Famed environmental warrior graces RC Manila assembly
The Rotary Club of Manila had a brilliant, unique guest speaker at its last weekly members’ meeting at the Manila Polo Club — the famed, internationally acclaimed author, lawyer, environmental activist, and recipient, in 2009, of what is regarded as the Nobel Prize of Asia, the Ramon Magsaysay Award (non-category), Antonio Oposa Jr. For about an hour and a half last Thursday, 21 September 2023, RC Manila members, officers and guests at the MPC’s Turf Room alternately stood up to sing along and listen to Oposa’s telling of “good stories,” his way, he said, of promoting and creating awareness for his advocacies and his passion for the environment. Oposa earned a law degree from the University of the Philippines College of Law. For a short time, he worked in a law firm, until he realized that his heart was not in the practice of law but rather with nature and the environment. He traveled to Norway and enrolled in a course on energy and the environment at the University of Oslo’s summer program and afterwards, to Boston, where he pursued and later obtained his LLM at the Harvard Law School in 1997. [caption id="attachment_188497" align="aligncenter" width="525"] Valiant environmental warrior Antonio Oposa: ‘My biggest achievement is that I have turned some of my adversaries into co-advocates. And what could be more inspiring now than to see their own children out there, protecting the sea?’[/caption] In 1993, Oposa made global headlines for the landmark case, Minors Oposa v Factoran where the Supreme Court ruled that the 43 children counseled by Oposa, who filed legal action against the Department of Environment and Natural Resources, seeking cancellation by the agency of existing timber license agreements and stopping the issuance of new ones, ruled in favor of the plaintiffs. “The case was brought to court amid the government’s then granting over 90 logging companies permits to cut down nearly four million hectares of old-growth forest when only 850,000 hectares remained. And forests were being logged at a rate of some 200,000 hectares per year! I told the Court how my son, only three at that time, would no longer see these forests by the time he was 10. I couldn’t help thinking, that if this wasn’t stopped not a single old-growth forest would remain for him and future generations to enjoy,” Oposa said. The case had initially been dismissed in trial court on the ground that there was no legal personality to sue. Oposa elevated the case to the Supreme Court, and in a much-hailed case of intergenerational responsibility, the Supreme Court upheld the legal standing and right of the children to initiate action on their behalf and on behalf of generations yet unborn. What was so remarkable about the case is that Oposa sued on behalf of generations yet unborn and today that milestone case is known in Philippine and global jurisprudence as the “Oposa Doctrine.” For its part, the Philippine Supreme Court, too, carved a permanent niche for itself in environmental law with its promulgation of Oposa v Factoran. It secured its place in history, earning praises from the international environmental community and a reputation as a champion of the right to a healthy environment. Oposa also recounted at this talk at the RC Manila meeting last Thursday another epic landmark case involving the legal tussle he waged against 11 government agencies for the cleaning up of severely polluted Manila Bay. In December 2008, a decade after he filed that case, the Supreme Court issued a decision in his favor. In a continuing mandamus ruling, the Supreme Court ordered all defendant agencies to implement a time-bound action plan that would clean up Manila Bay and to give the Court a progress report on the matter every three months. Oposa talked about the Island Sea Camp he organized in 2001 in Bantayan Island where he gave children lessons on coral reefs, snorkeling and sustainable practices. In 2003, 2004, while holding weekend training camps for children in the Sea Camp “we noticed the rampant illegal fishing going on. Dynamite fishing and commercial fishing intrusions into prohibited coastal zones went unchecked. Something had to be done,” related Oposa. Thus, was born the Visayan Sea Squadron. “I organized a strike team with crack enforcers from the National Bureau of Investigation, Navy, fishermen, sea watch volunteers, lawyers, law students and even a few foreigners. The target was not small fishermen but crime syndicates and operators behind the sale of blasting caps and dynamite powder. Seizures and raids followed,” he said. Operations were so effective that word went out that his friend Jojo de la Victoria, the fearless Cebu City Bantay Dagat (Sea Watch) chief, and Oposa were targets of assassination. A local newspaper interviewed De la Victoria, revealing an intelligence report about illegal fishing operators putting up a P1-million bounty for him and Oposa. In 12 April 2006, 48 hours after he was interviewed, De la Victoria was felled by a hired gunman outside his house in Cebu City. “Jojo’s