Bong Go files OFW Ward bill to support medical needs of Overseas Filipino Workers
Senator Christopher “Bong” Go has introduced on August 17, Senate Bill No. 2414 which aims to further promote the welfare and support the medical needs of Overseas Filipino Workers (OFWs). The OFW Ward bill, if enacted into law, mandates the establishment of an OFW ward in every Department of Health (DOH)-retained hospital across the country. These wards will be exclusively for OFWs and their dependents in need of hospital confinement due to health conditions. DOH will determine the number of beds in the OFW Wards based on the distribution of OFWs in their respective catchment areas. The Act covers all OFWs and their dependents, including land-based OFWs, seafarers, and other sea-based workers. Dependents are defined as parents, legal spouse, legitimate, illegitimate, legitimated, and legally adopted children who are unmarried, not gainfully employed, and not over 18 years old, or those over 18 but incapacitated due to mental or physical defects. The Act provides for the coordination between DOH and the Department of Migrant Workers (DMW) and other concerned government departments and agencies, along with Local Government Units (LGUs), to promulgate rules and regulations for its implementation. Go emphasized the importance of the bill, saying, "OFWs are our modern-day heroes, and their well-being is a priority for our country.” “Through the establishment of wards dedicated to OFWs, we guarantee immediate and efficient health care services. This is not just a dream but a commitment to our OFWs,” he added. The COVID-19 pandemic has severely impacted OFWs, affecting their profession, livelihood, health, and safety. The OFW Ward Act is a response to these challenges, ensuring that OFWs and their dependents have access to healthcare services during these trying times. "In light of the unpleasant circumstances faced by our OFWs and their families, we must take necessary steps to ensure their safety and well-being," Go explained. Go’s commitment to OFWs has previously materialized with the establishment of a dedicated OFW Hospital in San Fernando City, Pampanga. Through his filed Senate Bill No. 2297, he now seeks to institutionalize the hospital and secure its long-term operations to cater to OFWs and their families. The hospital, generously donated by the provincial government of Pampanga, began operations in May 2022. It comprises six stories with a capacity of 100 beds, primarily dedicated to OFWs and their eligible dependents. Earlier, Go cited that the establishment of the Overseas Filipino Workers Hospital in the city demonstrates his and former president Rodrigo Duterte's commitment to improving the country’s healthcare system and promoting the welfare of Filipino migrant workers and their families. “Naisakatuparan po ang pangarap natin na magkaroon ng sariling departamento, ito pong Department of Migrant Workers. The Senate version of the Act, Senate Bill No. 2234, was authored and co-sponsored by Go. It is a consolidated version of an earlier bill he introduced to establish the Department of Overseas Filipino Workers. Meanwhile, Go initiated the Malasakit Centers program back in 2018. He is the principal author and sponsor of Republic Act No. 11463 or the Malasakit Centers Act of 2019. The centers provide a one-stop shop of various government agencies including the Department of Social Welfare and Development, DOH, Philippine Health Insurance Corporation, and Philippine Charity Sweepstakes Office. Bong Go continues efforts to improve public service delivery
Senator Christopher “Bong” Go remains committed to supporting economic recovery and bolstering the healthcare system in various communities. Being an adopted son of Zambales, he continues to help improve public service delivery in the province. In a speech during his visit to Olongapo City, Zambales, on Saturday, 19 August, Go reiterated his dedication to providing immediate aid to communities in need especially the poor. “Huwag po kayong magpasalamat sa akin. Parati naming naririnig ‘salamat Senator Bong Go, salamat (dating) pangulong (Rodrigo) Duterte sa mga tulong.' Sa totoo lang po, kami po ang dapat magpasalamat sa inyo dahil kami po’y mga probinsyano na binigyan n’yo po ng pagkakataon na makapagserbisyo po sa inyo. Maraming salamat po sa inyong lahat,” Go said. “Hinding-hindi ko po sasayangin ‘yung pagkakataong ibinigay ninyo sa akin, magtatrabaho po ako para sa Pilipino. Wala po akong piling oras, Lunes hanggang Linggo, umaga hanggang gabi magtatrabaho po ako para sa Pilipino sa abot ng aking makakaya,” he added. Go and his team distributed grocery packs, vitamins, masks, and snacks to 2,000 struggling residents, composed of persons with disabilities, solo parents, and transport workers, at the Rizal Triangle Multipurpose Center. Go's vision for a stronger healthcare sector continues through his advocacy for the establishment of more Super Health Centers (SHCs). Recognizing the importance of accessible healthcare services, especially after experiencing a global health crisis, Go has championed the cause of establishing these centers to provide primary care, early detection of diseases, and needed medical consultations to a broader range of citizens. Go cited that necessary funds have been allocated last year for DOH to construct SHCs in Iba, Botolan, and Castillejos, while another center will be established in Castillejos under the 2023 budget. The SHCs are medium versions of polyclinics and are bigger than rural health units, which offer basic services, such as database management, out-patient, birthing, isolation, isolation, diagnostic (laboratory: x-ray, ultrasound), pharmacy, and ambulatory surgical unit. Other available services are eye, ear, nose, and throat (EENT) service, oncology centers, physical therapy and rehabilitation center, and telemedicine where remote diagnosis and treatment of patients will be done. “Ang ikinaganda po nito, (pwede na) diyan na po magpapakonsulta. Tulfo on ID: ‘Why BSP?’
