Lebanon court orders ex-car boss Ghosn out of Beirut home: official
A Lebanese judge has decided to evict former Nissan boss Carlos Ghosn from his luxury home, a judicial official said Saturday, four years after an investment firm accused him of "trespassing". Ghosn, who took up residency in the Beirut property after fleeing prosecution in Japan in 2019, appealed the ruling on Friday, the official added. A spokesperson for Ghosn confirmed he had appealed. Ghosn and his wife must "vacate the property... within a month", according to a copy of the decision seen by AFP and dated 16 October. The home with pink walls in the Lebanese capital's upscale Ashrafieh neighborhood is worth some $19 million and is registered to Lebanese company Phoinos Investment, the judicial official said, requesting anonymity as they were not authorized to speak to the media. Phoinos initiated the legal action in 2019 and has accused Ghosn of "trespassing on private property and living in the home without legal basis", the official added. According to the court document, Ghosn said the company was affiliated with Nissan and that "the property was purchased... for his residence, and there is a signed agreement with Nissan that grants him the right to reside" there. Ghosn occupied the home "according to a contractual relationship linking... Ghosn and Nissan", the decision said. However, the end of that relationship and the plaintiff's wish to retake the property invalidates "the legal basis" of his occupancy, it added. In a written statement to AFP, a Ghosn spokesperson said documents that had been unavailable for prior hearings in the cast would support his appeal. "He will now be able to present all the documents held up in Japan that he was unable to secure on time," the statement said. Ghosn, the former chairman and chief executive of the Renault-Nissan-Mitsubishi alliance, was arrested in Japan in November 2018 on suspicion of financial misconduct, before being sacked by Nissan's board in a unanimous decision. He jumped bail late the following year and made a dramatic escape from Japan hidden in an audio-equipment box, landing in Beirut, where he remains an international fugitive. Ghosn has always denied the charges against him, arguing they were cooked up by Nissan executives who opposed his attempts to more closely integrate the firm with French partner Renault. Japan and France have sought his arrest, but Lebanon does not extradite its citizens, and judicial authorities have slapped a travel ban on Ghosn, who holds Lebanese, French, and Brazilian nationality. DOLE lauds outstanding Public Employment Service Offices across nation

Countless proclamations yet no action – HPFPI President
Speaking during the Philippine Forum 2023 at the PICC, People’s Federation of the Philippines Incorporated National President Maria Theresa Carampatana lamented the seeming inaction to address housing problems. She claimed that they have yet to see the implementation of several government programs. “There are so many proclamations that have not been taken care of, so if there is a solution, why not implement it immediately?” Carampatana said. She added: “If we are slow to come up with solutions and slow to take action, we will not achieve anything.” Carampatana outlined the primary issues and problems of poor citizens who have remained stigmatized due to insecurity of land and housing tenure, irregular jobs, and limited participation in development planning. Housing programs, she said, are equally important as appropriating funds for education and basic services. “If housing is not given the same focus as education and basic services, and if that continues, the problem of house deficits will increase,” she said. Carampatana presented priority actions and solutions: People-led Housing and Urban Development, Diversified Housing Modalities and Finance Mechanisms, and Security of Tenure for Urban Poor Communities. Warlito G. Quirimit, chief of the Department of Human Settlements and Urban Development Public Housing and Settlements, said the department has outlined resettlement housing options as a solution to the existing problem. “Under this framework, we are building resettlement housing options that must be available and affordable to the affected families. Included in this framework it also requires community development,” Quirimit said. Quirimit also added that the purpose of the community-based initiative is to promote the participation of the affected families in the urban poor community. “The community-based initiative approach, which was issued under the Memorandum Circular 2019-714 under this strategy is designed to build on community initiative and promote the participation of the affected families through their community associations in relation to the resettlement decision-making process. The community association participates in the project planning and in the implementation, particularly in the choice of permanent housing in resettlement projects, through financing in the selected sites and other commitments to participate in the project implementation process,” He said. The 4PH program, a centerpiece of the Marcos Administration, calls for the development of one million housing units annually until 2028 to address the housing needs and backlogs, while also improving target beneficiaries’ affordability by lowering the affected families’ monthly amortization and facilitating access to both end-user financing and developmental loans. U.S. asserts safe WPS passage for all