life was not in vain. After his funeral, a core team met for dinner to regroup. The tide of illegal fishing started to turn. Exploits of the Visayan Sea Squadron — and the courage and synergy of the men and women who made it happen — became known far and wide,” Oposa said. He continued, “Four years after Jojo died, Visayan Sea Squadron co-founder Alfredo Marañon was elected governor of Negros Occidental province. He gathered the other governors in the region to begin a restorative plan for the Visayan Sea which encompasses an area of over a million hectares. The governors passed a landmark joint resolution declaring the entire Visayan Sea a marine reserve.” For his valiant work as an environmental warrior, Oposa has been the recipient of many award in recognition of his valiant work as an environmental warrior. Aside from receiving the Ramon Magsaysay Award in 2009, he was given the equally prestigious Center for International Environmental Law Award in 2008. Earlier, in 1997, he was conferred the United Nations Environment Programme Global 500 Roll of Honor, the highest UN honor in the field of the environment. Asked if there was anything about his attainments that gives him the most satisfaction, Oposa said, “My biggest achievement is not that I caught this violator and that violator when we were busy with our Visayan Sea Squadron operations; it is that I have turned my adversaries into co-advocates. Some of those who had opposed me are now supporting me in my advocacies. NAIA bomb threat suspect identified
After being identified as the person who allegedly sent a bomb threat through text message to the Ninoy Aquino International Airport hotline, the Philippine National Police Aviation Security Group together with the Airport Police Department, arrested the female passenger as the suspect in the recent bomb threat at the NAIA. According to the airport authority, PNP-AVSEGROUP authorities and the APD successfully apprehended a passenger for her alleged involvement in the threat at NAIA Terminal 3 on the night of the same day, based on the report that a text message was received by the NAIA hotline through SMS on Wednesday morning, 16 August 2023. PNP-AVSEU NCR Chief Police Col. Arnel J. Apud identified the suspect as a 21-year-old female presently residing at #036 Jasmine St., Saint 2, Christopher Subdivision, Barangay. Mayapa, Calamba, Laguna, and an outbound passenger of Cebu Pacific flight 5J803 bound for Singapore, with an estimated time of departure of 8:15 p.m. on 16 August. Police Col. Apud said that the reports revealed that after receiving an alleged bomb threat sent via SMS to the NAIA hotline, the operatives from AVSEGROUP, in coordination with the APD, immediately initiated operational research to identify and locate the suspect responsible for the alleged bomb threat. After a thorough investigation and gathering of evidence, later that day, personnel of AVSEGROUP were able to locate the suspect and arrest her for violation of PD 1727, otherwise known as the malicious dissemination of false information or the willful making of any threat concerning bombs, explosives, or any similar device.” She was promptly informed of the nature of her arrest and was apprised of her rights under the law. The suspect was immediately brought to NAIA Police Station 3 for documentation and proper disposition. PBGEN Jack L. Author’s Note. This story is inspired by true events in Manila, Philippines in the early 1950s. Mawan is a rags-to-riches guy, like a few other famous Filipino Taipans. He stowed away on a cargo ship in Shanghai bound for Manila. Upon reaching Manila, he jumped ship in the dark of night and found his freedom from great poverty to less poverty. He slept in front of a bank on Plaza Cervantes until the police shooed him away. He was forced to sleep under a nearby footbridge along the bank of the Pasig River. For six months, he survived by trading in junk, old newspapers, and empty bottles (dyaryo-bote). He was a “no-English-no-read-no-write” kid. Maning, the bank manager, who often saw Mawan loitering outside the bank and was getting annoyed, asked him in Pilipino where he was from. Mawan answered in Cantonese. It was the beginning of an instant friendship as the manager was once a Shanghai boy himself. Mawan blurted out his story of adventure. Maning adopted Mawan as his own son and gave him a job as a janitor at the bank. He slept in the garage of the manager’s Chinatown home. To cut the story short, in 10 years, Mawan graduated from janitor to clerk to supervisor at the bank. He later resigned, and in another 10 years, graduated from junk shop owner to stockbroker. He became a billionaire at the age of 33. At that time, China bought most of the global supply of coal, which was fuel for cement plants, inducing a nationwide coal shortage. Cement stocks fell to their lowest point and that was when Mawan used all his savings to purchase stocks of the largest cement plant in the country. He ignored Maning’s warnings that it was a dangerous move. When the shortage was over and coal was once again available for