A senator questioned the Bangko Sentral ng Pilipinas for assuming responsibility for printing the national identification cards under the Philippine Identification System or PhilSys project. Tulfo said he was puzzled as to how the BSP, in charge of printing Philippine money, became part of the PhilSys implementation. The project had a P28 billion budget after Republic Act 11055, or the Philippine Identification System Act was signed into law by President Rodrigo Duterte in August 2018. In October 2019, former BSP Governor and now Finance Secretary Benjamin Diokno signed a memorandum of agreement with National Statistician Claire Dennis Mapa for the production of national ID cards for an estimated 116 million Filipinos. Probe looms Tulfo questioned why the BSP accepted the printing of the ID cards and later, passed on the task to AllCard Inc. which has a poor performance record. He claimed AllCard Inc. has been delaying the implementation of its contract with other agencies. Tulfo bared he will soon file a resolution to investigate the matter concerning BSP and AllCard Inc.’s printing agreement. Tulfo lamented that since the National ID law was passed in 2018, only 36 million physical national ID cards have been printed — which is roughly one-third of the government’s 92 million target. “Now, once again, AllCard has delayed the implementation of its contract with the BSP. It’s not just delayed, it created a big mess,” he said. He deplored the BSP’s failure to correct the design of the QR code for national ID cards, noting that the existing design was too small and could not store enough information. “As a result of this, BSP may need to destroy millions of cards that have been initially printed to be replaced by a new design,” he added. On its sealed pact with the PSA for the PhilSys project, the BSP shall produce 116 million cards over three years. Bong Go boosts fire victims’ recovery in Cebu City
Senator Christopher "Bong" Go has remained steadfast in his dedication to assisting disaster victims as shown by his team’s relief operations on Monday, 14 August, to communities affected by fires in Cebu City. Go’s team, in coordination with Mayor Mike Rama, Vice Mayor Raymond Alvin Garcia, and the Department of Trade and Industry (DTI), assisted 103 recovering fire victims gathered at the Atillo Gymnasium in Barangay Punta Princesa. DTI provided livelihood assistance through its Pangkabuhayan sa Pagbangon at Ginhawa (PPG) program which Go pushed for during the Duterte administration and continues to support its implementation in order to boost livelihood recovery of those affected by various crises. In addition to the livelihood support, Go’s team provided shirts and masks to all beneficiaries, and a pair of shoes, a watch, a cellular phone, and balls for basketball to select recipients. “Sa panahon ng kahirapan at pagsubok dulot ng iba't-ibang sakuna, nais namin sa inyo'y magbigay ng pag-asa at tulong na magbibigay daan sa inyong mga pangarap. He also asked for support for the passage of Senate Bill No. 188, which aims to establish the Department of Disaster Resilience (DDR). The proposed legislation envisions a new government department led by a cabinet secretary, focusing on comprehensive approaches to strengthen disaster preparedness across the country. The DDR's core areas of concentration include disaster risk reduction, disaster preparedness, response and recovery, and the advancement of resilience. “Mayro’n rin po ako nai-file na Department of Disaster Resilience, ito pong departamento na ito, a cabinet-secretary level na siya po ang makikipag-coordinate bago pa dumating ‘yung bagyo at ilikas po ang mga kababayan natin sa ligtas na lugar at preposition of goods,” Go explained. “Part rin po ito ng trabaho nila ang disaster-related tulad ng sunog. Kapag may lindol, sunog, bagyo at itong pagputok ng bulkan, ilikas na kaagad sa mga ligtas na lugar. Iyan po ang Department of Disaster Resilience at restoration of normalcy kaagad,” he added. As chairperson of the Senate Committee on Health and Demography, Go initiated the Malasakit Centers program in 2018 in Cebu City after he personally witnessed the struggles of financially incapacitated Filipinos in getting medical assistance from the government. It was later institutionalized under Republic Act No. 11463, which he principally sponsored and authored. To date, there are 158 Malasakit Centers, including those at Vicente Sotto Memorial Medical Center (VSMMC), Cebu City Medical Center, and St. Anthony Mother & Child Hospital, that have helped over seven million Filipinos, according to the Department of Health (DOH). Other Malasakit Centers in the province are located at Cebu Provincial Hospital in Carcar City, Lapu-Lapu City District Hospital, Eversley Childs Sanitarium and General Hospital in Mandaue City, and Talisay District Hospital in Talisay City. Moreover, Go said DOH has identified areas to construct Super Health Centers (SHCs) in the province. SHCs were funded to be established in the cities of Bogo, Danao, Lapu-Lapu, and Mandaue; and in the towns of Borbon, Cordova, Moalboal, Samboan, and San Francisco in 2022. This year, more Super Health Centers were funded in the cities of Carcar, Cebu, Talisay, and Toledo; and in the towns of Carmen, Consolacion, Liloan, Medellin, and San Nicolas. Bong Go visits ‘egg basket of the Philippines’ to conduct relief ops