It has nothing to do with that particular country, or so they claimed rather cautiously and diplomatically. Navies of the Philippines and the United States opened their bilateral naval exercises yesterday, along with six other countries, at Naval Station Jose Andrada on Roxas Boulevard, Manila. The drills involve at-shore events at the Philippine Navy’s headquarters before going out to sea for exercises intended to improve the allied naval forces’ interoperability. Dubbed Exercise Sama-Sama, or Together, the exercise, according to Philippine Navy chief Vice Admiral Toribio Adaci, has nothing to do with a particular country that has figured in increasing tensions in the West Philippine Sea. But Adaci was obviously referring to China whose coast guard had used water cannons on Philippine Coast Guard-led resupply missions to Filipino troops stationed on the BRP Sierra Madre at Ayungin Shoal in the WPS. Adaci opened the exercise with US Fleet Commander Vice Admiral Karl Thomas. “The exercise is designed to be conducted here in Manila and the southern Luzon area,” Adaci said. Thomas, for his part, stressed the need to recognize the rules-based international order. Strong word “I think it is important that all nations have a right to sail and operate in the West Philippine Sea — free from worrying about being attacked,” Thomas said. “And attack is probably a strong word.” “I would say, free from being coerced, free from being intimidated. You know we want the commons to be common and open and free. And so long as our nations operate in accordance with the rule of law, in accordance with the rules and regulations, with the United Nations Convention on the Law of the Sea,” he said. Like Adaci, Thomas did not mention China, but it is common knowledge that the United States military has been conducting “freedom of navigation” patrols to keep the South China Sea open to international commerce. President Ferdinand Marcos Jr. last week ordered the PCG to cut the 300-meter floating barrier installed by Chinese militia vessels at Bajo de Masinloc or Scarborough Shoal. PN assets in action A 2016 arbitral ruling deemed China’s territorial claim on nearly the entire South China Sea, including areas that overlap the WPS, invalid. The ruling stemmed from a 2013 case filed by the Philippines against China before the Permanent Court of Arbitration, or PCA, after Beijing seized control of Scarborough Shoal in 2012. As the PCA junked China’s nine-dash line South China Sea claim, it affirmed the Philippines’ entitlement to its 200-nautical mile exclusive economic zone. Around 700 sailors and marines from different PN units are participating in the exercise, which will see in action, among other assets, the BRP Antonio Luna, and an AW109 naval helicopter. For the second straight year, the exercise will include the navies of Japan, the United Kingdom, Canada, France and Australia. They will be participating mainly in humanitarian assistance and disaster response drills. Observers Meanwhile, the Royal New Zealand Navy and the Indonesian Navy are also joining as observers the naval exercise that dates back to 1994 when it was known as Cooperation Afloat Readiness and Training. In 2017, its name was changed to Exercise Sama-Sama. Subsequently, the exercise was conducted annually across various regions: In 2017 at Naval Forces Central; in 2018 at Naval Forces Northern Luzon; in 2019 at Naval Forces West; and in 2021 at the Northern Luzon Command. Last year, it was held alongside Exercise Lumbas — the bilateral navy-to-navy exercise between the Philippines and Australia — with the limited participation of France, Japan and the United Kingdom. Sara Duterte’s P2.7B confidential expenses as Davao mayor should be probed—Castro
Davao City’s confidential expenses that ballooned to P2.697 billion during Vice President Sara Duterte’s stint as mayor should be probed by the Commission on Audit, a lawmaker said Monday. The call for investigation was prompted by the 2022 report of the CoA, which found that Davao City spent P2.697 billion on confidential expenses between 2016 to 2022, or an average of PP385.3 million per year over the preceding six years. Duterte served as the Davao City mayor from 2016 to 2022 before she assumed the VP post in July of last year. Based on CoA findings, Davao City incurred P144 million of confidential expenses in 2016, which was more than doubled to P293 million in 2017 and further climbed to P420 million in 2018. The city’s confidential fund expenses further grew to P460 million in 2019 and were maintained consistently for the subsequent years of 2020, 2021, and 2022. In an interview on Monday, ACT Teachers Partylist Rep. France Castro, who sought the CoA probe, stressed that the P2.697 billion totality of confidential expenses of Davao City in the previous six years “could have been utilized more effectively to benefit the education sector, specifically by providing much-needed support to teachers.” “We were shocked also [by] the report of the CoA. With this controversy of confidential funds, we are thinking of asking the CoA to investigate,” she said. “The CoA should file an audit observation memo and then ask them to explain maybe the misuse of funds and then file necessary legal action.” She added, “Imagine more than a million a day spent for the confidential funds in a city. I just wonder how it was spent and where it was spent. So, we want the CoA to review if the city government of Davao City led by Vice President Sara Duterte by then really followed the guidelines or the joint circular 2015-01.” The said joint circular outlined by CoA with the Departments of Budget and Management, National Defense, and of the Interior and Local Government, and Governance Commission for GOCCs, contains guidelines on the entitlement, release, use, reporting, and audit of confidential and intelligence funds that are in the General Appropriations Act. Daily Tribune has been asking for Duterte’s comment, but she remained mum on the issue. While Castro admitted that the local government units are entitled to confidential funds for peace and order maintenance, it was “ironic” that Duterte sought allocation of such funds given that she claimed Davao City was “very peaceful, disciplined, and well” during her tenure. "So why is it necessary to have an increasingly confidential fund?" the lawmaker stressed, noting such a fund should be used for other fruitful endeavors. "I remember the time the teachers of Davao City were asking for city allowance, but she did not grant it. Instead, she refused and even got mad with ACT (Alliance of Concerned Teachers) during that time," Castro pointed out. While none in the law limits the amount of confidential funds, the militant lawmaker pointed out that it should be rationalized. A proposed law aimed at imposing a cap and limit on confidential funds, streamlining the allocation of such that would promote transparency and accountability, is currently being crafted, according to Castro. Man on a mission
