PCG’s problematic dualism
There is a world of difference between the roles of a civilian agency and those of a military command. No civilian agency or military command should be doing the role of the other, lest they overlap, conflict, or render redundant their authority. The role of the Philippine Coast Guard is a good subject for legislative review — whether it fulfills a purely civilian function or a purely military one. The fact that it’s an attached agency of the Department of Transportation as much as an attached service of the Department of National Defense “confers” upon it a dualism that may be at cross purposes. While the PCG can fit either role, it shouldn’t. For in so doing, the line between maritime law enforcement and national defense is blurred. One may be led to think that, perforce, the PCG is unadulteratedly a military organization as it used to be part of the Philippine Navy, a major branch of the Armed Forces of the Philippines. Something explains this duality, but it may require assessment as to whether it must continue to have this dual character. In principle, any individual or unit that performs a task or mandate that essentially belongs solely to the military must forthwith be under a military commander or military organization. Who can even begin to fathom what it means when the Commandant of the Philippine Coast Guard reports directly to the Transportation Secretary in the enforcement of maritime law, but also reports to the Defense Secretary if not the President in wartime? If one should take a cursory look at those who served as commandants of the PCG since its founding in 1967 under different presidents, one would find, viz.: 1) During Rodrigo Duterte’s term, only three served for over a year, while four served for less than a year, and one for only 18 days; 2) Under Benigno Aquino, four barely completed a year, one just a year, and one more than two years; 3) Under Gloria Macapagal-Arroyo, three served for barely a year, two served over two years or so; 4) Under Joseph Estrada, one served for two years; 5) In Fidel Ramos’ time, five served for less than a year, one for 32 days, and one for almost three years; 6) Under Corazon Aquino, two served for two years, one for three years, and two for a week or so; 7) Under Ferdinand Marcos Sr., four served for over a year, three served for 3, 4, 5 years, respectively. This tells us that commandants, as presidential appointees, must be the personal choices of the presidents they serve. With a change of the occupant in Malacañang, a change in the leadership of the PCG also takes place, good or bad. It’s said that the PCG’s “transformation into a non-military organization” and its “civilian character” allowed it “to receive offers of vessels, equipment, technology, services, cooperation and other needed assistance from other countries,” that otherwise would not have been feasible were it a military agency. President Fidel Ramos signed Executive Order 475 on 30 March 1998 to separate the PCG from the Philippine Navy, and Executive Order 477 to transfer it from the DND to the DoTC, a month thereafter. Thus, even FM Jr. has been heard saying, “Our friends from other countries will help strengthen the PCG’s capabilities.” Today, the President envisions the PCG as a “central actor” insofar as West Philippine Sea matters are concerned; thus, he ordered several 40-foot long patrol vessels to be built in Cebu to improve the PCG’s capabilities in maritime territorial disputes. In the face of China’s unprecedented coast guard expansion — the largest in the world — “civilianizing” the PCG makes little sense. It’s a Catch-22 on how to “reinvent” the PCG. Maritime zones long defined under law — JPE
Chief Presidential Legal Counsel Juan Ponce said the Senate should not bother enacting the maritime zones measure since the country’s territory has long been defined under the Baselines Law. Enrile was reacting to reports that the Senate is consolidating eight proposed measures seeking to define the maritime zones of the Philippines that the legislators said should strengthen the country’s claim in the West Philippine Sea, but which would merely duplicate a 2009 law. Senator Francis Tolentino, the Special Committee on Philippine Maritime and Admiralty Zones chairperson, had said that a new Philippine map, with its specified maritime zones, would be included in the proposed mandate. “We will be sending a copy of the measure to the UNCLOS (United Nations Convention on the Law of the Sea) Secretariat (and) the United Nations for their recognition as well. But again, the other countries supporting us would also support our claim based on our new Maritime Zone Law,” he said. The Baselines Law is already in the hands of international bodies. The proposed measure, Tolentino said, would also specify the sea lanes, air routes, and natural resources within the country’s exclusive economic zone. “Once crafted into law, this will be part of our argument that China should abide by UNCLOS because the progeny of UNCLOS is the Maritime Zone Law. So this will fortify our claim,” he said. The process, however, is redundant since “we already have the Baselines Law,” Enrile indicated on his weekly program Bayan ni Juan. “We applied the principle of archipelagic waters consisting of Amianan island in the north and Sibutu in the east, and you have a 12-mile limit from the baseline that is considered part of Philippine waters where Filipinos can fish,” he explained. So they don’t have to craft another law since the law already exists; it was enacted during the term of former President Gloria Macapagal-Arroyo, according to Enrile. He added that the nine-dash line of China did not cover those areas under the law since China respected