Japan will continue transparency about ALPS treated water release
The Daily Tribune recently published the opinion entitled “Releasing Fukushima water amid protests?” by Mr. Bernie V. Lopez, which worsens the misperception of Japan’s discharge plan. Therefore, I would like to provide explanations based on scientific evidence and facts as well as Japan’s efforts to take the measure in the most accountable and transparent manner. First of all, the water to be discharged is NOT “nuclear wastewater”.” It is “ALPS (advanced liquid processing system) treated water,” which has been sufficiently purified until the concentration of radioactive materials other than tritium is below the regulatory standard and then is further diluted before it is discharged. Tritium is a radioactive material that exists in nature, and can be found in rainwater and also in our bodies, but does not accumulate in the body. The reason for the discharge of ALPS-treated water is not a fear of the dangers of storing large amounts of nuclear wastewater but to restore life in Fukushima and achieve reconstruction. The Subcommittee on Handling ALPS Treated Water considered five options: geosphere injection, discharge into the sea, vapor release, hydrogen release, and underground burial. Of those methods, discharge into the sea was determined to be the best from a risk management perspective, because it has a proven track record in domestic and international nuclear facilities and is easy to monitor. Discharge of ALPS-treated water is an issue that cannot be postponed to construct new facilities to safely proceed with the decommissioning work, which will be more fully underway in the future. On 4 July 2023, The International Atomic Energy Agency or IAEA, the world’s authority on nuclear-related issues, published the Comprehensive Report on the Safety Review of the ALPS Treated Water at TEPCO’s Fukushima Daiichi Nuclear Power Station, which presents the findings of a nearly two-year review conducted by the IAEA and independent international experts based on scientific evidence. The report states that Japan’s plans to discharge the ALPS-treated water into the sea and associated activities are consistent with relevant international safety standards, and the discharge will have a negligible radiological impact on people and the environment. On 24 August 2023, the Fukushima Daiichi Nuclear Power Station, or FDNPS, initiated the discharge of ALPS-treated water to promote the reconstruction of Fukushima. Since the start of the discharge, it has been confirmed that the concentration of nuclides including tritium in seawater and marine products is far below the standards, which indicates that the discharge is safe as planned. Specifically, Japan is implementing three types of monitoring (monitoring of treated water in tanks, real-time monitoring of a wide range of nuclides, mainly tritium) with the involvement of the IAEA. If a problem is detected during this monitoring process such as detecting radioactivity levels exceeding standards, appropriate measures will be taken, including immediate suspension of the discharge. In more detail, we will manage the annual discharge volume of tritium so it will not exceed 22 trillion Bq, which is equivalent to the target discharge management value for the Fukushima Daiichi Nuclear Power Station before the accident. It is worth noting that other countries also discharge tritium into the sea in compliance with their domestic laws and regulations; for instance, according to the China Nuclear Energy Association website, China, discharging 112 trillion Bequerel, or Bq, from Yangjiang Nuclear Power Plant , 102 trillion Bq from Ningde NPP, 90 trillion Bq from Hongyanhe NPP in 2021. The amount of tritium in the ALPS-treated water is far smaller than the amount of tritium discharged from many nuclear power plants and other facilities in other countries. Consultations with stakeholders Furthermore, the aforementioned article states that “Japan planned the release unilaterally — no transparency, no consensus. They never made an effort for international awareness and inspection.” However, the fact is that Japan has provided information and has engaged in consultations with the interested parties including both international and domestic ones in a transparent manner based on scientific evidence, with an emphasis on providing sufficient data. In addition, Prime Minister Fumio Kishida has emphasized that every possible measure would be taken to ensure the safety of discharge and that any emission that would harm the health of citizens or the marine environment would not occur. He also explained Japan’s efforts regarding the discharge of ALPS-treated water at ASEAN-related Summit Meetings in Jakarta on September 6 and 7 and the G20 New Delhi Summit on September 9 and 10, which led to a wider and deeper understanding of our approach. The positive recognition and support in the international community for Japan’s efforts and its commitments are currently spreading. Many countries including the U.S., Australia, and NZ officially welcomed the IAEA’s Comprehensive Report, and also Prime Minister of the Cook Islands, as Chair of the Pacific Islands Forum (PIF) acknowledged Japan’s efforts. Recently, on the margin of the Japan-ASEAN Summit Meetings, H.E. Mr. Joko Widodo, President of the Republic of Indonesia expressed his understanding of Japan’s position. In addition, on the margin of the G20 New Delhi Summit, H.E. Mr. Recep Tayyip ERDOGAN, President of the