Many barangay posts in BARMM uncontested
As the October barangay and Sangguniang Kabataan elections draw near, we wrote about the apprehension of the authorities over the conduct of the elections in the Bangsamoro Autonomous Region in Muslim Mindanao or BARMM. The Philippine National Police has statistics on several towns flagged as possible election “hot spots.” In fact, they have asked for a postponement of the elections in those areas, but the Commission denied this despite documented incidents of election-related violence. But just as there are conflict areas, there are an almost equal number of barangays where peace is expected to prevail. There will be no contest in those barangays as the candidates will run unopposed. While this could taint the democratic process as the right of citizens to choose their leaders will be somehow restricted, it is still a welcome development. How does this work? This needs the intervention of the patriarchs of families, the elders of the village, and city or town executives. What is essential is to resort to what local tribes (among Maranaws) call “musawarah,” which is Arabic in origin, and “musyawarah,” which is the Malay word for consultation or dialogue. Contending candidates engage in dialogue to find common ground for agreement to avoid a socially, financially, and politically costly election. In the case of a barangay where one family numerically dominates, they choose by rotation from among the siblings or family leaders who will be the Punong Barangay. The other positions, like barangay councilor or kagawad, secretary, treasurer, etc., are equally divided among themselves. And there is an equitable distribution of the salaries and whatever largesse the barangay will receive from the government and local projects. In contested barangays, the town mayor offers a hefty sum to the party running against his chosen candidate and promises a monthly allowance and other assistance. By buying off the different bets, the mayor gets the full support of the barangay, with the Punong Barangay acting as his political operator when the mayoral elections come around. Experience tells us that the mayor, supported by most Punong Barangays, gets to perpetuate his dynastic family in power. This is also one way of settling “rido” or family feuds that are a side issue during elections. Through back channeling and having a common candidate and slate, families that for years were involved in “rido” are open to reconciliation. A Rappler report said about “149 barangays in Maguindanao del Sur’s 24 towns have unopposed bets for barangay chair.” And local leaders are still negotiating to have more unopposed candidates in more barangays. According to local leaders, this scheme is resorted to not necessarily for partisan considerations but for peace because election rivalries are the common cause of “rido.” This is happening also in Marawi City, Lanao del Sur and many other BARMM barangays. Through the efforts of provincial governors and city and town mayors, several barangays have candidates running unchallenged in October. Democrats might find this an assault on the freedom of the people to choose their leaders. They will claim that politicians manipulate the people to surrender their fundamental rights as citizens to perpetuate themselves in power and protect their dynasties. But what good is democracy if we have conflict and instability in the villages and one cannot sleep at night for fear of violence? In weighing which interest is preponderant — peace or freedom — pacifists will go for the former. Metro anti-crime drive nets 149 in 5 days
The Philippine National Police on Tuesday said that 149 were arrested during a five-day anti-illegal drug operation in Metro Manila from 7 to 11 August. In a statement on Tuesday, National Capital Region Police Office chief Brig. Gen. Jose Melencio Nartatez said that a total of 252 operations were conducted across the five districts resulting in the arrest of 149 individuals involved in various illicit drug-related activities and seizing the value of the confiscated contraband, including shabu, marijuana, and ecstasy estimated at P6,436,311.60. The five districts covered by the NCRPO are the Manila Police District, Quezon City Police District, Northern Police District, Southern Police District, and Eastern Police District. The NPD carried out 20 operations during this time frame, leading to the apprehension of 23 suspects and confiscated contraband had an estimated Dangerous Drugs Board value of P 525,257.20 while the EPD engaged in 29 operations that resulted in the arrest of 44 individuals while the value of the confiscated illegal substances reached P882,524.00. The MPD executed 22 operations, successfully apprehending 52 suspects with a combined DDB value of P1,038,564 worth of seized items while the SPD conducted 41 operations, leading to the arrest of 62 individuals and the total DDB value of confiscated substances stood at P957,586. P1.59-M marijuana, shabu seized in 1 week