it. Among the islands in the Baselines Law within the country’s territory are the Kalayaaan group of islands and Bajo de Masinloc, also known as Scarborough Shoal. The Baselines Law, or Republic Act 9522, enacted in 2009, was cited as the basis for seeking the intervention of the United Nations-backed Permanent Court of Arbitration at the Hague, which subsequently issued the ruling in July 2016 that favored the Philippines. Enrile, one of the law’s authors, said it intended to encourage further dialogue with China while asserting the country’s stake. A peaceful negotiation would be the only way for the Philippines to settle the West Philippine Sea issue with China under the landmark measure, particularly its claims over the Kalayaan island group and Scarborough Shoal. Enrile said the regime of islands the Baselines Law sought to protect was demarcated based on the provisions of UNCLOS. China protested the law’s enactment, but Enrile said a dialogue might iron out the kinks between both nations. “The only capability we have is through negotiations; we must use patience in negotiating with China,” he said. Teodoro gets CA nod
The Commission on Appointments on Wednesday approved the ad interim appointment of Gilberto “Gibo” Teodoro Jr. as secretary of the Department of National Defense. Prior to his confirmation, the 12-member House contingent of the powerful CA spared Teodoro from questioning as a “courtesy” to the Defense chief who previously worked as Tarlac's 1st district representative. “The 12-member House of Representatives contingent will no longer ask questions regarding the nominee being a former member of Congress for three consecutive terms in the 11th, 12th, and 13th Congress,” said Camarines Sur 2nd District Rep. LRay Villafuerte, the majority leader of the CA. Villafuerte added that the House contingent “has no doubt regarding the fitness and integrity of the nominee”. He appealed to their counterpart, the Senate to accord the same courtesy to Teodoro. From the 12-member Senate contingent, only Senator Risa Hontiveros asked questions to Teodoro. Hontiveros questioned Teodoro about his plans for the DND, now under his watch for the second time. He held the same position under the administration of then-President Gloria Macapagal Arroyo at the age of 43, the youngest ever appointee to the agency. Responding to the lawmaker’s query, Teodoro admitted that there has been a “shift in the evolution” from his first stint in the DND. He noted that he is now focusing on “straddling the balance between maintaining internal security and with an emphasis definitely given what is happening to the outside environment.” “We are strengthening our defense posture. We are gradually enhancing the capabilities of the AFP (Armed Forces of the Philippines),” he said. The Defense chief said he is also working on “leveraging” the country’s alliance with other nations to strengthen the country’s capability to protect itself from external threats. By doing so, he noted that he would try to introduce “management solutions to managerial problems, and not military solutions to managerial problems.” “That is the transformation that we are trying to make. We are also deeply restrategizing what we intend to do at least in the next five years in order not only to make the defense department more responsive to the outside and internal environments but also to make more efficient our use of resources, and to use information technology to the highest extent possible,” he added. Teodoro also underscored the importance of strengthening the country’s capability to respond to external strength and not just rely on diplomacy. “[T]he intensity of the need to focus on protecting our sovereignty, our sovereign rights, in the exclusive economic zone and other jurisdictions of the country become more paramount now, as the whole world is in a raise for resources,” he said. “We could not afford to be laidback here. We should be cognizant of it because we can and principally use diplomacy, however, if diplomacy is not backed up by a strong spinal cord, then we will just be stymied by a greater force,” he added. He made the remarks amid the increasing tension between the Philippines and China in the West Philippine Sea. China claims the vast South China Sea, including the West Philippine Sea. On 12 July 2016, the Philippines won its arbitral case against China in the Permanent Court of Arbitration – a landmark decision that China continues to reject. Teodoro said the Defense Department wishes the concentrate on not only guarding the islands of the archipelago and its internal waters but also on securing “peaceful, unimpeded, and unobstructed exploitation, and exploration of our sovereign rights over the 200 nautical mile EEZ of the republic and in all areas of the Philippines, to secure our baselines.” Last June, President Ferdinand Marcos Jr. announced Teodoro’s appointment as the new DND secretary, replacing Carlito Galvez Jr. who led the agency for five months. “They’re dreaming,” former president Rodrigo Duterte said as he broke his silence over the claims that the Philippines, during his administration, promised to remove the Philippine Navy’s commissioned vessel BRP Sierra Madre from Ayungin Shoal in the West Philippine Sea. In a recent episode of his program 'Gikan sa Masa, Para sa Masa’ over the SMNI News Channel earlier this week, Duterte bluntly denied giving out “an inch of territory” to China during his term. “I did not discuss anything about territory. For one, what is there on the map is ours. We are not claiming an area over what is really legally ours. So, that Sierra Madre—is claimed by the Philippines as ours (in) that area—so let it just remain there,” he said. Duterte agreed that setting up the BRP Sierra Madre in Ayungin symbolizes the country’s sovereign rights over the WPS. “Maybe, as a symbolic thing, to put a notice on everybody na atin ‘yan (that it is ours), which is good. Kung ako ang tanungin mo, prangkahan ko lang either kung sino ang nakikinig dyan (If you would ask me, I will tell you frankly, to whoever is listening now)—whether its a foreign country or the government)” he said. “Kung ako magdala ako ng maraming barko sa navy na sira-sira butasan ko 'yan dun. Taiwan OFW Ugnayan shelter makes do sans MECO support
