Mla slams Beijing’s expanded SCS claim
The Department of Foreign Affairs has strongly protested China’s inclusion of the entire West Philippine Sea in the newest version of its standard map, calling it “unacceptable.” Manila, through the DFA, made this very clear to Beijing on Thursday as it rejected China’s map that depicts its new “10-dash line” claim to the entire South China Sea, including maritime zones of the Philippines, Taiwan, Malaysia, Brunei, Vietnam and Indonesia. The map was issued by China’s Ministry of Natural Resources on 28 August, drawing protests from Malaysia and India (see related story). “This latest attempt to legitimize China’s purported sovereignty and jurisdiction over Philippine features and maritime zones has no basis under international law, particularly the 1982 United Nations Convention on the Law of the Sea,” the DFA said. The DFA reiterated to China that a 2016 international arbitral ruling invalidated its “nine-dash line” claim in the South China Sea and affirmed the Philippines’ exclusive economic zone in the West Philippine Sea. This was in reference to the final judgment rendered by the Permanent Court of Arbitration on 12 July 2016. “It (decision) categorically stated that ‘maritime areas of the South China Sea encompassed by the relevant parts of the nine-dash line are contrary to the Convention and without lawful effect to the extent that they exceed the geographic and substantive limits of China’s maritime entitlements under the Convention,’” the statement said. “The Philippines, therefore, calls on China to act responsibly and abide by its obligations under UNCLOS and the final and binding 2016 Arbitral Award,” the DFA added. China claims nearly the entire South China Sea, including the West Philippine Sea, but has not recognized the arbitral ruling. Neither did Beijing participate in the court’s proceedings. During a Malacañang press briefing, Foreign Affairs Undersecretary Daniel Espiritu confirmed Manila had filed a diplomatic protest with Beijing regarding the issue. Beijing’s revised map features a sequence of 10 dashes arranged in a U-shape, encompassing not only parts of the Philippines but of self-ruled Taiwan as well as parts of the exclusive economic zones of Malaysia, Brunei, Vietnam and Indonesia. “Suffice it to say that we have already expressed our opposition to that matter,” Espiritu told Palace reporters. “We are definitely against it, we reject it, and we continue to advocate for a peaceful resolution of disputes in that aspect,” he added. Asked how this would affect the Philippine position when Marcos meets with his Southeast Asian and Chinese counterparts during the upcoming Association of Southeast Asian Nations summit, Espiritu said the leaders would not complete their discussions on the matter in just one, two, or three meetings. “Progress has been made. We also expressed our profound satisfaction with recent developments in the South China Sea, particularly on the issue of the water cannoning,” Espiritu said. “We emphasized that these actions must be avoided, as they erode trust, escalate tensions in the South China Sea, and destabilize the peace and stability in the region,” Espiritu added. China’s defense For its part, the Chinese Ministry of Foreign Affairs defended the map, saying it is “in accordance with the law.” “On 28 August, the Ministry of Natural Resources of China released the 2023 edition of the standard map. It is a routine practice in China’s exercise of sovereignty in accordance with the law,” Chinese Foreign Ministry spokesperson Wang Wenbin said. Wang called on the countries affected by the new map to “stay objective and calm, and refrain from over-interpreting the issue.” Four of the 10 members of ASEAN are primary claimants to the resource-rich South China Sea — Vietnam, Malaysia, Brunei and the Philippines. Final and binding In reaction, National Security Adviser Eduardo Año said the Philippines does not recognize China’s nine-dash line claim, more so its expanded 10-dash line. “The arbitral award is final and binding,” Año said. “It gives us our maritime entitlement, our extended economic zone, our territorial waters, and our extended continental shelf.” The Philippines, he said, is not alone in its rejection of the 10-dash line. India and Malaysia have also expressed their opposition to the new map. “There would be more countries, I think, to react adversely against this 10-dash line,” Año said. “Our Armed Forces, our uniformed services, our government will do everything in their capacities to ensure that we are protecting our national interest.” President Ferdinand Marcos Jr., meanwhile, will