He has been to hell and back since entering the country’s premier military school, the Philippine Military Academy, where he graduated magna cum laude in 1982, to seeing action as a police officer, and lately to waltzing into the ring of fire by entering politics. Much has been written about the exploits of former police general Benjamin “Benjie” Magalong, Baguio City Mayor, since 2019, with the positive usually outweighing the negative. Love him, hate him, but believe me, Magalong is no lone ranger. He can sustain the hard yards of fighting criminality and corruption that one wonders where he gets all the energy and focus in addressing the challenges that come his way. Last month, Magalong and a few local chief executives launched “Mayors for Good Governance,” a campaign for responsible leadership and anti-corruption in local governments. They signed A2, a manifesto committing local executives to transparency and the rule of law. The movement has already received support from more than 150 city and municipal mayors nationwide, a testament to how much rests on his stewardship. Corruption is like a “communicable” disease that can easily transmit the evils that go with it from the lowest strata to the highest echelon of society. It has many forms and strains — from petty graft to large-scale kickbacks — and affects people from all walks of life, generations, and races. People get used to it until it becomes a way of life, and in the process, they lose their independence of thought because their eyes are shut. Pope Francis described it best: “Some people behave in relation to corruption as they would with drugs. They think they can take it and leave it as they please. They start with something minor: a kickback here, a bribe there. And between this and that, they gradually lose their freedom.” Fighting corruption is like fighting drugs; it is never one-sided. There are hits and misses along the way. Anything is fair game when you put a face into a noble cause. I was a field operative of the Philippine Drug Enforcement Agency assigned in Region 8 when Magalong was director of PDEA’s Special Enforcement Service, which was responsible for dismantling numerous drug laboratories and causing the dismissal of several police scalawags. Magalong is one straight arrow. He never compromises his name when it comes to fighting drugs and crime. However, he is also a caring leader who always looks after his men like he would his children. He never tolerates shenanigans but lavishes praise and support for a well-done job. That’s why it did not come as a surprise when he was made chairman of the Mamasapano Board of Inquiry in 2015, which investigated the carnage of 44 Special Action Forces in Maguindanao. I have seen firsthand Magalong’s sincerity when it comes to public service. A public servant who goes beyond his comfort zone to give timely and proper assistance to the public, Magalong has the integrity and bravery to stand by his ideals to the detriment of his career because he wants the country to succeed. Like Magalong, I also had my share of fighting the tentacles of corruption in PDEA and later at the Bureau of Customs, once touted as the most corrupt government agency, during my seven-month stint as a commissioner despite the brickbats and the Sword of Damocles hanging above me. It was a lonely battle indeed, especially since I came to the bureau all alone. Tormentors coming from opposite directions were having a field day — from the not-so-harmless Marites (Mare, ano ang latest?) and Mariposa (Mare, post mo na) to greedy politicians and industry shenanigans. I have no moral qualms regarding Magalong’s mission — to take the arduous and lifelong task of making a difference in people’s lives, especially the poor, who are most hurt by corruption. Taking the high road is never easy, and I am sure that knowing Magalong, he could surmount all the hurdles, including the legal ones, that come in the end. BFP received an unmodified opinion from COA
The Bureau of Fire Protection (BFP) received an unmodified opinion from the Commission on Audit (COA) for the first time in the fiscal year of 2022 and it got a perfect score of 20. According to the COA, the released report is based on the Financial Management Performance Rating based on the financial audit performed in this period of 2022 report by Michael R. Bacani Director Cluster 4, Defense and Security. Based on the COA report, BFP received a 93 percent score an excellent score from the first Financial Performance Rating report. Before this, it will be recalled that the COA approved the action of the Bureau of Fire Protection (BFP) about the fact that the BFP should have a modernization program to keep up with the modern era. The COA report stated that there was nothing wrong with the actions taken by the BFP in placing the technical requirements that the Bureau of Fire needs to keep up with the BFP's modern methods and modernization program. Meanwhile, the COA report of the Financial Management Performance Rating said the BFP got an excellent rating this past period of 2022. Makati subway facing delays due to SC ruling
The Makati City subway project, the first underground railway project undertaken by a local government unit, is facing another headwind after its alignment was adversely affected by the tug-of-war between the cities of Makati and Taguig over territorial disputes. In a stock report on Wednesday, private proponent Philippine Infradev Holdings, Inc. disclosed that the project alignment is no longer viable as the depot and a few stations, which were supposed to traverse through Makati City properties, were found to be within the jurisdiction of Taguig City instead as ruled by the Supreme Court or SC. "Under the Joint Venture Agreement executed between the Makati City Government and the Company, the depot and a few stations of the Makati City subway system will be in the affected areas. Also, the alignment of the subway will no longer be feasible," the company informed the stock exchange. Particularly, the SC decision affected the Makati City subway project's depot in Cembo as well as the planned stations in the University of Makati in West Rembo, and Ospital ng Makati in Pembo. Thus, Infradev said it has reached out to the Makati City government, through an Intent Notice, to discuss the next course of action that they should take following the SC order. In April 2022, the SC Third Division ruled with finality that the disputed areas, Bonifacio Global City and nearby Enlisted Men’s Barrio or EMBO barangays, were under Taguig City's jurisdictions. However, before Taguig City’s courts assume pending litigations over the said areas, which