cement production, Mawan’s stocks soared to the stratosphere and, at their peak, he unloaded at 55 times their purchase price. He, in fact, caused the stock to take a deep dive as many investors followed his move. He married the daughter of a Chinese billionaire and had a daughter, Melissa. Mawan spoiled her, but he knew that she would not be able to survive in a cruel world with a silver spoon in her mouth. So, he yanked her out of her comfort zone and immersed her in mud, sending her to live with the laborers he had contracted to build a huge mall in Cebu City. MELISSA: Papa, thank you for letting me help your workers. I’m so bored reading books, I’m going crazy. MAWAN: Can you manage to live in a small beach shack with no maid and no car? MELISSA: I am so happy helping the workers, I can take any kind of discomfort. But I got a worker’s daughter as my maid. I’m on top of the world, Papa. MIAA demonstrates NAIA’s emergency response preparedness at CREX 2023
PASAY CITY — The Manila International Airport Authority (MIAA) showcased its emergency response capability and preparedness during the Crash and Rescue Exercise (CREX) 2023 at the airside premises of Ninoy Aquino International Airport (NAIA) on Friday, 4 August. The successful demonstration of this year’s full-scale simulated emergency CREX allows MIAA to ensure that the prescribed plans, guidelines, and organizational setup of the 8th edition of the NAIA Airport Emergency Plan 2023 adequately and effectively address emergencies occurring at or within the immediate vicinity of the country’s main gateway. “A dependable communication and coordination system is essential for a responsive Airport Emergency Plan (AEP). This exercise puts our communication and coordination system to the test, not only among MIAA offices but also with our external partner agencies,” said MIAA officer-in-charge Bryan Co. “We want to assess primary and secondary responders’ ability to respond to an aircraft crash and the resulting mass casualty event, including rescue and fire suppression, treatment and transport of survivors, and crash site security. The exercise also validates the methods for shifting from an emergency situation to normal airport operations following a potential major incident,” Co added. The scenario for CREX 2023 involved a commercial aircraft bound for Subic, CREX flight #0000, carrying 76 passengers and four crew members, that suffered a left engine malfunction during the take-off run after a flock of domestic pigeons crossing the runway was ingested into the aircraft's number one (left) engine, causing the aircraft to crash. The aircraft lost thrust on its number one engine during take-off. The pilot attempted to abort the take-off, but the aircraft veered off the runway and came to a stop on the western portion. A fire broke out on the left wing. In this mock incident, there were 80 casualties, with 72 survivors and eight deceased. In addition to the standard fire suppression, medical, emergency response, and search and rescue activities, this year's CREX edition featured the activation of Cebu Pacific's Accident Site Go Team, marking the first time MIAA partnered with an airline. “Cebu Pacific prioritizes safety and has established processes when it comes to emergency response. We thank the MIAA for the opportunity for us to train together to help ensure that communication systems are in place in the event of a multi-agency response,” Cebu Pacific President and Chief Commercial Officer Xander Lao said as the airline demonstrated its emergency response, particularly in providing support to victims as well as processing and cross-matching victims and family members. The CREX is held to continuously meet security standards set by the International Civil Aviation Organization (ICAO). In compliance with ICAO’s Suggested and Recommended Practices, the CREX is held every two years, but the full-scale exercise may not be conducted if the airport’s emergency plan was activated. The last full-scale CREX was on 19 October 2017. Several actual aircraft incidents in the succeeding years then brought to the fore MIAA’s emergency response capabilities. In August 2018, a Plan 1 emergency under its Airport Emergency Plan was activated when a Xiamen Air aircraft veered off the main runway while attempting to land during a heavy downpour. Barely two years after, another Plan 1 emergency occurred in March 2020, when a Lion Air medivac flight caught fire while it was rolling for take-off. The most recent involved a Saudia Airlines flight that went off the taxiway onto the grassy portion when its six right landing gears malfunctioned in June 2022. All passengers and crew were immediately evacuated and brought to NAIA Terminal 1. No one was hurt as a result of the incident. NAIA is rated as a Category IX airport, while MIAA’s current rescue and firefighting capability is Category X compliant, making it ready to respond to an airport emergency involving an Airbus A380. With the support of highly skilled fire and rescue personnel, a medical team well trained and experienced in aviation