Bankman-Fried to testify at his US crypto trial
Sam Bankman-Fried, founder of the collapsed cryptocurrency exchange FTX, plans to make another high-stakes gamble and testify in his defense on Thursday at his criminal fraud trial. Bankman-Fried's decision to take the stand comes after three weeks of devastating testimony for the 31-year-old known as SBF, who has been accused of stealing billions of dollars from clients. His lawyer, Mark Cohen, told Judge Lewis Kaplan he expected Bankman-Fried's testimony to last for four or five hours. He is expected to begin around 2:00 p.m. (1800 GMT). Prosecutors were wrapping up their case on Thursday and handing it over to the defense, which said it plans to call four witnesses, including Bankman-Fried. Bankman-Fried, once one of the most respected figures in crypto, has been charged with seven counts of fraud, embezzlement, and criminal conspiracy. If convicted, he could face a de facto life sentence of more than 100 years in prison. The Massachusetts Institute of Technology graduate had, in just a few years, turned his FTX platform into the world's second-biggest crypto exchange -- making him a tech-world billionaire wunderkind. But his empire began to crumble last November when a news report pointed to unhealthy ties between FTX and Alameda Research, Bankman-Fried's personally owned trading company. Amid growing revelations, major investors pulled their money out of FTX, sinking it swiftly into bankruptcy. Some $8.7 billion was still unaccounted for after the dust settled, according to the receiver appointed to manage the liquidation. Bankman-Fried has denied taking other people's money, blaming former colleagues for the situation. But key witnesses in recent weeks, all former FTX or Alameda employees, refuted his account. Supported by internal documents compiled by the prosecution, they said he was behind the breaches and did not lose sight of the financial situation of FTX and Alameda. Ex-girlfriend offers evidence Among those taking the stand was Caroline Ellison, Bankman-Fried's former business partner and girlfriend. She offered conclusive evidence against him and delivered details on his management, saying he was involved in all major decisions. Ellison, a Stanford University mathematics graduate, was appointed by Bankman-Fried in 2021 to head Alameda, whose activities were largely financed by money from customers of FTX without their knowledge. She has pleaded guilty to fraud charges and agreed to cooperate with the prosecution, as have two other close associates of Bankman-Fried. Bankman-Fried's decision to testify in his defense is unusual in a country where criminal defendants generally decline to do so because they have to face cross-examination and run the risk of incriminating themselves. Hollywood producer Harvey Weinstein, comedian Bill Cosby, singer R. Kelly, and drug trafficker Joaquin "El Chapo" Guzman were among high-profile defendants who declined to testify at their recent trials. BoC-NAIA turns 63
Beyond Borders: A New Era for Digitalization and Customs Excellence was the theme chosen by the Bureau of Customs -Ninoy Aquino International Airport to commemorate its 63rd founding anniversary and over 60 years of dedicated public service. District Collector Atty. Yasmin Mapa emphasized the BoC-NAIA’s impressive accomplishments and development while Collector Mapa praised the port’s exceptional revenue collection record, which generated a total of P31.3 billion in revenue from January to September this year. This represented an increase of P1.3 billion over the prior year and outperformed the collection target for the time by P1.1 billion. This success demonstrates BoC-NAIA’s ongoing dedication to assisting the Bureau in achieving its broad objectives. Collector Mapa stated that in August 2023, BoC-NAIA passed its second surveillance audit for ISO quality management system certification, recognizing the value of simplified customs procedures. With 23 enrolled ISO-certified processes and 10 ISO support processes, the port has the most certified processes of any BOC port. With this accreditation, cargo clearance procedures are guaranteed to be recognized internationally, facilitating trade for stakeholders and customers. She added that BoC-NAIA will remain steadfast in its enforcement policies, intercepting narcotics with an estimated street value of P994 million in 2023. Collector Mapa highlighted the port’s role in preventing the entry of illicit goods, seizing a total of P1 billion worth of drugs, jewellery, wildlife, currencies, medicines, and other regulated items. The port received commendations from the Department of Environment and Natural Resources for curbing wildlife smuggling. BoC-NAIA is aggressively advancing digitization initiatives in keeping with the celebration’s theme. The port is organizing consultative discussions for the electronic tracking of air cargo and is