A shelter run by a Filipino priest in Taiwan, which has been assisting overseas Filipino workers in distress, will no longer be receiving support from the Philippine representative office there. Father Joy Tajonera, who runs the Ugnayan shelter in Taichung, said that under the new administration, the Manila Economic and Cultural Office in Taiwan has decided to halt support for his work at Ugnayan. Tajonera, in a recent interview with Daily Tribune’s Usapang OFW digital show, revealed that “MECO has decided not to support the work of Ugnayan to help Filipinos in Taiwan.” “This is the first time for us not to receive support from the government; from the time of GMA up to Duterte, we got support from MECO,” Tajonera said, referring to former presidents Gloria Macapagal-Arroyo and Rodrigo Duterte. He added that the pullout of support has nothing to do with the changes that had been put in place with the enactment of RA 11641, or the Department of Migrant Workers Act, replacing the Philippine Overseas Employment Administration. Among the changes were the setting up of the Migrant Workers Office, replacing the Philippine Overseas Labor Office, to address the needs of OFWs, whether legal or undocumented, and assigning support for non-OFWs like tourists, students, business people, and the like — to embassies and consulates, and in the case of Taiwan, to MECO. “That has nothing to do with the pullout of support because the assistance that we provide is for all who need help regardless of race, not just OFWs, although they are the ones we give assistance to the most,” Tajonera said. The MECO is the Philippine representative office in Taiwan in keeping with the One-China policy adopted by the Philippines in 1975. “MECO decided under this new administration that they would not support us anymore. No reason was given, and I decided not to pursue an explanation anymore as we continue to provide support with the help of our ministry. We have not stopped with our services to fellow Filipinos, regardless of reason or situation,” Tajonera said. Tajonera added that he will not be seeking financial help from the Taiwan government despite the pullout of support from MECO. “We want to keep Ugnayan independent. I believe that our mission in Ugnayan is to help people without conditions, especially when it comes to providing shelter,” he said. A leftist party-list representative, one among those who foist their nationalistic pretense, who has been critical of the previous administration’s war on drugs but couldn’t for once slam the communist rebels for their terroristic activities, and always engaged in either wrong or misleading narratives, has once again unleashed a thoughtless and unstudied declaration, poking her finger in the West Philippine Sea dispute vis-a-vis China’s claim that the Philippines had committed to removing the BRP Sierra Madre which has been aground for a long time at the Ayungin Shoal. This time she has targeted former President Rodrigo Roa Duterte for the latter’s alleged silence on the issue in the face of former presidents Gloria Macapagal-Arroyo’s, Joseph Estrada’s and President Ferdinand Marcos Jr.’s denial of making such a commitment to China. She has cast suspicion on the former maverick President’s and the latter’s daughter’s (Vice President Sara Duterte) alleged non-issuing a denunciation statement against China’s attacking the resupply mission to BRP Sierra Madre and failing to deny having made the aforementioned pledge. In the first place, there is no need to dispute China’s claim because, for one, it has not submitted proof as to the identity of a government official who made such a commitment, and on what occasion and year it was made. For another, assuming a commitment was made by whomsoever, the same could not be undertaken given that the ship in question is in Ayungin Shoal, which is within the exclusive economic zone of the Philippines, over which place the latter has sovereign rights under international law and the United Nation Convention on the Law of the Sea or UNCLOS, and therefore it can do whatever it pleases. Moreover, the arbitral ruling handed by the Permanent Arbitration Court has affirmed the Philippines’ sovereign rights’ claim to it while it rejected China’s expansionist claim over the West Philippine Sea — hence, any contrary claim over the use of the same or invocation of whatever commitment made in regard thereto not only has become moot if not irrelevant but — and more importantly no basis in international law. There is no need for FPRRD to issue a statement to deny or dispute China’s claim simply because as aforestated, it has not validated its allegation with any semblance of proof. Moreover, it is irrelevant at this stage owing to the arbitral award. Even if it is relevant, the denial of the existence of such commitment by no less than the current head of state is more than sufficient. Unlike this impertinent lawmaker, FPRRD abhors calling attention to himself. To require the Vice-President to issue a similar denial and a denunciation against China’s assault on the Philippine Coast Guard is redundant, with PBBM having already an official statement on the matter. The