CHR welcomes murder charges vs. cops linked to Jemboy Baltazar’s death
The Commission on Human Rights on Saturday welcomed the filing of murder charges against six police officers in connection with the “unjust killing” of 17-year-old Jerhode “Jemboy” Baltazar Navotas City in August. In a statement, the CHR likewise commended the Department of Justice for “conducting a comprehensive review” of Baltazar’s slay case, which has led to the decision to file murder charges against police officers allegedly involved in the killing. “This swift development on the case is an important step towards ensuring justice and accountability, especially as it involves law enforcement agents,” it said. The human rights body said the “senseless death” of Baltazar “underscored the importance of holding law enforcement agents” accountable for their actions to curb violations and abuses that breach fundamental rights. CHR firmly stressed that positions of authority, including law enforcers, “are not above the law. “Those who committed alleged violations must be held responsible considering that they made an oath to serve in accordance with the rules and standards required of police officers," it added. CHR hopes that the filing of murder charges against the suspects "will serve as a strong message that any alleged human rights violations by law enforcement officers will not be tolerated in our society.” “Aside from its crucial importance in delivering justice to Jemboy and his family, it can also help restore public trust in our law enforcement agencies,” it further stated. "The Commission also expects that the case amplifies the importance of abiding with established rules of operations that adhere to human rights-based policing to prevent violations that denigrate human rights, especially the utmost right to life.” CHR likewise urged the Philippine National Police to continue strengthening its programs and training “that will imbue its personnel with a renewed commitment to human rights practice” and values in the conduct of their duty. The commission said it will continue monitoring the case and provide support “in aid of ascertaining justice.” “As we mark this positive development, it is equally important to ensure continued commitment to due process, transparency, and accountability throughout the legal proceedings," it said. After the issuance of the warrant of arrest, the six police officers turned themselves into the Criminal Investigation and Detection Group in Lucena City in Quezon last Wednesday. They will be facing murder charges and are not entitled to bail. Eight policemen, including the six who were ordered arrested by the court, were dismissed due to serious grave neglect of duty. Since then, their benefits have been forfeited and their eligibility was revoked. While they were perpetually disqualified from holding any other government posts. 6 cops in teenage slay ordered arrested
The Regional Trial Court of Navotas City has ordered the arrest of six policemen charged with a non-bailable case of murder for the killing of teenager Jerhode “Jemboy” Baltazar last 2 August. The order was issued last Tuesday, 3 Oct. by Judge Pedro T. Dabu Jr. of RTC Branch 286. Ordered arrested were PSSg. Gerry S. Maliban, PSSg. Antonio B. Bugayong Jr., PEMS. Roberto D. Balais Jr., PSSg. Nikko PInes C. Esquillon, PCpl. Edmar Jade S. Blanco and Pat. Benedict D. Mangada — all members of the Navotas City police station. Judge Dabu in his order said “the Court finds probable cause to issue a warrant of arrest against all the above-named accused to place them under the custody of the law in order not to frustrate the ends of justice.” “Considering that the accused stand charged with murder, they are not entitled to bail as a matter of course,” the judge also said. The Department of Justice filed the murder charges before the RTC last Monday, 2 October. Record showed that Baltazar was fishing when he was shot dead last 2 August in Barangay NBBS Kaunlaran in Navotas City. In fending off responsibilities, the policemen claimed that they were conducting follow-up operations against robbers when they mistook the victim as one of the suspects. Cop, brother face kidnapping raps
Southern Police District Director Brig. Gen. Roderick Mariano ordered the filing of charges against a policeman and his brother who allegedly kidnapped and illegally detained a female Chinese national. The suspects who will be charged were identified as SSgt. Lordgrin Figueroa, 39, assigned at the Pasay Criminal Investigation and Detection Group; and his brother “Nelson,” 20, now detained at the police custodial facility. Charges for Illegal Detention, Robbery Extortion, violations of Republic Act 10591 (Comprehensive Law on Firearm and Ammunition) in relation to RA 7166 (Omnibus Election Code), Falsification of Public Documents, and Article 179 of the Revised Penal Code (Illegal Use of PNP Uniform). Reports showed the brothers were arrested on Sunday, 3 September at around 10:48 p.m. inside Qing Qing hotel located along Figueroa Street, Barangay 74, Pasay City. Mariano said the Pasay police, under the supervision of city police chief, Col. Froilan Uy, conducted a rescue operation for a 26-year-old female Chinese national who was allegedly detained by the suspects inside the hotel room. The suspects reportedly attempted to extort money amounting to P500,000 for her release. A friend of the victim, a 34-year-old Malaysian national, sought police assistance and reported the incident on September 4. He provided the Pasay police with a photo of the victim in handcuffs, a PNP ID belonging to a certain PMSG John Reggie Reyes, and text messages from the suspects demanding for the P500,000 ransom money. The rescue operation, Mariano said was immediately conducted, leading to the arrest of the suspects. Police recovered one 9mm Taurus with serial number TBW77621 a property of PNP, one magazine loaded with 14 live ammunition, a PNP ID, a wallet, 14 pieces of P1,000 bills, five assorted identification cards and three cellphones. Mariano said, as members of the PNP, they are committed to upholding the law and ensuring the safety and security of all citizens and visitors. 2 alleged Indian terrorists deported
