Patriots owner s prostitution case heads to appellate court
By TERRY SPENCER Associated Press FORT LAUDERDALE, Fla. (AP) — Prosecutors charging New England Patriots owner Robert Kraft with twice buying sex from massage parlor prostitutes will attempt to save their case this week by arguing to an appeals court that his rights weren't violated when police secretly video-recorded him in the act. Prosecutors will tell the Florida Fourth District Court of Appeal during an online hearing Tuesday that a county judge erred when he invalidated the January 2019 search warrant allowing police to install secret cameras at Orchids of Asia spa as part of an alleged sex trafficking investigation. The judge said the warrant didn’t sufficiently protect the privacy of innocent customers who received legal massages, and he barred the videos’ use at trial as well as testimony about what they showed. If the ruling stands, it will deal a fatal blow to the prosecution's case. “Mr. Kraft's guilt is a virtual certainty” and he has no right to benefit from any possible mistakes police made involving innocent customers, Deputy Solicitor General Jeffrey DeSousa wrote in court documents. Kraft's attorneys vehemently disagreed, arguing that if the three-justice panel allows the videos' use, “civil liberties cherished in Florida and beyond” will be endangered. “If the state wins this appeal, then everyone loses, not just the accused,” attorney Frank Shepherd wrote. “Government could run roughshod over privacy and constitutional rights while evading scrutiny.” The Jupiter police recordings led to misdemeanor charges against Kraft and two dozen other alleged Orchids of Asia customers. The spa owners and some employees are charged with prostitution-related felonies. Most cases are in limbo while the appeals are heard. If prosecutors can’t use the videos, they would almost certainly dismiss any misdemeanor charges awaiting trial. Some defendants took plea deals but Kraft refused. The felony cases could proceed, as those have other evidence besides the videos. Kraft, a 79-year-old widower and part-time Palm Beach resident, has pleaded not guilty but issued a public apology. He faces a possible one-year jail sentence if convicted, but would likely receive a fine, community service and other sanctions. Kraft, whom Forbes Magazine ranks as the 82nd richest American with a worth of almost $7 billion, is employing several high-priced attorneys to fight the charges. DeSousa submitted several arguments against Palm Beach County Judge Leonard Hanser's ruling. Among them: — The warrant is valid because police minimized any privacy invasion by having only three detectives monitor video. Any further minimization, such as recording only snippets of each massage, would have made the investigation impossible. — Kraft illegally paid for sex and is lawfully covered by the warrant, even if the justices determine police violated innocent customers' privacy rights. — If the warrant is invalid, the detectives relied on it “in good faith” and a sanction banning the video is too extreme. Shepherd submitted several counterarguments for Kraft. They include: — Detectives' privacy protection efforts were insufficient because they recorded seminude men and women receiving legal massages, making the Kraft recordings also illegal. — Police had enough evidence to charge the spa owners with felonies without recording, making the cameras “wholly gratuitous." — The evidence detectives presented to obtain the magistrate's warrant approval was “deliberately misleading,” negating any argument they acted in good faith. The justices won’t immediately rule after the hearing; decisions usually takes weeks. The losing side will likely appeal to the Florida Supreme Court, which could accept the case or let the justices’ ruling stand. Authorities say the Orchids of Asia investigation was part of a multicounty probe into possible sex trafficking by spa owners who they believe brought women from China and elsewhere to work as prostitutes. About 300 people were charged with various felonies and misdemeanors, but no trafficking charges were pursued — prosecutors say they received no cooperation from masseuses whom they suspect were trafficked. According to police, Kraft's chauffeur drove him to Orchids of Asia on the evening of Jan. 19, 2019, where detectives recorded him engaging in a sex act with two women and then paying an undetermined amount in cash. Investigators said Kraft returned the next morning and engaged in recorded sex acts with a woman before paying with a $100 bill and another bill. Hours later, Kraft was in Kansas City for the AFC Championship game, where his Patriots defeated the Chiefs. His team then won the 2019 Super Bowl in Atlanta, the Patriots’ sixth NFL championship under his ownership. Prosecutors offered to drop the charges if Kraft entered a diversion program for first-time offenders. That would include an admission he would be found guilty if the case went to trial, a $5,000 fine, 100 hours of community service and attending a class on the dangers of prostitution and its connection to human trafficking. Deceased Maine shooter had mental health problems: police
