Ex-employee questions BI chief’s appointment
The job of Immigration Commissioner Norman Garcera Tansingco may be in limbo following the revelation by a former bureau employee that Tansingco has a pending case before the Office of the Ombudsman. Based on a document obtained by DAILY TRIBUNE, Tansingco is among the respondents in a human smuggling complaint before the Office of the Ombudsman by former Bureau of Immigration Intelligence Division employee Richard de Leon Cabochan Jr. on 21 April 2015. “One of the respondents in the complaint is Atty. Norman Garcera Tansingco. Based on my records, the last pleading I filed in the case was a supplemental affidavit dated 24 June 2015. In addition, I also filed two other cases with your honorable office docketed as OMB CASE NO. IC-OC-14-1351° and OMB CASE NO. IC-0C-14-4768,” Cabochan told DAILY TRIBUNE when sought for comment. Cabochan was prompted to question Tansingco’s appointment through a letter addressed to Ombudsman Samuel Martires dated 19 September 2022, after a clearance was released by Maria Agnes L. Forteza, Graft Investigation Officer I, dated 1 September 2022. An Ombudsman clearance is a requirement for a Presidential appointee. Cabochan, in his letter, said Tansingco is not fit to be installed as BI commissioner because of his pending case before the Ombudsman. “To my displeasure, I came to know that Atty. Tansingco, a respondent in the abovementioned case, was the newly appointed commissioner of the BI. The said event had me surprised because it is my understanding that to be a confirmed appointee of a head of a government agency, one must possess a clean record or background as evidenced by various clearances issued by concerned government offices of the Republic of the Philippines,” Cabochan’s letter to Martirez read. Cabochan said Tansingco was able to fool Malacañang’s steering committee — the Presidential Management Staff — by saying that he was not involved in any criminal or administrative cases. “An investigation of the matter showed that Atty. Tansingco obtained a ‘clearance’ stating that he had no pending criminal or administrative cases with your honorable office. To reiterate, the same was issued last 1 September 2022,” Cabochan said. “I was surprised about this development, considering that it is to my knowledge that the complaint for the alleged human smuggling that I had filed is still being heard by your honorable office and has yet to be resolved, considering that I have yet to receive any document of the results of the proceedings conducted,” Cabochan letter to Martirez read. “Despite such fact, it appears from the abovementioned document that the case I had filed was already resolved without me, the complainant, being duly informed of the same,” he added. Not notified He further asked Martirez why the Ombudsman did not notify him that Tansingco was given a clearance by the Ombudsman, a clear violation of his right to the due process of law. “It is my understanding that this runs counter to the established procedures in the resolution of filed complaints in your honorable office wherein the parties should be duly informed of the results of the proceedings. I further understand that this right to be informed of the results of the proceedings is part of the due process of law as it would allow the parties to seek relief from the decision by filing the appropriate action in case they disagree with the outcome of the proceedings,” the letter said. California sues oil giants, alleging climate risks deception
The US state of California sued five of the world's largest oil companies on Friday, alleging the firms caused billions of dollars in damages and misled the public by minimizing the risks from fossil fuels, according to a court filing. It follows numerous other cases brought by US cities, counties, and states against fossil fuel interests over the impact of climate change as well as alleged disinformation campaigns spanning decades. The civil case was filed in a superior court in San Francisco against ExxonMobil, Shell, BP, ConocoPhillips, and Chevron, which is headquartered in California. The American Petroleum Institute, an industry group, is also a defendant in the case. "Oil and gas company executives have known for decades that reliance on fossil fuels would cause these catastrophic results, but they suppressed that information from the public and policymakers by actively pushing out disinformation on the topic," the 135-page complaint read. "Their deception caused a delayed societal response to global warming. And their misconduct has resulted in tremendous costs to people, property, and natural resources, which continue to unfold each day." The suit seeks the creation of an abatement fund to pay for future damages caused by climate disasters in California, which is on the front lines of climate change-fueled wildfires, flooding and other extreme weather phenomena. "By downplaying the scientific consensus on climate change and emphasizing uncertainty, Defendants hoped to delay any regulatory action that might seek to reduce or control (greenhouse gas) emissions, thereby threatening the industry's profits," the complaint added. Representatives of the defendants did not immediately reply to requests for comment from AFP. "For more than 50 years, Big Oil has been lying to us -- covering up the fact that they've long known how dangerous the fossil fuels they produce are for our planet," California Governor Gavin Newsom said in a statement on Friday. Barangay Captain accuser cries harassment, files grave coercion at Ombudsman