Senator Christopher "Bong" Go emphasized the paramount significance of stronger government interventions for supporting impoverished Filipinos adversely affected by various crises as he personally led a relief activity for struggling Batangueños in San Jose town on Thursday, 17 August. In 2022, former president Rodrigo Duterte approved a law declaring San Jose town in Batangas as the country's "egg basket” through Republic Act No. 11707, which recognizes the local and national "economic significance" of San Jose's egg industry. Recognizing the urgent need for support, Go for his part has tirelessly championed the cause of the most vulnerable members of society, ensuring that essential government aid reaches those who need it the most. In partnership with the local government of San Jose, the Department of Social Welfare and Development (DSWD), and the Department of Labor and Employment (DOLE), Go assisted 1,558 fellow Batanguenos at the Vanolato Realty basketball court. Go and his team provided grocery packs, masks, vitamins, and meals to each beneficiary. MPTC, SMC forges historic P72-B toll road deal
Two industry powerhouses—Metro Pacific Tollways Corp. or MPTC and San Miguel Corp. or SMC—are set to jointly develop two toll road projects with a combined cost of P72 billion that would further ease mobility in Southern Luzon. The companies signed a Memorandum of Agreement last Monday, 14 August, where they formalized their bid to design, build and operate the 87.96-kilometer Cavite-Batangas Expressway or CBEX and Nasugbu-Bauan Expressway or NBEX. According to SMC President and CEO Ramon S. Ang, the partnership is a “historic collaboration” that will deliver world-class road networks for Filipinos. “This collaboration stands as a testament to what we can achieve when we are united in purpose,” Ang said. Meanwhile, MPTC Chairman Manuel V. Pangilinan said: “Together with SMC, we envisage a future where our CBEX and NBEX can help pave the way for connectivity and economic growth in the CALABARZON region.” The CBEX is a 27.06-kilometer road that will establish a crucial link connecting CALAX’s Silang (Aguinaldo) Interchange to Batangas, Meanwhile, the 60.90-kilometer NBEX will provide seamless connectivity from Nasugbu to Bauan, Batangas. The route will traverse the townships of Silang, Amadeo, Tagaytay, Indang, Mendez, and Alfonso in Cavite before crossing into Nasugbu and finally reaching Bauan, Batangas. The groundbreaking of CBEX is scheduled for 2024, while NBEX is likely to be complete and open to the motoring public by 2027. In 2018, MPTC presented a proposal for the 50.4-kilometer Cavite-Tagaytay-Batangas Expressway project to the Department of Public Works and Highways and was granted the original proponent status. Similarly, SMC's unsolicited proposal for the CBEX and NBEX was approved by the Cavite and Batangas government. Quantifiable targets for national ID issuance needed—Escudero
Senator Francis Escudero said the government agencies involved in the implementation of the Philippine Identification System (PhilSys) project should present “quantifiable targets” to the Senate when they are called for 2024 national budget hearings. Escudero said the Philippine Statistic Authority—the lead implementing agency for the PhilSys project—should explain the special provision in its budget appropriations. He questioned the PSA’s previous provision stating that “it shall set a timetable to fully establish and implement the system, which shall not be later than December 31, 2024.” "So wala na ba talaga yung original na target na end of 2023, wrap up na ang proyekto?" he asked. Escudero cited the Republic Act 11055, which institutionalized the national ID system, was signed by President Duterte on 6 August 2018, but five years later, the government seems to fail in meeting its own target. "Too much fanfare and promise," Escudero lamented, noting that the delivery of national IDs to Filipinos “shambled with so much delays,” resulting in millions of backlogs for the PSA. "Panahon ng silipin kung ano nga ba ang iniunlad nito paglakipas ng limang taon,” he added. Escudero said the Palace is asking P1.6 billion budget for the continuing implementation of the PhilSys project next year so it can further “accelerate the issuance” of national ID cards. Thus, the senator would like to scrutinize "at what speed will it be done and will it be fast enough to overtake the backlog.” The PSA proposed P8.8 billion to fund its 2024 PhilSys project implementation. “Even President [Ferdinand] Marcos Jr. highlighted this allocation in his traditional Budget Message