push for a rules-based international order and for parties to follow the United Nations Convention on the Law of the Sea during the upcoming 43rd Asean Summit next month, DFA Undersecretary Espiritu said on Thursday. “The Philippines will continue to uphold and exercise freedom of navigation and overflight in the South China Sea in accordance with international law,” Espiritu added. He said Marcos is expected to have one-on-one meetings with Cambodian Prime Minister Hun Manet, Vietnamese Prime Minister Pham Minh Chinh, South Korean President Yoon Suk Yeol, and Timor Leste Prime Minister Xanana Gusmão. “With Vietnam, the focus will be on strengthening the strategic partnership between the two countries and, of course, cooperation on rice and food security,” he said. ‘Cancel China projects’ With Beijing’s unrelenting expansion into the SCS, Infrawatch PH convenor Terry Ridon said the government should reconsider existing and upcoming China-assisted infrastructure projects. “Senate President Juan Miguel Zubiri had earlier suggested a boycott of all Chinese companies and products, including the Chinese Communication Construction Company, to protest Beijing’s continued incursion into our territory,” Ridon said. “Why not push that call up a notch and call on the Marcos administration to cancel all China-assisted infrastructure projects in the pipeline?” he added. There are presently six major infrastructure projects financed with Chinese loans, the biggest of which is the PNR South Long Haul Project, a 380-kilometer railway that will link Calamba in Laguna and Legazpi in Albay. Rep. Salceda not calling for Frasco resignation
Albay Rep. Joey Salceda, one of the first who lambasted Tourism Secretary Cristina Frasco over the non-inclusion of Albay's iconic Mayon Volcano in the DoT's latest promotional ad campaign, said on Tuesday that he would not join calls for the latter's resignation. Instead, he said, his province Albay would help the DoT chief to lure foreign tourists into the country in the midst of the backlash over the blunder. "Albay will help her. I offer to her my personal experience as former Governor of Albay, when we grew foreign tourist arrivals by 4,700 percent, and became the country's rising tourism star," Salceda said, noting that prior to the pandemic, Albay had 1.32 tourists per resident, which was higher than the national average of 0.57. The economist-lawmaker, who appeared to be less irate, bared that Frasco followed her recommendation to terminate the consultant, correct mistakes and investigate internally, and be more inclusive with destinations featured. "When we resume session in Congress, we will seek facts. She is open. We can disagree without malice," the lawmaker said. "I will criticize openly, as needed. That's my job as a legislator and a representative of my people. But after heated discussions, we must remain focus on solving problems." To recall, Salceda went ballistic by the DoT's failure to include Mayon in its latest campaign video, "Love the Philippines," saying Frasco, whom she called her friend, had failed Albay and that Mayon deserved better treatment. Salceda argued that it would not have cost much to include just a scene of Mayon, where Albayanos relay their bread and butter. Tourism Secretary Christina Garcia-Frasco on Wednesday clarified that the video that was unveiled on Tuesday, coinciding with the launch of its new campaign "Love the Philippines", is just a primer and may be developed in the coming days or weeks. Frasco’s clarification was amid the disappointment of Albay 2nd District Representative Joey Sarte Salceda for not including on the said video the majestic Mayon Volcano, the natural wonder representing his province, Albay. Salceda, in a statement on Wednesday, aired his displeasure to her friend Frasco for seemingly forgetting Mayon Volcano on the video of the tourism campaign. “I remain disappointed in my friend, Secretary Frasco, for the exclusion of Mayon Volcano in the new official tourism video of the Philippines. I am more disappointed in the response that I should not bring this issue up because, anyway, Mayon is included in the 50 major volcanoes and mountains represented (by a pixel!) in the official tourism logo and slogan,” the lawmaker said. Frasco was quick to answer, saying she recognizes their ties as allies and family friends for many years, extolling Salceda being a staunch ally for Philippine Tourism, “especially with his successes as the governor of Albay and we certainly honor and recognize the contributions of the province to the tourism portfolio of the country.” “The tourism video that has just been released by