Days after she filed a graft case against Quezon City Barangay Kaligayahan Chairman Alfredo ‘Freddy’ Roxas, threats that something bad would happen to her kept pouring in her mobile phone and social media account. Aljean Abe, the village's former teaching aide went to the Office of the Ombudsman on Friday to file another Grave Coercion charge against Roxas in relation to Republic Act 3019 or the Anti-Graft and Corrupt Practices Act. Abe in her complaint furnished to Daily Tribune narrated that when she filed the graft charges on September 11, 2023, several messages were sent to her cellular phone by supporters of Roxas threatening to do harm to her. Abe averred that the threat messages came from Mark Roldan Santiago Sedilla and Jennilyn Guiling Montefalco both employees of Brgy. Kaligayahan and avid supporters of Roxas who is also an honorary councilor for being the president of League of Barangay Chairmen in the city. Fearing for her life and her family, Abe decided to transfer to a place where Roxas and his supporters could not reach her. However, the following day (September 12) she was surprised to see their barangay vehicle parked in front of her new address where Melanie Aviguetero, Jamaica Jallorica, and the unidentified man tried to take photos of her. The three are also employees of Brgy. Kaligayahan, according to Abe, informed her that she needed to go to their office and talk to Roxas. Two days after (September 14, 2023) Abe said she received a text message asking why she filed a graft case against Roxas. She was also asked if she needed monetary assistance from their barangay and if she wanted to be hired again as a barangay worker. If she agrees, she needs to go to their barangay to sign a contract and some documents in front of a lawyer. These things, Abe said prompted her to file the grave coercion charges against Roxas. Abe, and another barangay worker, Hernando Compedio filed charges of violating the Anti-Graft and Corrupt Practices Act against Roxas a couple of weeks ago upon learning that their names were still included in the barangay payroll list even after they had already been fired and resigned from their jobs. Other charges of graft practices were also filed by Barangay Kaligayahan Kagawad laban kay Punong Barangay Allan Francisco Jr. against Roxas over a resolution passed without the proper barangay council session. Roxas meanwhile, could not be reached to comment on the charges hurled against him. Ex-ally sues Monaco’s ruler in ‘Rock Files’ scandal
A former confidant of Monaco's ruler Prince Albert II is suing the monarch in an unprecedented and potentially damaging court case triggered by the release of leaks that have rocked the usually placid Mediterranean playground for the rich and famous. Claude Palmero was for over two decades in charge of managing the palace's assets, first for Albert's father Rainier III, the husband of the US actress Grace Kelly, and then their son Prince Albert when he became ruler in 2005. But now Palmero is asking for around one million euros ($1.1 million) in damages from the palace, according to a complaint seen by AFP, over losing his job after becoming embroiled along with other former senior palace officials in unverified allegations posted in the "Dossiers du Rocher" ("Rock Files", referring to Monaco by its nickname) website from 2021. The website hosted videos, confidential email conversations and hostile articles dealing with property development in the principality. The controversy has roughed up the usually calm waters around Monaco, a tiny principality surrounded by French territory which attracts ultra-rich residents –- like tennis star Novak Djokovic and formula 1 champion Lewis Hamilton -- due to its favourable tax regime. With a population of barely 40,000, Monaco neither imposes income nor wealth taxes. Among the material published by Dossiers du Rocher were email exchanges between four people close to Albert, including Palmero, accusing them of collusion in an alleged financial scam. As well as Palmero, Albert's chief of staff Laurent Anselmi also lost his job in June. 