currently in the pilot testing phase of the electronic airwaybill filing. In addition, there are plans to categorize goods and work with pertinent organizations to integrate iDeclare into the e-travel system to provide a centralised platform for trip declarations. A memorandum of agreement between the BoC and the Philippine Postal Corporation was ceremonially signed during this celebration in an effort to speed up, secure and enhance the quality of customs clearance for postal commodities. At the ceremony, BoC-NAIA showcased its newly revamped website and E-Airway Bill System, showcasing its dedication to operating more efficiently. The event was capped off with awards for top imports and standout personnel, underscoring their critical contribution to the port’s development and prosperity. BOC, PCG, PNP bust P2.2-B shabu from Mexico shipment
Combined elements of the Bureau of Customs, the Philippine Coast Guard, Philippine National Police, among other enforcement units, uncovered a shipment from Mexico containing 323 kilos of methamphetamine hydrochloride (shabu) at the Manila International Container Port terminal in Manila on 4 October, Wednesday. A belated report from the BOC said the contraband's estimated street value was P2.2 billion, concealed in a jerky beef shipment from Mexico. The shipment arrived at the MICP on 24 February 2023 from Logistica Integral Aduanal Meyma and Aime Express Logistics SA DE CV, Mexico, and was consigned to a certain Salesbeat Within OPC. Incidentally, the BOC Intelligence and Investigation Service received “derogatory information that the subject shipment contain illegal drugs”, and accordingly monitored closely the declaration, processing, and/or movement of the same. However, despite considerable lapse of time, no goods declaration was filed for the subject shipment. On 29 September 2023, CIIS-MICP requested the District Collector of MICP to issue a Pre-Lodgment Control Order against the subject shipment described in the covering Bill of Lading to contain laminated beef jerky. Pursuant to PLCO issued by District Collector Romeo Rosales dated 29 September 2023, in the presence of operatives from the Customs Anti-Illegal Drug Task Force, Philippine Drug Enforcement Agency, BOC-X-Ray Inspection Project, Philippine National Police-Drug Enforcement Group, BOC-Enforcement and Security Service, PCG), Chamber of Customs Brokers, Inc., and CIIS-MICP, the shipments were subjected to X-ray scanning last 2 October 2023 and 100 percent physical examination, which yielded more or less 323 kilograms of shabu concealed inside the laminated beef jerky. Thereafter, the identified shabu was temporarily loaded back inside the subject container, padlocked, and sealed with the signatures of the assigned Customs examiner and afore-identified witnesses. Deputy Commissioner for Customs Intelligence Group Juvymax Uy said that this latest operation is not only a coordinated response to the President’s call but also a fulfillment of the agency’s mandate to protect the country’s borders and ensure the security of all ports of entry. On the other hand, District Collector Romeo Rosales stressed that: “Our officers continue their dedication to our border security mission, which led to this latest shabu interception. Their drive, vigilance, and alertness on a daily basis made this operation possible. P1B for Marawi victims, a cruel joke (2)
Throwback. Through our pen, we appealed to the government several times to create a Truth Commission to investigate the ruination of Marawi City so that it may pick up one or two ideas on how to combat urban terrorism and be ready to deal with a similar tragedy. But our pleas fell on deaf ears. Our unspoken purpose was to prove that while the siege triggered the war, the heavy loss of lives and damage were inflicted by government forces. And this could have been minimized if the government had adopted an open mind about solutions to the impasse. There were overtures for the surrender of the much-outnumbered and outgunned rebels, but these were rejected by the government. For what reason? This column does not buy the claim of critics that it was to justify the imposition of martial law, which did happen, or the wild indictment that the government wanted to test the modern new armaments it had acquired from foreign countries, including fighter jets and pilot training. Marawi presented an opportunity for the experiment. It was not likewise the bravado of army centurions who wanted to show that their forces were capable of fighting in dense forest jungles where they were trained and in the jungle of high-rise urban structures. These are innuendoes and claims which could have been validated or invalidated through investigation. What was proven was the recklessness, if not sheer incompetence, of our jet fighter pilots who bombed places kilometers from their intended targets. In our barangay, Tolali, there