lady solon nastily insinuates that FPRRD has been sleeping with the enemy citing instances that she did not particularize forgetting that even if he has developed a friendship with China’s President, his virtual speech before the United Nations, asserting our sovereignty over the West Philippine Sea and his raising the arbitral ruling in a face-to-face dialogue with President Xi Jinping on his first state visit to China spoke eloquently of his position that he is fiercely opposed to China’s unlawful incursions on Philippine waters. This member of the Lower House has also repeated the lie started by some anti-Duterte critics that the latter has described the arbitral ruling as a mere piece of paper. For her education and others. PRRD was describing how China is treating the favorable decision by not only ignoring it but committing repeated acts of aggression against the Philippines. China is demonstrating its rejection of the international arbitral court ruling by treating it as a worthless piece of paper. President Ferdinand Marcos Jr. has appointed Teodoro “Teddy Boy” Locsin Jr. as the President’s Special Envoy to the People’s Republic of China for Special Concerns, the Presidential Communications Office announced on Wednesday in a Facebook post. Locsin’s recent appointment came amid the resurgence of tensions in the West Philippine Sea between China and the Philippines. In a Viber message to Palace reporters, Communications Secretary Cheloy Garafil said Marcos appointed Locsin to boost the bilateral relations between the two countries. Locsin, who is the Foreign Affairs Secretary of then-President Rodrigo R. Duterte from 17 October to 30 June 2022, takes on the new task “in a concurrent position” as the Philippine Ambassador to the United Kingdom of Great Britain and Northern Ireland. The Chief Executive appointed Locsin UK ambassador with jurisdiction over Ireland, Isle of Man, Bailiwick of Jersey, and Bailiwick of Guernsey on 30 August 2022. During his tenure, he frequently lodged numerous diplomatic complaints and occasionally used the social media platform X (formerly Twitter) to criticize China. JV: Not my father who made ‘deal’ to remove BRP Sierra Madre
Senator Joseph Victor “JV” Ejercito on Monday refuted claims that it was his father, former President Joseph “Erap” Estrada, who made an alleged agreement with China to remove the BRP Sierra Madre from the Ayungin Shoal. Ejercito said the claim that it was his father who committed to removing the BRP Sierra Madre from Ayungin Shoal is “impossible,” since it was Estrada who ordered the grounding of the World War II ship in the low-tide elevation. “That claim seems inconsistent. The mere fact President Estrada was the one who ordered the BRP Sierra Madre be grounded in Ayungin Shoal, it’s impossible he will commit to remove the same,” he told reporters in a Viber message. He also took a swipe against columnist Rigoberto Tiglao, who claimed it was his father who made such a commitment to China. “At least President Erap had the courage to fight for our sovereignty,” he said. “Unlike them who paved the way for NBN-ZTE, the first salvo of Chinese intrusions in our country,” he added, referring to the canceled National Broadband Network project with ZTE Corp., a Chinese telecommunications firm, during the time of former president Gloria Macapagal Arroyo, now Pampanga 2nd District Representative. Tiglao served as the former presidential spokesperson and Chief of Staff of Arroyo, who served as the 14th president of the Philippines following the ouster of Estrada during the second People Power Revolution or EDSA II in 2001. China is insisting on its territorial rights over the Ayungin Shoal, which is located 105 nautical miles west of Palawan and is part of the Philippines’ exclusive economic zone. It also claimed the Philippine government had repeatedly made promises to tow away the grounded BRP Sierra Madre from Ayungin Shoal. “Who was closer to China? Was it Erap? The VFA was in fact approved also during his time,” said Ejercito, referring to the Visiting Forces Agreement between the Philippines and the United States. According to the Department of Foreign Affairs, the Philippines decided in 1999 to deploy the BRP Sierra Madre as a permanent station on Ayungin Shoal in response to China’s illegal occupation of Panganiban Reef in 1995. Bongbong’s foreign policy: More like ‘Macoy’ than ‘Digong’
Despite being dismissed as a spoiled brat and a weakling by both his father and the man he succeeded, Rodrigo Duterte, President Ferdinand Marcos Jr., in his first year in office, stood up to China and showed he is more like the older Marcos than Duterte. Always underestimated, Marcos Jr., observers noted, spent much of his political career surrounded by powerful women, including former First Lady Imelda Marcos and his sister, Senator Imee Marcos. But this shouldn’t fool one into thinking that he is not his own man. Only days after winning last year’s presidential elections, he asserted his independence by denying top allies, including running mate Sara Duterte, key cabinet positions. He also showed his own distinct approach on the foreign policy front by holding cordial meetings with diplomats from both traditional and regional partners. While emphasizing his preference for a diplomatic engagement with China, Marcos Jr., notes the Asia Maritime Transparency Initiative, reiterated the finality of the arbitral tribunal ruling in the South China Sea, and made clear he “will not compromise it in any way,” calling the country’s sovereignty “sacred.” “Taking into consideration the widespread skepticism towards Beijing among Filipinos and within the country’s defense establishment, Marcos Jr. adopted a calibrated assertiveness