'From another age' In charge of the crown assets, Palmero was known as a Monegasque eminence grise, who was tasked with strategic issues including taking a stake in Nice's airport and buying property, as well as being a keeper of palace secrets. He lodged an appeal against his dismissal in the case before Monaco's constitutional court, known as the Supreme Tribunal, that his lawyer filed on 13 July. "No reason has ever been given to justify these decisions that come from another age and manifestly violate the principle of legality," said the complaint filed by one of his lawyers Pierre-Olivier Sur and seen by AFP. "Prince Albert II during his reign has congratulated himself in front of his subjects and the whole world that Monaco is a state of law. "Alas, there are circumstances where this principle is sadly forgotten by him and favour the violence of arbitrariness," it added. Palmero is seeking the condemnation of the prince to repair "the immense moral damage, injury and disruption to living conditions", claiming the one million euros and his reinstatement. Albert's lawyer Jean-Michel Darrois said in response: "This is a discretionary decision by the royal house as is the case with several other monarchies." But the controversy is deeply unwelcome for Albert, who has already been under intense scrutiny over his marriage to Princess Charlene, the former South African Olympic swimmer in 2011, in French and international media in recent months. Charlene only returned to Monaco in March 2022 after a months-long absence for medical treatment. Raids and infighting The case, which is set to be heard in the coming weeks, comes as judicial authorities launched a series of searches in mid-July at the four former confidants of the prince accused in the Dossiers du Rocher. All those involved deny the allegations put forward by the Dossiers du Rocher, which published their private correspondence and whose origins remain a mystery despite investigations by the French and Monaco authorities. Patrice Pastor, a Monegasque construction entrepreneur, has filed a complaint over alleged influence peddling against them. But while they suspect him of being behind the website the businessman strongly denies this. The purported motive of Pastor, whose group is worth up to 30 billion euros, is alleged by his enemies to have wanted to maintain control over lucrative real estate transactions in the principality, which Palmero and his allies sought to limit. According to official figures, 88 new apartments were sold in 2022 in Monaco, for a stratospheric total amount of 1.2 billion euros. The Pastor group is particularly involved in the Mareterra project, six hectares of luxurious buildings looking out to the Mediterranean. First reported by France's Le Monde daily, the searches targeted, in France and Monaco, the homes and offices of Claude Palmero, the law firm of Thierry Lacoste, childhood friend of the prince, Laurent Anselmi, and Didier Linotte, president of the Supreme Tribunal, who is about to leave office. Monaco's prosecutor general refused any comment. The four men do not deny being in touch with each other but insist it was to deal with regular business of Monaco. Two other men are also reported to be part of the group: former Monaco government chief Michel Roger, who is said to have formed it, was left a paraplegic after an accident in 2015. The sixth man was Jean-Francois Renucci, former head of the court of cassation in Monaco, who died in a car accident between Monaco and Nice in 2021 just as the Dossiers du Rocher scandal was erupting. GSK sues Pfizer over patents for RSV vaccine
GlaxoSmithKline sued Pfizer on Wednesday over patent infringement, alleging the US drugmaker's RSV vaccine steals key elements of the British company's version. The case, filed in federal court in the state of Delaware, pits the producers of the only two approved vaccines for respiratory syncytial virus against each other. The United States on May 3 approved GSK's Arexvy as the first vaccine for RSV; that was followed on May 31 with US approval of Pfizer's Abrysvo. Both vaccines have since been approved by the European Union. "Upon information and belief, Pfizer knowingly uses GSK's claimed inventions in Abrysvo without permission," said the GSK complaint. The complaint describes Arexvy as "the result of more than 15 years of research and development by GSK scientists," adding that Pfizer's program on an RSV vaccine began "no earlier than 2013." The lawsuit lists four GSK patents granted by US officials between 2013 and 2023 that Pfizer is alleged to have infringed. The suit seeks compensation for lost profits and royalties and a permanent ban on Pfizer selling the product in the United States. RSV is a widespread, highly contagious pathogen most known for causing bronchiolitis -- an irritation and inflammation of the small airways -- in young children, especially in winter. Popstar Lizzo named in employee harassment suit
US performer Lizzo has been sued by three of her former dancers who allege the body-positive pop diva created a hostile work environment, court filings seen by AFP showed Tuesday. The suit filed in Los Angeles accuses Lizzo, whose self-love message has resonated around the globe, as well as other defendants of various violations of California labor law. "Plaintiffs Arianna Davis, Crystal Williams and Noelle Rodriguez allege sexual, religious and racial harassment, disability discrimination, assault and false imprisonment, among other things," the law firm representing them said in a statement. "Davis and Williams were eventually fired while Rodriguez resigned over the appalling behavior," it added. One of the allegations centers around an Amsterdam red-light district sex show which the dancers say they felt pressured to attend. At the show Lizzo pressured her dancers to interact with the nude performers, the