was a disastrous mis-hit of a target that killed about 10 Marines, which some Maranaws described as the law of “morka” or karma in action. Why resuscitate these tales? It is to show that the heavy damage was caused by government forces which, by the dictates of any law of any society, be it international or international human rights, moral, divine, including the Code of Hammurabi and Kalantiaw, the culprit is obliged to pay for the damage it inflicted. The amount of reparations should be reasonable or at least proximate to their claim. That is why when the Department of Budget and Management dangled the amount of P1 billion as compensation for Marawi victims, it was met with disbelief, which led to a spirited protest. Unkind words were expressed by victims whose consciences were revolted. They could not believe that the policymakers could be so insensitive to the cry for justice by a segment of Philippine society that had suffered historical injustice from foreign invaders and their own government. The radicals among them cried state terrorism — no wonder the fire of secession and independence still burns in the hearts of many Moros. The situation tends to ignite more hostility towards the government. We hate to picture a situation where about half of the validated claims of victims will be paid and the other half unpaid after five years when the compensation stops. God forbid we will see dystopia and brewing sedition or revolution in our midst, and there is no need for millions in confidential and intelligence funds to predict its occurrence. The deliberations in the House of Representatives, which were uploaded on social media, were revealing. Rep. Mujiv Hataman of the lone district of Basilan, a veteran legislator who expresses his views vividly with his command of the national language, was in his element asking scathing questions of the sponsor of the budgetary bill, Congresswoman Stella Quimbo. Very clearly, she was groping for facts, figures, and explanations from officials of the Department of Budget to answer Rep. Hataman. Even with masteral and doctorate degrees tucked in her belt, she was no match for Hataman, who displayed Socratic maieutic in fielding questions. In another session, the region’s favorite son, Rep. Zia Alonto Adiong, bewailed the inequity and injustice of proposing only P1B for the Marawi victims. He got the DBM’s commitment to find a way to increase the Marawi compensation budget. Better services seen after GCash acquires ECPay
Customers can expect better services from financial service provider Gcash after its parent firm Globe Fintech Innovations Inc. or Mynt acquired 77 percent of Globe Telecom Inc.'s stake in Electronic Commerce Payments Inc. or ECPay for P2.31 billion. In a stock report on Monday, Globe disclosed that ECPay’s minority stakeholder, Payment One, Inc., is also a party to the transaction — effectively making it a full acquisition of ECPay by Mynt. The deal is still subject to regulatory approvals but once it is closed, ECPay will have access to GCash's platform which would translate to easier and more seamless services for users. “Mynt’s digital savviness will spill over to ECPay, maximizing its previously untapped potential. GCash, on the other hand, can further differentiate itself from its competition as mobile wallets in various shapes and sizes continue to pop up," Globe’s Chief Finance Officer, Rizza Maniego-Eala said in the report. "With ECPay in Mynt’s capable hands, Globe can better steer its ventures and synergistically grow the entire Globe Group ecosystem,” she added. Meanwhile, for Globe President and CEO Ernest L. P1B for Marawi victims a cruel joke (1)
I beg my readers’ kind indulgence for using this column as a platform to air our grievances. This is something personal to us, and it is my moral obligation to add my voice to the public indignation sweeping a part of Morolandia. For transparency and disclosure, my family was a victim of the war and is seeking compensation for the damage to our precious possessions. Having said that, as the national budget deliberations for 2024 draw to a near conclusion, the public discourse in Morolandia on the compensation for the 2017 Marawi Siege victims heightened. It’s the issue much discussed in public fora, coffee shops, and social media platforms of Muslims. The Moro attention is largely riveted to the budget deliberations in the House of Representatives, where the budget bill originates by provision of the Constitution. Social media likewise reported the hearing conducted by the Oversight Committee for the Marawi Compensation Law jointly chaired by Senator Ronald dela Rosa and Rep. Zia Alonto Adiong. According to reports, P1 billion is proposed in the 2024 budget for compensation, which is the same amount appropriated in the current budget, alarmed resident victims. They have reason to fear that P1 billion is becoming the appropriation