Republic of Türkiye said that he is aware of Japan’s sincere efforts, and H.E. Mr. Mark RUTTE, Prime Minister and Minister of General Affairs of the Kingdom of the Netherlands expressed his full support to Japan’s approach. Therefore, the author’s claim that Japan had “no transparency, no consensus” is inaccurate. As the author correctly stated, “Secrecy will be Japan’s enemy” and Japan has been and will prioritize our transparency. At the end of the day, all the questions should be left to scientists and experts on nuclear issues, to draw a conclusion that can stand the test of scientific evidence and facts. Having gone through unprecedented hardships since the Great East Japan Earthquake, we remain committed to facing the most difficult challenges with complete transparency in close collaboration with the IAEA. After the start of discharge into the sea, Japan will continue to conduct three types of monitoring in a multilayered manner with the involvement of the IAEA. We hope to gain the understanding and support of the international community. The government of Japan will continue to provide the necessary information transparently based on the conclusion of the comprehensive report and will continue efforts to gain further understanding from the international community, while scientifically refuting politically motivated opinions. Circular Explorer boosts Manila Bay rehab
A solar-powered, marine waste-removing vessel has removed and recycled 600,000 tons of plastic waste from Manila Bay from January, when it started its cleanup of the polluted body of water, to June. On 10 September, the Circular Explorer also collected 18,415 kilograms of waste, including 7,965 kilograms of plastics, in 3.84 million square meters of the bay. With the significant accomplishment of the Circular Explorer, which is operated by the Holcim Group and One Earth-One Ocean, a partnership with the Department of Environment and Natural Resources is now in the works to align the vessel’s activities with the agency’s Manila Bay rehabilitation program. “We are proud to see the Circular Explorer in action and responding to the enormous challenge of marine pollution. The vessel also plays a key role in amplifying our message on the importance of circularity to preserve natural resources and minimize waste,” Holcim Philippines president and CEO Horia Adrian said. “With the first months of cleanup operations, a vision has become reality. We are now actively helping clean Manila Bay with this unique prototype vessel,” OEOO Circular Explorer project manager Daniel Scheler said. The Philippine Coast Guard Marine Environmental Protection Command participate in the Circular Explorer’s daily cleanup of the bay. The vessel has special sensors for collecting data on marine microplastics, huge concentrations of which endanger aquatic life. The gathered information is shared with the University of the Philippines Marine Science Institute, which is studying waste management and aquatic conservation strategies. The vessel is also spreading awareness on the importance of a circular economy through an education campaign with the advocacy organization Asia Society for Social Improvement and Sustainable Transformation. “I am stoked to see even more important milestones coming up soon, as we are about to take the next exciting steps toward consolidating our Education and Scientific pillars,” according to Scheler. Iloilo International Airport receives ISO Certification
The Iloilo International Airport received an official certification for its Environmental Management System (ISO 14001) awarded by the Civil Aviation Authority of the Philippines together with the Local Government Unit of Iloilo, the European Aviation Safety Agency, and a certification body from Bureau Veritas. The awarding ceremony was held at the airport’s departure area and was attended by CAAP officials and representatives from the Iloilo LGU, EASA and Bureau Veritas. According to the “Plan, Do, Check, and Act” method of environmental regulation compliance, ISO 14001 outlines the requirements for an Environmental Management System. It lays out a framework that a business or organization may use. In addition to these benefits, it aids businesses in increasing resource efficiency and reducing waste, giving them a competitive edge and the confidence of stakeholders. Iloilo International Airport received the accreditation on 31 May 2023, and it is a mark of distinction given to organizations that have guaranteed that their environmental impact is being measured and improved. On 7 July 2020, the airport’s journey towards accreditation started, and an Environmental Management Team was established to concentrate on this objective. Several EMS efforts were carried out to raise awareness and disseminate information among the partner agencies, stakeholders, and workers of the airport to get ready for the assessment of ISO 14001 compliance. These initiatives were intended to guarantee that the community around the Iloilo International Airport had a thorough awareness of EMS. The airport went through two audit stages on 6 January and 2-3 February, respectively, to achieve the “recommended” status for certification. Skating out of stress, to feel free
