NSC bares options vs increasing China’s aggressive actions in WPS
The Philippines has a lot of options to respond to the increasingly aggressive actions of China in the West Philippine Sea, which include the filing of a case in the International Tribunal for the Law of the Sea or ITLOS in response to the latest collisions of Manila and Beijing vessels in the Ayungin Shoal. This was bared in a radio interview by National Security Council spokesperson, Undersecretary Jonathan Malaya, on Tuesday. Malaya said President Ferdinand Marcos Jr. has ordered the Philippine Coast Guard to complete the maritime investigation on the separate collisions concerning China Coast Guard vessels and Armed Forces of the Philippines-contracted boat for the rotation and re-provisioning or RoRe mission in the area. “Kasi may mga patudsada rin ang China sa atin at kailangan sagutin natin ‘yan with proofs and evidences and then magmi-meeting po ‘yung security cluster para mapag-usapan yung resolute response sa maging action ng China sa pinakahuling RoRe mission,” he told the SuperRadyo DzBB. Malaya, also the spokesperson of the National Task Force on the West Philippines Sea, noted that the government and security sector are exploring all options to respond to China’s aggression towards WPS. But, he did not divulge the country’s step-by-step actions. “I’m not at liberty to discuss that now because we cannot telegraph our moves to China. China doesn’t expose their plans either, so we can’t let them know what we intend to do,” he said. Malaya said the results of the maritime investigation will be presented to Marcos and will be followed by discussions of the administration’s concerned cabinet members on the possible response to the matter. “There a lot of options that are [placed] in the table right now, we can file a case in the International Tribunal for the Law of the Sea or ITLOS,” he stressed. Malaya emphasized that the Department of Foreign Affairs and the Philippine Coast Guard “made it clear” that China had violated maritime rules and collision regulations during the Ayungin incident. “We have a lot of recourse that we can do because of this unprecedented event that happened, but it would be up to the President and the concerned Cabinet members what will be our next move,” he added. “There’s no decision on that so far. It will be decided by the Cabinet cluster and by the President himself. Let’s just wait for their responses. Beijing ‘violated’ 3 maritime laws
China violated at least three international maritime rules during the collisions of its ships with Philippine vessels at Ayungin Shoal on 22 October. Commodore Jay Tarriela, Philippine Coast Guard spokesperson for the West Philippine Sea, said vessels of the China Coast Guard and Beijing’s maritime militia infringed on provisions of the 1972 Convention on the International Regulations for Preventing Collisions at Sea, or COLREGs. “The first one violated was Rule 2 or the responsibility of the vessel. This rule emphasizes that nothing in the COLREGs can absolve any vessel from the duty to avoid a collision,” he said. Tarriela explained that deliberately blocking a vessel “not only increases the risk of collision” but also disregards the “fundamental principle of taking action to prevent a potential collision.” China also ran afoul of Rule 7, or the risk of collision, which requires every vessel to “use all available means appropriate to the prevailing circumstances and conditions to determine if a risk of collision exists,” he said. Tarriela said that Rule 7 is considered in conjunction with other relevant rules and factors, such as Rules 5 (look-out), 6 (safe speed), and 8 (action to avoid collision). During the incidents, China ignored Rule 18A or “the responsibilities between vessels” which requires a vessel to keep out of the way of another vessel if the latter has the right of way, Tarriela said. By deliberately blocking a vessel, “you are not allowing the other vessel to proceed in accordance with their right of way,” he explained. Shadowed He noted the active participation of the Chinese militia ships in the harassment and blocking of the supply contingent from the Armed Forces of the Philippines. “For the first time, the Chinese maritime militia vessels are also doing such dangerous maneuvers. They even collided with our PCG vessel. Before, they were just taking orders from the CCG,” he said. During the resupply mission, the Philippines was outnumbered by five CCG vessels, eight militia ships, and two People’s Liberation Army Navy vessels. The Chinese ships shadowed and harassed the Philippine vessels. A CCG vessel collided with the AFP-chartered resupply ship, Unaiza May 2, as it attempted to block the latter’s path to the BRP Sierra Madre at about 10.5 nautical miles from Ayungin Shoal on Sunday. India using anti-money laundering rules to ‘silence critics’ — Amnesty Int’l