the Department of Tourism is only the beginning; for indeed, there is just so much to love about our country. So, I assure Congressman Joey Salceda that our effort to promote equally our destinations in the country will continue,” Frasco said. “This is just the beginning to give the world a flavor and a taste of the Philippines,” she added. Further, the Tourism secretary maintained that the Department is holding the "Philippine Experience: Heritage, Culture, and Arts Caravan" in the Bicol Region, adding, “It would have been this July but given the circumstances in the region at the moment, tentatively it has been set for August and our regional offices have been in coordination with our local government units there.” The hurt Salceda said in his statement that he expressed his frustration because tourism is disproportionately more crucial in Albay, and Bicol at large. “This is how thousands of Albayano families make a living. It would not have cost much to include just a scene of Mayon, but it would have meant the world to Albay families relying on tourism for their bread and butter,” he said. Moreover, the lawmaker stressed that Albay has the only international airport in South Luzon—Bicol International Airport, which the government calls "the most scenic international gateway in the country." He said per capita, Albay is one of the country's most important tourist destinations, while pre-pandemic, it attracted 1.32 tourists per resident, while the top region, Central Visayas, attracts just 1.17, and the national average is 0.55. “Bicol's economy depends heavily on tourism, more so than the rest of the country. Last year, accommodation and food service (the most direct sector affected by tourism) was 1.93% of total regional GDP, while the national average was 1.80 percent,” he said. “Just to demonstrate how affirmative support from the national government can be a game-changer for tourism: When I was governor of Albay, we increased foreign tourist arrivals from 8,700 in 2006 to 374,000 in 2015. Total tourist arrivals swelled from 123,000 to 1.4 million over the same period,” Salceda underlined. On the other hand, he said, “Mayon deserves better than a pixel in the logo where you need strained eyes to see it. Comelec to adhere SC’s status quo order on Rosal
The Commission on Elections on Thursday said that it will comply with the Supreme Court’s Status Quo Ante Order decision that effectively reinstates Carmen Rosal as mayor of Legazpi City, Albay a day after the poll body certified her disqualification as “final and executory.” “The Commission on Elections, through the Clerk of the Commission, received from the Supreme Court its Status Quo Ante Order in the Carmen Rosal Disqualification Case. As we have consistently committed, the Commission on Elections will abide by and comply with any order, ruling or directive of the Highest Court of our Land,” Comelec spokesperson John Rex Laudiangco said. Comelec’s statements come as the Supreme Court acted on the two petitions for certiorari under Rule 65 in relation to Rule 64 of the Rules of Court assailing the Comelec resolutions that disqualified Rosal as candidate for mayor of Legazpi City, Albay in the 2022 polls. The assailed resolutions — dated 4 October 2022 and 4 May 2023 in SPA 22-032 (DC) — directed the Special City Board of Canvassers of Legazpi City to proclaim second placer Alfredo A. Garbin Jr. as the duly-elected mayor of Legazpi City. The SC en banc — in its Status Quo Ante Order dated 11 May 2023 given by authority of Acting Chief Justice Marvic M.V.F. Leonen, upon the written recommendation of the Member-in-Charge — deemed it necessary and proper to consolidate the two petitions docketed as G.R. 266775 (Oscar Robert H. Cristobal v. Comelec, Alfredo A. Garbin, Jr., Joseph San Agustin Armogila, and Carmen Geraldine Rosal) and G.R. 266796 (Carmen Geraldine Rosal v. Comelec, Joseph San Agustin Armogila, Alfredo A. Garbin Jr. and Oscar Robert H. Cristobal); require respondents Comelec, Garbin, Armogila, Rosal, and Cristobal to file a consolidated comment within 10 days from notice; and issue a status quo ante order requiring the parties to observe the status quo prevailing before the issuance of the Comelec resolutions. Armogila and Rosal were candidates for councilor and mayor of Legazpi, respectively, in the 2022 national and local elections. Armogila filed a petition for disqualification against Rosal before the Comelec on the grounds of vote buying under Section 68(a) of the Omnibus Election Code and violation of the prohibition on release, disbursement, and expenditure of public funds under Section 261(v) of the same law.