The relentless anti-drug campaign by operatives of the Southern Police District, headed by Brig. Gen. Roderick Mariano, netted a big number of drug personalities and confiscated P1.59 million worth of illegal drugs. A total of 76 drug suspects was arrested and millions worth of illegal drugs seized from 7 to 13 August. The report showed, the illegal drugs confiscated consisted of 504.02 grams of marijuana and 225.78 grams of shabu. A total of 87 persons were also arrested for illegal gambling with P14,476.75 in bet money confiscated. Also enforced by the SPD personnel are city ordinances leading to the apprehension of 1,118 persons for drinking in public; 2,093 for smoking in public; 1,113 for being half-naked in public places; 662 for curfew violations; 162 for urination in public places; 2,203 for traffic code violations; and 1,080 for obstruction-related incidents. Mariano said there are also nine persons arrested for possession of illegal firearms. Nine firearms were recovered including one that was voluntarily surrendered. The SPD chief said they will continue their anti-drugs and anti-criminality campaign in different areas under their areas of jurisdiction. IACAT-11 reopens at Davao airport
DAVAO CITY — To intensify its campaign at eliminating trafficking in person and other diverse types of exploitation, the Inter-Agency Council Against Trafficking-11 reopened its office at the Davao City International Airport on 14 July. The reopening of the office is a result of a joint endeavor aimed at eliminating TIP and diverse types of exploitation — including sexual exploitation, prostitution, pornography/online sexual abuse or exploitation of children, illegal recruitment and forced labor. It will also serve as a vital hub for coordination, information sharing, and implementing strategies to protect vulnerable individuals. In a presentation, Barbara Mae Flores, the deputy regional prosecutor of the Regional Prosecution Office 11 and the chief of operations IACAT-11 Anti-TIP Task Force said they established the office at the DIA since traffickers use commercial planes in transporting victims. “Airports may be our last chance of visibility and protection. Knowing where and/or how to report suspected TIP incidents is one step in eliminating TIP,” said Flores, adding that they will also be putting up a help desk as an effective prevention of TIP through the improvement of intelligence, surveillance and monitoring activities. “For a timely apprehension of traffickers and interception/rescue of victims and as an immediate assistance to victims or potential victims as well as create and maintain a database and advocate against TIP inside airports,” Flores said. Smuggled tobaccos seized
DAVAO CITY — Authorities confiscated P450,000 worth of smuggled cigarettes at the Sirawan Toril District checkpoint here on Wednesday night. Task Force Davao commander Col. Darren Comia on Thursday reported that authorities confiscated at least 850 reams of illegal items from a certain Salvador Gloria Jr., a resident of E. Rodriguez in Quezon City. The suspect was immediately turned over to the Toril Police Station for proper filing of appropriate charges in of violation of RA 4712 or the Act amending certain sections of Tariff and Customs Code of The Philippines. QC councilors want ‘stronger’ village chiefs vs hoarding
Two Quezon City councilors proposed an ordinance that will help President Ferdinand Marcos Jr. curved agricultural smuggling and caught syndicates involved with hoarding and controlling the supply of basic commodities. Councilor Rannie Ludovica and Councilor Dave Valmocina — both of District 2 — authored the ordinance which mandates punong barangays or village chairpersons in Quezon City to prevent hoarding of basic necessities and prime commodities. The two councilors stressed that the powers of village chiefs should be strengthened giving them additional authority and responsibility to accelerate the apprehension of erring warehouse owners, as well as the confiscation of hoarded merchandise or smuggled goods. MMDA upgrading EDSA CCTVs
The Metropolitan Manila Development Authority is currently modernizing its closed-circuit TV cameras throughout the 24-kilometer stretch of Epifanio delos Santos Avenue, or EDSA. MMDA acting chairman Romando Artes ordered the installation of high-resolution and night-capable CCTV cameras, as well as back-facing units that could record license plates after the vehicles had passed by. The high resolution cameras will be added to existing ones, which were installed as part of the bus carousel program. The MMDA said the installation of the cameras was agreed upon amid the Supreme Court’s suspension of the non-contact apprehension policy, or NCAP. Many motorists have been using the busway because of the NCAP’s suspension, exposing them to accidents, MMDA spokesperson Melissa Carunungan said. The NCAP system was previously used by the MMDA to issue traffic violation tickets to motorists using the busway, but NCAP’s suspension has emboldened them, Carunungan said. MMDA has admitted before that it do not have enough traffic enforcers to catch all violators, thus it wants the ban on the NCAP by the SC lifted. As the MMDA awaits the