used to be part of Makati, it first needs to secure a writ of execution. A writ of execution is a legal order issued by a court that qualifies the enforcement of a judgment or court decision. In 2019, the Makati City Government signed the Joint Venture Agreement with Infradev and its partner after the company hurdled the competitive Swiss Challenge and obtained approval for the construction, operation, and management of the intra-city subway. Under the joint venture, Makati would only contribute land it currently owns for the project. The subway aims to connect key points in Makati like the current Central Business District at the corner of Ayala and Sen. Gil Puyat Avenues, Circuit City, Makati City Hall, University of Makati, Ospital ng Makati and other new growth areas within the city. The subway is planned to have up to 10 air-conditioned, underground island stations whose entrances will be linked to destinations across the city. The project can accommodate up to six-car trains, with room for over 200 persons per car, with more than 700,000 passengers per day to be accommodated and served by the proposed mass transport system. Return separation pay, viral ex-cop told
Brig. Gen. Niño David Rabaya, director of the Philippine National Police-Retirement and Benefits Administration Service, demanded from viral road rage ex-cop Wilfredo Gonzales the return of the money he received despite his dismissal from the police service. Gonzales was dismissed for grave misconduct in 2018, two years after he retired upon reaching the mandatory retirement age of 56 where he got his separation pay. His dismissal which stemmed from a gun-toting incident he was involved in in 2006 led to the forfeiture of his benefits retroactively. In a press conference in Camp Crame on Monday, Rabaya, said Gonzales is required to bring back to the PNP around P588,000 sending him letters demanding the return of the money, since 2019 but they have yet to get any response from him. “It’s basically his terminal leave or leave credits as he also received ‘three’ year lump sum pension starting 2016 to 2019 but when the PRBS was able to receive the dismissal order, his monthly pension which was supposed to start in 2019 was not anymore activated. So basically he is not anymore receiving pension from us,” Rabaya told reporters. “As a matter of procedure, we are already preparing the demand letter for patrolman Gonzales to return the money. We will be taking civil action against him. We have already referred this to our legal then civil action will be taken against him if he refuses to return the amount,” he stressed. The QC People’s Law Enforcement Board started the conduct of a thorough investigation of the incident upon the order of Quezon City Mayor Joy Belmonte. The probe aims to identify the lapses committed by the police during the settlement of the case. Gonzales is currently in hot water after he was involved in a viral altercation with a cyclist in Quezon City on 28 August. He hit the cyclist on his head and even pulled out and cocked his gun. Gonzales said they had already settled the matter in a police station. It was reported that the cyclist paid Gonzales P500 for the damages to his vehicle during the settlement. Gonzales is now facing charges for alarm and scandal filed by the Quezon City Police District. DoT chief seeks Rotarians’ support for tourism projects

Frasco reported that the efforts of the DoT, along with the whole-of-government approach ordered by President Ferdinand Marcos Jr. in implementing the department’s projects with an eye to restoring the glory of the tourism industry has resulted as of 30 August 2023 into 3.6 million international arrivals, surpassing the total number of international arrivals last 2022. The figure is already 75.92 percent of the country’s target of 4.8 million tourist arrivals this year. “Philippine tourism contributed 6.2 percent to our gross domestic product in 2022; it is being hailed by our economic managers as the second growth driver in the first six months of this year,” she said. By the end of 2022, Frasco said the tourism industry has contributed over P1.87 trillion to the Philippine economy as a composite of international and domestic spending, representing a 67 percent recovery since 2019. “Tourism also contributed over 5.5 million in tourism employment, an 11 percent share of the national employment, and also represents over 93 percent in recovery from 2019 data,” she added. Frasco also said that the rallying of Philippine tourism after the battering it got from the pandemic stands at 66.3 percent, higher than the 54 percent average recovery of ASEAN nations in 2022. As per tourism receipts, Frasco said the industry has already breached P285.9 billion as of 31 July 2023. Pillars of Tourism The Tourism secretary stressed that to give the Philippines a fighting chance at standing shoulder-to-shoulder with its neighbors in the ASEAN region, her department had crafted the National Tourism Development Plan 2023-2028, which does not only focus on the promotion of tourism alone but also in analyzing and understanding the essential pillars of tourism. Approved by President Marcos Jr. last May 2023, the NTDP provides a framework to guide the development and implementation of programs, projects, and activities towards a sustainable, innovative, inclusive, and globally competitive tourism industry. NTDP’s seven strategic goals include improvement of tourism infrastructure and accessibility; cohesive and comprehensive digitalization and connectivity; enhancement of overall tourist experience; equalization of tourism product development and promotion; diversification of the tourism portfolio through multidimensional tourism; maximization of domestic and international tourism; and strengthening tourism governance through close collaborations with national and local stakeholders. Putting the Plan into concrete action, the DoT hopes to have an accumulated total of 51.9 million tourist arrivals and 34.7 million tourism-related jobs in the country by 2028. Frasco said in terms of infrastructure, the DoT has partnered with the Department of Public Works and Highways to improve accessibility in the regions with tourism sites. “This is by constructing, rehabilitating and adding tourism roads leading to tourist destinations. This year, over 158 kilometers of tourism roads have already been constructed,” she