Trafficker mom offers own kids for online sexual exploitation
A 32-year-old woman from Talomo District, Davao City has been sentenced to four life imprisonments and ordered to pay a total of P6 million for multiple violations, including the violation of the Anti-Trafficking in Persons Act and the Special Protection of Children Against Abuse, Exploitation, and Discrimination Act. The woman was arrested after offering to sexually abuse her six-year-old son and one-year-old daughter in exchange for money or other considerations. The presiding judge found her guilty of qualified trafficking, child abuse, and offering child sexual abuse material through a computer system. In addition to the life sentences, she was also sentenced to an additional 14 years in prison and ordered to pay fines and damages. The arrest and rescue operation were carried out by law enforcement agencies in collaboration with social workers. The conviction is seen as a testament to the government's efforts to combat trafficking and online sexual abuse and exploitation of children. 3 wanted suspects fall in Rizal sting
Three wanted persons were arrested in separate manhunt operations on Tuesday, the Rizal police provincial office said Wednesday. Rizal police provincial director P/Col. Rainerio de Chavez said the three individuals were nabbed for various cases in the towns of Rodriguez and Tanay, and Antipolo City. In Rodriguez, the 42-year-old accused, identified only as alias Zaldy, was arrested by operatives of the Rodriguez Municipal Police Station by virtue of a warrant of arrest for the crime of frustrated murder. It can be recalled that the accused was allegedly tagged behind the stabbing incident against alias Ryan who miraculously survived the attack after he was rushed to a nearby hospital. In Antipolo, rape suspect alias Junior was nabbed by the police by virtue of a warrant of arrest issued by Judge Jose Bayani Usman of Puerto Princesa City Regional Trial Court Branch 50 (Family Court) for the crime of two counts of rape, acts of lasciviousness, and violation under Republic Act 7610 or the Anti-Child Abuse Law. Probe on PNP abuse, rights violation sought
Senator Raffy Tulfo on Friday filed a resolution urging the Senate to probe alleged abuse, killings and human rights violations by the members of the Philippine National Police due to their “persistent failure” to follow police operational procedures. Senate Resolution 767 is urging an appropriate committee in the upper chamber to undertake an inquiry against police officers engaged in abuse of power, criminal acts and violation of human rights. Tulfo lamented that cops must enforce the law accordingly, maintain peace and order, and ensure public safety and internal security in the country. However, he lashed out about several reports indicating that police operations have failed due to their negligence in operational procedures. He cited the 12 August incident wherein Pandi police officers entered the property of Rodelio Vicente claiming they were just conducting a “manhunt” for an alias “Elmer” without any warrant of arrest or justification. The cops eventually arrested Vicente for allegedly committing direct assault and disobedience to a person in authority and was taken into custody for no valid reason. Tulfo slammed the arresting cops for not wearing their uniforms and using ski masks during the supposed manhunt operations. Vicente’s daughter was also physically assaulted by these police officers. Also, Tulfo cited the case of John Francis Ompad who was killed by Police Corporal Arnulfo Sabillo from the PNP Rodriguez, Rizal last 20 August while conducting an “Oplan Sita” — a police checkpoint. Ompad allegedly refused to show driving documents and ran away from the checkpoint, prompting Sabillo to chase the rider and shoot him. “The aforementioned two incidents happened within the same month; and just weeks after the death of Jerhode Jemboy Baltazar who was killed by PNP Police Operatives from Navotas under a claim of mistaken identity,” Tulfo wrote in his resolution. “The operation was found to have had several irregularities and non-compliance with the PNP Police Operations Procedure,” he added. Tulfo stressed that the protection of human rights remains a “fundamental principle” enshrined in the Constitution. He further pressed the need for the police officers to strictly observe their Police Operations Procedure and to ensure strict application of the internal discipline of the PNP. Las Piñas man collared for child abuse