suit alleges. It also alleges that Lizzo's dance leader, Shirlene Quigley, frequently made sexual comments and proselytized her Christian beliefs, especially against pre-marital sex, "regardless of protestations." The dancers also say that there was an extended dispute over compensation between legs of Lizzo's global tour. The lawsuit alleges that white managers from Lizzo's production company, Big Grrrl Big Touring, Inc., which was also named in the complaint, "often accused the Black members of the dance team of being lazy, unprofessional, and having bad attitudes." "Not only do these words ring familiar as tropes used to disparage and discourage Black women from advocating for themselves, but the same accusations were not levied against dancers who are not Black," according to the complaint cited in the statement. "Only the dance cast -- comprised of full-figured women of color -- were ever spoken to in this manner, giving Plaintiffs the impression that these comments were charged with racial and fat-phobic animus," it added. Instagram ‘most important platform’ for child sex abuse networks: report
Instagram is the main platform used by pedophile networks to promote and sell content showing child sexual abuse, according to a report by Stanford University and the Wall Street Journal. "Large networks of accounts that appear to be operated by minors are openly advertising self-generated child sexual abuse material for sale," said researchers at the US university's Cyber Policy Center. "Instagram is currently the most important platform for these networks with features like recommendation algorithms and direct messaging that help connect buyers and sellers." According to the Journal, a simple search for sexually explicit keywords specifically referencing children leads to accounts that use these terms to advertise content showing sexual abuse of minors. The profiles often "claim to be driven by the children themselves and use overtly sexual pseudonyms", the article detailed. While not specifically saying they sell these images, the accounts do feature menus with options, including in some cases specific sex acts. Stanford researchers also spotted offers for videos with bestiality and self-harm. "At a certain price, children are available for in-person 'meetings'," the article continued. Meta, Instagram's parent company, did not immediately respond to a request for comment from AFP. According to the Journal, the social media giant acknowledged problems within its security services and said it had created a task force to address the issues raised. Last March, pension and investment funds filed a complaint against Meta for having "turned a blind eye" to human trafficking and child sex abuse images on its platforms. Lebanese ambassador in France accused of rape, violence
Lebanon's ambassador to France, Rami Adwan, has been investigated for rape and intentional violence following complaints by two former embassy employees, informed sources said Friday confirming a Mediapart report. A first woman, aged 31, filed her complaint in June 2022 for a rape she says was committed in May 2020 in the ambassador's private apartment. According to her deposition seen by AFP, she made clear her lack of interest in having sex and that she screamed and burst into tears. The woman, who was working as an editor, had already reported to police in 2020 that Adwan, in his post since 2017, had struck her during an argument in his office. She did not, however, file a complaint as she did not wish to "break the life of this man," married and a father. According to the complaint, she had a "loving relationship" with the ambassador who carried out "psychological and physical violence with daily humiliations". The second woman, aged 28, had for her part embarked on a relationship with the ambassador shortly after she arrived as an intern in 2018. She made a complaint last February following an alleged series of physical attacks she says resulted after she turned down sexual relations. The second woman claims Adwan tried to hit her with his car after an argument on the sidelines of last year's Normandy World Peace Forum. She further accused the ambassador of trying to strangle her at her home last December by pressing her face to her bed. "My client contests all accusations of aggression in any shape or form: verbal, moral, sexual," Adwan's lawyer Karim Beylouni told AFP. "Between 2018 and 2022, he had with these two women romantic relationships punctuated by arguments and breakups," Beylouni said. An informed source said the Paris judicial police had closed the case. French supermarket CEO detained in stock manipulation probe