Since the first patent for a roller skate was awarded in 1819 to a certain M. Petibled of Paris, roller skating has gone through a lot of development before evolving into what we know it now as a recreational and competitive sport. While sports such as speed skating, hockey and figure skating have been institutionalized, recreational roller skating has had its time in the spotlight over the years. Then Covid-19 happened in early 2020, and roller skating became popular again as a solo activity. Its resurgence continues post-pandemic for fitness and just for fun. [caption id="attachment_175690" align="aligncenter" width="525"] Skating is good for fitness. | Photographs Courtesy of Chai Timbungco[/caption] Skating to destress Sesilya Rosario Timbungco, nicknamed Chai, started skating using inline skates (meaning the wheels are in a straight line) with her older cousins when she was around seven years old. Then she studied figure skating for two years, starting at age nine, before moving on to other things. In 2020, she picked up inlines again because “ironically, it was safer to be out on the streets because there were almost zero cars” at the height of community lockdowns and social restrictions. “What I like about skating is that it makes me feel good about myself,” she tells DAILY TRIBUNE in an online interview. “It’s also an outlet for me because it allows me to physically destress. From a technical standpoint, I like skating because of the diverse disciplines under its umbrella -- ice skating, dance skating, derby, quad hockey, speed, park, vert, etc.” The 31-year-old skater, who works as an insights community manager at a software company adds, “Skating is good for fitness because it involves the coordination of your entire body, even if it doesn’t seem like it. It’s all about balance, especially when learning your edges! Once you nail the basics, you pretty much won’t forget how to do it — just like riding a bike.” “It’s a good fitness option, but like with all other sports, make sure it is safe for you,” she points out. “Generally, skating is for everyone. But if you have balance issues, are pregnant or have bad hip mobility, it’s best to consult your doctor.” Chai makes it clear that skating is a sport, even if you do it recreationally or as a hobby. “So there will be maintenance expenses,” she says. “If you don’t get any upgrades and sticks with a decent pair, maintenance won’t be that expensive. A good entry-level pair costs around P5,000 to P8,000. There are many other factors to consider, but that’s the base price for entry-level skates.” These days, she usually skates at the basketball court at their home, though she really misses skating outdoors. She considers Bonifacio Global City as one of the friendlier spaces for skating. If she has to go to the rink, she says she only goes to Rolyo Sk8house at the Circuit Makati. Chai is also a co-founder of the Everywhere We Skate PH community on Facebook, whose goal is to “help raise awareness about local roller skating and make skating accessible in all ways, little ways, that we can,” while “bringing in roller skating brands into the local scene.” Chai’s tips in buying your first pair of skates: Measure your feet. Measure in inches and in centimeters. Never ever correlate shoe size with skate size. Skates have to be snug, but not tight. If you’re in between sizes, always choose the bigger size. There will be workarounds to a slightly loose boot, but it’s impossible for you to use skates that are too small Buy good brands, even if it means buying them second hand. That doesn’t mean branded is always good, nope. Make sure you research before buying anything! There are reputable brands that make nice skates that are good enough as second-hands. If that isn’t an option, make sure you buy skates that are within your current skill level. For example, buying an advanced boot is not the best for a beginner who doesn’t have proper foundation yet. Try them out at the rink first (if you can) before deciding on a big purchase like our own skates. Make sure you learn how to read wheel hardness (it’s not hard), as well as the other components of your skates. Other than looking up what to buy, also learn about maintenance and how to make normal adjustments to your skate. When skating for the first time, Chai recommends doing these steps: Bend your knees. “I can’t stress this enough, but bend your knees,” she says emphatically. “It’ll save you from potential nasty falls!” Wear gear. Avoid slopes. “It’s a common misconception that slopes are good for beginners because they’ll help you roll faster. That’s true, but that’s why it’s dangerous for someone who doesn’t know how to stop yet.” Feeling of freedom Roller skating was likewise a childhood hobby for Raqs Regalado, a 39-year-old event manager and costume designer. “But it was during the pandemic that I fell back into it,” she says in another online interview, “Because I found my old pair of skates (that I got at a Japanese thrift shop back in college) while we were trying to Marie Kondo our place during the first few weeks of the lockdown.” Post-pandemic, Raqs can usually be found skating at the Bike Playground or at other indoor rinks around the Metro, and for outdoor skating, at BGC. “What I like about it most is the feeling of freedom it gives me and the friends I’ve made in this hobby,” she points out. “It’s good for fitness because it activates muscles you never even knew existed. Like it’s a whole different muscle group working when you skate.” “There are cheap, generic ones but cheap skates also mean cheaper materials were used,” she adds. “Skates manufactured by bigger, skate-focused brands will always be more expensive than the generic ones, but I think of it as investing on the quality of skates