Police in Maine said Saturday that the man who gunned down 18 people at a bar and a bowling alley and later committed suicide, suffered serious mental health issues, but was able to buy weapons legally because he had never been forcibly committed to treatment. The body of Robert Card, a 40-year-old army reservist, was discovered Friday night inside a tractor-trailer near a recycling center where he used to work, said Maine public safety commissioner Mike Sauschuck. Card had shot himself. Investigators are still struggling to determine Card's motive for carrying out Wednesday's massacre in the town of Lewiston. However, Sauschuck said that Card had reportedly been hearing voices and suffering from paranoia. "Clearly there's a mental health component to this," Sauschuck told reporters. Investigators found a "paper-style" note that Card had left to a loved one which contained a password to his phone and bank account information, Sauschuck said, adding that the note had the tone of a suicide letter. Card was found in possession of three weapons, one of them a long gun, all purchased legally because he had never been forcibly committed to a mental institution. Despite the apparently clear mental health issues and a reportedly recent psychiatric evaluation undergone by Card, "a background check is not going to ping that this individual was prohibited," Sauschuck added. The sigh of relief The discovery of Card's body ended a massive two-day manhunt, which had this quiet city of 38,000 people on lockdown, with businesses and schools closed and residents terrified. Sauschuck acknowledged the help Card's family had provided to the investigation, saying his relatives were among the first people to call the police and identify the suspect. "This family has been incredibly cooperative with us," he said. Lewiston finally breathed a sigh of relief with businesses beginning to open and people appearing on the streets Saturday. Several posters reading "Lewiston strong" were seen in the city. Shukri Abasheikh, 60, was finally able to reopen her halal grocery store after the lockdown. "This morning I'm so happy because the last two days, we were worried a lot and we were scared," Abasheikh told AFP. "My customers were calling me saying we don't have milk, we don't have anything, can you open and I said, 'I'm scared.'" Upon learning that Card was dead, Sheri Withers, 44, owner of a Lewiston art gallery, said she felt "a balance of relief and remembering how to breathe, but also just being sad because, you know, it was a human life." For now, residents are "just trying to rebuild the pieces, and getting on from here is gonna be the next step for our community," she added. A local resident named Danica, who was buying coffee at a drive-through, said she was happy Card was dead, but at the same time wished he had first been brought to justice. "I think he took the coward's way out of doing it by suicide," Danica, who declined to give her last name, told AFP. "I think he should be held accountable for his crimes." In a statement issued shortly after Card's body was discovered Friday night, President Joe Biden vowed to renew efforts to curb gun violence in the United States. COMELEC disqualifies QC SK chairman candidate for ‘vote buying’
A candidate for Sangguniang Kabataan chairmanship in Quezon City was disqualified by the Commission on Elections over 'vote buying' charges. In a seven-page resolution issued on 26 October 2023 and signed by COMELEC's Second Division Presiding Commissioner Marlon Casquejo, concurred by Commissioners Rey Bulay and Nelson Celis, noted that SK candidate Judielyn Bartolome Francisco of Barangay San Bartolome was "disqualified" to run for the upcoming BSKE elections as she violated Section 68 (a) of the Omnibus Elections Code for "vote buying". The case stemmed from a petition filed by Arjay Lacsa on 26 September this year, who claimed that Francisco engaged in vote buying by sponsoring and funding a leadership seminar "cum" team building of some 80 youths of their village at Paradise Adventure Camp in San Jose Del Monte, Bulacan held on 16 and 17 September 2023, a few weeks after the filing of candidacies. Pieces of evidence presented by Lacsa included social media posts of the participants themselves tagging Francisco as their " future SK chairman" and three affidavits of witnesses who claimed that Francisco was even present in that event. On 5 October, the COMELEC summoned Francisco to explain her side who gave her reply on 9 October saying she did not have the resources to fund the gathering while she also admitted being there as a host for the opening program "in return for a professional fee." She also informed the commission that she also filed perjury charges against Lacsa's witnesses at the Quezon City Prosecutor's Office. The commission, however, concluded that they "are not convinced" as Francisco's lengthy answer reveals that "they are in the nature of general denials emanating from respondent's self-serving and uncorroborated statements." Pilmico on World Bread Day: Bread’s transformative impact on communities