The head of a top French supermarket chain was briefly taken into custody for questioning Thursday in an inquiry over stock price manipulation, insider trading, and corruption suspicions, a source close to the case said. Jean-Charles Naouri -- already under pressure to reduce debt at retailer Casino -- was held in Paris by judges probing links between the CEO and a populist financial journalist who has made several attempts at the French presidency. The alleged acts date to 2018 and 2019, the source told AFP, with judges investigating since 2020. Lawyers for Naouri did not respond to requests for comment. Sources familiar with the matter told AFP later Thursday that Naouri had been released without charges being brought against him at this stage. Investigators searched Casino's headquarters as well as Naouri's home in May 2022. According to the French daily Le Parisien, Casino paid more than 800,000 euros ($857,000) to several companies controlled by Nicolas Miguet, editor of financial newsletters who has sought the French presidency on an anti-tax platform. The French financial markets regulator AMF, which lodged the complaint, suspects that in exchange Miguet made "buy" recommendations on Casino shares in his various publications and statements. In a recent financial filing, Casino said the legal inquiry was based only on "an encounter with a former consultant to Casino" and denied the allegations. Priest arraignment postponed
A Quezon City court on Thursday moved the supposed arraignment of exorcist priest Fr. Winston Cabading to 1 August due to a pending appeal at the Department of Justice. Cabading was charged with offending religious feelings, as the case against him stemmed from the 2022 complaint filed by former Commissions Chief Harriet Demetriou after his statements on the authenticity of the 1948 Lipa Apparitions were quoted in a digital Catholic show. Demetriou, in her complaint, accused the priest of being a “rabid critic” of Mary and lambasted his comment that there exists a 1951 Lipa Diocesan Verdict that “negated the authenticity of the 1948 apparition of Our Lady, Mary, Mediatrix of All Grace.” He was supposed to undergo arraignment Thursday morning but the Quezon City Regional Trial Court Branch 81 rescheduled the arraignment of Cabading to 1 August at 8:30 a.m. The Court also allowed Cabading to travel abroad to visit his family but was required to post a travel bond twice the amount of his bail bond. On the other hand, the Catholic Bishops’ Conference of the Philippines, also issued a certificate of good standing for the priest last Wednesday. The certificate stated that Cabading “is a Dominican priest of good standing and is not under any censure or investigation by the CBCP.” The CBCP, for its part, has shouldered the blame over Cabading’s case, saying it may be due to the “shortcomings” of Church leaders. The Catholic Bishops’ Conference of the Philippines also issued a certificate of good standing for the priest last Wednesday. The certificate stated that Cabading “is a Dominican priest of good standing and is not under any censure or investigation by the CBCP." 13 more women accuse France’s Depardieu of sexual violence
Another 13 women have accused French actor Gerard Depardieu of sexual violence over two decades, investigative website Mediapart has reported, in the latest such allegations against him. The 74-year-old actor, long a star in France before the 1990 film "Green Card" made him a Hollywood celebrity, has through his lawyers categorically denied any wrongdoing. Contacted by AFP, the prosecutor's office on Wednesday said it had not received any new complaints, but that their investigation into 2018 accusations he had raped young French actress Charlotte Arnould was ongoing. Mediapart said Tuesday that 13 other women had also come forward to accuse Depardieu of molesting them on the set of 11 films or series that came out between 2004 and 2022 or in other locations offset. The accusations ranged from "a hand in underwear, on the crotch, on the buttocks or on the breasts" to "obscene sexual remarks" and "insistent grunts", Mediapart said. Even when this alleged abuse happened on set in front of witnesses, when the women complained, crews often laughed it off, saying it was just the actor's way, the investigative website reported. Rape allegation Actress Arnould filed her complaint in the summer of 2018 when she was 22, saying she had been raped twice by Depardieu in his Paris mansion a few days earlier. The actor -- a friend of Arnould's family -- was charged in December 2020 but not jailed. None of the 13 women have filed official complaints, Mediapart said, but three have given testimony to the judiciary. One of them said she did so "to help Charlotte Arnould" and break the silence on such incidents in the filmmaking sector. She told Mediapart she was an extra on the 2015 film "Big House" when Depardieu suddenly slipped his hand into her dress and she "felt his fingers trying to... reach my knickers". After she pushed it back, "he became aggressive. He tried to get past my underwear and finger me. I understood he was no longer acting. If I hadn't stopped him, he would have succeeded," she said. In 1991, Time magazine asked Depardieu about a 1978 interview in Film Comment magazine in which he described his rough childhood and was quoted as saying "I had plenty of rapes, too many to count". Asked if he had participated in the rapes, he told Time that he had. "But it was absolutely normal in those circumstances," the actor said. Depardieu later denied making the remarks and threatened to sue the magazine, but Time refused to retract the passage, saying the interview had been recorded on tape.