towards China while welcoming pragmatic cooperation on the economic front,” AMTI said. The perceived wisdom on the younger Marcos’s foreign policy, according to AMTI, is that he is nothing but a mild-mannered version of Duterte. In fact, he was the only candidate during the elections who publicly backed full continuity in the country’s Beijing-friendly policies. He barely mentioned the treaty alliance with the United States, emphasizing his preference for a diplomatic engagement. “Whatever we do, we can’t go to war… we don’t want to go to war with China,” he was quoted to have said. A year into office, however, it is obvious the younger Marcos was advocating a centrist position in the territorial dispute. It was, according to one analyst, a middle-of-the-road decision aimed at appeasing both superpowers, China and the United States. Indeed, it was a balancing act complicated by both internal and external factors. While Duterte was reluctant to confront China over the South China Sea, Marcos Jr. has adopted tougher rhetoric, showing a better appreciation of how the Philippines should position itself given the very uncertain strategic environment it is facing. He is said to have been able to forge closer relations with Washington because his family already has long-standing ties with Beijing which affords him a degree of capital. Despite the growing Chinese coercive actions against the Philippine Coast Guard and Filipino fishermen in the West Philippine Sea, Marcos Jr. welcomed continued economic engagement with China under his “Friend to all, enemy to none” policy first espoused by Duterte during his pivot to Beijing. Balancing act Compared to former presidents before him, Marcos Jr.’s foreign policy is truly a balancing act not much different from his father’s. Ferdinand Marcos Sr. (1965-1986), during his presidency, pursued a foreign policy that sought to balance relations with both the United States and other countries, including those in the Soviet Bloc. He declared martial law in 1972, and this had implications for the country’s foreign relations. The Philippines’ relationship with the US was close, but during his time, Marcos also sought to strengthen ties with our Asian neighbors. Corazon Aquino (1986-1992) focused on restoring democracy and human rights in the Philippines after the end of the Marcos dictatorship. She sought to rebuild relations with other countries that had been strained during Marcos’s rule. Her administration also emphasized diplomatic engagement with ASEAN countries and the international community. Fidel V. Ramos (1992-1998) prioritized economic diplomacy and focused on attracting foreign investment to boost the Philippine economy. He worked to strengthen relationships with ASEAN and APEC countries and fostered ties with the US, Japan, and other regional partners. Joseph Estrada (1998-2001) emphasized national sovereignty and non-interference in domestic affairs. He pursued good relations with ASEAN nations but was criticized for a more inward-looking approach to foreign affairs. Gloria Macapagal-Arroyo (2001-2010) focused on economic diplomacy and sought to improve the Philippines’ standing in the international community. She maintained strong ties with the US and also expanded engagement with China. Benigno “Noynoy” Aquino III (2010-2016) emphasized upholding the rule of law in the region and advocating for the Philippines’ territorial claims in the South China Sea. He strengthened relations with traditional allies like the US and worked to foster closer ties with other Asian countries. While Bongbong Marcos is not his father, the legacy of the former Filipino strongman hangs over his administration. This legacy of pragmatism is also reinforced in the sentiments of the defense establishment and the broader Filipino public who want the government to take a tougher stance against China. Last September, First Lady Liza Araneta-Marcos posted on her official Facebook page a photo showing her at the groundbreaking ceremony of the new catering area in Malacañang. No other details of the project were released. The post got mixed reactions from netizens. However, despite the praise and criticisms of said post, it somehow got us into thinking — who are the people behind the important functions of each and every chief executive living in the Palace? Hands down, Glenda Rosales Barretto comes to mind. The one and only doyenne of Philippine cuisine. She of the Via Mare fame. From Ferdinand Marcos Sr. down to Ferdinand Marcos Jr., Barretto presided over numerous state dinners in Malacañang. The most recent was the inaugural ball of the 17th president of the Philippines, Ferdinand “Bongbong” Marcos Jr. Barretto is caterer extraordinaire well-known for reinventing and refining Filipino dishes fit to be served at the highest tables in the land. During PBBM’s inauguration, she served savory chicken soup with ginger, lemongrass and green papaya (more like a deboned chicken tinola), prawn in roasted coconut cream, seared prime beef tenderloin with kaldereta sauce and guava-basil sorbet. Barretto is also popular for her humba (a Visayan braised pork similar to the classic adobo), crispy adobo flakes (ultra crunchy and extra flaky dish using chicken, beef or pork), pancit luglog, puto bumbong and bibingka. Via Mare, founded in 1975, has a well-established and long-standing reputation of being the choice concessionaire to do banquets for heads of state and international guests in the Palace serving traditional flavors. Tripartite Agreement for Joint Marine Seismic Undertaking (JMSU) unconstitutional–SC
