Lebanon court orders ex-car boss Ghosn out of Beirut home: official
A Lebanese judge has decided to evict former Nissan boss Carlos Ghosn from his luxury home, a judicial official said Saturday, four years after an investment firm accused him of "trespassing". Ghosn, who took up residency in the Beirut property after fleeing prosecution in Japan in 2019, appealed the ruling on Friday, the official added. A spokesperson for Ghosn confirmed he had appealed. Ghosn and his wife must "vacate the property... within a month", according to a copy of the decision seen by AFP and dated 16 October. The home with pink walls in the Lebanese capital's upscale Ashrafieh neighborhood is worth some $19 million and is registered to Lebanese company Phoinos Investment, the judicial official said, requesting anonymity as they were not authorized to speak to the media. Phoinos initiated the legal action in 2019 and has accused Ghosn of "trespassing on private property and living in the home without legal basis", the official added. According to the court document, Ghosn said the company was affiliated with Nissan and that "the property was purchased... for his residence, and there is a signed agreement with Nissan that grants him the right to reside" there. Ghosn occupied the home "according to a contractual relationship linking... Ghosn and Nissan", the decision said. However, the end of that relationship and the plaintiff's wish to retake the property invalidates "the legal basis" of his occupancy, it added. In a written statement to AFP, a Ghosn spokesperson said documents that had been unavailable for prior hearings in the cast would support his appeal. "He will now be able to present all the documents held up in Japan that he was unable to secure on time," the statement said. Ghosn, the former chairman and chief executive of the Renault-Nissan-Mitsubishi alliance, was arrested in Japan in November 2018 on suspicion of financial misconduct, before being sacked by Nissan's board in a unanimous decision. He jumped bail late the following year and made a dramatic escape from Japan hidden in an audio-equipment box, landing in Beirut, where he remains an international fugitive. Ghosn has always denied the charges against him, arguing they were cooked up by Nissan executives who opposed his attempts to more closely integrate the firm with French partner Renault. Japan and France have sought his arrest, but Lebanon does not extradite its citizens, and judicial authorities have slapped a travel ban on Ghosn, who holds Lebanese, French, and Brazilian nationality. Criminal case filed vs Pura Luka Vega
A criminal charge has been filed against Pura Luka Vega by the Kapisanan ng Social Media Broadcasters ng Pilipinas Inc. for their controversial “Ama Namin” performance posted on social media in July. Leo Alarte of the KSMBPI submitted their organization’s complaints to the Pasay City Prosecutor’s Office on Monday. The case filed by the group was in connection with violation of Article 133 of the Philippine Constitution, which talks about “offending religious feelings,” as well as Section 6 of Article 201 of the Revised Penal Code in relation to the Cybercrime Prevention Act of 2012. The group said the complaints were in relation to Pura’s controversial “Ama Namin” performance, which the group described as “pambabastos sa Panginoon.” The KSMBPI said they were hurt by Pura Luka Vega’s Ama Namin performance, especially since the Philippines is among the Christian countries of the world. To recall, Pura was arrested and was held under the custody of the Manila Police District Station 3 in Quiapo, Manila, after the devotees of the Black Nazarene, Hijos del Nazareno, filed a complaint. Pura was released after posting bail after three days of being incarcerated. He expressed surprise to be served the arrest warrant as they did not receive the subpoena summoning them to court. They said the document was delivered to another address. Pura also reiterated that their “Ama Namin” performance was not meant to be disrespectful to people of faith. 2 Koreans wanted for telecom, wire fraud arrested
Two fugitives were captured by the Bureau of Immigration (BI) after being sought by South Korea and the US for their involvement in fraud-related operations. BI Commissioner Norman Tansingco confirmed the arrests of the two South Korean fugitives, who were identified as Kwon Junyoung, 38, and Seok Jongmin, 48. The two were arrested last Saturday in Brgy. Cuayan, Angeles City, Pampanga, by the BI Fugitive Search Unit (BI-FSU) operatives. Tansingco said that the operation was conducted in collaboration with the South Korean authorities, government intelligence groups, and the Angeles City Police Station. According to the South Korean authorities, Kwon is wanted for telecommunications fraud in South Korea, while Seok is wanted in Texas for engaging in wire fraud, money laundering, and identity theft. The BI chief said that as the BI board of commissioners has already issued summary deportation orders against them, soon they will be deported to face the crime they committed. Tansingco added that their names were also placed on the bureau’s blacklist of undesirable aliens, so they are now banned from re-entering the Philippines, the BI chief added. According to information obtained from Interpol's National Central Bureau (NCB) in Manila, the Suwon District Court in Korea issued an arrest order for Kwon on 12 December 2019. Authorities claimed that Kwon was part of a telecom fraud syndicate operating in Dalian, China, that used voice phishing to call random victims. Based on reports, the callers impersonated investigators from the Seoul Central Prosecutor's Office in order to harass the victims and trick them into transferring money to the syndicate's accounts. In contrast, the NCB revealed that Seok is the subject of an arrest warrant issued by the US district court in Western Texas. He is accused of conspiring to commit wire fraud, three counts of wire fraud, conspiring to commit money laundering, and three counts of aggravated identity theft. Seok is accused of working with other suspects to gain access to the websites of the US Departments of Defence and Veterans Affairs using thousands of US military veterans' stolen personal identification information (PII), depriving the victims of their benefits. The BI-FSU also reported that Seok was arrested after posting bail at the Angeles City regional trial court, where he was charged with robbery and extortion, and will be transferred to the BI’s facility in Bicutan, Taguig. While Kwon will remain in the custody of the Angeles City police due to his ongoing local case, he will continue to be under the BI’s legal custody for deportation proceedings. CHR welcomes murder charges vs. cops linked to Jemboy Baltazar’s death
