‘Sinag’ and ‘Lupa’: Light that guides and land that nourishes
In late September 2019, the Cultural Center of the Philippines mounted the son et lumiere titled “Sinag: Festival of Radiance,” accompanied by a video projected on the façade of its iconic Brutalist Main Building, dancing fountain, performances and installations, as part of the celebration of the 50th anniversary of the establishment of one of the Philippines’ revered cultural institutions. The light show was staged again in the following years with different themes even during the imposed lockdowns in the first years of the coronavirus pandemic in 2020 and 2021, serving as beacon of hope during one of the most challenging times for the arts and culture sector. The “Sinag” light-and-sound show continued to be mounted this year, fast becoming a tradition for CCP, as it commemorated its 54th founding anniversary and signaled the sector’s embarking on the road to recovery. It also recognized the sector’s perseverance and determination to continue creating and healing with its theme, “Tuloy Ang Palabas”(The Show Continues).” This year, the Main Building has remained dark and silent as it closed down in January for a three-year rehabilitation and renovation, but it came alive again from 28 September to 1 October for “Sinag 2023: Tuloy Ang Palabas.” A short video was projected on the façade, showing snippets of productions, projects and performances in the past nine months, all held in different venues outside the Main Building. The main part was a spectacle of colors and moving patterns, conceptualized by CCP light designers Camille Balistoy, Danilo Villanueva, Louie Alcoran and Shantie De Roca. This was accompanied by music by Soundridemusic and Makai-symphony, spliced by Jerry Tria. Capping the show was a video showing CCP’s reach in the country, through a map created by Reily Villaruz, as well as glimpses of performances and projects in the planning, accompanied by Jed Balsamo’s “Rurok.” As the CCP Main Building highlighted art’s role as light giver, the park beside it, CCP Liwasang KaLIKHAsan, is venue for an exhibit of installations depicting popular creatures of Philippine folklore. [caption id="attachment_191675" align="aligncenter" width="525"] Kapre. | PhotoGRAPHS by Roel Hoang Manipon FOR THE DAILY TRIBUNE[/caption] The kapre, aswang and tikbalang often figure in horror stories told to children, but acclaimed artist Abdulmari “Toym” de Leon Imao, son of the late National Artist for visual arts Abdulmari Asia Imao, regarded them as nature guardians, thus the title “Tanod-Lupa.” “Tanod-Lupa” was first mounted in celebration of Earth Day on 22 April, but was brought back for the anniversary celebration, and it seems fitting for the Halloween and Christmas seasons. Imao was inspired by stories about these creatures, many of which most likely can be traced from pre-colonial times, during his childhood. “My mom is Kapampangan, and they have wonderful stories of mythology such as Apo Mallari god of Mount Pinatubo. My dad came from the South. He was a Tausug. Mindanao is also rich in stories. The Sarimanok itself is a mythical creature. My appreciation comes from a fascination from childhood and growing up with these stories and narratives from my parents,” he said. “I am very fascinated with tikbalang. There are some stories that tell that it is actually a friend. The tikbalang also has a masculine appearance, very heroic,” he added. Working together with lantern makers from San Fernando City, Pampanga, headed by Arvin Bondoc Quiwa, and using materials such welded steel, fiberglass, ropes and lanterns with LED lights, Imao reimagined the creatures to be cartoonish but still retaining some scary and mysterious qualities. The most prominent among Imao’s works is his large installation in the shape of the panolong, a decorative detail of the traditional house of the Meranaw people, and the sarimanok, a popular design motif of several Moro ethnic groups, frequently used by his father in his works. Women’s tennis returns to China after Peng Shuai boycott
Professional women's tennis tournaments return to China on Monday, less than two years after the WTA vowed to boycott the country out of concern for player Peng Shuai and risks to its players and staff. The WTA tournament opening Monday in the southern metropolis of Guangzhou will be the first in mainland China since 2019 -- and while no top-20 stars are expected to attend, it is set to attract plenty of attention. The WTA suspended activities in China in December 2021, when former world doubles number one Peng briefly disappeared after making -- and then withdrawing -- accusations of sexual assault against a senior Chinese leader. Saying the issue was "bigger than business", the tennis body insisted it would not hold events in China until Beijing guaranteed the safety of Peng. "Given the current state of affairs, I am also greatly concerned about the risks that all of our players and staff could face if we were to hold events in China," WTA chief Steve Simon said at the time. Peng published a long social media post in November 2021 saying she had been "forced" into sex during a years-long, on-and-off relationship with Zhang Gaoli, a married ex-vice premier of China 39 years her senior. She has since denied she accused anyone of sexual assault and described the situation as a "huge misunderstanding". Peng has not been seen outside China since the allegations were made. In April this year though, the WTA announced the resumption of tournaments, admitting its "principled stand... a powerful message to the world" had not been able "to bring about change". "It was, in my opinion, a complete capitulation, because it was pretty obvious to anyone who knows anything about