you’re getting. Your safety depends on it.” Raqs truly believes that everybody can skate. “But I wouldn’t force it on someone who does not want to. You have to at least be interested to try it and eventually find happiness in it. Once you find joy in skating, that’s when you start wanting to learn more.” She has found her kindred spirits on Everywhere We Skate PH when it was founded in 2020: “Chai reached out to me and told me about the online skating community they’ve build. Of course, I instantly joined. There were only about 50 members that time. A few months in, and they asked me to be one of the group admins. Now, we have over 10,000 members. We welcome skaters of all levels and skate enthusiasts. Our main goal is to have a safe space for healthy exchanges of skate-related information.” Raqs’ tips in buying your first pair of skates: Assuming that you’ve already tried rental skates at the public rink, and you really liked it and want to get into skating, then start doing your research on the particular skates that have aesthetically caught your attention. Check for materials used, reviews and after-sales services. If you can also determine what type of skating you want to immerse yourself in (such as outdoor cruising, aggressive skating, artistic skating, etc.), that would also be very helpful in choosing your first pair of skates. NYC activities above board — chairman
National Youth Commission chairman Ronald Cardema defended the agency's annual hosting of Sangguniang Kabataan summits and trainings which were flagged by the Commission on Audit, pointing to Kabataan Partylist Representative Raoul Manuel as the one besmirching his office. In an interview with the Daily Tribune at the NYC office in Quezon City, Cardema said newspaper reports (not in this paper) failed to mention that not a single "disallowance" was made. In its annual audit report on the NYC for 2022, the COA noted the agency’s “excessive payment of hotel room reservations,” as well as the local accounts of NYC showed that its training expenses amounted to P31.4 million while travel expenses reached P5.43 million. The COA said that the NYC’s local travel expenses jumped by 321 percent from P1.29 million in 2021 to P5.43 million in 2022. Training expenses, on the other hand, surged by 575 percent from P4.65 million to P31.4 million during the same period. "Of course, it would jump. From pandemic period which we are barred from holding such, it will surely ballooned because we never hold those trainings during that period," Cardema explained. He added that they are mandated to hold SK trainings, sometimes called "summit", to prepare the young officials for their positions. An annual budget of P50 million is allotted for this purpose, and according to Cardema, there are over 42,000 barangays around the country that have the same number of SK officials composed also of a chairman and seven kagawads (local councilors). "Di nga namin makumpletong bigyan lahat ng training sa dami (We can't even complete their entire number to train)," Cardema said, noting that some SK chairmen are also considered government officials for being the SK Federation president, heading the entire city or province's SK members and sit as a member of the city council or provincial boards. "Local officials na din ang turing sa kanila (They are considered local officials already). Sometimes they brought along with them a team (photographer, staff, and even families) and would not want to be booked at the hotel we contracted because of these factors. So they would instead pay for their own, in a much expensive hotel," the NYC official further explained. For this reason, Cardema added we're acceptable to COA. "That is why we have 'zero' disallowance (in that report)." He blamed Manuel for insinuating the NYC's alleged overspending, as he always hurled some criticism to the Makabayan Bloc in Congress which Kabataan Partylist is a member, for failing to condemn the Communist Party of the Philippines, New People's Army, and National Democratic Front. Training the SK officials, the NYC chairman said, is a hard thing to do, especially for a commission composed of only 150 personnel including him. "My travel allowance is only P500,000, that sometimes requires me to go to regions and provinces. One time I was made to attend an Asian youth forum, half of that travel allowance was spent already. How are the others, which I have to attend?," Cardema asked. The NYC is the government's sole policy-making body on youth affairs but also coordinates and implements programs designed to respond to and raise awareness on youth issues. Its mandate is enshrined in the 1987 Philippine Constitution, to wit: "The State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being. The Information Age started at the beginning of the 21st century, and the world evolved to an easier way to connect and communicate with people all over the globe. Information is being used in different ways to gain knowledge and to adapt to the era of globalization. As globalization makes its mark, cyberspace is being used as a platform to protect the interests of each state. The Philippine Army is embracing these changes to keep pace with modernization. The path began in 2012 when the AFP embraced cyberspace as a functional domain of operation and acknowledged cyberspace as an essential tool to counter threats to the rapid growth of technology. In 2016, the Philippine Army created the Cyber Management Branch to facilitate the cyberspace operations of the Army. After a few years of adjustment, the Army formed it’s Cyber Battalion (Provisional) on 16 October 2020. Today, for the Cyber Battalion’s initiatives and efforts to accomplish its tasks, the Digital Innovations Community presents The Outstanding Cybersecurity Initiative 2023 Award in recognition of the unit’s robustness and effectiveness in cybersecurity measures, proactive threat detection and response, adherence to best practices and industry standards, and impact on preventing security breaches or mitigating risks. The Army also lauded the recognition given to its officers as they steer the unit to greater heights. FDA warns public vs glow-in-the-dark ‘lato-lato’