India is exploiting recommendations by a global money-laundering watchdog as a "draconian" tool to shutter civil society groups and suppress activists and critics, Amnesty International said Wednesday. Government critics within civil society organizations and the media have long complained of harassment in the world's biggest democracy under Prime Minister Narendra Modi's Hindu-nationalist administration, a charge it strenuously denies. Amnesty said the recommendations of the Paris-based Financial Action Task Force (FATF) were being abused to bring in "draconian laws to stifle the non-profit sector" and block organizations from funding. The 39-nation FATF, of which India has been a member since 2010, is mandated to tackle global money laundering and terrorist financing. Critics say Modi's government has sought to pressure rights groups by heavily scrutinizing their finances and clamping down on foreign funding. "Under the guise of combatting terrorism, the Indian government has leveraged the Financial Action Task Force's recommendations to tighten its arsenal of financial and counter-terrorism laws which are routinely misused to target and silence critics," Amnesty International India chair Aakar Patel said in a statement. In the last 10 years, India has canceled the licenses of more than 20,600 non-governmental organizations, with nearly 6,000 of these taking place since 2022, the report said. In 2020, Amnesty International had to suspend its Indian operations after its bank accounts were frozen. The Indian government defended its move, accusing Amnesty of "illegal practices" involving the transfer of "large amounts of money" from Amnesty UK to India. LTO issues show cause order vs Cavite ‘road rager’
The Land Transportation Office on Tuesday revealed that it has issued a show cause order against the registered owner of a vehicle whose driver figured in another road rage incident inside a subdivision in Imus, Cavite. The issuance of the SCO on the registered owner of a white Honda CRV with license plate REN123 was in compliance with the order of LTO Chief Assistant Secretary Atty. Vigor Mendoza II to the LTO Regional Office 4A to immediately conduct investigation into the misbehavior of the male driver before and during the confrontation. In the SCO signed by LTO regional director Cupido Gerry Asuncion dated 25 September, the registered owner was asked to explain in a notarized affidavit on why she should not be penalized in connection with the incident. “You are directed to submit your response under oath within five days from the receipt hereof why no disciplinary action should be taken against you,” the SCO read. The violation is Reckless Driving under Section 48, Article V of the Republic Act 4136, or the Land Transportation and Traffic Code. The incident is now viral in the social media with the videographer saying that the driver appeared to be under the influence of liquor. In the video, the Honda CRV was seen swerving on a public road in an apparent bid to block the vehicle from behind to pass and later, the driver of the Honda CRV stopped the vehicle and confronted the driver of the vehicle behind him. The driver of the Honda CRV was also heard in the viral video cursing at the occupants of another vehicle. MONTREAL, Canada (AFP) — Meta is being accused of endangering lives by blocking news links in Canada at a crucial moment, when thousands have fled their homes and are desperate for wildfire updates that once would have been shared widely on Facebook. The situation “is dangerous,” said Kelsey Worth, 35, one of nearly 20,000 residents of Yellowknife and thousands more in small towns ordered to evacuate the Northwest Territories as wildfires advanced. She described to AFP how “insanely difficult” it has been for herself and other evacuees to find verifiable information about the fires blazing across the near-Arctic territory and other parts of Canada. “Nobody’s able to know what’s true or not,” she said. “And when you’re in an emergency situation, time is of the essence,” she added, explaining that many Canadians until now have relied on social media for news. Meta on 1 August started blocking the distribution of news links and articles on its Facebook and Instagram platforms in response to a recent law requiring digital giants to pay publishers for news content. The company has been in a virtual showdown with Ottawa over the bill passed in June, but which only takes effect next year. Building on similar legislation introduced in Australia, the bill aims to support a struggling Canadian news sector that has seen a flight of advertising dollars and hundreds of publications closed in the last decade. The Philippines "exposed" China’s activities in the West Philippines Sea during the recent Indo-Pacific Chiefs of Defense conference, Armed Forces of the Philippines chief General Romeo Brawner Jr. bared Monday. In a radio interview, Brawner said some 23 defense chiefs across the Indo-Pacific, along with China’s deputy chief of defense, were present during the discussions. “Of course, binanggit natin doon sa ating discussions 'yung ginagawa ng China. In-expose natin doon sa iba't ibang bansa (We mentioned China’s activities in our discussion. We exposed them to different countries)," he said. Brawner said China responded by insisting that they still follow international rules, that the South China Sea is theirs and that the 2016 arbitration ruling that favored the Philippines over the nine-dash line “is invalid and unacceptable.” The AFP chief added that China asserted that they will continue their activities in the SCS. In 2016, The Hague Tribunal invalidated Beijing’s "nine-dash line doctrine" over the entire SCS region