Makati petitions status quo ante vs Taguig
Makati City Mayor Abby Binay yesterday filed an “Urgent Motion for Clarification with Prayer for the Issuance of a Status Quo Ante Order” before Branch 153 of the Taguig City Regional Trial Court in a case entitled “Municipality of Taguig (Now City of Taguig) v. Municipality of Makati (Now City of Makati) et al.,” Civil Case No. 63896. The lady mayor, in an ambush interview, said there should be a smooth transiton because they don’t want disruption of delivery of basic services to the residents. In the Urgent Motion, Makati City asked RTC-Taguig to issue a status quo order against Taguig City citing its attempts to unilaterally and arbitrarily implement the Supreme Court’s decision without any writ of execution from the trial court and even prior to the metes and bounds of parcels 3 and 4 of Psu-2031 being determined. Binay filed the Urgent Motion accompanied by City Administrator Claro Certeza and City Legal Officer Michael Camiña. The status quo order, which is similar to a cease-and desist order, is an order to maintain the last actual, peaceable, uncontested state of things which preceded the controversy. It was noted in the Urgent Motion that the Supreme Court has consistently ruled that a “status quo order is warranted in order to promote common good as well as protect the public interest.” Binay said the court is the best avenue to address the matter as far as they are concerned because Taguig City doesn’t want to sign the writ of execution and the memorandum of agreement Makati City is proposing to have a smooth transition. “Even the issue of ownership they don’t want to tackle and it seems they have a different interpretation of the SC ruling and we also have a different view and the best solution is for the court to determine this matter,” Binay said. According to Mayor Binay, “Makati only wants an orderly administration of the Supreme Court decision with the least disruption to the residents and the uninterrupted delivery of basic services in the affected areas.” EMBO residents At the moment, Makati City continue to provide the needed services to the affected enlisted men’s barrio residents because they don’t want interruption and they are the ones giving the funding not Taguig City. “The problem with them they are choosing what they want to take over what about disaster, garbage collection, school, health services, electricity? There are so many things that should be settled first and as long as there is no writ of execution we will continue to provide services to the residents,” Binay said. Makati City cited a number of “alarming and highly confusing incidents” caused by Taguig’s attempt to forcibly execute the SC Decision without a valid writ of execution. These include attempts to enter the premises of a housing project owned by Makati City, as well as to forcibly take possession of several school buildings and health centers in the affected barangays. “Taguig cannot simply take the law into its own hands and act as it pleases without any writ of execution issued by the court. Because of Taguig’s arbitrary, whimsical, and capricious attempts to unilaterally implement the SC Decision in a piece-meal manner, the people’s welfare has been unduly prejudiced by Taguig City and has created unwarranted tension and confusion among the residents and various government agencies,” Mayor Binay said. Makati City noted that the Supreme Court did not expressly order any part of the SC Decision to be immediately executory, nor did it expressly mention in the dispositive part the exact metes and bounds of Parcels 3 and 4 of PSU-2031. Makati City, therefore, asked the trial court to clarify and confirm the necessity of Taguig City first obtaining a writ of execution as well as the court determining the exact metes and bounds of Parcels 3 and 4 of PSU-2031 before the SC Decision can be implemented. The Urgent Motion will also allow Makati to assert its rights as owner of properties located in the disputed areas. As stated by Mayor Binay, “[t]he present case involves a territorial dispute. Immigration: No change in procedures, travelers ‘need not worry’
The Bureau of Immigration clarified on Friday afternoon that it retains the same metrics in assessing departing tourists. BI Commissioner Norman Tansingco confirmed the statements of the Department of Justice stating that the new guidelines issued by the Inter-Agency Council Against Trafficking are a clarification of the already existing guidelines on departure formalities. DOJ Secretary Jesus Crispin Remulla had clarified on Thursday that there are no additional restrictions for departing Filipino tourists in the recently announced recommendations by IACAT. Remulla said the guidelines merely streamline the requirements and do not add more. More than 95 percent of departing Filipinos would not need to present more documents apart from the basic ones, he said. For his part, Tansingco said that under the guidelines, all departing Filipino tourists are only required to have a passport