to Congress as a way "to accelerate the issuance" of the national ID card, which every citizen is mandated by law to have,” Escudero said. Meanwhile, Escudero likewise noted that while the PSA has the appropriations, the delays can also be attributed to the problems in the printing services for the national ID—which is being facilitated by the Bangko Sentral ng Pilipinas. "For an agency which prints money and runs the mint, this delay to the people, more so that they are compelled to register and apply for it, is unacceptable," he said. Of the 77.325 million who have registered as of 7 July 2023, Escudero said only 41.358 million plastic cards have been printed and dispatched to various PSA field offices. Of the dispatched, only 34.719 million physical ID cards were received by owners. "Yung 38.608 million printed lang sa papel. Habang 1.2 million ang dinownload na lang nila at sila na ang nag-print. MIAA demonstrates NAIA’s emergency response preparedness at CREX 2023
PASAY CITY — The Manila International Airport Authority (MIAA) showcased its emergency response capability and preparedness during the Crash and Rescue Exercise (CREX) 2023 at the airside premises of Ninoy Aquino International Airport (NAIA) on Friday, 4 August. The successful demonstration of this year’s full-scale simulated emergency CREX allows MIAA to ensure that the prescribed plans, guidelines, and organizational setup of the 8th edition of the NAIA Airport Emergency Plan 2023 adequately and effectively address emergencies occurring at or within the immediate vicinity of the country’s main gateway. “A dependable communication and coordination system is essential for a responsive Airport Emergency Plan (AEP). This exercise puts our communication and coordination system to the test, not only among MIAA offices but also with our external partner agencies,” said MIAA officer-in-charge Bryan Co. “We want to assess primary and secondary responders’ ability to respond to an aircraft crash and the resulting mass casualty event, including rescue and fire suppression, treatment and transport of survivors, and crash site security. The exercise also validates the methods for shifting from an emergency situation to normal airport operations following a potential major incident,” Co added. The scenario for CREX 2023 involved a commercial aircraft bound for Subic, CREX flight #0000, carrying 76 passengers and four crew members, that suffered a left engine malfunction during the take-off run after a flock of domestic pigeons crossing the runway was ingested into the aircraft's number one (left) engine, causing the aircraft to crash. The aircraft lost thrust on its number one engine during take-off. The pilot attempted to abort the take-off, but the aircraft veered off the runway and came to a stop on the western portion. A fire broke out on the left wing. In this mock incident, there were 80 casualties, with 72 survivors and eight deceased. In addition to the standard fire suppression, medical, emergency response, and search and rescue activities, this year's CREX edition featured the activation of Cebu Pacific's Accident Site Go Team, marking the first time MIAA partnered with an airline. “Cebu Pacific prioritizes safety and has established processes when it comes to emergency response. We thank the MIAA for the opportunity for us to train together to help ensure that communication systems are in place in the event of a multi-agency response,” Cebu Pacific President and Chief Commercial Officer Xander Lao said as the airline demonstrated its emergency response, particularly in providing support to victims as well as processing and cross-matching victims and family members. The CREX is held to continuously meet security standards set by the International Civil Aviation Organization (ICAO). In compliance with ICAO’s Suggested and Recommended Practices, the CREX is held every two years, but the full-scale exercise may not be conducted if the airport’s emergency plan was activated. The last full-scale CREX was on 19 October 2017. Several actual aircraft incidents in the succeeding years then brought to the fore MIAA’s emergency response capabilities. In August 2018, a Plan 1 emergency under its Airport Emergency Plan was activated when a Xiamen Air aircraft veered off the main runway while attempting to land during a heavy downpour. Barely two years after, another Plan 1 emergency occurred in March 2020, when a Lion Air medivac flight caught fire while it was rolling for take-off. The most recent involved a Saudia Airlines flight that went off the taxiway onto the grassy portion when its six right landing gears malfunctioned in June 2022. All passengers and crew were immediately evacuated and brought to NAIA Terminal 1. No one was hurt as a result of the incident. NAIA is rated as a Category IX airport, while MIAA’s current rescue and firefighting capability is Category X compliant, making it ready to respond to an airport emergency involving an Airbus A380. With the