Every year on 16 October, the world celebrates “World Bread Day” to honor all kinds of bread around the world. A dietary staple in people’s lives for centuries, bread plays a much more significant role in the lives of those who bake bread as their primary source of livelihood. Pilmico has been a steadfast partner of bakers since 1962. It has given out 108 bakery kits nationwide since it started distributing livelihood kits in 2016. In honor of the “World Bread Day,” Pilmico reflects on how it has helped change the lives of several people through bread. Feeding the future Pilmico’s “Kutitap Feeding Program” was launched as a sustainable initiative to address malnutrition in public schools while at the same time supporting local bakeries. The program was made possible through the help of its partner bakeries, who went through technical training and received equipment from Pilmico. They provided bread to public schools within their communities. The Kutitap Feeding Program started in Iligan City in 2015 and in Tarlac in 2018. Since then, the program has progressively evolved through the years. Due to pandemic restrictions, it was turned into the “Kutitap Care Package,” where students received baked goods and eggs through its partner bakery, Aguila Bakeshop. Now, the program has also started incorporating meats in the meals served to the daycare students in Bamban, Tarlac. Aside from feeding students with nutritional bread, this initiative also contributed to the success of some partner bakeries such as C&G Bakery from Iligan City. Marlon C. Gecale, owner of C&G Bakery, has devoted his life to baking — from when he was a teen working as a baker to an adult owning his bakery. In between, he worked as an OFW and his passion for baking grew stronger, prompting him to have his own bakery. After buying an oven with his first salary, Gecale and his wife spent the next five years building their small bakery while he worked abroad. In 2017, they applied to become a bakery partner for Pilmico’s “Kutitap Feeding Program.” They were determined to prove that their small bakery could fulfill the demands of the program despite their new and small bakery. By partnering with Pilmico for the Kutitap Feeding Program, C&G Bakery, owned by Marlon Gecale, was able to expand to three more branches in Mindanao. Gecale underwent a month-long training with Pilmico where he earned new technical skills in baking and new recipes, which he still uses in his bakery. Since then, their bakery has grown and has been a reliable partner of Pilmico in various programs including the Iligan Community Pantry. Today, C&G Bakery has expanded to three branches in Iligan City, Misamis Oriental and Zamboanga del Sur. 'Tinapay Ti Uno' program Aside from Pilmico’s own initiatives, it has partnered with local government units such as the Department of Agrarian Reform Tarlac for the “Tinapay Ti Uno” program in partnership with Technical Education and Skills Development Authority, Department of Trade and Industry and the Office of Congressman Jaime Cojuangco from the 1st District of Tarlac province. This program aims to create healthy buns using locally sourced ingredients from Agrarian Reform Beneficiary Organizations and provide them to public school students in the 1st district of Tarlac. A total of 11 ARBOs participated in a bun and special bread competition where the winners will be responsible for the distribution of buns to the students. In the competition held last 24 2023, three ARBOs were hailed as the grand winners: Cabayaoasan Farmer Agriculture Cooperative from Paniqui, Tarlac; Bacabac Farmers Producers Cooperative from Brgy. Bacabac, Camiling, Tarlac; and Sinulatan 1st Agriculture Cooperative from Brgy. Sinulatan 1st, Camiling, Tarlac. Each winner received a bakery livelihood package from Pilmico that included an oven, stainless steel table, bread rack, bread showcase, proofer with cover, spiral mixer and 10 Pilmico flour sacks. In addition to the equipment, the winners were to receive technical assistance and bakery management training from Pilmico as they set up their bakery business. During the winners’ onsite bakery training in Camiling, Tarlac last 3 October, it was revealed that two out of the three ARBOs have already opened their bakeries within their communities. Luxembourg, EU’s richest country, grapples with housing crisis