China that China wasn't going to offer a free or fair investigation into the sexual assault claims," China-based sports expert Mark Dreyer told AFP. "I really do feel they've undone all that good will that they had gained by taking a principled stance." Dreyer added that the suspension had been largely symbolic as most international sporting events were put on hold during the pandemic under China's strict zero-Covid policy. - An economic choice - China is a crucial market for the WTA, given the quality of local infrastructure and investment as well as TV rights and sponsorship deals with mainland partners. "The choice to return is an economic one," Lionel Maltese, a former member of the executive committee of the French Tennis Federation, told AFP. "The income generated in China has a strong impact on the financing and income of all players." Before the pandemic, the WTA organized 10 tournaments in China each year -- with a total of $30 million in prize money -- out of more than 60 tournaments globally. These included the WTA Finals in Shenzhen, which in 2019 offered the largest tennis prize in history: $4.4 million. China is also home to five players on the world's top 100 list. They include 20-year-old Zheng Qinwen, world number 22 and recent quarter-finalist at the US Open, and 21-year-old Wang Xinyu, this year's French Open women's doubles winner. These stars have boosted the popularity of tennis in China, along with the market's economic potential. "If you have enough big names, the money will come, the tournaments will come," Dreyer told AFP. - 'Convictions' - The headliners in Guangzhou are likely to be world number 24 Magda Linette from Poland and Romania's Sorana Cirstea, currently world number 26. It is unclear if any players will be vocal about Peng, with Maltese saying there was "no leadership among players on ethical issues". "Very few athletes are taking a stand," he said. But France's Alize Cornet, ranked 99th globally, announced this week she would skip the tournament. "Staying true to my convictions and careful about my health, I decided that I will not be playing in China this year," she wrote on social media. Peng herself could make an appearance. ‘Margaritaville’s’ Jimmy Buffett, 76
“Margaritaville” singer-songwriter Jimmy Buffett has died on 1 September at his home in Sag Harbor, New York. He was 76. A statement from his official website reads: “Jimmy passed away peacefully on the night of September 1st surrounded by his family, friends, music and dogs. He lived his life like a song till the very last breath and will be missed beyond measure by so many.” Buffett succumbed to Merkel cell skin cancer to which he was diagnosed four years ago. “He continued to perform during treatment,” the statement said while playing his last show, a surprise appearance in Rhode Island, in early July. Buffett, whose real name is James William Buffett, was born on Christmas day in 1946 in Pascagoula, Mississippi, and grew up in Alabama. He earned a bachelor’s degree in history from the University of Southern Mississippi in 1969. He credited early years playing and singing in the streets and bars of New Orleans. Buffett’s recording career spans more than 50 years. His hits include “Margaritaville,” “Come Monday” and “It’s Five O’Clock Somewhere.” His fans call themselves “Parrot Heads.” He also wrote songs about his plane being shot at by Jamaican police (“Jamaica Mistaica”), getting lost in the Sahara Desert (“Buffet Hotel”) and smugglers he had known around the Florida Gulf Coast (“A Pirate Looks at 40”). Buffett also authored bestsellers on both the fiction and non-fiction lists of the New York Times Book Review. The bona fide business mogul put up diversified lifestyle brand businesses, such as Margaritaville hotels, restaurants and retirement communities, along with sidelines such as Land Shark beer. Buffett is survived by his wife of 46 years, Jane (Slagsvol) Buffett, his daughters Savannah Jane (Joshua) and Sarah Delaney, his son Cameron Marley (Lara), his grandson Marley Ray and devoted dogs Lola, Kingston, Pepper, Rosie, Ajax and Kody. French rugby star Haouas detained over domestic violence: lawyer
French rugby star Mohamed Haouas has been placed in police custody for alleged domestic violence, his lawyer Marc Gallix told AFP on Saturday. The 29-year-old married father of two who plays for Montpellier and has won 16 international caps was detained on Friday, Gallix said, confirming a report published earlier on Saturday by French sports daily L'Equipe. He was part of France's Six Nations squad this season, although he received a red card for headbutting on his only appearance, against Scotland, and was banned for the rest of the tournament. He is currently awaiting the verdict of a trial held in Montpellier this month for his role as "leader" in a brawl 10 years ago. Prosecutors have requested he receive a two-year suspended sentence with the court's decision due on 30 June, two months before the World Cup in France. In February 2022, Haouas received an 18-month suspended sentence for his part in a series of robberies in April 2014 and for receiving a stolen car. Haouas told his trial in Montpellier this month that "my aim is to never to return to court" and that he wanted to "turn the page on" mistakes made during his childhood. He has spent his entire playing career at Montpellier, but next season is switching to rival Top 14 side Clermont. Change of address information failure