template for the ensuing years. The Marawi Compensation Board or MCB, created to process, approve and pay legitimate claims, will fold the tent and become a functus oficio in 2028 because the law provides for a five-year life span. Let’s do the math. If the budget is not increased, the aggregate appropriation for Marawi victims will only be P5 billion, which is ridiculously insufficient vis-a-vis the number of victims and the magnitude of their claims. From an unofficial report, we gathered that “as of 18 September 2023, there were 75 death claims, 74 structural claims, 1,858 other properties claims, and 4,041 multiple claims. Hence, there were 6,048 claims as of the latest report by the in-take team from July to September. (And) 362 claims have been evaluated or are ready for final deliberation.” The claims statistics are increasing exponentially by the day, with the list of claimants getting longer. The MCB asks for something like P10 billion or more as an aggregate ballpark figure to compensate all the victims. The sparse appropriation has triggered unkind comments from citizens calling the proposed amount outrageously deficient, cruel jokes and insulting the victims. While the public is amused by the stories in tri- and social media on funding for projects that are less urgent — like the millions needed for the confidential and intelligence funds of agencies to address “kuno” (allegedly) the threat of terrorism — here we have a situation where the threat of terrorism is real. Our security and intelligence authorities will tell you that the remnants of the ISIS-affiliated Maute Dawliyah Islamia group are just around the corner, engaged in sporadic hit-and-run guerrilla ambushes to make their presence known. Terrorist cells are confirmed to be existing in the hinterlands of Morolandia. The disgruntled victims of the Marawi war are easy prey for recruitment by the dissidents. There is no denying the depth and scale of the damage sustained by the Marawi victims of the war. The whole world was watching on their television sets for months the daily telenovela-like bombing of the city in what Confucious described as “burning the house to catch a rat.” We have written numerous published articles pleading for cessation of the bombing, but the thrashing by state authorities continued. We note with gratitude the public expression of support by Senator De la Rosa, chair of the Special Committee on Marawi Rehabilitation, who spent years studying at the Mindanao State University in Marawi City, along with Muslim Senator Robinhood Padilla. Senator Risa Hontiveros, in her recent trip to Marawi, saw for herself the progress of the claims processing and has likewise committed support. The list of senators and House representatives joining the chorus of support is getting longer. BFP received an unmodified opinion from COA
The Bureau of Fire Protection (BFP) received an unmodified opinion from the Commission on Audit (COA) for the first time in the fiscal year of 2022 and it got a perfect score of 20. According to the COA, the released report is based on the Financial Management Performance Rating based on the financial audit performed in this period of 2022 report by Michael R. Bacani Director Cluster 4, Defense and Security. Based on the COA report, BFP received a 93 percent score an excellent score from the first Financial Performance Rating report. Before this, it will be recalled that the COA approved the action of the Bureau of Fire Protection (BFP) about the fact that the BFP should have a modernization program to keep up with the modern era. The COA report stated that there was nothing wrong with the actions taken by the BFP in placing the technical requirements that the Bureau of Fire needs to keep up with the BFP's modern methods and modernization program. Meanwhile, the COA report of the Financial Management Performance Rating said the BFP got an excellent rating this past period of 2022. In this regard, according to the COA report this past 2010, the BFP launched its Modernization Program by the government's Comprehensive Fire Code of 2008 so that the Bureau of Fire can adapt to modern times in the event of a fire. The report further stated that the main goal is for the government to upgrade its firefighting capability with adequate personnel and adequate firefighting equipment to protect people from dangerous fires. It was further noted in the COA report that the total funds of the Modernization Program amounted to P13.17 Billion from the year 2011 to 2017. Earlier this past 2019, Senator Bong Go filed a bill in the Senate requiring the BFP to implement the modernization program of the Bureau of Fire Protection. According to the COA report, there is nothing wrong with the technical requirements in requirements for the modernization program because it is in line with the COA report on the COA's performance audit. The Commission also believes that the government should strengthen its fire suppression campaign in conjunction with its ongoing modernization program. Major asteroid sample brought to Earth in NASA first