The Supreme Court ruled with finality its January 2023 decision declaring as unconstitutional and void the Tripartite Agreement for Joint Marine Seismic Undertaking (JMSU) entered into by the government during the term of former President Gloria Macapagal-Arroyo with China and Vietnam in 2004. The Court’s en banc issued a resolution penned by Associate Justice Samuel H. Gaerlan which held that the motion for reconsideration (MR) filed by the government failed to raise new arguments that would warrant the reversal of the said decision. The MR according to the court, “merely repleaded the issues raised in the comment and memorandum, which the Court had already passed upon in the assailed decision.” In its January 2023 decision, the SC declared the JMSU unconstitutional for allowing wholly-owned foreign corporations to participate in the exploration of the country’s natural resources without observing the safeguards provided in Section 2, Article XII of the 1987 Constitution. Under the JMSU, which expired in 2008, the Philippines, China and Vietnam through their respective national oil corporations -- Philippine National Oil Company (PNOC), China National Offshore Oil Corporation (CNOOC), and Vietnam Oil and Gas Corporation (PETROVIETNAM) -- agreed to conduct joint explorations of the disputed South China Sea but up to 80 percent of the JMSU site is within the Philippines’ 200-mile exclusive economic zone. The case stemmed from the petition filed Bayan Muna Party-List Representatives Satur C. Ocampo and Teodoro A. Casiño, Anakpawis party-list Rep. Crispin Beltran, Liza Maza and Luzviminda Ilagan of the Gabriela Women’s party-list groups, then Rep. Lorenzo Tanada III and former senator Senator Teofisto “TG” Guingona III. Respondents in the petition were then president Gloria Macapagal-Arroyo, her executive secretary Eduardo Ermita, her foreign and energy secretaries as well as the Philippine National Oil Company and the Philippine National Oil Company-Exploration Corporation. The court in denying the MR, the Court reiterated that the JMSU is unconstitutional as it involves the exploration of the country's natural resources. Since the objective of the JMSU as stated in its Fifth Whereas Clause is “to engage in a joint research of petroleum resource potential” in the Agreement Area, the agreement clearly involved exploration, the Court noted. It dismissed the respondents' insistence that JMSU does not involve exploration considering that the term “exploration” under R.A. No. 387 (Petroleum Act of 1949) was already repealed by Presidential Decree (PD) No. 87 or the Oil and Exploration and Development Act of 1972. But the Court held that PD No. 87 does not provide a contrary definition for the term “exploration” and does not at all define “exploration.” Likewise, the Court noted that, that for the JMSU to be valid, it must be executed and implemented under any of the following modes under Section 2, Article XII of the Constitution (National Economy and Patrimony): : (1) directly by the State; (2) through co-production, joint venture or production-sharing agreements with Filipino citizens or qualified corporations; (3) through small-scale utilization of natural resources by Filipino citizens; and (4) through agreements entered into by the President with foreign-owned corporations involving technical or financial assistance for large-scale exploration, development, and utilization of minerals, petroleum, and other mineral oils. The JMSU, the Court held, does not fall into the first three modes since it involves foreign-owned corporations. “For an agreement/contract under the fourth mode to be valid, it must foremost be entered into by the President himself or herself. In the case at bar, the President is neither a party nor a signatory to the JMSU and the contracting party is PNOC,” the SC added. It also pointed out that the government has no full control and supervision under the JMSU since under Articles 11.2 and 11.4 of the agreement, the PNOC “illegally allowed joint ownership of information about our natural resources” with CNOOC and PETROVIETNAM. The argument of the respondents that the government did not lose control and supervision over information about our natural resources was belied by JMSU’s provision stating that the parties to the agreement shall have equal rights, interests, and obligations, according to the SC. Under JMSU, the Court said the PNOC and/or the Government would even need the prior written consent of CNOOC and PETROVIETNAM before it could disclose any of the information acquired. Gibo and Ted, as they are often referred to by many, are the two newest officials to join the Marcos Jr. Cabinet. That it took almost a year to fill the key positions at Defense and Health may be taken in either a positive or negative light, with people likely to veer either way depending on their political colors. Gilbert Teodoro and Dr. Teodoro Herbosa, upstanding men they may be to their friends and family, may just as easily be criticized for past actions, devotions, or decisions. Who are we to know, really, what they can do unless we look at their track record and reputation? Still, the most critical (or cynical) may argue that these are no guarantee that they can “do the job.” We will know in the end, won’t we, but there is never a bottom in the well of hope. The real question, as we may simply put it, never mind the whispers and whines, is this: are they the right men for the job? These are transformative times, as we often say. Experienced and capable as they may be, Gibo and Ted are coming in at a time when many factors have changed for the departments they are set to lead. Or, indeed, for the world. Teodoro has headed the Department of National Defense before. Yet in then President Gloria Macapagal-Arroyo’s time, the DND did not experience the level of aggression now being felt from China over