The Food and Drug Administration has warned the public against the purchase and use of unauthorized use of glow-in-the-dark “lato-lato” (clackers) toys with handles. In an advisory, the FDA said the glow-in-the-dark “lato-lato” toys, which are classified as toy and childcare article products, showed no valid Certification of Product Notification. The Certification of Product Notification is a requirement for companies to provide consumers with a better awareness of certain products, such as medical devices, cosmetic products, toys and childcare articles. “Pursuant to Book II, Article I, Section 1 (a) of the Rules and Regulations Implementing Republic Act No. 9711, otherwise known as the "Food and Drug Administration Act of 2009", the manufacture, importation, exportation, sale, offering for sale, distribution, transfer, non-consumer use, promotion, advertising, or sponsorship of any health product without the proper authorization from the FDA is prohibited,” the regulatory body said. According to the DFA, since the glow-in-the-dark “lato-lato” toy has not gone through the notification process of the FDA, the agency cannot assure its quality and safety. “The use of such violative product may pose health risks to consumers,” it said. The agency also warned the public that the glow-in-the-dark “lato-lato” toy, which is a ommon toy among young Filipino children, may pose hazards that come from ingredients that are not allowed to be part of toys and childcare article products. “The use of substandard and possibly adulterated toy and childcare article products may result to health risks including, but not limited to, endocrine disruption and reproductive or development effects; or may result to injury, choking or suffocation due to its small or broken parts,” it said. “In light of the foregoing, the public is advised not to purchase the aforementioned violative toy and childcare article product,” it added. Egypt clinic helps women reclaim bodies scarred by genital mutilation
Intissar was only 10 years old when she was forced to undergo genital mutilation, but 30 years later, one clinic is offering help for some of the millions of Egyptian women affected by the still-rampant practice. Intissar, a journalist who like other women cited here spoke under a pseudonym to protect her identity, recalls having spent 30 years "completely deprived of pleasure, without any connection to my body". Her story closely resembles that of millions of Egyptian women and girls who have gone through female genital mutilation (FGM) at a young age, despite state-sponsored efforts seeking to curtail the practice. But for three years, one clinic has sought to change the reality of many of these women. In 2020, surgeons Reham Awwad and Amr Seifeldin became the first to offer clitoral reconstruction surgery in Egypt through their clinic, Restore FGM. Surgery is "the last resort", Awwad told AFP in her Cairo clinic. A common first step in the clinic's treatment is psychosexual counseling coupled with plasma injections, which Awwad said "can reduce the need for surgery by 50 percent". The plasma injections allow for the regeneration of damaged tissue without subjecting women to new, invasive procedures. Nourhan, also using a pseudonym, described chronic pain and a severed sense of pleasure in the two decades since she underwent genital mutilation at 11. Now in her 30s, the suffering has given way to "completely new sensations", Nourhan told AFP eight months after going under the knife again for reconstruction surgery. But more than the physical effects, Nourhan said she finally felt "in charge of my body again". Holiday peak Intissar recounted the day that her grandmother took her -- with the consent of her parents, a doctor and a principal -- to perform the harmful practice. When she cried, her grandmother "would tell me this was for my own good, that I was better this way", she told AFP. Under the grandmother's care, she spent her summer vacation recovering. Now aged 40, the prospect of undergoing reconstructive surgery offers her renewed hope. Lobna Darwish, gender officer at the Egyptian Initiative for Personal Rights, urged "prevention campaigns in schools right before the holidays", citing seasonal peaks of FGM during those periods to allow time for recovery after the procedure. In Egypt, the Arab world's most populous country with a largely conservative society, 86 percent of ever-married women aged 15 to 49 have undergone FGM, according to the latest official figures from 2021. Most commonly, they are subjected to the partial or total removal of the clitoris and the labia minora, which according to the World Health Organization can cause pain, bleeding, infections, painful sexual intercourse and complications during childbirth. The practice -- misguidedly meant to reduce libido