A seven-year space voyage came to its climactic end Sunday when a NASA capsule landed in the desert in the US state of Utah, carrying to Earth the largest asteroid samples ever collected. Scientists have high hopes for the sample, saying it will provide a better understanding of the formation of our solar system and how Earth became habitable. When they learned that the capsule's main parachute had deployed, "I literally broke into tears," the Osiris-Rex mission's principal investigator Dante Lauretta told a press conference. "That was the moment I knew we made it home... For me, the real science is just beginning." The 3.86-billion-mile (6.21-billion-kilometer) journey marked the United States' first sample return mission of its kind, the US space agency said in a post on X, formerly Twitter. NASA chief Bill Nelson hailed the mission and said the asteroid dust "will give scientists an extraordinary glimpse into the beginnings of our solar system." The Osiris-Rex probe's final, fiery descent through Earth's atmosphere was perilous, but NASA managed to engineer a soft landing at 8:52 am local time (1452 GMT), in the military's Utah Test and Training Range. Four years after its 2016 launch, the probe landed on the asteroid Bennu and collected what NASA estimated is roughly nine ounces (250 grams) of dust from its rocky surface. Even that small amount, NASA says, should "help us better understand the types of asteroids that could threaten Earth." The sample return "is really historic," NASA scientist Amy Simon told AFP. "This is going to be the biggest sample we've brought back since the Apollo moon rocks" were returned to Earth. Osiris-Rex released its capsule early Sunday from an altitude of more than 67,000 miles. The fiery passage through the atmosphere came only in the last 13 minutes, as the capsule hurtled downward at a speed of more than 27,000 miles per hour, with temperatures of up to 5,000 degrees Fahrenheit (2,760 degrees Celsius). NASA images showed the tire-sized capsule on the ground in a desert wash, with scientists approaching the device and taking readings. Eventually, they concluded the capsule was not breached, meaning its all-important air-tight seal remained intact, avoiding any contamination of the sample with desert sands. The team then lifted the capsule by helicopter to a nearby "clean room." Meanwhile, the probe that made the space journey fired its engines and shifted course away from Earth, NASA said, "on its way" for a date with another asteroid. Japanese samples On Monday, the sample heads to the Johnson Space Center in Houston for additional study, and NASA plans to announce its first results at a news conference 11 October. Roughly one-fourth of the sample will be immediately used in experiments, and a small amount will be sent to mission partners Japan and Canada. But most of it will be saved for future generations -- a "treasure for scientific analysis for years and years and years to come, to our kids and grandkids and people that haven't even been born yet," Lori Glaze, director of NASA's Planetary Sciences division, said. Japan had earlier given NASA a few grains from asteroid Ryugu, after bringing 0.2 ounces of dust to Earth in 2020 during the Hayabusa-2 mission. Ten years before, it had brought back a microscopic quantity from another asteroid. But the sample from Bennu is much larger, allowing for significantly more testing, Simon said. Earth's origin story Asteroids are composed of the original materials of the solar system, dating back some 4.5 billion years, and have remained relatively intact. They "can give us clues about how the solar system formed and evolved," said Osiris-Rex program executive Melissa Morris. "It's our own origin story." By striking Earth's surface, "we do believe asteroids and comets delivered organic material, potentially water, that helped life flourish here on Earth," Simon said. Scientists believe Bennu, about 500 meters (1,640 feet) in diameter, is rich in carbon -- a building block of life on Earth -- and contains water molecules locked in minerals. Bennu surprised scientists in 2020 when the probe, during its brief contact with the asteroid's surface, sank into the soil, revealing an unexpectedly low density, like a children's pool filled with plastic balls. Understanding its composition could come in handy, for there is a slight -- but non-zero -- chance (one in 2,700) that Bennu could collide catastrophically with Earth, though not until 2182. Up to 2M reservists eyed once ROTC becomes mandatory
