNN article reported that the Vatican reaffirmed its 1951 decree, precisely the questionable Pope Pius XII decree. Only the Pope has the authority to confirm and declare a Marian apparition. If the 1951 Pope Pius decree is now in question, so also are all the recent bans and suppressions of Mediatrix activities in Lipa. The added sentence reads, “The Confraternity of the Mediatrix of All Grace is a movement with dozens of chapters nationwide.” Confraternity members report that a Filipino priest very close to Pope Francis approached him to forward the sentiments of the Mediatrix devotees. He said the Pope simply passed the ball to the Dicastery. And since the Dicastery is vehemently anti-Mediatrix, it was a dead end, a failed attempt. Many Confraternity members were disappointed. The Confraternity has a nationwide presence, although its membership keeps moving dynamically forward and backward. There are chapters whose memberships are strong and keep growing, but there are some whose memberships have decreased. The dynamic chapters include Cebu, Iloilo, Guimaras, Kidapawan, Davao City, General Trias, and Jaro, to name a few. However, the Confraternity is different from the devotees. Confraternity members are essentially professionals, educated and articulate. They are well organized and subject to meetings and activities. The ordinary Mediatrix devotees are peasants, farmers, and fishermen, and are simply humble churchgoers, not so organized. But there are so many who have a strong faith and devotion to Mama Mary in their hearts. They do not even know the issues in the conflict. Their devotion is based on their hearts, not their minds. When the entire Philippine Church was held in submission by the Vatican under threat of excommunication or alienation, it was the laity that took up the cudgels, out of reach of the clutches of the Vatican and the CBCP. The Confraternity distributed hundreds of life-size Mediatrix statues nationwide. They laid the infrastructure for devotion to spread like wildfire to the sea of marginal devotees. It is estimated from Confraternity reports that Mediatrix devotees are broadly around four million nationwide. Herein lies the victory of the Virgin over the Vatican. Despite 70 long years of suppression and repression since the 1951 apparitions to this very day, Mediatrix devotion proliferates. The Vatican and the CBCP have succeeded in silencing Filipino nuns, priests, bishops, and cardinals but they are helpless against the true Marians among the masses. Even the suppressed Church prelates still believe in the silence of their hearts in the Mediatrix. Suppression has ironically strengthened the Filipino Marians. The Confraternity says it has devised a simple strategy. The Commission on Appointments on Wednesday approved the ad interim appointment of Gilberto “Gibo” Teodoro Jr. as secretary of the Department of National Defense. Prior to his confirmation, the 12-member House contingent of the powerful CA spared Teodoro from questioning as a “courtesy” to the Defense chief who previously worked as Tarlac's 1st district representative. “The 12-member House of Representatives contingent will no longer ask questions regarding the nominee being a former member of Congress for three consecutive terms in the 11th, 12th, and 13th Congress,” said Camarines Sur 2nd District Rep. LRay Villafuerte, the majority leader of the CA. Villafuerte added that the House contingent “has no doubt regarding the fitness and integrity of the nominee”. He appealed to their counterpart, the Senate to accord the same courtesy to Teodoro. From the 12-member Senate contingent, only Senator Risa Hontiveros asked questions to Teodoro. Hontiveros questioned Teodoro about his plans for the DND, now under his watch for the second time. He held the same position under the administration of then-President Gloria Macapagal Arroyo at the age of 43, the youngest ever appointee to the agency. Responding to the lawmaker’s query, Teodoro admitted that there has been a “shift in the evolution” from his first stint in the DND. He noted that he is now focusing on “straddling the balance between maintaining internal security and with an emphasis definitely given what is happening to the outside environment.” “We are strengthening our defense posture. We are gradually enhancing the capabilities of the AFP (Armed Forces of the Philippines),” he said. The Defense chief said he is also working on “leveraging” the country’s alliance with other nations to strengthen the country’s capability to protect itself from external threats. By doing so, he noted that he would try to introduce “management solutions to managerial problems, and not military solutions to managerial problems.” “That is the transformation that we are trying to make. We are also deeply restrategizing what we intend to do at least in the next five years in order not only to make the defense department more responsive to the outside and internal environments but also to make more efficient our use of resources, and to use information technology to the highest extent possible,” he added. Teodoro also underscored the importance of strengthening the country’s capability to respond to external strength and not just rely on diplomacy. “[T]he intensity of the need to focus on protecting our sovereignty, our sovereign rights, in the exclusive economic zone