support of highly skilled fire and rescue personnel, a medical team well trained and experienced in aviation medicine, a fleet of modern firefighting and medical vehicles, pneumatic aircraft lifting systems, and various other rescue equipment, the MIAA Emergency Services department is on par with its counterparts in the region. “As this is a multi-agency response to a simulated emergency, assessment activities will be done after the exercise, where stakeholders are welcome to share their observations and raise comments and suggestions to improve our airport emergency plan and coordination system. The response is a community effort, and we appreciate everyone’s contribution in our quest to maintain the global standards of safety and security in NAIA,” Co said. “We would also like to thank our secondary responders for their support: Pasay City General Hospital, Ospital ng Parañaque, San Juan De Dios Hospital, Philippine Airforce, Las Piñas General Hospital, Philippine Coast Guard, Taguig City Fire Station, Manila Medical Center, Bureau of Fire Protection (BFP) – Makati, Philippine National Police Aviation Security Group, Las Piñas City Fire Station, BFP Parañaque, Philippine General Hospital, Philippine Red Cross – Pasay City Chapter, and the Metropolitan Manila Development Authority,” Co added. 3 Bureau of Corrections officers sacked
Bureau of Corrections director general Gregorio Catapang Jr. on Tuesday revealed that he has ordered the immediate dismissal from service three corrections officers who were found guilty for grave misconduct. Catapang identified the erring BuCor officers as Correction Officers II Marlon Esguerra, Zol PG Plenos and Prison Guard 1 Ernesto Dionglay Jr. Plenos was also ordered to surrender his government issued firearm. The BuCor chief stressed that the sacking of the officer should serve as a warning to erring personnel to shape up or leave the bureau. “We will be relentless in our campaign to reform the bureau of misfits and this is to show that we mean business,” Catapang said. Reports disclosed that Esguerra was found guilty of grave misconduct when he was found to possess seven bricks of tobacco which he hid in his belt. He was scheduled for duty at the office of the Officer of the Day at the Maximum Security Compound of the New Bilibid Prison on 4 May 2018. He admitted the offense, citing financial difficulties. Plenos, on the other hand, was found in possession of six pieces of La Reyna Tobacco while entering the Gate 4 of MaxSecom on 23 August 2017. He also admitted charges against him. Meantime, Dionglay was arrested on 3 August 2017 in possession of 46.55 grams of suspected methamphetamine hydrochloride also known as “shabu” which he hid in his underwear. He was arrested by personnel of the Philippine National Police-Special Action Force detailed at Gate 4 Annex designated as Employees Gate of the MaxSecom. SC junks celebrity doctor’s appeal
The Supreme Court on Tuesday disclosed that it has dismissed the appeal of celebrity doctor Joel Mendez to set aside the decision of the Court of Appeals affirming the seven-year jail term slapped against him by the Regional Trial Court of Quezon City for violating the provisions of Republic Act 8282 or the Social Security Act of 1997. In a six-page resolution dated 31 July 2023, the High Court’s First Division did not give merit to Mendez’s claim that the CA’s Former Special Eight Division — through Associate Justices Edwin Sorongon, Sesinando E. Villon and Marie Christine Azcarraga-Jacob — committed grave abuse of discretion when they outright dismissed his petition. This stemmed from the petition of Mendez before the SC invoking anew “extrinsic fraud” on the part of his lawyer in seeking reconsideration of the CA’s ruling. The doctor claimed that the failure of his former counsel to attend scheduled hearings for his presentation of evidence and his counsel’s failure to inform him of the hearings and that his presence was required during the proceedings were tantamount to “extrinsic fraud.” Extrinsic fraud refers to “fraudulent act of the prevailing party in litigation committed outside of the trial of the case, whereby the defeated party is prevented from fully exhibiting his side of the case by fraud or deception practiced on him by his opponent, such as by keeping him away from court; by giving him a false promise of a compromise; or where the defendant never had the knowledge of the suit, being kept in ignorance by the acts of plaintiff; or where an attorney fraudulently or without authority connives at his defeat.” The SC, though, held that Mendez’s contention that the failure to present his side due to his former counsel’s negligence constitutes extrinsic fraud, “is untenable.” “As a ground for the annulment of a judgment, extrinsic fraud must emanate from an act of the adverse party, and the fraud must be of such nature as to have deprived petitioner of their day in court,” said the SC. “The fraud is not extrinsic if the act was committed by