There could be about two million reservists who will be able to augment the reserve force of the Armed Forces of the Philippines every year if the Reserve Officers’ Training Corps becomes mandatory again. This was bared by Major General Joel Alejandro Nacnac, Deputy Chief of Staff for Reservists and Retiree Affairs of the AFP, over the weekend during the opening of the National Reservists Week. “Every year, if ROTC becomes mandatory, we expect an additional two million students from all of the universities,” Nacnac told the reporters in an interview. He said projected servicemen from ROTC will be classified as a “standby reserve”—which is mobilized only in times of national emergency or war. The AFP reserve force is currently at 1.2 million as of June 2023, which is composed of over 71,000 “ready reservists,” more than 15,000 affiliated units from other organizations and institutions, and 1.1 million standby reservists—with most of them from the Philippine Army. The ready reservists are called at “any time to add to the regular forces.” The National Reservist Week is the AFP’s annual activity of the “purposely to widen the Reserve Force manpower build-up and for the existing reservists to be accounted.” The event also provides reservists an update on the current AFP policies and directives with regard to the Reserve Force Development Programs as well as establish a robust operational Reserve force by way of checking their individual readiness in order to provide support to the Regular Force to fulfill its mandate. The bill requiring ROTC for students enrolled in at least two years of an undergraduate degree is pending in the Senate plenary. On the other hand, Senator Ronald “Bato” Dela Rosa the government may allot P4.2 billion for free uniforms yearly if the proposed mandatory ROTC program becomes law. “If it will materialize, every year we’re going to budget P4.2B for uniforms alone for cadets,” he said in a recent hearing on the budget of the Department of Science and Technology and its attached agencies. India parliament reserving third of seats for women
A landmark law passed by India’s parliament expands the number of women members to 30 percent from the current 13 percent. The country’s upper house passed on Thursday the bill reserving a third of seats in the national and state legislatures for women. The lower house passed its version a day earlier. All the 215 members of the upper house present voted for the measure brought by Prime Minister Narendra Modi’s government. “A defining moment in our nation’s democratic journey!” Modi said in a post on X, formerly known as Twitter, soon after. The bill was first introduced in 1996 but only gathered support across most political parties lately. Just 104 of India’s 788 members of parliament were women after the last national election, according to government figures — a little over 13 percent. Those figures reflect a broader under-representation of women in Indian public life. Just under a third of working-age Indian women were in the formal labor force last year, according to government data. The quota will take effect only once India redraws its electoral boundaries after the mammoth undertaking of a census for its 1.4 billion people — the last one, due in 2021, was postponed indefinitely because of the coronavirus pandemic. Martin vows budget passage
House Speaker Martin Romualdez on Thursday pledged to fast-track the passage of the P5.768-trillion proposed national budget for fiscal year 2024 after President Ferdinand Marcos Jr. deemed the measure “urgent.” Marcos on Wednesday wrote the House a letter addressed to Romualdez seeking the immediate enactment of House Bill 8980 to “enable the government to effectively perform its constitutional mandate.” Marcos’ proposed national spending plan for next year under the National Expenditure Program is P500 billion, or 9.5 percent, higher than this year’s P5.268 trillion budget, which the House approved in barely six weeks last year in accordance with the President’s order. Next year’s P5.768 trillion, if passed, would be the highest budget ever approved by Congress. “We appreciate President Marcos’ leadership and his prioritization of the national budget. His decision to certify this crucial legislation as urgent reflects his unwavering commitment to the welfare and progress of our nation,” Romualdez said. Bong Go joins Asian Games send-off; renews advocacy for athletes’ welfare