and other jurisdictions of the country become more paramount now, as the whole world is in a raise for resources,” he said. “We could not afford to be laidback here. We should be cognizant of it because we can and principally use diplomacy, however, if diplomacy is not backed up by a strong spinal cord, then we will just be stymied by a greater force,” he added. He made the remarks amid the increasing tension between the Philippines and China in the West Philippine Sea. China claims the vast South China Sea, including the West Philippine Sea. On 12 July 2016, the Philippines won its arbitral case against China in the Permanent Court of Arbitration – a landmark decision that China continues to reject. Teodoro said the Defense Department wishes the concentrate on not only guarding the islands of the archipelago and its internal waters but also on securing “peaceful, unimpeded, and unobstructed exploitation, and exploration of our sovereign rights over the 200 nautical mile EEZ of the republic and in all areas of the Philippines, to secure our baselines.” Last June, President Ferdinand Marcos Jr. announced Teodoro’s appointment as the new DND secretary, replacing Carlito Galvez Jr. who led the agency for five months. Aside from Teodoro, the CA also approved the promotion of 11 generals and senior officers of the AFP. Japan boyband agency admits founder’s sexual abuse
The president of Japan's biggest boyband agency admitted on Thursday that its late founder sexually abused young aspiring stars, decades after the allegations against him first emerged. Johnny Kitagawa died of a stroke aged 87 in 2019, having engineered the birth of J-pop mega-groups including SMAP, TOKIO and Arashi that amassed adoring fans across Asia. Allegations of abuse surfaced in Japanese media in 1999 but it was not until this year that they ignited full-on soul-searching, following a BBC documentary and denunciations by victims. "Both the agency itself and I myself as a person recognize that sex abuse by Johnny Kitagawa took place," said Julie Fujishima, a niece of the accused music mogul who died in 2019. "I apologize to his victims from the bottom of my heart," she told a packed news conference in Tokyo while announcing she was stepping down as head of Johnny & Associates "to take responsibility". "I take seriously what happened." Fujishima, who said she had stepped down on Tuesday, named singer and actor Noriyuki Higashiyama, a veteran member of the talent agency, as her successor. "It will take an enormous amount of time before we can regain trust," Higashiyama said. "I will stake the rest of my life on addressing this problem." Fujishima said she will remain in the agency's leadership to help "compensate" victims. - Defamation - Before his death, Kitagawa had successfully sued for defamation over the claims, although the verdict was partially overturned on appeal. He was never criminally charged. A panel of experts last month released the results of its first, in-depth probe into the allegations against Kitagawa, concluding that his abuse went as far back as the 1950s, even before the company was founded. Over the years, aspiring boyband idols collectively dubbed "Johnny's Jrs" sought his tutelage, and the panel estimated that at least "a few hundred" of them had been victimized. The report also quoted former recruits alleging in graphic detail how Kitagawa would perform oral sex on them, fondle them in their genitals or force his way into their beds at night. The panel said Fujishima, who was named Kitagawa's successor after his death, had been "remiss" in her duties because she failed to probe the allegations despite her knowledge of them. Her attitude perpetuated the leadership's tendency to look the other way, the report said. Fujishima, for her part, offered an apology in May but denied she had known about her uncle's predatory history. She chalked her ignorance up to what she framed as the extremely opaque, family-run nature of the boyband empire. "We do not believe there was no problem," she said in May, expressing her regret that she had let herself grow inured to the "abnormalness" of the agency's inner workings. US lawmaker promises ‘resolute reaction’ if Taiwan attacked
Any unprovoked attack on Taiwan will result in a "resolute reaction" from Washington, US Congressman Rob Wittman said Friday during a visit to Taipei. China claims self-ruled Taiwan as its territory to be taken one day, by force if necessary, and it has ramped up pressure in recent years with near-daily air incursions and frequent military drills around the island. Wittman, a Republican, is vice chair of the House Armed Services Committee, which oversees funding for the US military, and is leading a delegation on a three-day visit to Taiwan. "President Tsai (Ing-wen), know that any, any hostile, unprovoked attack on Taiwan will result in a resolute reaction from the United States," he said during a speech Friday. Wittman said peace and stability in the Indo-Pacific region is built on "a foundation of strength". "We know strength is the best deterrence to anyone that may think there is an opportunity to act badly in this region." While the United States officially recognizes Beijing over Taipei, it is Taiwan's key ally, providing weapons and aid to boost its defenses against an increasingly aggressive China. Wittman also promised Friday to help resolve the delivery backlog of weapons purchased by Taiwan. This week, US President Joe Biden's administration approved direct military aid to Taiwan for the first time under a financing program for foreign governments. Senate to continue IACAT probe despite suspension of travel guidelines