said. Aside from this, Frasco said the DoT has also coordinated with the Department of Transportation in improving connectivity, primarily in the country’s gateways for the improvement of flights and tourist journeys. With this, Frasco said the country is starting to see robust recovery of connectivity in the country, including a 100 percent increase in flights in Clark International Airport; a 614 percent increase in flights in Kalibo International Airport; and over a 300 percent increase in flights in Mactan-Cebu International Airport, among other airports in the country. Moreover, she said they also partnered with the Department of Information and Communications Technology for the purpose of improving internet connectivity across 94 tourist destinations in the country. Connectivity in 47 of these destinations have already improved, according to Frasco. e-VISA Furthermore, Frasco said the DoT has engaged with other government agencies, namely the Department of Foreign Affairs, the Department of Justice, the DICT, and the Bureau of Immigration for the streamlining of the visa application process, aiming to enhance convenience and accessibility for all international travelers, starting with Chinese visitors. Last 24 August, the DFA implemented the Philippine e-Visa system in Philippine Foreign Service Posts in China. The Philippine e-Visa will allow foreign nationals entering the country for tourism or business to apply for temporary visitor visas remotely through their personal computers, laptops and mobile devices. Other initiatives conceptualized by the DoT to improve the tourism experience include the “Hop in Hop Off” project; being part of the “Love the Philippines” tourism slogan; the “Philippine Experience”; facilitating a cultural tourism circuit development focused on heritage, culture, and arts to enhance current tour and domestic circuit offerings, which include Food and Gastronomy, Pilgrimage and Wellness, Living Cultures and Heritage, and an Arts caravan. In order to equip Filipino tourism workers, the DoT is set on training 100,000 of these workers and capitalize on the world-renowned Filipino hospitality. “We have already managed to train over 71,000 Filipino workers,” Frasco said. Optimistic “Frasco said the Marcos administration remains optimistic about tourism recovery and the resurgence of the nation. “Our numbers will indicate that tourism will continue to be a top economic driver that will provide massive employment and livelihood opportunities to Filipinos and our MSMEs,” she said. Meta fights sprawling Chinese ‘Spamouflage’ operation
Meta on Tuesday said it purged thousands of Facebook accounts that were part of a widespread online Chinese spam operation trying to covertly boost China and criticize the West. The campaign, which became known as "Spamouflage", was active across more than 50 platforms and forums including Facebook, Instagram, TikTok, YouTube and X, formerly known as Twitter, according to a Meta threat report. "We assess that it's the largest, though unsuccessful, and most prolific covert influence operation that we know of in the world today," said Meta Global Threat Intelligence Lead Ben Nimmo. "And we've been able to link Spamouflage to individuals associated with Chinese law enforcement." More that 7,700 Facebook accounts along with 15 Instagram accounts were jettisoned in what Meta described as the biggest ever single takedown action at the tech giant's platforms. "For the first time we've been able to tie these many clusters together to confirm that they all go to one operation," Nimmo said. The network typically posted praise for China and its Xinjiang province and criticisms of the United States, Western foreign policies and critics of the Chinese government including journalists and researchers, the Meta report says. The operation originated in China and its targets included Taiwan, the United States, Australia, Britain, Japan and global Chinese-speaking audiences. Facebook or Instagram accounts or pages identified as part of the "large and prolific covert influence operation" were taken down for violating Meta rules against coordinated deceptive behavior on its platforms. Meta's team said the network seemed to garner scant engagement, with viewer comments tending to point out bogus claims. Clusters of fake accounts were run from various parts of China, with the cadence of activity strongly suggesting groups working from an office with daily job schedules, according to Meta. 'Doppelganger' Some tactics used in China were similar to those of a Russian online deception network exposed in 2019, which suggested the operations might be learning from one another, according to Nimmo. Meta's threat report also provided analysis of the Russian influence campaign called Doppelganger, which was first disrupted by the security team a year ago. The core of the operation was to mimic websites of mainstream news outlets in Europe and post bogus stories about Russia's war on Ukraine, then try to spread them online, said Meta head of security policy Nathaniel Gleicher. Companies involved in the campaign were recently sanctioned by the European Union. Meta said Germany, France and Ukraine remained the most targeted countries overall, but that the operation had added the United States and Israel to its list of targets. This was done by spoofing the domains of major news outlets, including the Washington Post and Fox News. PLDT bolsters alignment with global climate reporting standards
Leading integrated telecommunications company PLDT Inc. continues to strengthen its alignment with global standards for climate action as it benchmarks with the 2023 disclosure system of the CDP. Previously known as the “Carbon Disclosure Project” and recognized globally by investors, cities and corporates, CDP provides guidance on climate-focused reporting metrics and facilitates an independent scoring on progress in terms of governance, risk management, target and performance and emissions data, among others. For its 2022 CDP assessment, PLDT received a “B” or a “Management” rating, signifying that the company has measures in place to manage its business impact on the environment. This was a significant improvement from its “C” or “Awareness” rating in 2021 and 2020 consecutively. Results of the 2023 CDP assessment are expected to be released by 2024. “Climate action is integral to our strategy of embedding sustainability in the way we do business. Settled doctrines on sexual harassment (3)