Senator Christopher "Bong" Go recognized athletes, coaches, and sports officials for their contributions to Philippine sports and their crucial roles in representing the nation on the international stage, during the send-off ceremony on Monday, 18 September, at the Philippine International Convention Center (PICC) in Pasay City, for Filipino participants in the 19th Asian Games and 4th Asian Para Games in Hangzhou, China. “Today, we gather here not only to celebrate the excellence of our athletes but also to bid them the best of luck as they embark on a journey to represent our great nation at the 19th Asian Games and 4th Asian Para Games in Hangzhou, China," said Go. Go took the opportunity to shed light on his proposed Senate Bill No. 2116, which aims to amend Republic Act No. 10699, also known as the National Athletes and Coaches Benefits and Incentives Act. "This bill which I authored carries the potential to bring about positive change in the lives of our athletes, particularly our para-athletes," he said. Go emphasized the need to increase the incentives for para-athletes, stating, "Sana po’y ma-increase naman rin po ang kanilang incentives na natatanggap dahil ‘yung honor po na dala nila sa ating bayan, pareho naman po ‘yong gold, silver, bronze at pinaghirapan rin po nila." The proposed measures seek to upgrade the incentives for para-athletes. This bill intends to provide equal opportunities and recognition to all athletes, thereby promoting inclusivity and diversity in sports. "The heart of this legislation is inclusivity and equality. It aims to elevate or increase the incentives for our para-athletes," he mentioned. Go, vice chairperson of the Senate Committee on Finance said he continues to advocate for additional budget for sports programs under the Philippine Sports Commission (PSC). He revealed that during the budget deliberations last year, he sponsored and successfully secured financial support for athletes participating in international competitions such as the 2023 Southeast Asian Games, which took place in Cambodia, and the forthcoming Asian Games in China. He also disclosed the allocation of P50 million through the PSC for the Asian Games, along with P30 million specifically for Asian para-games. Go also highlighted the importance of collaboration between the government and the private sector in achieving sports excellence. "’Pag nagsama ang gobyerno at pribadong sektor, walang imposible.” Meanwhile, in his speech, the senator also touched on the state of sports facilities in the country, emphasizing the need for comfortable training grounds for athletes. "Grassroots program, it's one way na ma-e-engganyo natin ang ating mga kabataan to get into sports, stay away from drugs, and to keep us healthy and fit," he said. He further elaborated on the connection between sports and health, saying, "Malaking bagay na fit tayo. Ang importante rin sa akin bilang chairman ng Senate Committee on Health, dalawa po 'yan. Importante sa akin ang sports at health. Magka-connect ang dalawang ito dahil para sa akin, kapag fit ka, healthy ka. Pangalagaan po natin ang kalusugan ng bawat isa. Declare MIF unconstitutional, group asks SC
Several lawmakers petitioned the Supreme Court yesterday to declare unconstitutional the Maharlika Investment Fund Act of 2023 under Republic Act No. 11954 signed into law by President Marcos last 18 July to be managed by the Maharlika Investment Corporation which has a seed capital of P150 billion. The petition was filed by Sen. Aquilino “Koko” Pimentel III, former congressman and Bayan Muna Chairman Neri Javier Colmenares, and former Bayan Muna congressmen Carlos Isagani Zarate and Ferdinand Gaite. The group in their petition also asked the high bench to issue a temporary restraining order or preliminary injunction or status quo ante order (SQAO) to stop immediately the implementation of RA 11954, and to conduct oral arguments. Named respondents in the petition were Executive Secretary Lucas P. Bersamin, Finance Secretary Benjamin E. Diokno, the House of Representatives, and the Senate. Three “serious grounds” were cited in the petition in seeking the unconstitutionality of Maharlika Investment Fund Act, namely: “RA 11954 is void because it was passed in violation of Section 26 (2), Article VI, of the 1987 Constitution; the test of economic viability as mandated under Section 16, Article XII of the Constitution was not complied with prior to the creation of the Maharlika Investment Corporation; and RA 11954 violates the independence of the Bangko Sentral ng Pilipinas as provided for under Section 20, Article XII of the Constitution.” The petition claimed on alleged violation of Section 26 (2), Article VI of the Constitution, that “the Presidential certification of the Maharlika Bill in the House of Representatives and Senate did not comply with the constitutional requirement” and since the bill was not enacted in accordance with the Constitution, it “therefore did not become a law.” The petition pointed out “the Maharlika Investment Fund Act of 2023 therefore requires intense congressional scrutiny, genuine consultation with stakeholders, and a careful study by independent economic experts.” It said that “both Houses of Congress, however, went on the opposite direction and rushed the Maharlika bills and short-circuited the constitutionally mandated legislative processes, through an unnecessary and constitutionally infirm Presidential certification of urgency.” The post Declare MIF unconstitutional, group asks SC appeared first on Daily Tribune......»»