The Senate wil continue its scheduled investigation into the departure formalities for international-bound Filipino passengers imposed by the Inter-Agency Council Against Trafficking despite the suspension of the guidelines' implementation. In a press conference at the Senate, Senate President Juan Miguel “Migz” Zubiri said while the suspension of the “stricter” guidelines is a welcome development, the upper chamber is still keen to know the basis behind such guidelines. “First of all, we thank them for the suspension because they’re supposed to implement it on 3 September, Sunday. So they will suspend it but at the same time, they have to explain to us how did they come up with the guidelines,” Zubiri said. He noted that the IACAT must explain the basis for requiring international-bound Filipino travelers to provide various documents such as original copies of birth certificates and affidavits of consular service for the traveler’s destination, among others. “There is no law that requires us to do so. So, in the absence of a law, we want to ask them their basis for these added requirements for Filipinos to travel abroad,” he added. He issued the remarks after the Department of Justice on Thursday suspended the implementation of the IACAT’s revised guidelines on departure formalities. On Wednesday, the upper chamber approved an unnumbered resolution seeking to stop the implementation of the revised guidelines on 3 September. It was followed by a separate unnumbered resolution that aimed to challenge the constitutionality of the travel guidelines before the Supreme Court. Zubiri lauded Justice Secretary Jesus Crispin “Boying” Remulla, for suspending the implementation of the “stricter” travel guidelines, which has earned criticism from Filipino travelers ahead of the order's scheduled implementation on the weekend. “This proves that government agencies and the DOJ secretary are listening and sensitive to the pulse of the public,” he said. JV: Not my father who made ‘deal’ to remove BRP Sierra Madre
Senator Joseph Victor “JV” Ejercito on Monday refuted claims that it was his father, former President Joseph “Erap” Estrada, who made an alleged agreement with China to remove the BRP Sierra Madre from the Ayungin Shoal. Ejercito said the claim that it was his father who committed to removing the BRP Sierra Madre from Ayungin Shoal is “impossible,” since it was Estrada who ordered the grounding of the World War II ship in the low-tide elevation. “That claim seems inconsistent. The mere fact President Estrada was the one who ordered the BRP Sierra Madre be grounded in Ayungin Shoal, it’s impossible he will commit to remove the same,” he told reporters in a Viber message. He also took a swipe against columnist Rigoberto Tiglao, who claimed it was his father who made such a commitment to China. “At least President Erap had the courage to fight for our sovereignty,” he said. “Unlike them who paved the way for NBN-ZTE, the first salvo of Chinese intrusions in our country,” he added, referring to the canceled National Broadband Network project with ZTE Corp., a Chinese telecommunications firm, during the time of former president Gloria Macapagal Arroyo, now Pampanga 2nd District Representative. Tiglao served as the former presidential spokesperson and Chief of Staff of Arroyo, who served as the 14th president of the Philippines following the ouster of Estrada during the second People Power Revolution or EDSA II in 2001. China is insisting on its territorial rights over the Ayungin Shoal, which is located 105 nautical miles west of Palawan and is part of the Philippines’ exclusive economic zone. It also claimed the Philippine government had repeatedly made promises to tow away the grounded BRP Sierra Madre from Ayungin Shoal. “Who was closer to China? Was it Erap? The VFA was in fact approved also during his time,” said Ejercito, referring to the Visiting Forces Agreement between the Philippines and the United States. According to the Department of Foreign Affairs, the Philippines decided in 1999 to deploy the BRP Sierra Madre as a permanent station on Ayungin Shoal in response to China’s illegal occupation of Panganiban Reef in 1995. A resolution denouncing China’s intrusion into the West Philippine Sea and its harassment of Filipino fishermen was approved by the Senate on Tuesday. The approval of Senate Resolution 718, authored by Senate President Juan Miguel “Migz” Zubiri and Senator Risa Hontiveros, came after the Senate held an executive session on Monday with Foreign Affairs Secretary Enrique Manalo, Armed Forces of the Philippines Chief of Staff General Romeo Brawner Jr., and National Security Adviser Eduardo Año, and their senior officials. Members of the Senate, as well as the mentioned officials, discussed Hontiveros’s earlier resolution which urges the national government, through the Department of Foreign Affairs, to elevate China’s incursions in the West Philippine Sea to the United Nations General Assembly. Under the resolution, the lawmakers urged the Philippine government, through the