following an arbitration case filed by the Philippine government on 22 January 2013. The Tribunal also ruled that China’s nine-dash line unilaterally encroached on territories of other member-states of the Association of Southeast Asian Nations. The Philippines has been urging China and other claimants to honor the ruling. Despite this, China rejected the Philippines' call to comply with the ruling. China also claimed that Ayungin or Ren'ai Reef is part of its Nansha Island. Recently, the Chinese Coast Guard blocked and directed water cannons at Philippine vessels en route to BRP Sierra Madre for a resupply mission in Ayungin Shoal. China accused the Philippines of violating their laws by “intruding” into the Ayungin Shoal. Brawner said the Philippines has been upholding a “diplomatic course of action” amid China’s untoward treatment against Filipino ships within parts of the WPS. “Our Department of Foreign Affairs has been talking with their Chinese counterparts to convince them not to block our resupply mission. While at the level of the Department of National Defense, they have been talking with counterparts, including with China’s defense attaché,” Brawner said partly in Filipino. Amid the ongoing tensions, Brawner said the AFP will continue to conduct its mission within the country’s exclusive economic zone. “Because that is our obligation, that is our right to provide our troops with supply and that the BRP Sierra Madre is a commissioned vessel of the Philippine Navy with our flag hoisted in there. [It is] very visible, so it is our right and an obligation to bring supplies to our soldiers,” he stressed. Brawner also emphasized that the country is strictly following rules of engagement and international laws. Senators blast China’s use of water cannon vs. Philippine vessels in Ayungin Shoal
Senators on Sunday condemned the "excessive and offensive" actions of Chinese Coast Guard vessels against Philippine vessels near the Ayungin Shoal last Friday. Senate President Juan Miguel “Migz” Zubiri called the People’s Republic of China’s actions “reaffirms the merit of the resolution the Senate has unanimously passed.” The incident, which took place on 5 August near the Ayungin Shoal, happened barely a week after the Senate unanimously adopted a resolution denouncing China's intrusion into the West Philippine Sea and its harassment of Filipino fishermen. “Because China contemptuously ignores protests, all the more that we have to rally the world to condemn acts which have no place in a civilized order,” Zubiri said in a statement. In a statement issued on Sunday, the Philippine Coast Guards accused the CCG of using water cannon against its vessels while en route to the Ayungin Shoal for a routine troop rotation and resupply mission. Ayungin Shoal is located 105 nautical miles west of Palawan and is part of the exclusive economic zone and continental shelf of the Philippines. In a separate statement, the Armed Forces of the Philippines also condemned China’s latest actions in the WPS, which it described as “excessive and offensive.” Zubiri said China’s actions are “yet again a manifestation of its ‘might vs. right’ treatment of its peaceful neighbors.” “By its actions, it shows diplomatic duplicity, of preaching about amity, but practicing hostile behavior,” he said. “We want to have friendship with you but why is it difficult to love you, China?” Senate Deputy Minority Leader Risa Hontiveros echoed the same sentiments against China, saying China has no right to block the Philippine vessels in its own territory. “The Chinese Coast Guard has absolutely no right to block, let alone water cannon, our supply vessels. They do not have any right to starve Filipinos in the Ayungin Shoal,” Hontiveros said in a separate statement. “China’s repeated provocations are in complete violation of UNCLOS and the 2016 Arbitral Award. I call on our regional neighbors and the broader international community to join the Philippines in condemning this dangerous behavior,” she added. In a bid to strengthen the country’s position in the Ayungin Shoal, the Philippine government permanently supplies its forces there through the BRP Sierra Madre. The BRP Sierra Madre was a World War 2 landing ship tank that was stationed at the Ayungin Shoal since 1999. Hontiveros said she is hoping that the Philippines could soon start joint patrols with other claimant countries in the South China Sea such as Vietnam, Malaysia, Indonesia, and Brunei. “We need to cooperate with them to halt these aggressive actions of China,” she said. “I am also hoping that the DFA is now formulating steps to raise China’s endless incursions to different international fora.” “The recently adopted Senate resolution 718, with its precision and specific recommendations, is at their disposal,” she added. Senate Resolution 718 urges the Philippine government, through the Department of Foreign Affairs, to “continue asserting” the country’s sovereign rights over its exclusive economic rights. 