SC’s verdict on the legality of the NCAP, it has opted to upgrade its camera system to still be able to monitor violations and accidents. Carunungan reported that there were 9,500 monthly average violations by motorists prior to the NCAP suspension, but that number rose to 22,000 violations per month after the NCAP suspension. There were 32,000 violations in May alone, she added. The MMDA also expressed optimism that the single ticketing system will solve issues like corruption and kotong because the system’s context mechanism has made payment or protest periods shorter. Previously, the payment for offenses varied by territory and was occasionally higher in some towns, but now the fines for the 20 most prevalent violations under STS had been standardized. With the implementation of the STS, the fines have become consistent, and the payment may be made immediately after the infraction, as the enforcers have a device for it. If the NCAP is reintroduced, the MMDA said motorists will be treated fairly because they can currently monitor all key roads in the city 24 hours a day, seven days a week. The MMDA is also preparing to computerize the mailing of notifications and has already reached an agreement with PhilPost. A barcode would be printed on the envelops for the quick sending of notices, which would also address the concerns raised by motorists such as due process and data privacy concerns. The Chief Executive made the remark during the 14th edition of the International Conference of Information Commissioners which he attended in Pasay City. “Like everyone here, we too recognize as a matter of principle that fake news should have no place in modern society,” Marcos said in his speech. Hence, Marcos reiterated the call to the executive branch and to all branches of government to genuinely uphold and give effect to the people’s right to information in their day-to-day operations, in good faith and with openness. “Undeniably, this is in our best interest as a nation. It is key to our pursuit of good governance, improved public service and a more progressive and sustainable society,” he said. During the administration of former President Rodrigo Duterte, the government issued Executive Order 2 which emphasized the right of the people to access information. The order established clear and balanced parameters for the Freedom of Information program under the Presidential Communications Office, which promoted transparency in government transactions and full accountability of officials. “We have to highlight that the FoI program has greatly advanced the campaign against misinformation and disinformation in the country, a problem that we in the Philippines also suffer from, and I guess all of us do around the world,” the President said. Marcos said that FoI is essential for good governance and promoting government transparency and accountability. He valued the FoI’s power to empower Filipinos to make informed decisions, participate fully in the democratic process, and hold their representatives accountable without fear or apprehension. He also credited the program for having “advanced the campaign against misinformation and disinformation in the country,” which he acknowledged was a problem suffered by the Philippines and other nations. MMDA seeks lifting of NCAP TRO
Acting chairman Romando Artes of the Metropolitan Manila Development Authority disclosed his intent to coordinate with the Office of the Solicitor General for the possibility of filing a motion for the Supreme Court to lift the temporary restraining order on the Non-Contact Apprehension Policy. Artes revealed an increase in accidents in the last quarter of last year, coinciding with the imposition of the TRO on the MMDA’s NCAP. We find it difficult to enforce the exclusivity of the said lane without the certainty of a CCTV-assisted apprehension, thereby exposing our motorcycle riders to a greater risk. The monitored traffic violations since the suspension of NCAP have also increased and in May this year, 32,739 traffic violations were recorded. Artes said these traffic violations cause road accidents and slow down vehicular traffic, Artes added. “We find it difficult to enforce the exclusivity of the said lane without the certainty of a CCTV-assisted apprehension, thereby exposing our motorcycle riders to a greater risk,” Artes said. To recall, the SC issued on 30 August 2022 a TRO against MMDA’s NCAP due to a petition filed before the high bench from motorists. The SC issued a temporary restraining order against the implementation of the NCAP by the local government units of Manila, Muntinlupa, Quezon City, Parañaque and Valenzuela and it later clarified that the injunction also covers a similar program of the MMDA. On 24 January, the SC has wrapped up the debate on the legality of the NCAP with questions on due process rights, the right to privacy of the traffic violators, potential retrenchment of traffic enforcers and traffic law enforcement potentially given to the private sector. Under the NCAP, CCTV and digital cameras identify and apprehend traffic violators through videos and