DFA, to “continue asserting” the country’s sovereign rights over its exclusive economic zone. Likewise, the agency was encouraged to “intensify” efforts to engage the international community in upholding its hard-earned victory at the Hague. The Philippines celebrated the seventh anniversary of its historic victory over China in 2016 last month, which solidified Manila’s claims to the West Philippine Sea. China has continued to reject the arbitral ruling and stood by its historic rights over the area. As of 5 July, the Philippine government, through the DFA, has filed a total of 30 diplomatic protests against China in the last seven months. Over the span of three years, Manila has sent a total of 427 notes verbale against Beijing. The resolution also states that the DFA is “expected” to continue holding dialogues with the Chinese government to push for recognition and respect of the Philippines’ sovereign rights over its EEZ and pursue the formulation of the Code of Conduct for the South China Sea based on international law and the UNCLOS. Should China continue to ignore the country’s efforts, the resolution contains actions the agency must do such as bringing international attention to China’s harassment of Filipino fishermen in the Philippine EEZ and its continued violation of the Hague Ruling and the UNCLOS; utilizing international fora to rally multilateral support for the enforcement of the Hague Ruling and raise awareness on the real situation in the West Philippine Sea; and engaging with “like-minded” countries to call on China to respect the Hague Ruling and the UNCLOS. The DFA is also encouraged to file a resolution before the United Nations General Assembly, to call for the cessation of all activities that harass Philippine vessels and violate the Philippines’ established rights in the West Philippine Sea; and pursue other diplomatic modes as the agency may deem appropriate and necessary. ‘Never watered down’ In his manifestation, Zubiri stressed that the resolution filed by Hontiveros was “never watered down,” but instead “strengthened.” “We came out with strong consensus yesterday after the discussions with the West Philippine Sea Task Force, together with the AFP chief of staff General Brawner and DFA Secretary Manalo and actually we never watered down the resolution that we filed, we actually strengthened the first resolution that we initially filed with Senator Risa,” he said. “I think what happened here is we strengthened the position of the government. Now we gave them several options to choose on how to deal with our neighbors in the North,” he added. CoA calls out Bucor on delayed projects
The Commission on Audit has called out the Bureau of Corrections for failing to closely monitor the implementation of its prison facility projects worth P984.953 million. According to audit findings, the unfinished infrastructure projects were extra jail facilities at all operating prison and penal farms aimed at decongesting the national prisons by providing additional dormitories to accommodate the growing inmate population. The projects, forged in 2019, aimed to provide segregated facilities to reduce jail violence. The projects included building regional prison facilities at the Leyte Regional Prison, and the Iwahig and Davao Prison and Penal Farm. Renovations were also planned at the Correctional Institution for Women, while at the San Ramon Prison and Penal Farm a one-story building was to be constructed. The projects all had a target deadline. On 25 November 2019, the BuCor received a P1-billion Special Allotment Release Order to construct and rehabilitate the prison facilities. However, an audit revealed that as of 31 December, four of the projects remained incomplete, notwithstanding that they had exceeded the extension of completion date. Primary concern Moreover, CoA noted that despite the non-completion of the projects within the agreed period of completion, liquidated damages equal to at least 1/10 of one percent of the cost of the unperformed portion of works for each day of delay were not imposed or deducted from the claims of the contractors, contrary to the Revised Implementing Rules and Regulations of the Government Procurement Reform Act (RA 9184). State auditors pointed out that failure to effectively oversee the infrastructure projects not only resulted in the delay in their completion but also a delay in providing relief for the congestion at BuCor’s prison facilities for persons deprived of liberty. In response, BuCor explained that the chief of the General Services Division constituted the Inspectorate Team for the Design and Build Project of the BuCor Facility — the team responsible for ensuring efficient and effective project monitoring and site assessment validation through ocular site inspections at the corresponding project sites. Now, the officers concerned, including ex-BuCor director general Gerald Bantag, will be held accountable for the variance in the actual site conditions and the approved project documents. The BuCor said a case has been filed with the Ombudsman for plunder, malversation of public funds and corresponding administrative charges against officials under the previous administration. Hundreds of Filipino Barbie fans dressed in pink expressed joy and relief Wednesday at the opening of the film about the famous doll that many had feared