If you are party to a case, it is vital that you inform the court where you want to receive its orders and decisions. Failure to do so might lead to disastrous consequences. Imagine losing the opportunity to file a motion for reconsideration solely because you did not inform the court about your change of address. Good if you won the case. At least there is nothing for you to ask the court to reconsider. But what if you lost? In Patrica Q. Austria-Carreon vs. Luis Emmanuel C. Carreon (G.R. 222908 promulgated on 6 December 2021), petitioner Patricia filed for a declaration of nullity of her marriage to her husband Luis. The trial court, after due proceedings, found the case meritorious and declared the parties’ marriage void. The State, through the Office of the Solicitor-General however, did not agree. It appealed the case to the Court of Appeals, which eventually decided the case in favor of the OSG’s argument. It reversed the trial court’s decision. The Court of Appeals after rendering said decision, furnished the parties a copy of the decision at their official addresses on record. Prior to the decision, however, petitioner Patricia’s counsel withdrew from the case. Said counsel requested the court that in lieu of his address, all orders of the court be furnished to Patricia at her own address. And accordingly, the appellate court did so. Unfortunately, petitioner Patricia, by the time the decision was sent to her address, no longer lived there. She, however, did not inform the court about her new address. The decision then became final and executory. Months ensued and Patricia asked her new counsel to check on the status of the case. Her new counsel found out there was already an entry of judgment, meaning the decision was no longer subject to reconsideration. Patricia argued in her motion for reconsideration that she never received the decision. Her argument did not merit the nod of the appellate court. Thus, the petitioner took the issue to the Supreme Court. This is the Highest Court’s pronouncement. “The records reveal that only petitioner could be faulted for her failure to receive a copy of the CA Decision. From the time of Atty. Bihis’ withdrawal of appearance as petitioner’s counsel on 12 September 2012, which was done with her conformity, until 12 January 2016, when petitioner’s new counsel filed a Formal Entry of Appearance with Motion for Reconsideration with the CA, the petitioner did not bother to secure the services of a new counsel. Worse, she transferred to another residence without informing the CA of her new address, which led to her failure to track the notices of the case. The records of the case also showed that the petitioner no longer filed the required appellee’s brief before the CA. The general rule is that where a party is represented by an attorney in an action or proceedings in a court of record, all required notices must be given to the attorney on record. The service of the court’s order upon any person other than counsel on record is not legally effective and binding upon the party, and it may not start the running of the corresponding reglementary period for the subsequent procedural steps that may be taken by the attorney. Here, there was no counsel of record at the time the CA rendered the assailed decision because the petitioner’s former counsel withdrew his appearance, with her conformity. As such, the CA sent all notices to the petitioner’s address on record. The notices were then returned unserved for the reason that the petitioner had ‘moved out.’ Indeed, petitioner cannot successfully invoke denial of due process in failing to receive the CA decision because of her own fault. Petitioner slept on her rights; first, by not securing the service of a new counsel after the withdrawal of representation by her former counsel with her conformity; and second, by not informing the CA of her new address. To countenance petitioner’s act would put a premium on negligence and encourage the non-termination of cases simply by not informing the courts of a new forwarding address.” See how devastating a simple mistake can do. Had she informed the court about her new address, she could have been informed right away about the court’s decision. More importantly, she could have done what was necessary; that is file a motion for reconsideration, within the period allowed by the rules. And had she done so, she may not have lost the fight. The filing of criminal charges against suspended Negros Oriental 3rd District Rep. Arnolfo “Arnie” A. Teves in the 4 March killings of Gov. Roel R. Degamo and nine other persons did not push through yesterday, 15 May, as earlier announced by Justice Secretary Jesus Crispin C. Remulla. Remulla said the charges against Teves will be filed “most probably on Wednesday,” 17 May, before the Department of Justice by the National Bureau of Investigation. The delay, Remulla said, was due to the suspects already in the custody of law enforcement agencies being represented by new lawyers. Before the appearance of the private lawyers, six persons surrendered to the military for their alleged involvement in the killings. They brought were provided counsel from the Public Attorney’s Office. Remulla expressed concern about the sudden representation by lawyers of those in government custody. “There’s a conspiracy and there are probably people with a lot of money operating within the conspiracy to be able to afford the lawyers they are now getting,” he said. “We suspect that they will change their statements later on and may make recantations of sorts,” Remulla added. Teves has been tagged as “one of the masterminds” in the killing of Degamo. The House suspended Teves as a legislator after he refused to return to the Philippines despite the expiration of his travel authority last 9 March. Joe Biden intensified his attacks Friday on President Donald Trump as they battled over the American Midwest, chasing every last vote with four days to go in a region that propelled the Republican to victory in 2016.