petitioner’s own counsel. In this light, we have ruled in several cases that a lawyer’s mistake or gross negligence does not amount to the extrinsic fraud that would grant a petition for annulment of judgment,” it added. Also, the SC stressed that Mendez failed to comply with the 60-day period under Rule 65 of the Rules of Court within which to file the present petition questioning the CA decision, adding that Atty. Marc Anthony B. Antonio, one of Mendez’s former counsels, received a copy of the CA resolution dated 16 April 2019 on 2 May 2019. Mendez alleged that Antonio informed him about the resolution only on 19 June 2019. The court added that Mendez — instead of filing the present petition for certiorari within 60 days from 2 May 2019 — secured the services of a new lawyer and filed the petition only on 8 August 2019, or 98 days after Antonio received the CA Resolution dated 16 April 2019. “As keenly observed by the OSG (Office of the Solicitor General, Mendez blames yet again one of his former lawyers who allegedly belatedly informed him of the receipt of the CA Resolution dated 16 April 2019,” the SC said. “This is a self-serving allegation not supported by any evidence and, thus, deserves scant consideration. A party alleging a critical fact must support their allegation with substantial evidence, for any decision based on unsubstantiated allegation cannot stand without offending due process,” it added. To recall, the CA — in its August 2018 decision — denied the petition filed by Mendez seeking to annul the 18 July 2016 decision of QC RTC Branch 88 Presiding Judge Rossana Fe Romero which found her guilty of violating Republic Act 8282. It did not give weight to Mendez’s contentions, stressing that the SC has previously ruled that a lawyer’s neglect in keeping track of the case and his failure to apprise his client of the development of the case do not constitute extrinsic fraud. Mendez, who owns a chain of dermatology clinics in the country, was sentenced to a jail term ranging from six years and one day as minimum to seven years as maximum by the QC RTC. He was also ordered to pay SSS a total of P1,865,657.50 representing unpaid contributions from October 2011 to January 2013 with an interest of three percent per month from July 2015 until full payment. Hun Manet has an economics degree from England and graduated from US military academy West Point, but there are few expectations he will uphold Western liberal ideals when he succeeds his father as Cambodia's prime minister. Groomed for years, the eldest son of Cambodia's iron-fisted ruler will take over next month in a dynastic transfer long in the making, which sees Hun Manet move from the premier's bodyguard unit to the seat of power in the capital Phnom Penh. After nearly four decades as Cambodian leader, Hun Sen on Wednesday announced his resignation in a televised speech, three days after claiming a landslide victory in a one-sided election that the ruling party was guaranteed to win after having silenced all viable opposition. Hun Manet, already a member of the ruling Cambodian People's Party's powerful permanent committee, has served as commander of the Royal Cambodian Army since 2018. Born on October 20, 1977, the princeling graduated from West Point in 1999 and has more recently met world leaders including President Xi Jinping of China -- Cambodia's main ally and benefactor. But the 45-year-old four-star general only contested a parliamentary seat for the first time in Sunday's election, a poll he has insisted was legitimate, while Western powers criticized it as neither free nor fair. 'After Hun Sen' While Hun Sen, one of the world's longest-serving rulers, has trailed the handover to his son for a year and a half, he has also made it clear that he intends to wield influence after he steps down, scotching the notion the country could change direction when Hun Manet assumes power. While Hun Sen's politics are shaped by his experiences of revolution and war as a young man during the genocidal Khmer Rouge regime in the 1970s, his son was raised in luxury and educated abroad. Hun Manet holds a PhD in economics from the University of Bristol in Britain, and was the first Cambodian to graduate from the prestigious US military academy. He has also served in leadership roles in the ruling CPP's youth movement, his father's bodyguard unit and the counterterrorism special forces. But a Western education is no guarantee of a more liberal approach, exiled politician Sam Rainsy, a longstanding foe of Hun Sen, told AFP this month -- pointing to Syria's brutal Assad dynasty. Here are some examples of acts that constitute constructive dismissal: In one case, an employee who was hired as a bookkeeper in a company engaged in the real estate business was held to be constructively dismissed when she was deprived of office space, was not given further work assignments, and was not paid her salaries until she was left with no choice but to stop reporting for work (Tan Brothers