would be banned. The fantasy-comedy movie drew intense scrutiny from censors over allegations that a brightly colored world map drawing showed China's claims to the South China Sea. China claims almost the entire waterway despite rival claims from other Southeast Asian countries, including the Philippines and Vietnam. Vietnam banned the film but -- to the relief of Filipino Barbie fans -- the Philippines' Movie and Television Review and Classification Board last week decided the child-like lines on the map did not depict the so-called nine-dash line that China uses to illustrate its claims, and gave it the green light. "I was really hoping that they wouldn't ban it or they would just cut the scene," said Nicole Tolentino, 23, who has been a Barbie fan for 20 years and even crocheted a pink top to wear for a screening at a Manila cinema. "But they didn't really do anything with it," she added. Outside the theater, excited fans milled around in fuchsia-tinted lighting, some posing for photos in a Barbie booth while others brought their own Barbie dolls to the screening. Martina Santiago said she had been saddened at the possible banning of the film, which stars Margot Robbie as Barbie and Ryan Gosling as her boyfriend Ken. "We had already prepared the outfit and everything... thankfully it pushed through," she said. The MTRCB had asked the Hollywood studio Warner Bros to blur the controversial lines "to avoid further misinterpretations". But AFP correspondents who watched the movie said the lines were clearly defined. Not all Barbie fans approved. "That's the part I did not like... Dear Editor Seeing the problem for what it truly is means half solving it. Both Russia and China have stubborn false views/beliefs and false historical narratives, coupled with avarice, in coveting what is not theirs. That’s the bottom line. Both nations need to see this. And that is the solution to the crises they have created, the peaceful way. Russia has harbored resentment against independent Ukraine since the collapse of the Soviet Union, and hallucinates that Ukraine is still part of “Mother Russia,” as opposed to the historic Act signed by Russian President Boris Yeltsin and Ukraine’s first president Leonid Kravchuk on 8 December 1991, recognizing Ukraine as an independent country. It was overwhelmingly approved by the people (90 percent) of Ukraine in a referendum even before the formal accord declaring their independence. China, for its part, in claiming almost all (90 percent) of the West Philippine Sea or South China Sea has only its own fabled “nine-dash line” to back up and defend its robbery or its continuing illegal occupation of the disputed sea. Studies and research by international experts and history professors disprove the “line.” Can we imagine if all nations created their own story and map artwork of the “nine-dash line” to invade neighboring territories? The situation in the West Philippine Sea between the Philippines and China is no different from the ongoing senseless, savage Russia-Ukraine war which Russia started and continues to inflame. It is a war better called the “Russia War.” May sanity prevail and humanity in humans triumph. Stop the bloodshed. China’s bullying is not limited to its bullying of our fishermen. It is depictive of its impudence and defiance of international law, more so its disrespect and contempt for our ethos and dignity as a people and nation. Imperious. BBM would do well to take every “goodwill” gesture of China to the Philippines with a grain of salt, if not view it as an act of ill will. Any help, aid, or “trade cooperation” China has offered and may offer in the future is and would be meaningless, and could be construed as fraught with bad intentions — unless they repent. China used to be a good friend to the Philippines, but not anymore. Dear officials of the land, beware of the present Chinese officials playing (subtle) the “forbidden fruit” game. Don’t bite the bug or the bait. Succumb not. What they are doing in the West Philippine Sea is unprecedented and indefensible. Open your eyes. Be very careful in dealing with them until they behave and cease their aggressions and juvenile sweeping claims to the contested body of water. Go ahead, dear senators, with your proposal to bring the WPS row to the United Nations for another just, intelligent decision/resolution of the brewing time bomb (for the world) on account of the incessant robber of foreign territories. It is a wise move. There are only two “ifs” — two crucial “ifs” — for China and the world to ponder upon. One is, if China won’t still budge and recognize another international ruling, this time by the United Nations no less, then all nations, not only the Philippines, should brace themselves for the undesirable. The other “if” is: If the Chinese leaders can’t and will not really accept the 2016 ruling of the arbitral tribunal rejecting its “nine-dash line” myth, before the action/decision of the United Nations, the only remaining wise thing left for them to do is to accept reason and justness. By doing so, they may engage our country and the rest of the claimant countries involved in the WPS row in a dialogue (serious, transparent, and sincere) to reach a compromise “win-win solution” for all — for the sake of peace and the saving of lives, and the preservation of our planet. Play fair and humane.