A joint operation by the Station Intelligence Section and the Women and Children Protection Desk of the Las Piñas City Police Station led to the arrest of the most wanted man in the city for August. The suspect, identified as Edward Treyes, alias Negro, 22, was nabbed along Madrigal Compound in Barangay Daniel Fajardo at around 7:30 p.m. on Friday. Treyes was apprehended based on a warrant of arrest for violation of Republic Act 7610, or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. The warrant was issued by Judge Elizabeth Yu Guray of Regional Trial Court Branch 202 of Las Piñas City on 11 June 2023. The recommended bail was set by Judge Guray at P200,000. Treyes was detained at the Station Custodial Facility in Las Piñas City. The police did not report what kind of abuse the suspect was being charged with. RA 7610 is a law that seeks to protect children from abuse, exploitation and discrimination. It defines child abuse as “the maltreatment, whether habitual or not, of a child by any person who has care or custody of the child, under circumstances which could produce physical, emotional or sexual harm.” The law also prohibits the exploitation of children in any form, including child labor, child prostitution and child pornography. Taytay most wanted netted
A most wanted person for the crime of rape and child abuse was collared by the police in Taytay, Rizal on Wednesday evening. The suspect — identified as Fredrick Vincent Fulugan, alias Vince — was nabbed by virtue of a warrant of arrest along Block 7, Lupang Arenda, Barangay Sta. Ana, Taytay at about 11:20 p.m. Fulugan is facing charges for two counts of statutory rape and child abuse with no bail recommended for allegedly raping a minor and is temporarily detained at the Taytay Municipal Police Station custodial facility for proper disposition and documentation. Aftermath of Heidi’s falsehood
On 2 April 2011, Commissioner-nominee of the Commission on Audit, Heidi Mendoza, was bypassed for the third time by the Commission on Appointments based on my opposition. With all due respect, I informed the President that official records revealed Mendoza’s questionable integrity, incompetence, and unfitness to hold the position. Against my request, President Noynoy Aquino reappointed Heidi Mendoza. Her whims and caprices and those of her tandem, Grace Pulido Tan, bloomed into their impunity of abuse. This episode today was selected from among the countless distressing stories derived from the aftermath of Heidi Mendoza’s falsehood. The illegal dismissal of Special Prosecutor Wendell Sulit by President Aquino was one of the worst miscarriages of justice in the country. Here are the arguments and lamentations against the injustice. Sulit should not have been held liable in relation to the plea bargaining agreement or PBA with former AFP comptroller, retired Maj. Gen. Carlos Garcia. Here is how injustice happens: The Office of the President did not have jurisdiction over Sulit; Sulit was not a presidential appointee at the time she signed the PBA. Legally, she was only a Deputy Special Prosecutor and was merely designated by former Ombudsman Merceditas Gutierrez as the OIC of the Office of the Special Prosecutor or OSP. She affixed her signature to the PBA because it was the prescribed office protocol vis-à-vis the hierarchy of officials in the office and it just so happened that she was the one designated as the OIC; The PBA was signed on 26 February 2010, while Sulit was appointed Special Prosecutor only on 10 March 2010; Sulit was never a part of the prosecution team that handled the plunder case of Garcia. The original panel of prosecutors that handled the plunder case was headed by then Ombudsman Simeon Marcelo, together with then Special Prosecutor Dennis Villa-Ignacio, Deputy Special Prosecutor Robert Kallos, Deputy Special Prosecutor Humphrey Monteroso, Director Cornelio Somido, and Director Elvira Chua; The Information was filed with the Sandiganbayan (Second Division) on 6 April 2005; Former Ombudsman Marcelo and former SP Villa-Ignacio actively participated in the pre-trial incidents (judicial determination of probable cause, motion to quash, hearing on the issuance of warrants of arrest) but after the arraignment (25 April 2006) of General Garcia they did not appear in the case anymore for unknown reasons; Wendell Sulit may not be faulted for allegedly failing and/or refusing to strengthen the plunder case against General Garcia because, in the first place, she was never part of the fact-finding investigation and evidence gathering; she was never part of the preliminary investigation; she had no participation in the preparation of the resolution indicting Garcia for plunder and was never part of the prosecution panel that handled the case with the Sandiganbayan; and Sulit was with the Office of the Special Prosecutor and once a case is filed with the Sandiganbayan, the special prosecutors are bound by the evidence attached to the case records assigned to them for prosecution with the Sandiganbayan. The special prosecutors may not insert or add additional pieces of evidence which were never part of the fact-finding preliminary investigation. However, notwithstanding this recognized limitation, and while already in the prosecution’s presentation of evidence stage, the prosecutors handling the case went out of their way to look for the suppliers or contractors who could testify before the Sandiganbayan that they gave commissions and kickbacks to General Garcia. The story of the Waco siege — from the lawyer who got inside