Brazil opens first ‘ExpoCannabis’ amid pot debate
Bubbling with euphoria as thick as the haze in the air, marijuana enthusiasts flocked this weekend to Brazil's first "ExpoCannabis," amid a national debate over decriminalizing the drug for personal use. Launched in Uruguay a decade ago, the huge marijuana fair opened its first international edition Friday in Sao Paulo, complete with DJs, guest speakers, myriad pot products and a large outdoor space packed with hundreds of visitors, nearly all of them smoking up. Organizers said they expected 20,000 people to attend the three-day event, which aims to showcase cannabis in its many uses, and not just recreational and medicinal. "We want to show the public all the plant's capabilities. We're not just talking about the pharmaceutical industry. The plant can also work in the food and beverage industry, the construction industry, the textile industry and biofuels," organizer Larissa Uchida told AFP. "It's a plant that has been demonized for many years, so there needs to be a whole deconstruction of this idea." Uchida said the event respected Brazilian legislation, with vendors selling cannabis accessories, extracts and derivatives -- but not the actual drug. Those smoking it at the fair likely purchased it illegally, but authorities appeared willing to turn a blind eye. Brazil’s 2006 drug law imposes prison terms for drug trafficking, and lighter penalties such as community service for possession, but has faced criticism for a lack of clarity over the line between the two. - Landmark court case - ExpoCannabis got its start in Uruguay in 2013, the same year the small South American country became the first in the world to fully legalize the regulated production and sale of recreational marijuana. The event in neighboring Brazil comes as the Latin American economic powerhouse re-evaluates its own prohibitionist drug laws. Brazil's Supreme Court is currently hearing a case that could decriminalize small-scale possession and use of cannabis and certain other drugs in the nation of 203 million people. Five of the court's 11 justices have so far ruled for decriminalizing marijuana for personal use, just one vote short of the majority needed. Ruling to decriminalize in August, Justice Alexandre de Moraes condemned existing anti-narcotics laws, which he said principally penalized "young people, especially uneducated Blacks, who are treated as drug traffickers for possessing small quantities." However, in a sign of how controversial the subject remains, Senate president Rodrigo Pacheco announced plans Thursday to introduce legislation to amend the constitution to explicitly make the possession of any amount of cannabis a crime. - Budding mega-industry - "I think it's very important to have the first edition (of ExpoCannabis) in Brazil right now," Sao Paulo state legislator Caio Franca told AFP at the fair. "We're at a very opportune moment for a conversation on cannabis-based medicines and recreational use, both from a legislative point of view and also in the courts," said Franca, who has introduced a bill to include medical marijuana in the Sao Paulo public health system. Marijuana for medical use also remains a touchy subject in Brazil. Patients have had to go to court to win the right to use the active ingredient cannabidiol, or CBD, for treatment of conditions such as epilepsy. Gabriel Vieira, an exhibitor at the fair, called for Brazil to join the growing number of countries that have partially or fully legalized cannabis. "We have to see the truth: there are a lot of people who consume it, whether it's medicinal or recreational. I think we need to follow in the footsteps of countries like Germany, the United States," said Vieira, who is 29. The economic potential of the budding global cannabis industry -- valued at $43.7 billion last year, and projected to grow to more than 10 times that by 2030 -- was on full display at the fair. Visitor Luciano Narita, 40, grinned as he showed off his haul of products. "I came here looking for new products, like this chocolate I bought, pipes, leaves," he said with a smile.