On Monday, the Bureau of Immigration announced that it had successfully deported the two Indians who had been tagged as terrorists. According to BI Intelligence Division Chief Fortunato Manahan Jr., Manpreet Singh Gill and Mandeep Singh were successfully deported on 13 August via Thai Airways flight bound for New Delhi. Manahan said that the two were escorted by BI Intel officers along with Indian authorities. Manpreet was ordered deported for being an undesirable alien after the BI learned from the US Federal Bureau of Investigation that he is wanted in India for a number of offenses, including violation of the unlawful activities prevention act, and that he is a suspect in a murder there. The Indian government further informed the BI that Manpreet is the subject of an arrest warrant issued by the Additional Chief Magistrate in Moga Punjab, for violating the country’s Arms Act. Mandeep was tagged as a fugitive and undesirable alien for violating the conditions of his stay. Manahan added that Manpreet and Mandeep were arrested with two others last March 7 in Iloilo City by the BI Fugitive Search Unit with the help of the anti-terrorism group, the Crime Investigation Coordinating Council, the Philippine National Police in Iloilo City, and government intelligence agencies. They were said to be involved in terrorist activities in Punjab, India. The two of their companions, Amrik Singh and Hayer Amritpal Singh, were already deported in May this year. Manpreet and Mandeep were deported after being cleared of local charges in the country. SC orders rearrest of ex-Palawan governor Reyes over Ortega murder
The Supreme Court (SC) has ordered the rearrest of former Palawan governor Mario Joel Reyes due to the 2011 murder of environmentalist and broadcaster Dr. Gerry Ortega. This came after the high bench denied Reyes’ petition for review and affirmed the amended decision dated 28 November 2019, and resolution dated 24 February 2021, of the Court of Appeals (CA) Special Former Eleventh Division in CA-G.R. SP No. 132847. Also, the temporary restraining order dated 23 March 2022 has been lifted. The SC in its ruling stated, “Accordingly, the Regional Trial Court, Branch 52, Puerto Princesa City, Palawan, is hereby ordered to cause the immediate re-arrest and detention of petitioner Mario Joel T. Reyes; and continue with the proceedings in Criminal Case No. 26839 with utmost dispatch.” The SC also addressed Reyes’ claims of reversible error, stating, “Unfortunately for petitioner (Reyes), the record, thus far, shows that the RTC (regional trial court) acted well within its jurisdiction. This, in turn, belies petitioner’s claim that the CA committed reversible error in sustaining the trial court’s decision to proceed with the criminal trial.” On the morning of 24 January 2011, Ortega, a prominent broadcaster and environmentalist, was fatally shot. Known as an “environmental hero,” Ortega’s murder drew significant attention. Marlon Recamata, the gunman, was arrested and pleaded guilty to the murder in February 2011. Reyes was identified as the mastermind behind Ortega’s killing by his former bodyguard, Rodolfo Edrad. The former governor was criticized by Ortega for alleged environmental destruction in the province. Reyes’ brother, former Coron Mayor Mario Reyes, was also implicated in the crime. The SC ruling satisfied the Ortega family, who said, “The Ortega Family welcomes the latest development to rearrest former Governor Joel Reyes. Our family is thankful that the Supreme Court sided with truth and justice. We have long hoped and prayed for the trial to continue. De Lima co-accused ordered transferred to Munti jail
The Muntinlupa City Regional Trial Court on Wednesday disclosed that it has ordered the transfer of Jose Adrian “Jad” Tamson Dera — a co-accused of former Senator Leila de Lima in a drug case — from the National Bureau of Investigation detention cell in Manila to the Muntinlupa City jail. Judge Abraham Joseph B. Alcantara of the Muntinlupa RTC issued the order on a petition filed by the NBI as he also granted the motion of the NBI for Dera to attend the 5 July 2023 hearing of the Senate Committee on Justice and Human Rights “on the alleged unauthorized trips of said accused outside the NBI Detention Facility.” “Accordingly, the Chief of the Security Management Section, the NBI, is directed to turn over the body of the living person of accused Jose Adrian Dera y Tamson to the Muntinlupa City Jail Male Dormitory, Tunasan, Muntinlupa City who is ordered to take custody of said accused during the pendency of the case and until further orders from the Court,” the RTC’s order stated. The court also ordered to bring accused Dera to the Senate hearing of the Committee on Justice and Human Rights with security escorts and upon proper coordination with the appropriate office of the said committee. To recall, Dera and six security personnel are facing a criminal complaint before the Department of Justice. They were arrested last 21 June while returning to the NBI detention facility in Manila after having gone out. Charges were filed against them for bribery, corruption of public official, infidelity in the custody of prisoner, and graft and corruption. The complaint though has yet to be resolved by the DOJ panel of prosecutors. Meantime, Dera on Wednesday admitted to senators that he was able to leave the NBI facility several times during the Senate justice and human rights investigation. According to Dera, he was able to leave the NBI’s detention facility on 20 January 2022 to have himself checked in a hospital in Manila. This was authorized by a court order dated 10 December 2021. He added that he was able to leave the detention facility for the second time to go to another hospital and have his heart checked, but this time he had no approval from the court. The third time that he was able to leave the NBI was on Father’s Day this year and the fourth time was on 20 June, reportedly for a date, where he and five NBI jail guards were nabbed. But during Senator Francis Tolentino’s interpellation, Dera also confirmed claims that he was also able to Calatagan, Batangas but he said he cannot recall the exact date. He also admitted going to Tagaytay City with other NBI officers. Dera, however, denied going to Subic contrary to some reports.