medicine, a fleet of modern firefighting and medical vehicles, pneumatic aircraft lifting systems, and various other rescue equipment, the MIAA Emergency Services department is on par with its counterparts in the region. “As this is a multi-agency response to a simulated emergency, assessment activities will be done after the exercise, where stakeholders are welcome to share their observations and raise comments and suggestions to improve our airport emergency plan and coordination system. The response is a community effort, and we appreciate everyone’s contribution in our quest to maintain the global standards of safety and security in NAIA,” Co said. “We would also like to thank our secondary responders for their support: Pasay City General Hospital, Ospital ng Parañaque, San Juan De Dios Hospital, Philippine Airforce, Las Piñas General Hospital, Philippine Coast Guard, Taguig City Fire Station, Manila Medical Center, Bureau of Fire Protection (BFP) – Makati, Philippine National Police Aviation Security Group, Las Piñas City Fire Station, BFP Parañaque, Philippine General Hospital, Philippine Red Cross – Pasay City Chapter, and the Metropolitan Manila Development Authority,” Co added. Angeles residents evacuated amid ‘Egay’
Angeles City, Pampanga — The local government here on Tuesday ordered the preemptive evacuation of residents living near riverbanks and creeks as part of its preparations for the coming super typhoon “Egay.” Angeles City Mayor Carmelo Lazatin Jr. said that he instructed Angeles City Disaster Risk Reduction and Management Officer chief Rudy Simeon and City Engineer Donato Dizon to lead the evacuation, stressing that it is better to be alert and prepared before any disaster happens. He also assured that in the event of an emergency, the city government — through the ACDRRMO and CEO — is ready to respond to any rescue, evacuation and clearing operations. According to Simeon, the ACDRRMO is closely monitoring the major river channels in Angeles City, the Abacan River and Sapang Balen Creek and as of the moment, no incident of overflowing and soil erosion on both sides of the riverbanks and creeks were reported. Waterflows in Sapang Balen creek and Abacan River, on the other hand, are still under normal condition. The ACDRRMO is in continuous coordination with the 33 Barangay Disaster Risk Reduction and Management Councils for any alerts in case of typhoon “Egay’s” onslaught. Meanwhile, Dizon said that his roving teams are ready to clear roads from any obstructions. Lazatin, meantime, wants to ensure everyone’s safety in the event of emergencies like strong winds toppling down certain obstructions. In other developments, at least 480 passengers are stranded in two ports of Western Visayas following the cancellation of trips due to super typhoon “Egay” and the southwest monsoon on Tuesday. Data from the Coast Guard District Western Visayas showed that 165 passengers bound for Tabuelan, Cebu were stranded at the Barcelona port in Escalante, Negros Occidental while 315 others bound for Mindoro, Romblon, and Batangas were stuck at the Caticlan Jetty port in Malay, Aklan. Canceled trips included those from ports of Estancia, Iloilo going to Sicogon/Gigantes Island; Concepcion to Tambaliza, Igbon, and Malangabang; Bancal in Carles to Gigantes Island, all in Iloilo and Ajuy port going to EB Magalona in Negros Occidental. Trips from the port of San Carlos City in Negros Occidental going to Toledo, Cebu were also suspended. The Montenegro Shipping Lines canceled its trips from Lapuz wharf going to Guimaras. According to the BI-CIA, the said victims, who were attempting to board their flight via Philippine Airlines bound for Thailand under the pretense of being tourists, were later revealed to be bound for the United Arab Emirates. Because of the contradictions in their claims, the immigration officer began to wonder about the travelers' motivations. They stated they were going on vacation, and one of the travelers' buddies and a sibling were supposedly paying for it. The victims, however, acknowledged their true location after further inquiry during a subsequent examination. Bureau of Immigration (BI) Commissioner Norman Tansingco said that this is a common scheme of human trafficking, wherein victims are made to go to a third country before flying out to the final port of destination. Tansingco stressed the significance of immigration officials' diligence and awareness in spotting potential instances of human trafficking and stopping such unlawful actions. The victims were immediately turned over to the MCIA Inter-Agency Council Against Trafficking (IACAT) for assistance in filing charges against their recruiter. The Bureau of Immigration urges the public to report any suspicious activities or individuals related to human trafficking to the authorities. The BI chief also said that this is a recurring scheme that uses visa-free countries as a jump-off point to other destinations, and they urge all aspiring overseas workers not to accept such offers and report attempts at illegal recruitment to local authorities.