territorial disputes. Dr. Herbosa is also not new to the Department of Health, having served as undersecretary during Noynoy Aquino’s presidency. He was also part of the Duterte government’s Covid-19 task force. The post-pandemic realities in the health sector will present him with fresh challenges, to be sure. It gets more interesting when one examines either man’s roots or affiliations, especially if looking into “why” they were given the government position. Teodoro’s ties to the Cojuangco clan and its “yellow” connotation, some say, could make it a little difficult for him this time around. However, his Marcos ties are also clear: his mother, Mercedes Cojuangco, was a member of the Batasang Pambansa during the Marcos Sr. presidency. Danding Cojuangco, his late uncle, was an ally of Ferdinand Marcos Sr. As DND secretary under Arroyo, he was a popular figure, touted as “the youngest person ever to hold the post” at age 43. He had a brilliant run until, some say, the president’s unpopularity at the time rubbed off on his chances to win elections. Some allege that he was “burned out” by the politics of the time — but that is all conjecture, as Teodoro practically went off the political grid for a decade, resurfacing to travel to Davao City and see than possible presidential bet Sara Duterte. Herbosa, medical trauma expert regarded as “a controversial figure during the pandemic,” has all the qualifications for the job, and likely both the strength and humility to handle problems when they arise. Joey Concepcion said Herbosa would help the government keep Covid-19 under control and keep public health in good standing, a must to have the national economy running at full capacity, a report says. So, back to the question: Are they the right men for the job? If they are to prove this, we have to set aside doubt and the tendency to speculate and just give them the chance they deserve. Former President Rodrigo Duterte and former Special Envoy to China and chief executive officer of Liwayway Marketing Corporation Carlos Chan were chosen to receive this year’s Award for Promoting Philippines-China Understanding or APPCU. Duterte and Chan were chosen as the Hall of Famer of APPCU among more than 30 applicants, as the award-giving body recognized their “prestige and stature and immense effort of work that they have over time, as evidenced by the extent of reach, impact, and reception of their works by communities and societies.” Aside from them, other awardees for the APPCU’s Outstanding Contributions are former Ambassador to Greece and Cyprus, Rigoberto Tiglao and Jaime Cruz, former Special Envoy to the People’s Republic of China’s Trade and Investments. On the other hand, recipients of Major Contributions are Regina Rosa Tecson, the director of the Satellite Office of Vice President Sara Duterte in Davao City and Jose Ong Tajan, the former president of APCU Baguio and the former chairman of the Filipino Chinese Chamber of Commerce of Baguio City. The formal bestowing of the award will be on 8 June at the Manila Hotel. APPCU, an annual undertaking, is a joint project of the Association for Philippines-China Understanding, or APCU, and the Embassy of the People’s Republic of China in the Philippines. Though it is in its third year already, relatively speaking, it is a novel award-giving body that pays special tribute to Filipinos who have made efforts through time to strengthen friendly ties and promote mutual understanding between the Philippines and China using their respective advocacies and expertise in the various fields and disciplines of mass media and public service; trade and commerce; and arts, culture, and the sciences. APPCU was conceptualized and launched on 16 July 2021 by then-China State Counselor and Foreign Minister Wang Yi and former Philippine President Gloria Macapagal-Arroyo, during the inauguration of the Manila Forum for China-Philippines Relations. The primary rationale behind launching APPCU is to actively continue promoting friendship between China and the Philippines and enhancing people-to-people exchanges, noting that amity between people holds the key to sound state-to-state relations. Essentially, the award is locating people who made a mark and contributed much effort through time in the improvement and advancement of Philippines-China bilateral friendly relations and understanding. PGMA clears FL from ‘coup’
Breaking her silence on the alleged House tussle, former President, now Deputy Speaker Gloria Macapagal-Arroyo slammed efforts to drag First Lady Liza-Marcos into allegations that the latter supported a plan to oust Speaker Martin Romualdez. The effort to pull her into the friction at the legislature “is disrespectful to her and to her intelligence,” Arroyo said in a social media post yesterday. “A report is going around that I was ‘duped’ by a congresswoman into thinking that the alleged House coup had the blessings of the First Lady. I am truly sorry that she should even be dragged into this political fantasy of a House coup,” Arroyo said. She slammed efforts to spread “pathetic rumors” from those who “are the ones duping the Filipino people.” “They should now move on to the serious business of making positive contributions to national progress,” Arroyo said of the rumor mongers. The social media post came on the heels of allegations that she orchestrated a failed coup against Romualdez. Rumors flew thick about the failed ouster move on 17 May when members of the House, before it adjourned session, voted Pampanga Representative Aurelio Gonzales Jr. as the new senior deputy speaker in place of Arroyo. Gonzales is one of the chamber’s deputy speakers before he was promoted to the second-highest post at the House. The reason given for