Blood had already been spilled during the armed standoff between US agents and the Branch Davidian cult in Waco, Texas, when lawyer Dick DeGuerin got a phone call. The worried mother of cult leader David Koresh said her son needed legal help. She hired DeGuerin. He was the first outsider to pass through the security cordon and enter the Mount Carmel compound, where the Davidians were holed up. DeGuerin came face to face with a badly wounded Koresh, and was in position to try to broker an end to the stalemate. Three decades later, as the story pours forth from the 82-year-old lawyer, he remains convinced that the 51-day siege could have ended peacefully without the deaths of nearly 80 people. DeGuerin's account strikes a chord in today's deeply polarized United States, where some see Waco as a symbol of government overreach. Even now, a memorial at the scene of those killed draws hundreds of visitors a month. When DeGuerin got the call from Koresh's mother, he knew that the case was of a "magnitude" beyond anything he'd ever faced. "I had handled some big cases, but nothing like this," DeGuerin recalled from his office in Houston. "The world was watching." The Branch Davidians were founded in 1959 as a splinter from the Seventh Day Adventist church. They believed in the imminent return of Jesus, and Koresh emerged as their charismatic leader in the 1980s. In 1993, the Bureau of Alcohol, Tobacco and Firearms (ATF) accused the group of stockpiling weapons, and obtained an arrest warrant for Koresh and a search warrant for the compound, where there were also allegations of child abuse. On February 28, ATF agents raided the complex, a gun battle erupted, several people died, and a tense weeks-long standoff set in. As he prepared to enter the compound in late March, DeGuerin thought he had worked out a deal with Texas Rangers law enforcement officers to manage Koresh's surrender. FBI agents took the lawyer close to the compound in the back of a tank, stopping about 100 yards away. "My handler said, 'Would you like some body armor?' I said, 'No, I'm not afraid of the Davidians... I just don't want you FBI snipers shooting at me.'" DeGuerin didn't know what to expect, but said he found Koresh, 33, to be intelligent and articulate, and could see he had gunshot wounds to his torso and wrist. Koresh was "very angry" at the siege by the FBI and ATF agents. DeGuerin saw it as his mission to get Koresh out of the compound and into court "without anybody else dying." "I told him, of course, that the law is the law and he had to obey the law even though it might conflict with his religious beliefs. He understood that," he said. As negotiations ground on, DeGuerin returned to the compound with another lawyer, Jack Zimmerman, who represented one of the other cult members. Patience was wearing thin, particularly among federal agents. "There were the negotiators that wanted it to end peacefully. And then there were the tactical people that just wanted to rush in and kill anybody and arrest him," DeGuerin said. "The tactical people won." As a final showdown loomed, DeGuerin sought to go back and make a final appeal for Koresh to surrender to authorities. But he was turned away. "This FBI agent told me, 'We don't need you anymore.'" On that day -- April 19, 1993 -- FBI agents in armored vehicles smashed into the compound buildings and pumped in tear gas. The causes of the subsequent fires are still disputed, but the compound burnt to the ground, claiming more than 70 lives, including some 20 children. Investigations cleared law enforcement of wrongdoing, but Waco became a rallying cry for Americans accusing their government of abuse of authority, and it spurred growth of militias across the country. In 1995, on the second anniversary of the raid, Timothy McVeigh, who had driven to Waco to witness the siege, carried out the Oklahoma City bombing killing 168 people. For DeGuerin, 30 years on, the lessons of Waco are clear. The federal agents had grown convinced that Koresh "was fooling them again" and would not surrender, he said. "They didn't wait.