Sexual harassment engenders three-fold liability: Criminal, to address the wrong committed against society; civil, to address the private wrong against the offended party; and administrative, to protect the public service. Criminal liability for sexual harassment notwithstanding, the offended party may pursue a separate civil action. Aside from the actual perpetrator, the employer or the head of office or institution may also be impleaded in an independent action for damages. They would be solidarily liable for damages if they did not take immediate action on a sexual harassment complaint. Unlike in a criminal action where the penalty is a fine, imprisonment, or both, the penalty in an administrative action is, at most, dismissal from the service. This is because an administrative action seeks to protect the public service by imposing administrative sanctions on the erring public officer. In prosecuting an offender for sexual harassment, the intent is immaterial. The mere commission is sufficient to warrant a conviction. The threshold is whether an act violates and/or threatens the personal space and physical safety of another person, regardless of the motive for committing the act. Guided by the foregoing, let’s take a quick look at actual cases of sexual harassment decided by the Supreme Court. In the case of Escandor v. People (G.R. No. 211962, 6 July 2020), the complainant testified to several acts of sexual harassment, including the respondent’s acts of grabbing her hand, kissing her, engaging in improper conversations, touching her thigh, giving her gifts, telling her that “she was the kind of girl he really wants,” asking her out on dates, and sending her text messages telling her that he missed her, that she looked beautiful, and that he loved her. The complainant stated that these acts made her feel disrespected, humiliated, cheap, uneasy, and frightened. She also could not concentrate on her work, could not sleep, and found herself “staring into empty space.” Without any doubt, the Supreme Court held that the respondent’s acts resulted in an intimidating, hostile, and offensive environment for the complainant, thereby making him guilty of sexual harassment. In another case (A.C. No. 5900, 10 April 2019), a professor was charged for allegedly unwanted sexual advances or innuendos against his students. One of his students recounted that in one of her class recitations, she sought clarification of a question propounded to her, saying, “Sir, come again?” The professor retorted, “What? You want me to come again? I have not come the first time and don’t you know that it took me five minutes to come, and you want me to come again?” In his defense, the professor said the joke was intended for himself and that in fact, the students had laughed at the joke. In ruling against the professor, the Supreme Court stated that the professor’s remarks could not be categorized as an innocent joke meant only to lighten the mood of the class. It was readily apparent that the remark was tasteless, vulgar, and crude and had no place in an academic setting. It was not clever wordplay or a mere statement with a sexual innuendo as its intended meaning was obviously discernible. The professor’s attempt at humor failed miserably as his words clearly referred to himself needing five minutes to ejaculate again. The professor’s statements made the student uncomfortable and embarrassed her in front of her classmates as it went beyond an innocent joke and was instead a gross graphic and insensitive remark. Thus, the Supreme Court ruled that the professor abused the power and authority he possessed over the students. His sexually laced conduct had created a hostile and offensive environment that deeply prejudiced his students. In what was supposed to be a safe place for them to learn and develop, they were instead subjected to unwarranted sexual advances. In another case, however, the Supreme Court clarified that casual gestures of friendship and camaraderie, done during festive or special occasions, and with other people present do not constitute sexual harassment. In Aquino v. Acosta [429 Phil. 498 (2002)], the Supreme Court ruled that the act of greeting a person with a kiss on the cheek, in “beso-beso” fashion, was not shown to have been carried out with lustful and lascivious desire or was motivated by malice or ill motive. The Court explained that pecks on the cheeks should be understood in the context of having been done on the occasion of some festivities, as busses on cheeks were simply friendly and innocent, bereft of malice and lewd design. US Justice Dept names special counsel to probe Biden’s son
The US Justice Department on Friday escalated its investigation into President Joe Biden's son Hunter, naming a special counsel amid allegations he engaged in illicit business deals overseas. Attorney General Merrick Garland appointed Delaware federal prosecutor David Weiss, who recently investigated Hunter Biden on tax and gun charges in a case that remains open. Weiss, who opened his probe in 2019, recently revealed that he was investigating Biden along other lines, and Garland said Weiss had requested special counsel status to be able to pursue his probe more widely. "Upon considering his request, as well as the extraordinary circumstances relating to this matter, I have concluded that it is in the public interest to appoint him as special counsel," Garland said. Deals in China, Ukraine Hunter Biden has come under investigation in Congress over business deals he did in China, Ukraine, and elsewhere during and after his father's 2009-2017 term as vice president. A former business associate told Congress recently that Hunter had gotten his father involved in telephone calls with his foreign partners several times. Republicans allege Joe Biden used his political position to help his son -- a claim the president denies. The move comes as Joe Biden is running for reelection, possibly in a rematch with former president Donald Trump, himself accused of felony crimes in the investigation by another Justice Department special counsel, Jack Smith. Garland gave no hint on the subject matter of Weiss' expanded probe, saying his elevation to the special counsel "reaffirms" the independence and authority of his investigation. Last month, the 