Corp. of Basilan City v. Escudero, G.R. 188711, 3 July 2013). In another case, an employee who was hired as a waiter in a hotel company was held to be constructively dismissed when his regular work days were reduced from five days to two days. The change in his work schedule thus resulted in the diminution of his take-home salary. The fact that he may have continued to report for work does not rule out constructive dismissal, nor does it operate as a waiver. (Regala v. Manila Hotel Corp., G.R. 204684, 5 October 2020). The Supreme Court explained that “constructive dismissal occurs not when the employee ceases to report for work, but when the unwarranted acts of the employer are committed to the end that the employee’s continued employment shall become so intolerable. In these difficult times, an employee may be left with no choice but to continue with his employment despite abuses committed against him by the employer, and even during the pendency of a labor dispute between them.” (The Orchard Golf and Country Club v. Francisco, G.R. 178125, 18 March 2013). In another case, a managerial employee was instructed to perform functions that were below her position. When she assigned another person to do the said functions and suggested a different procedure to her boss, the latter reacted negatively and told her she was stupid and incompetent. She was also asked to resign on more than one occasion but was later told to stay. After she was assured that she could keep her job, she was treated indifferently by the management. The Supreme Court held that acts of disdain and hostile behavior such as demotion, uttering insulting words, asking for resignation, and apathetic conduct towards an employee are tantamount to constructive dismissal. (Bayview Management Consultants Inc. v. Pre, G.R. 220170, 19 August 2020). In another instance, an employee became the subject of constructive dismissal in the guise of a transfer. She was initially promoted to the position of Chief Operating Officer in one of the employer’s branches. However, two months after her promotion, she was appointed instead as Compliance Manager, and her position of COO was declared abolished when the management decided to undertake an “organizational restructuring.” It appears, however, that the said position was actually never abolished as another employee was appointed to take her place. The appointment was even publicly announced via an official communication disseminated company-wide. The Supreme Court held that when another employee is soon after appointed to a position that the employer claims to have been abolished, while the employee who had to vacate the same is transferred against her will to a position that does not exist in the corporate structure, there is evidently a case of illegal constructive dismissal. (Ico v. Systems Technology Institute, Inc., G.R. 185100, 9 July 2014). An employee who is constructively dismissed is entitled to two reliefs, namely, back wages and reinstatement. However, where reinstatement is no longer feasible, the employee shall be granted separation pay in lieu of reinstatement (Cornworld Breeding Systems Corp. v. Temperatures reached new highs on Monday as heatwaves scorched parts of the Northern Hemisphere, triggering health warnings and fanning wildfires in the latest stark reminder of the effects of global warming. From North America to Europe and Asia, people gulped water and sought shelter from the sweltering heat, with the mercury expected to reach new highs in several places in the next few days. Europe, the globe's fastest-warming continent, was bracing for its hottest-ever temperature this week on Italy's islands of Sicily and Sardinia, where a high of 48 degrees Celsius (118 degrees Fahrenheit) is predicted, according to the European Space Agency. "We're from Texas and it’s really hot there, we thought we would escape the heat but it’s even hotter here," Colman Peavy, 30, said as he sipped a capuccino at an outside terrasse in central Rome with his wife Ana at the start of a two-week Italian vacation. With June already having been the world's hottest on record, according to the EU weather monitoring service, Mother Nature seemed intent on July not falling far behind. China reported a new high for mid-July in the northwest of the country, where temperature reached 52.2C in the Xinjiang region's village of Sanbao, breaking the previous high of 50.6C set six years ago. In nearby Turpan city, where ground surface temperatures sizzled at 80C in some parts, authorities have told workers and students to stay home and ordered special vehicles to spray water on major thoroughfares, the meteorological body said. In Cyprus, where temperatures are expected to remain above 40C through Thursday, a 90-year-old man died as a result of heatstroke and three other seniors were hospitalized, health officials said. In Japan, heatstroke alerts were issued in 32 out of the country’s 47 prefectures, mainly in central and southwestern regions. At least 60 people in Japan were treated for heatstroke, local media reported, including 51 who were taken to hospital in Tokyo. The heat was enough for at least one man to dispense with social mortification in Hamamatsu city. "It’s honestly unbearable without a parasol, although I have to admit it is a bit embarrassing," he told national broadcaster NHK of the umbrella in his hand. Japan's highest-ever temperature was 41.1C first recorded in Kumagaya city in 2018. 