Luxembourg's residents may be classified as the wealthiest in the European Union, but the sky-high cost of buying or renting a home in the country has made living there nearly impossible for some. The crisis has become the number one concern in the Grand Duchy of 660,000 people -- smaller than Rhode Island, the smallest US state -- as it goes to the polls on Sunday. Pascale Zaourou, a teacher and mother of three children, had to wait five years before being able to access coveted social housing. "On the private market, renting an apartment with two rooms costs at least 2,000 euros -- it's difficult with only one income," she told AFP at a recent demonstration in Luxembourg City. "Affordable housing is scarce, especially for young people and single-parent families," she said. Antoine Paccoud, a researcher at the Housing Observatory, which compiles data guiding government policy, backed up that sentiment. "More and more Luxembourgers are crossing the border to live in Germany, Belgium, or France just because rents and property prices are lower," he said. The situation is jarring for a country with a flourishing economy based around financial services. Net average earnings for a single worker in Luxembourg were 47,000 euros ($49,000) annually in 2022, according to estimates from the EU's statistics agency -- the highest in the bloc. 'Overshadows all others' In the capital city, new-build flats sell for 13,000 euros per square meter (around $1,300 per square foot) and older ones go for 10,700 euros. The average cost of a house is 1.5 million euros. Rents increased by 6.7 percent between June 2022 and June 2023, much faster than the inflation rate of 3.4 percent over that period. Philippe Poirier, a political analyst at the University of Luxembourg, told AFP that housing has become "the question that overshadows all others" at the legislative elections. He ticked off "the scarcity of housing and land, the cost of construction or purchase, and the high rents" as the key problems. The two major political parties hoping to spearhead the next government have pledged action. Prime Minister Xavier Bettel's Liberal Party promised to create a super-ministry for housing, wants to tax vacant properties more and invest in social housing. Socialist leader Paulette Lenert -- the health minister in the current coalition government -- is pushing for huge investments in affordable housing. 'Holding on to land' But the structural problems with housing run deep and changing them will not be easy. Paccoud said a lack of inheritance tax and only symbolic duties have encouraged owners to sit on land without developing it. "0.5 percent of the resident population, or 3,000 people, own half of the buildable land," he said. "These owners are holding on to their land as long as possible because prices are increasing." The economic opportunities on offer also bring in droves of foreign workers, which helps drive up the cost of the limited housing pool. Around half the people living in Luxembourg are not citizens of the country. There is a wide gulf in terms of homeownership rates between native Luxembourgers, at 80 percent, and foreign residents at just 50 percent. While many Luxembourgers have nearly guaranteed jobs working for state institutions, foreigners have to deal with the changeable job market. "Those who are at the bottom of the scale in Luxembourg are rather the resident foreigners," Poirier said. Marcos: Free rice distribution to continue until prices normalize
President Ferdinand Marcos Jr. on Friday said the government will continue to distribute rice for free to Filipinos until prices stabilize, but that the goal is to normalize the situation so that market forces can take over. In a media interview with reporters after the distribution of rice in Siargao, Marcos said that the government has implemented various measures to stabilize rice prices, including price controls and the buying price set by the National Food Authority. "We will just have to – if we are able to stop all smuggling and hoarding, then there will be no need for us to provide it for free because prices will stabilize and remain stable, following the natural seasonal fluctuations," Marcos told reporters. After rice prices soared due to supply shortages, the government began distributing confiscated rice to Filipinos in several parts of the country for free. The President said the government is also implementing other measures to stabilize prices, such as price controls and purchasing rice from local farmers at a higher price. DND, AFP, Comelec sign pact for orderly barangay, SK elections
The Department of National Defense and the Armed Forces of the Philippines on Thursday signed an agreement with the Commission on Elections to ensure peaceful and orderly barangay and Sangguniang Kabataan elections nationwide on 30 October. Defense Secretary Gilberto Teodoro Jr. signed the pact with Comelec chairperson George Erwin Garcia at the DND headquarters in Camp Aguinaldo, Quezon City. The signing was also witnessed by AFP Chief Gen. Romeo Brawner Jr. and Comelec Commissioner Ernesto Ferdinand Maceda Jr., who is in charge of the Committee on Kontra Bigay. The Committee on Kontra Bigay aims to combat the “deplorable practice of vote buying”, which Teodoro said continues to pollute the country’s democracy. “Ang tao, naiimpluwensyahan ng mga bagay na hindi kanais-nais. Kaya po ang fault niyan ay nasa namimigay,” he said. On the other hand, Brawner signed a separate memorandum of understanding with Garcia allowing Comelec to deputize AFP personnel to ensure free, orderly and peaceful barangay elections.