valid for at least 6 months, a valid visa if one is required, a boarding pass and a confirmed round-trip ticket. The BI chief said that the new guidelines merely write down requirements for other categories of departing Filipinos. Tansingco added that, as in the past, only departing Filipinos with red flags may be asked to present extra supporting documents, which are now specified in the rules. With the new list provided, immigration officials would be forced to focus on pertinent criteria rather than requesting pointless paperwork. “This is the same procedure we have been previously implementing, but it has been streamlined by the IACAT so it is clearer for Filipinos,” Tansingco added. The guidelines, the IACAT had explained, streamline requirements for each type of departing passenger in line with the president’s directive. The BI also said the move would clarify needed departure documents and eliminate unnecessary requirements and questions from immigration officers. Tansingco said the guidelines on departure formalities have been in place since 2012 and were later revised in 2015. He assured travelers that the new guidelines would not be a reason for unnecessary interviews. “There is no new policy for departing tourists being implemented by the BI,” said Tansingco. “The guidelines have been here since 2012—which is more than a decade ago—and have been refined by IACAT to address concerns raised by the public. Departing tourists need not worry,” he added. The IACAT is an interagency body chaired by the DOJ and co-chaired by the Department of Social Welfare and Development. Some of the member agencies are the BI, the Department of Foreign Affairs, the Department of Information and Communications Technology, the Department of Tourism, the Department of Migrant Workers, the Commission on Filipinos Overseas, the National Bureau of Investigation and the Philippine National Police. Also members of the council are non-government organizations International Justice Mission, Coalition Against Trafficking of Women-Asia and the Pacific and the Blas Ople Policy Center and Training Institute. Senator Imee Marcos on Friday asked why the Philippines is the sole candidate of the United States for its plan to temporarily house Afghan nationals while it is processing their special immigrant visas in its country. Marcos raised the question during the hearing of the Senate Committee on Foreign Relations on the supposed request of Washington to house Afghan nationals in Manila. “Thailand is also a treaty ally of the US. I was told that no request was ever made for Thailand. Why only the Philippines?” she asked. Philippine Ambassador to the United States Jose Manuel “Babe” Romualdez said the Philippine Embassy in Washington D.C. received the formal request from the US as early as October last year. “They approached us in October, and we said that we will consider it and we’re going to study the matter. But we did not ask them why they picked us. The only reason they told us is because the Philippines is an ally that they could ask [for] this particular favor, perhaps you want to call it that. They have brought it up to the highest level in our government, including our President,” Romualdez said. Marcos also questioned why the US did not consider housing Afghans in US territories such as Guam, Puerto Rico and Guantanamo. In response to the question, Foreign Affairs Secretary Enrique Manalo said aside from being a treaty ally, the Philippines is known for its “long tradition of providing humanitarian assistance,” hence, “they have approached us.” Manalo also explained that under US law, special immigrant visa applicants are not allowed to be in the US while their applications are ongoing. “Actually, they are SIV [special immigrant visa] applicants and they are not applying for refugee status or refugees as such. As we understood from the US, their laws required that SIV applicants have to be processed in third countries – I mean not in the United States,” he said. “Perhaps that could be the reason why -- in fact, that is one the reasons why they approached us on this,” he added. If the government grants the request, Afghan nationals who previously worked for the US would be granted non-immigrant status. However, according to Marcos, this is also in conflict with the Philippine Immigration Law as Afghan nationals fall under “category a,” requiring them to obtain a Philippine visa first before entering the country. “So, that puts into question their status if they’ll remain in the Philippines as well? That also puts into question our ability to impose our laws on all those in our territory,” the senator stressed. “And we’ll sacrifice all that simply because we’d like to accommodate a favor that could probably serve elsewhere,” she added. Manalo said that is something that the Philippine government must clarify with the US government. “We have to make it clear to the US that they could not stay longer than they are allowed according to Philippine law because of their category,” he said.