53-year-old Hunter aborted a plea deal with Weiss over gun and tax charges after a judge pointed out inconsistencies in the agreement. The deal would have seen Biden avoid prison: he would have been sentenced to probation on two tax avoidance counts, and be forced into a counseling and rehabilitation program for the firearms charge. But the deal fell apart after Judge Maryellen Noreika queried why the gun charge was included in a tax case, and whether the agreement protected Biden from charges that might arise from a wider investigation of his business dealings. Biden then entered a not-guilty plea, and the two sides were expected to work out a new agreement. But in a filing in Delaware court on Friday, Weiss said those talks had reached an impasse and withdrew the offer of a plea deal. Instead, he indicated that the tax charges could be expanded to other venues. Republicans say DOJ protecting Biden There was no comment from the White House on Weiss's elevation to special counsel. In a social media post, a Trump spokesperson alleged that the Biden family had been "protected by the Justice Department for decades." Bong Go asks for accomplishment report of DPWH’s flood control projects
Senator Christopher "Bong" Go stressed on August 9, Wednesday, the need for accountability, strategic prioritization, and long-term solutions to address recurring problems in flood-prone areas during a Committee on Public Works hearing on the country's flood control master plan and outstanding projects. “Yun lang po sir ang tatlong hiningi ko: (1) accomplishment report, (2) copy of master plan at (3) prioritization dito sa mga flood control projects ninyo po na dapat po’y makinabang yung mga lugar na dapat makinabang – yung mga flood prone areas,” he asked during the hearing. Go asked DPWH for an accomplishment report detailing the flood control initiatives undertaken during former president Rodrigo Duterte's term. He also requested a copy of the master plan outlining both current and upcoming projects. The senator said the budget allocated for flood control continues to increase from P82 billion in 2019, 80.7 billion in 2020, 90.9 billion in 2021, 127.4 billion in 2022, 182 billion in 2023, and now with a proposed budget of P215.6 billion for 2024, not including foreign assisted projects and those funded by the private sector. “Ibig sabihin, tumataas po ‘yung budget ninyo for flood control. Pero ‘di pa rin po nabibigyan ng solusyon ang problema sa pagbaha,” he stated, indicating a broader concern about the strategy and effectiveness of flood control projects in the country. The senator also expressed confusion and concern over the prioritization of some flood control projects, questioning why some areas with little or no population receive flood control measures while highly populated areas still suffer from recurring floods. “Despite having flood control projects initiated or requested by legislators and local officials, ang expertise ay nasa DPWH. Kayo dapat ang magsabi kung ano ang tama at mali, kung saan ba dapat ilagay ang flood control, slope protection at iba pang proyekto, at kayo ang dapat nakakaalam paano masolusyunan ang paulit-ulit na pagbaha sa bansa,” Go stressed. In response, DPWH Secretary Manuel Bonoan said there is a need to protect the environment and production areas but agreed that populated areas should be prioritized. Go said “yung nakikita ko minsan, maraming mga flood control, eh, may bundok namang nagpo-protection sa kanila.” “Eh, dito sa mga patag na lugar — halimbawa itong Bulacan — halos walang bundok ito. Walang nagpo-protect sa kanila sa mga umaagos na malalakas na tubig mula sa taas ng bundok. Eh, ‘yun pa ang kulang-kulang sa flood control. Maybe just check your prioritization plans,” added Go. The senator's call for action originated not only from a practical perspective but also from a compassionate stance. He acknowledged the difficulties faced by the citizens affected by flooding and said "ang hirap mabahaan, parang back to zero na naman po sila," underscoring the challenges of recovery. “Para po silang nasunugan, kaya lang pinagkaiba, makalabas pa rin sila, pero mahirap, sira yung gamit, basa dito, sasakyan, basa yung mga telebisyon nila, parang nag-umpisa po muli sila,” added Go. Go recalled how, during the time of former president Duterte, the administration had insisted on an equitable distribution of the budget for all regions, whether for flood control or any infrastructure. “Talagang gusto niya, hinayaan niya po ang departamentong mag-determine kung saan ‘yung priority niya talaga at nangangailangan,” said Go. “Pakiusap ko lang po sa inyo, full support naman po ako sa inyong opisina, ever since noon pa. Ayusin lang po ‘yung prioritization at ‘wag pong mapabayaan itong mga lugar na flood prone po talaga,” he added. Meanwhile, Go also highlighted the need to address compensation for right-of-way claims, especially for those who are less wealthy and struggle to have their claims recognized. “In relation to DPWH projects… gusto ko lang po malaman, itong prioritization ng pagbabayad ng right-of-way… kase ‘yung mayayaman, balewala sa kanila ‘yun. May mga may hawak ng titulo, halos namamatay na lang na hindi na-claim. Mga isang kahig, isang tuka, nasa bundok, natatamaan ‘yung kalye nila, ‘yung hindi binabayaran,” said Go. “Ano po ba ang prioritization rito sa right-of-way? Lalo na ‘yung mga maliliit. ‘Yun ang napansin ko. Pabalik-balik na, years hindi pa nababayaran,” he added. Bonoan acknowledged the importance of prioritizing all acquired properties and explained the challenges in budgeting for right-of-way compensations. He revealed that the allocated budget for these compensations has been very minimal over the past three years, with only a fraction of the requested amount being granted. Go’s demands for transparency and prioritization in flood control projects were made considering recent flooding incidents across Luzon due to heavy rains brought by tropical cyclones Egay and Falcon as well as the Southwest Monsoon or Habagat. His teams have been going around these areas to provide relief to affected communities particularly in Cagayan, Ilocos Norte, Ilocos Sur, Pangasinan, La Union, Zambales, Pampanga, and Bulacan. “Ang suliraning ito ay nagpapakita lamang ng kahalagahan ng masusing pag-aaral at aksyon upang maisaayos ang flood control strategies sa ating bansa. Sublime! ‘Barbie’ tops $1bn globally in first for solo woman director