and preserve women's chastity -- has been illegal in Egypt since 2008, and is regularly condemned by both Muslim and Christian religious authorities. Yet it remains widespread, not only in Egypt but in multiple other African countries and beyond, often cutting across social classes. Egypt marks its national day for the elimination of FGM on June 14, and every year, government-sponsored TV advertisements list its dangers. While experts say the awareness campaigns have largely scared off parents from what they were told was a dangerous procedure performed by suspect midwives in rural backrooms, a rebranding has kept FGM alive. Parents began opting for what seemed like a safer option, with official figures now showing three-quarters of procedures in Egypt are done by doctors. Intissar, who has studied the practice, said it was being promoted for its "aesthetic" value. When Nourhan and her then eight-year-old sister were recovering, she recalled how the women in their family praised not just the religious and moral virtues of FGM, but how "it was better and cleaner". In reality, Intissar said, FGM aims "to disconnect women from their bodies and their pleasure". Self-discovery Egypt has regularly toughened penalties on both doctors and parents over FGM, but both Darwish and Awwad described an uphill battle against ignorance. "We need proper sex education in schools, and to raise awareness of the dedicated hotline" created in 2017, Darwish said. Awwad noted that "at no point... do doctors learn about reconstructive surgery". And women are scarcely given the chance to get to know their own bodies. At every first consultation, the surgeon gives her patients a mirror so they can look at their genitals -- often for the first time. Intissar was shocked and furious. "Up until that point, I thought they had only removed a small piece of skin. But then I found out they had taken the entire labia and part of the clitoris," she said, recalling how right then she had decided to reclaim her agency. But the decision takes time and money. Nourhan fundraised for a year to be able to afford the surgery, which costs 40,000 Egyptian pounds (around $1,300) -- 10 times the country's average monthly salary. "Authorities need to... offer reconstructive surgery in public hospitals," she argued. By working together, the CHR can provide the DoJ with vital information and evidence gathered during their investigations, facilitating the prosecution of human rights violators. This collaboration would streamline the process, ensuring that justice is served swiftly and comprehensively. Moreover, a collaboration between the CHR and the DoJ would strengthen the dissemination of human rights knowledge and awareness. The CHR possesses expertise in human rights education and advocacy, while the DoJ has a broad network and resources for public outreach. By pooling their efforts, these institutions can develop comprehensive public awareness campaigns to educate Filipinos about their rights and the avenues available for seeking justice. Through joint workshops, seminars, and publications, they can promote a culture of respect for human rights and empower individuals to take action against violations. Importantly, collaboration would also facilitate the sharing of best practices, knowledge, and expertise between the CHR and the DoJ. Both institutions have unique perspectives and experiences in addressing human rights challenges. New Legazpi mayor ‘victim’ of election violation
Recently-declared Legazpi City Mayor Atty. Alfredo Garbin Jr. on Monday commented on the decision by the Commission on Elections to disqualify his rival, Carmen Geraldine Rosal over a violation in the Omnibus Election Code. Garbin — who was the former Ako Bicol Partylist representative — stressed that he was a “victim” in Rosal’s reported violation of Section 68(a) of the OEC, “for giving money to influence. Induce or corrupt the voters.” This was in response to a “2-Day Tricycle Driver’s Cash Assistance Payout” by Rosal and her husband, disqualified then-governor Noel Rosal, which was reportedly posted on Facebook March last year. The petition was filed last year by Joseph San Juan Armogila, with Garbin as petition-intervenor. “Comelec said that this will not be tolerated as it will be susceptible to abuse, especially to incumbent officials. This is our way for the poll body to recognize our standing, our legal interest, to the issue of disqualification,” Garbin said. In its 4 May decision, the poll body said that their activity is a violation of Section 68(a) of the OEC, revising their October 2022 decision which previously ruled that she violated Section 261 (v) of the Code because Rosal was not holding public office at the time. Garbin was declared by Comelec as the new Legazpi City mayor, arguing that the activity by Rosal was already deemed ground for disqualification even before the polls. “Deeming that Mayor Rosal, disqualified as such should not have been a valid candidate in the first place, she should not have been voted on in the elections,” said Comelec spokesperson John Rex Laudiangco. “The Commission en banc ruled further that the voters are fully aware of this fact, with such awareness bounding on notoriety, but nonethless voted for her, knowing fully well of an impending disqualification and ineligibility,” he added. Rosal could still challenge the decision before the Supreme Court, but the poll body’s ruling will be final and executory five days after the ruling was promulgated.