the switch in posts was that it will relieve Arroyo of “the heavy load required from the position.” Congratulations flowed A day after the apparent demotion, congratulatory messages from congressmen from prominent political parties in the House poured for Gonzales, as well as for Romualdez, which caused more tongues to wag. But the former Chief Executive previously set the record straight, saying that despite her previous ambitions, she had no intention of succeeding Romualdez and that she respected Mr. Marcos’ choice to support his cousin as House leader. “I will just say three things: Every politician worth his or her salt would know that in the Philippines, no House coup can ever succeed without the consent of the President. That is simply a fact of life in Philippine politics.” “Second, I made a humble contribution to the joining of forces that became the UniTeam, and the resulting supermajority in the House is a major force for delivering our President’s agenda. Thus, I would never take any action to destroy it.” “Third, I did not have any conversation, here or abroad, with any congressman or congresswoman, or any other politician active or retired, to plot, support, encourage or participate in any way in any alleged House coup.” Arroyo’s post puts it. Likewise, Arroyo firmly stated that being Speaker once more “is no longer part of my political objectives.” Arroyo held the post from 2018 to 2019. Arroyo added that when she learned of reports that she was suspected of plotting a “coup” against Romualdez, “I decided I must speak out to clarify my political position.” She ceded, however, that some of her actions may have been “misconstrued, such as my recent trip with a delegation of Congressmen to South Korea for some official meetings.” Arroyo insisted that her only aims as representative of the 2nd district of Pampanga were to support the legislative agenda of Speaker Romualdez and President Marcos and to use whatever experience as a former President to help out “when I am called upon to do so.” Diplomatic responsibility Outside of her role as Congresswoman, her public interest is to help reduce tension between the United States and China, “given that I was strongly allied to both countries when I was President.” Arroyo was elected Speaker of the 17th Congress in place of Davao del Norte Rep. Pantaleon Alvarez. The fire was further fueled by an announcement of Vice President Sara Duterte, after the Arroyo’s demotion, that she was tendering her “irrevocable resignation” from the ruling Lakas-CMD, which she co-leads with Romualdez. Days following Arroyo’s statement, Romualdez slammed claimed attempts to destabilize the House, declaring that the lower chamber was “in order” and would not in any way allow political maneuverings. “There is still much work to do, so occasional moves to destabilize the House should be nipped in the bud,” he said. After exchanging barbs, Romualdez and Arroyo were seen together at the rostrum at Gonzales’ oathtaking on Monday last week, indicating that no further turmoil was on the horizon. Before the ceremony, Romualdez and Gonzales even made a traditional gesture of respect on Arroyo on the plenary floor with a pagmamano. The next day, Romualdez and Arroyo were spotted together after the swearing-in of 19 new Lakas-CMD members, dousing all suspicions of the leadership dispute in the chamber. Decades-old EPIRA needs to catch up — DOE
The Department of Energy is carefully studying the Republic Act 9136 or the Electric Power Industry Reform Act of 2001 or EPIRA to ensure that the more than two decades-old law can keep up with the changing energy landscape while upholding the interest of the consumers. “Right now it is a case of there is always a continuing effort to amend the EPIRA so that we can adjust certain parts that may require some tweaking,” Energy Secretary Raphael Perpetuo Lotilla said in a recent interview with reporters. Lotilla said the EPIRA amendments can be related to the Energy Regulatory Commission’s powers and penalties it may impose and the Philippine Competition Commission's powers relative to the energy sector. “These are just some of the things that we need to clarify, but even without these amendments within the framework of the existing EPIRA we will proceed,” he added. The EPIRA passed during the time of former President Gloria Macapagal Arroyo, mandates ERC and PCC to promote competition, encourage market development, ensure consumer choice, and penalize abuse of market power in the restructured electricity industry. The law also promotes competition by creating a level playing field, among others, in the competitive retail electricity market. In a hearing at the House Committee on Energy last week, Undersecretary Sharon Garin, disclosed that the EPIRA should be realigned to ban foreign-owned or foreign government-backed enterprises from engaging in power transmission. The DoE has drafted a bill backed by lawmakers to include additional paragraphs in EPIRA that would effectively ban the involvement of companies controlled or acting on behalf of foreign governments in the country's electric transmission business. Once the bill is passed into law, state-run enterprises currently operating in the country will be forced to divest their investments within 10 years. Meanwhile, Meralco's First Vice President and Head of Regulatory Management Jose Valles also warned that lower investments in the generation sector can lead to higher electricity prices due to the absence of competition amid fewer players. Currently, the country's transmission system is solely operated by the National Grid Corporation of the Philippines, a private company whose 40 percent stakes are owned by the State Grid Corporation of China.