Hollywood's pink wave has yet to crest as Warner Bros.' "Barbie" dominated for a third straight weekend in North American theaters, pushing the film's global haul past $1 billion in a first for a woman director, industry watcher Exhibitor Relations said Sunday. The Greta Gerwig-directed blockbuster, starring Margot Robbie as iconic doll Barbie and Ryan Gosling as boyfriend Ken, earned a projected $53 million for the Friday-through-Sunday period, for a domestic total of $459 million and a whopping $1.03 billion worldwide. Not only has "Barbie" thus become the first movie directed solely by a woman to pass the $1 billion mark, but it did so faster than any film -- including those directed by men -- in Warner Bros.' 100-year history, executives there said. The film, which earlier scored the biggest opening weekend of the year, "has captured the imagination of moviegoers around the world and the results are incredibly impressive," analyst Paul Dergarabedian of Comscore said. Universal's "Oppenheimer," the dark historical drama that has placed second to "Barbie" in their debut weeks, was bumped by Warner Bros. newcomer "Meg 2: The Trench," an action film featuring gargantuan prehistoric sharks. "Meg 2" pulled in $30 million for the weekend, while Christopher Nolan's "Oppenheimer" earned $28.7 million to push its global total to $552 million. That total made the story about the creation of the atomic bomb the all-time top-grossing World War II film, ahead of Nolan's own "Dunkirk" ($527 million) and Steven Spielberg’s "Saving Private Ryan" ($482 million), not adjusted for inflation, according to Hollywood Reporter. Fourth place for the weekend went to "Teenage Mutant Ninja Turtles: Mutant Mayhem," the latest in the franchise about a team of reptilian heroes in a half-shell. The Paramount animated comedy, featuring the voices of Jackie Chan and Post Malone, brought in $28 million. Disney released "Haunted Mansion" slid two spots to fifth, with the lavishly produced kid-centric film -- starring LaKeith Stanfield, Tiffany Haddish, and Owen Wilson -- earning $8.9 million. Holding its own in sixth was the independent "Sound of Freedom," from Santa Fe Films and Angel Studios, at $7 million. The low-budget action thriller has sparked controversy, with critics saying its story about child sex trafficking plays into Qanon conspiracy theories. All in all, it was an exceptional weekend for Hollywood, with the top four films all raking in $28 million or more. Not only did the top films come close to doubling the total from the same weekend last year, they surpassed the corresponding pre-pandemic weekend in 2019, analysts said. Ken might even have said -- a line Ryan Gosling reportedly ad-libbed during the filming of "Barbie" -- that the weekend was "Sublime!" USAID, Nestlé PH strengthen barangay local government SWM capacity
The U.S. Agency for Development (USAID), has partnered with Nestlé Philippines, in strengthening the capacity of barangay (village) government units on how to enhance their solid waste management (SWM) systems and be resilient to climate change. A two-day training on formulating barangay SWM Action Plans was held at Nestlé’s headquarters last July, for five pilot barangays in Parañaque City and one of each of Nestlé’s host cities in Tanauan and Lipa, Batangas. Together with USAID, the training was co-facilitated by the Paranaque City Environment and Natural Resources Office (CENRO) and USAID’s Clean Cities, Blue Ocean grantee, Pure Oceans. “Keeping our oceans free of plastic is essential for maintaining the natural beauty of the Philippines, helping to ensure sustainable fisheries and protect the livelihoods of millions of Filipinos, while also reducing the impacts of climate change,” USAID, Philippines Environment Office Director, Ryder Rogers said. “At USAID, we are pleased to work with Nestlé Philippines in partnership with barangay governments and local communities to help address and mitigate the impacts of ocean plastic pollution,” he added. In January 2022, USAID and Nestlé Philippines signed a memorandum of understanding to work together in enabling local government units and community leaders in the Philippines to educate communities on the link between climate change and solid waste management. Through USAID’s Clean Cities, Blue Ocean program and Nestlé’s Climate Change and Solid Waste Management initiatives, the goal is to increase communities’ access to education on the Ecological Solid Waste Management of 2000 (Republic Act No. 9003) and share practical tips on SWM. “Nestlé Philippines is committed to tackling urgent issues of plastic waste and climate change through our groundbreaking and large-scale environmental initiatives,” said Jose Uy III, Nestlé Philippines’ SVP and Head of Corporate Affairs. “Through our partnership with USAID, we are able to help empower community leaders at the local level to progress toward a waste-free future.," Uy said. Ian Posadas, Assistant Barangay Secretary and Focal Person of the SWM Committee of Barangay Vitalez, Parañaque City, was one of the participants and he shared, “the 2-day training workshop is a big help for us. As the smallest barangay [in Paranaque City], we need to focus on the 3Rs – reduce, reuse, recycle – and the management of our waste. This plan will be like our lighthouse, or basis, for the next few years and to see if we are accomplishing the plans we have developed during today’s workshop.” The plans drafted are for 2024-2026 but for Barangay Captain Lope Lina of Barangay Bagong Pook, Lipa City in Batangas plans to start early. “I decided that by August, we will start drafting an ordinance strictly implementing segregation so that the support of Nestlé and its partners to us will not be wasted,” Lina said. USAID launched the Clean Cities, Blue Ocean program in August 2019 as the agency’s flagship program to respond to the ocean plastics pollution crisis. The five-year (2019-2024), $53 million program works at the global level and in specific, rapidly urbanizing focal countries to address ocean plastics directly at their source. By strengthening waste management systems and building circular economies, city by city, the program builds sustainable solutions that reduce ocean plastics while empowering vulnerable populations and mitigating pollution that affects human health and our climate.