images of their violations. Once detected, the LGU issues traffic citation tickets and mail them directly to the vehicle’s registered owners. Non-payment of fines within seven days means that their vehicles will not be accommodated for re-registration. Associate Justice Japar Dimaampao asked Solicitor-General Menardo Guevarra how personal data are protected. Guevarra said during the oral argument that only authorized persons coming from the local government units may have direct access to the LTO (Land Transportation Office) database. The NCAP, according to the lawyers of the cities that are already implementing it, is a measure to eradicate corruption that will no longer need traffic enforcers in the future. However, Associate Justice Marvic Leonen said it would mean the retrenchment of traffic enforcers and reliance on the private sector to enforce traffic laws. The cities, such as Manila, Quezon City, Muntinlupa and Parañaque, tapped the QPax Traffic Systems Inc. to implement the NCAP by placing CCTVs and digital cameras in major thoroughfares, intersections and busy streets. The injunction was based on the petitions filed by four transport groups-Kilusan sa Pagbabago ng Industriya ng Transportasyon Inc., Pasang Masda, Alliance of Concerned Transport Operators, and Altodap-asking the SC to declare unconstitutional the said traffic apprehension scheme. Kuya Bong backs body cam proposal
Senator Christopher Lawrence “Bong” Go has recently expressed his support for the proposal to equip police officers with body cameras especially during anti-illegal drug operations. In an ambush interview after personally aiding indigent residents in Roxas City, Capiz on Monday, the senator emphasized the importance of transparency in police operations, particularly in the implementation of warrants of arrest and the apprehension of suspects. “We are urging law enforcers to utilize those body cams purchased by the Philippine National Police so that there will be no doubts and there will be transparency in every operation that they will conduct,” said Go, who also serves as vice chair of the Senate Committee on Public Order. The senator also emphasized the importance of discipline in the police force. In an effort to improve the quality of evidence gathered during drug operations, it has been suggested that authorities use the footage captured from body cameras worn by police officers before, during, and after drug busts. By relying on body camera footage, authorities can improve transparency and accountability in law enforcement operations and ensure that any wrongdoing or misconduct by law enforcement personnel can be investigated and addressed accordingly. Go, however, pointed out that only a few bad apples exist in the PNP and stressed that corrupt officers must be separated from the honest ones to prevent the spread of corruption. The lawmaker also said that police officers should not have any reason to get involved in corruption, especially with the increase in their salaries. He then emphasized that the police force should continue fulfilling their responsibility to protect Filipinos and combat the illegal drug trade, which destroys families and communities. Earlier, Go filed Senate Bill 422 which, if passed into law, will entitle any officer or enlisted personnel of the AFP and Philippine National Police, who is facing before the prosecutor’s office, court or any competent body, any charge arising from an incident related to the performance of official duty to free legal assistance. Anti-crime ops net 31 suspects
The Philippine National Police-Criminal Investigation and Detection Group disclosed on Wednesday that its operatives arrested 20 persons in an intensified one-day anti-criminality operation across the country which led to the recovery and confiscation of several pieces of evidence and the suppression of illegal activities. CIDG chief Brig. Gen. Romeo Caramat said 25 operations were conducted on Tuesday, resulting in the apprehension of 31 individuals and the seizure of evidence worth P719,045. Caramat said under the campaign against wanted Persons or Oplan Pagtugis, there were 19 manhunt operations that ended in the arrest of eight Most Wanted Persons, two of whom were classified as Regional, three as Provincial, three as Municipal, and the arrest of 11 Other Wanted Persons. He added that one suspect was apprehended during the two police operations undertaken that resulted in the seizure and surrender of two firearms under Oplan Paglalansag Omega or the campaign against loose firearms. On Oplan Bolilyo or the campaign against illegal gambling, five suspects were collared, and the confiscation of bet money amounting to P4,045 while one operation was conducted against the illegal refinery/manufacturing of LPG resulting in the arrest of a suspect and the seizure of evidence worth P15,000. In the campaign against unlawful destruction of natural resources or Oplan Kalikasan, one police operation was conducted that led to five arrests and the confiscation of evidence with an estimated value of P700,000 in Barangay Balagtas Batangas City, Batangas.