The Commission on Human Rights on Saturday welcomed the filing of murder charges against six police officers in connection with the “unjust killing” of 17-year-old Jerhode “Jemboy” Baltazar Navotas City in August. In a statement, the CHR likewise commended the Department of Justice for “conducting a comprehensive review” of Baltazar’s slay case, which has led to the decision to file murder charges against police officers allegedly involved in the killing. “This swift development on the case is an important step towards ensuring justice and accountability, especially as it involves law enforcement agents,” it said. The human rights body said the “senseless death” of Baltazar “underscored the importance of holding law enforcement agents” accountable for their actions to curb violations and abuses that breach fundamental rights. CHR firmly stressed that positions of authority, including law enforcers, “are not above the law. “Those who committed alleged violations must be held responsible considering that they made an oath to serve in accordance with the rules and standards required of police officers," it added. CHR hopes that the filing of murder charges against the suspects "will serve as a strong message that any alleged human rights violations by law enforcement officers will not be tolerated in our society.” “Aside from its crucial importance in delivering justice to Jemboy and his family, it can also help restore public trust in our law enforcement agencies,” it further stated. "The Commission also expects that the case amplifies the importance of abiding with established rules of operations that adhere to human rights-based policing to prevent violations that denigrate human rights, especially the utmost right to life.” CHR likewise urged the Philippine National Police to continue strengthening its programs and training “that will imbue its personnel with a renewed commitment to human rights practice” and values in the conduct of their duty. The commission said it will continue monitoring the case and provide support “in aid of ascertaining justice.” “As we mark this positive development, it is equally important to ensure continued commitment to due process, transparency, and accountability throughout the legal proceedings," it said. After the issuance of the warrant of arrest, the six police officers turned themselves into the Criminal Investigation and Detection Group in Lucena City in Quezon last Wednesday. They will be facing murder charges and are not entitled to bail. Eight policemen, including the six who were ordered arrested by the court, were dismissed due to serious grave neglect of duty. CIDG nabs 6 suspects in missing cockfighters case
The Criminal Investigation and Detection Group on Friday arrested six suspects in the case of missing 'sabungeros' (cockfighting enthusiasts) in Parañaque City, Philippine National Police chief Gen. Benjamin Acorda Jr. said on Friday. According to CIDG chief Maj. Gen. Brig. Gen. Romeo Caramat Jr., the CIDG Region 4A arrested Julie Patidongan alias Dondon, Mark Carlo Zabala, Roberto Matillano Jr., Johnny Consolacion, Virgilio Bayog and Gleer Codilla at around 1:45 p.m. at Jackielou Village and Fortunata Village, both in Parañaque City, based on the arrest warrant for kidnapping and serious illegal detention issued by Regional Trial Court NCJR Branch 40, Manila, dated 24 January 2023, with no bail recommended. Acorda said aside from the six suspects, two companions of the suspects identified as Melchor Neri and Victorino Diocoso were also arrested for obstruction of justice. “I hope that with the arrest of these suspects, those who were reportedly backing out as witnesses may reconsider their position, and I do believe the case is still strong. We have enough evidence to continue with the case,” Acorda said in a press briefing held at Camp Crame. Acorda said the CIDG created Special Investigation Task Group “Sabungero” on 24 January 2022 to focus on the reported missing sabungeros. Based on the agency's investigation, at least 34 sabungeros have been reported missing as of this date. “I would like to commend the CIDG for their unrelenting efforts that led to the arrest of the six suspects. We hope that their arrest will give assurance to the families that the PNP have not reneged on their commitment to pursue this case until justice is served,” said Acorda. The Department of Justice has offered a P6 million reward for any information on the arrest of the six suspects. Acorda said that because police officers are not allowed to receive rewards and this goes to the action agents, the informants who are instrumental in their arrest will receive the reward, with the hope that this will convince others to support the PNP in manhunt operations against other wanted persons. A separate case for kidnapping and serious illegal detention was also filed by CIDG in relation to the case of the missing master agent of online "sabong" Ricardo Lasco, who was reportedly abducted on 30 August 2021 in San Pablo, Laguna. So far, the criminal complaints filed by the CIDG in the Manila Arena case and the case of Lasco have been found by the courts to have probable cause, resulting in the indictment of respondents through the issuance of arrest warrants.