'Oppressive' US heat In western and southern states in the US, which are used to high temperatures, more than 80 million people were under advisories as a "widespread and oppressive" heatwave roasted the region. California's Death Valley, often among the hottest places on Earth, reached a near-record 52C Sunday afternoon. In Arizona, the state capital Phoenix recorded its 17th straight day above 109 degrees Fahrenheit (43 degrees Celsius), as temperatures hit 113F (45C) on Sunday afternoon. "We're used to 110, 112 (degrees Fahrenheit) ... But not the streaks," Nancy Leonard, a 64-year-old retiree from the nearby suburb of Peoria, told AFP. "You just have to adapt". Southern California was fighting numerous wildfires, including one in Riverside County that has burned more than 7,500 acres (3,000 hectares) and prompted evacuation orders. Historic highs forecast In Europe, Italians were warned to prepare for "the most intense heatwave of the summer and also one of the most intense of all time," with the health ministry sounding a red alert for 16 cities including Rome, Bologna and Florence. Greece saw a respite on Monday, as temperatures eased a bit and the Acropolis in Athens resumed its regular opening hours after shutting for a few hours during the previous three days. But a new heatwave was expected from Thursday and meteorologists warned of a heightened risk of wildfires amid strengthening winds from the Aegean Sea. In Romania, temperatures are expected to reach 39C on Monday across most of the country. Little reprieve is forecast for Spain, where meteorologists warned that "abnormally high" temperatures on Monday, including up to 44C in the southern Andalusia region in what would be a new regional record. Killer rains Along with the heat, parts of Asia have also been battered by torrential rain. South Korea's president vowed Monday to "completely overhaul" the country's approach to extreme weather, after at least 40 people were killed in recent flooding and landslides during monsoon rains, which are forecast to continue through Wednesday. In northern India, relentless monsoon rains have reportedly killed at least 90 people, following burning heat. Major flooding and landslides are common during India's monsoons, but experts say climate change is increasing their frequency and severity. 6 killed in China kindergarten attack
BEIJING, China (AFP) -- Six people were killed and one wounded in an attack at a kindergarten in southern China’s Guangdong province on Monday, a spokeswoman for the city government said. “The victims include one teacher, two parents and three students,” she said. She did not offer details about the identities or ages of the victims, nor the weapon used in the attack, which took place in the city of Lianjiang. “One suspect has been arrested,” she said, adding that a police investigation was underway. The suspect was a 25-year-old male surnamed Wu, local police said in a statement. The incident took place around 7:40 am (2340 GMT on Sunday), the state-backed China News Network reported. Videos shot by passersby claiming to show the crime scene were removed from video-sharing platform Douyin and Twitter-like Weibo. While guns are strictly controlled, China has been struggling with a spate of mass stabbings. Violent crime has been on the rise as the economy has grown in recent decades and the gap between rich and poor has widened rapidly. Spate of attacks Fatal attacks targeting students and schools have occurred nationwide in recent years. The attacks have forced authorities to step up security and prompted calls for more research into the root causes of such violent acts. Last August, three people were killed and six others wounded in a knife attack at a kindergarten in southeast China’s Jiangxi province. In April 2021, two children were killed and 16 others wounded when a knife-wielding man entered a kindergarten in southern China. In June of the previous year, 37 students and two adults were wounded by a knife-wielding attacker at a primary school in southern China. And in November 2019, a man climbed a kindergarten wall in southwest Yunnan province and sprayed people with a corrosive liquid, wounding 51 of them, mostly students. The same year, eight schoolchildren died and two others were wounded in a “school-related criminal case” in the central Hubei province, with a 40-year-old man arrested. And in April 2018, a 28-year-old man killed nine college students and injured 12 others outside their school in the northern province of Shaanxi.