'Heed Senate’s call' For his part, Senate Deputy Majority Leader Joseph Victor “JV” Ejercito called on the national government to heed the Senate’s resolution which contains several recommendations for the executive department. “We cannot let this slip. This is too much already! China is very frustrating! China’s hostile actions towards our Philippine Navy, Philippine Coast Guard, and fishermen are extreme. Our territory, security, and peace are at stake here,” he said in a separate statement. “I urge the national government to heed the Senate's recent resolution on China's aggression and take decisive measures to safeguard our territorial integrity,” he added. Ejercito continued: “These measures will require us to expedite the modernization of the Armed Forces of the Philippines and strengthen our defense cooperation program and pacts with our allies.” For Senate Majority Leader Joel Villanueva, China’s actions against PCG in the WPS require a strong stance from the Philippine government. “This is the reason why the Senate adopted Resolution No. 79 strongly condemning incursions like this,” Villanueva said. “Your Senate is always ready to fight for and protect the country’s sovereignty and sovereign rights.” Like Ejercito, Villanueva reminded the executive department of the newly adopted resolution which contains a guide for the DFA. “We urge the Department of Foreign Affairs to implement the courses of action stipulated in the resolution passed by the Senate to finally put an end into this harassment and bullying by China,” he said. Under the resolution, the DFA is “expected” to continue holding dialogues with the Chinese government to push for recognition and respect of the Philippines' sovereign rights over its EEZ and pursue the formulation of the Code of Conduct for the South China Sea based on international law and the UNCLOS. Should China continue to ignore the country’s efforts, the resolution contains actions the agency must do such as bringing international attention to China's harassment of Filipino fishermen in the Philippine EEZ and its continued violation of the Hague Ruling and the UNCLOS; utilizing international fora to rally multilateral support for the enforcement of the Hague Ruling and raise awareness on the real situation in the West Philippine Sea; and engaging with “like-minded” countries to call on China to respect the Hague Ruling and the UNCLOS. The DFA is also encouraged to file a resolution before the United Nations General Assembly, to call for the cessation of all activities that harass Philippine vessels and violate the Philippines' established rights in the West Philippine Sea; and pursue other diplomatic modes as the agency may deem appropriate and necessary. ‘Sensible plans' For his part, Senate Minority Leader Aquilino “Koko” Pimentel III urged the PCG to come up with sensible plans to overcome China’s increasingly aggressive actions towards Philippine vessels that are on a re-supply mission to the Ayungin Shoal. “The PCG should overcome the CCG on our re-supply missions. They should come up with sensible plans behind closed doors,” Pimentel said in a separate statement. Asked if the recent actions of China against Philippine vessels could trigger the activation of the mutual defense treaty between the Philippines and the United States, Pimentel said: “Use diplomacy and intelligent tactics.” “The MDT should not be invoked lightly. ICC probe: Allow now, challenge later
The Philippines may just let the International Criminal Court’s investigation into the bloody drug war of the previous administration roll in the meantime and then challenge its jurisdiction later, according to Cagayan de Oro Rep. Rufus Rodriguez Thursday. The government, whose plea to block the probe fell on deaf ears, has high hopes the international tribunal would eventually grant its appeal to lay off the country. “The proper and only course of action for the Republic of the Philippines is to raise the issue of jurisdiction when the case is eventually filed in the ICC. Jurisdiction can be questioned at any stage of the proceedings,” said Rodriguez, a lawyer. “When the case is brought to the ICC, we raise the issue of jurisdiction, and the Philippines will surely secure its dismissal for lack of jurisdiction,” he added. Calls have been made to end the ICC’s probe into former President Rodrigo Duterte’s “war on drugs” that claimed thousands of lives during his six years in office that started in 2016. Justice Secretary Jesus Crispin Remulla has firmly maintained that the country would not engage with the ICC, insisting the government would not let the court interfere in the country’s business. ‘Oplan Tokhang’ Senator Ronald “Bato” Dela Rosa, who during the Duterte administration led the anti-drug campaign known as “Oplan Tokhang,” had previously said he was ready in case a warrant of arrest was served on him, but only if by Philippine authorities and not by any foreigner directed by the ICC. But for Rodriguez, the government officials concerned should compose themselves and study the ICC decision well. “There is no need for our government officials to make many extraneous comments on the decision,” he said. Some 6,000 persons were reportedly killed in Duterte’s drug war, according to government data, the majority of whom were from low-income families. However, local and international human rights organizations estimated the number of victims at more than 30,000. Meanwhile, senators expressed dismay at the ICC decision that turned down the Philippine appeal, saying there was no need for it since the Philippines has a “working justice system.” Senator Ramon “Bong” Revilla Jr. on Thursday said the ICC should not be allowed to meddle in the country’s affairs. “We do not need to remind them that we are a free, independent, and sovereign nation governed by our laws,” he said. Revilla said that since Philippine government officials will be held liable for violations, the laws of the country should prevail and not of foreign prosecutors. “I am befuddled by the ICC’s pursuit of this obvious baseless persecution while legitimate concerns and crimes against humanity are being perpetrated in other parts of the world as we speak. It is obvious the ICC’s interest here is not justice but something else entirely,” he said. Operating very well Senator Mark Villar said there was no need for any international body to intervene in the country’s justice system, stressing that Philippine democracy is fully functioning. He said the Philippine justice system is “operating very well” and it could address its own human rights concerns. “Our government has a very strong justice system that is working so I don’t think we need international interference. We have our courts, we have a strong justice system, that’s what I believe,” Villar said in a recent interview. Aside from Duterte and Dela Rosa, the ICC report included Senator Christopher “Bong” Go and incumbent Vice President Sara Duterte in the probe. Unfazed Dela Rosa has remained unfazed by the ICC ruling and is even mulling another Senate term, although he said the ICC probe will affect a reelection bid. “Since I am identified with the former president, I may not get the votes. The votes I will get will be those in support of [former] president Duterte. But the support may even grow since many Filipinos are also angered by [the ICC’s] interference in our sovereignty, so its impact on my reelection bid may even be positive,” he said. Strict time frame for basic permits pushed
Sen. Sherwin Gatchalian said Saturday the issuance by government agencies of basic permits must have a strict time frame. Senator Sherwin Gatchalian (MANILA BULLETIN FILE PHOTO) Gatchalian, former chairman of the Senate Committee on Economic Affairs, issued the statement during a radio interview on the acceptance by the Senate and House of Representatives bicameral conference committee of a provision in the proposed Bayanihan 2 law that sought a three-year suspension on the issuance of different permits for cell towers of telecommunication companies (telcos). ’’Ang sinusuportahan natin ay mabilis, ‘yung moratorium kung puwedeng tanggalin ibang permit, ‘wag na dumaan sa Sangguniang Panlungsod, tanggalin narin ang permit sa barangay kung dadaan ka naman ay mayor bakit sa barangay captain pa,’’ he said. Boasting of a deep roster of talents led by strong hitters in Alyssa Valdez, Jema Galanza and Michele Gumabao, the Cool Smashers have in their collection a total of three titles in three years including back-to-back Open Conference crowns. And making this star-studded team work and the Creamline players function at their best is setter Jia Morado. Morado joined the pink-clad squad in the PVL’s Open Conference back in 2017 after a short hiatus following Ateneo de Manila University’s runner-up finish in UAAP Season 79. In Creamline, which finished third in the Reinforced Conference during the league's inaugural season, Morado reunited with Valdez after last seeing action together in the UAAP in 2016. The playmaker’s first official game as a Cool Smasher was on July 1, 2017 when Creamline opened its tournament campaign against the Jema Galanza-led Adamson University-Akari at the FilOil Flying V Centre in San Juan. Morado got the starting role as the Cool Smashers’ main setter the previous conference Alex Cabanos took a backseat. In front of a very excited 1,205-strong crowd, Morado, who a couple months before announced her decision to forego her final year with the Lady Eagles after losing to archrival De La Salle University in the UAAP Finals, once again wove her magic. Despite still adjusting with her new teammates, Morado sure brought out the best in her spikers. Rosemarie Vargas hammered 16 attacks in her 18-point explosion, Valdez also had 16 kills for 18 markers while Pau Soriano got 11 points as Morado pulled the strings of the Creamline’s offense for an opening-day, 25-17, 18-25, 25-15, 25-22, win. Morado registered impressive numbers in her first action in the PVL. She dished out 36 excellent sets that helped the Cool Smashers nail the bulk of their 49 attack points. Morado also posted six points coming off three spikes, a kill block and two aces. On the defensive end, Morado was as sharp as she put up seven digs. “It feels great to play. It’s a great experience playing with new players naman this time,” said Morado in her first PVL post-game interview. In that first match, Morado also faced off with a young Adamson playmaker in Louie Romero. The then Kings’ Montessori setter held her own against Morado with 34 excellent sets. The Cool Smashers would eventually win their next six games in the single round eliminations. However, with Valdez joining the national team in its training for the Kuala Lumpur Southeast Asian Games, Creamline came up short in the semifinals against eventual champion BaliPure and settled for a third place finish.
