SEC extends amnesty program deadline til end of 2023
The Securities and Exchange Commission (SEC) has announced an extension of the amnesty program deadline for non-compliant and suspended or revoked corporations. The deadline to file amnesty applications and settle amnesty fees has been extended until the end of 2023. The amnesty program offers reduced penalties for corporations that have incurred fines for late or non-filing of their General Information Sheet (GIS), Annual Financial Statements (AFS), and official contact details. Corporations can avail of the amnesty by submitting an Expression of Interest form on their SEC Electronic Filing and Submission Tool (eFAST) accounts. Additional requirements must be submitted by January 31, 2024. Failure to submit the complete set of requirements will result in forfeiture of the amnesty fee and petition fee. The SEC has also released a list of corporations at risk of having their certificates of incorporation revoked for failure to submit their GIS. The updated scale of fines and penalties for reportorial requirements will be implemented on January 1, 2024. The SEC will strictly enforce the submission of reportorial requirements and impose penalties, including monetary fines, delinquency status, and suspension or revocation of a corporation's certificate of incorporation. Steps gaining exporter status under RCEP outlined
Exporters wishing to avail themselves of preferential tariffs under the Regional Comprehensive Economic Partnership can apply with the Bureau of Customs to become an approved exporter, according to a customs official. Gina German, head of the Preferential Rate Unit of the BoC Port of Manila, is encouraging Filipino exporters to start leveraging the RCEP’s benefits, foremost of which is being allowed to source materials and products from the 14 other member parties of the mega free trade agreement at lower duty rates. Study and comply German also urged companies to study and comply with the RCEP’s rules of origin (ROO), a requirement to get preferential tariff treatment under the world’s biggest trade deal. Essentially, the ROO can be regarded as a passport for products, a way to determine the country of origin of a product and establish its eligibility for preferential tariff treatment. It can help businesses reduce costs and boost their competitiveness within the regional market. Under RCEP, originating goods are those falling under three categories: wholly obtained in the RCEP party or member state of the agreement; those produced in a party exclusively from originating materials from one or more of the parties; and those produced in a party using non-originating materials, provided the good satisfies the applicable requirements set out in Annex 3A (Product-Specific Rules). Documentary requirements German said applicants seeking “approved exporter” status under RCEP should submit the following documentary requirements: • Duly accomplished application form • BoC’s Certificate of Registration • Product Evaluation Report or PER, if applicable Meanwhile, traders applying for approved exporter status, should submit a producer’s declaration indicating the originating status of the good for which the trader will be completing a declaration of origin and stating the producer’s readiness to cooperate in verification. “If you are a trader, you need to know who produces the good or you still have a declaration that it is originating in the Philippines so that you will be ready during the retro verification or verification of the importing country,” said German during her talk last month at a Department of Trade and Industry webinar. In addition applicants have to submit a list of the authorized signatories of the DO and their respective specimen signatures. The application form should be submitted in both hard copy and electronic Portable Document Format to the deputy commissioner of the Assessment and Operations Coordinating Group through the Customer Care Center or CCC. The Export Coordination Division or ECD will then evaluate the application based on the following criteria: Exporter is a legitimate exporter who must have been transacting with the BOC for at least one year prior to the date of application Exporter must have been exporting products to at least one RCEP party for at least one year • Exporter must have good compliance measured by risk management of the BOC • Exporter must have a sound bookkeeping and recordkeeping system • Exporter must have responsible officers or persons authorized to sign the DO, who must have sufficient knowledge, competence in ROO application • Exporter must be willing to be subjected to regular monitoring and inspection to determine correctness of its declaration with respect to the goods exported. Written authorization After evaluation the ECD will grant the status of approved exporter to the successful applicants by issuing a written authorization with its corresponding authorization code within 14 working days. From there, the BOC will input the details of the approved exporter in its Approved Exporter Database for circulation among the RCEP parties. RCEP came into effect officially for the Philippines on June 2, 2023 after the Senate finally ratified the agreement in February this year. The Philippines was the last country to ratify RCEP, a free trade pact among the 10 members of the Association of Southeast Asian Nations — Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, Vietnam — and the five ASEAN FTA partners Australia, China, Japan, South Korea, and New Zealand. ‘Fake wife’ intercepted by BI officers
The Bureau of Immigration (BI) warned on Friday the traveling public not to fall prey to recruiters providing fake documents. The warning was issued by BI in response to the case of a female traveler who was stopped from departing at the Ninoy Aquino International Airport (NAIA) on 19 October after a BI officer discovered that her departure had earlier been postponed after she was discovered using fraudulent travel credentials. The passenger stated she was traveling to Oman to visit her husband but the marriage certificate she produced was forged. She eventually admitted that every document she had submitted was a fabrication, including the purported affidavit of support from her partner. The passenger intended to depart for Malaysia in September of last year, but immigration agents stopped her because she was carrying the wrong paperwork, according to a later review of her travel history. According to the BI's immigration protection and border enforcement unit (I-PROBES), the victim even supplied an altered wedding photo to officials to mislead them. The victim also admitted that she paid more than P30,000 for the fake documents, which authorities believe were used to illegally work abroad. Her case was immediately forwarded to the Inter-Agency Council Against Trafficking (IACAT) to file cases against her recruiter. GM Robles assures ironed-ticket claimant of releasing his lotto winnings
The long wait for a jackpot lotto winner with a damaged winning ticket is finally over after Philippine Charity Sweepstakes Office General Manager Melquiades Robles has vowed that his office will abide by the Supreme Court's decision ordering the Agency to turn over the more than P12-million Lotto 6/42 jackpot prize to the bettor. GM Robles warmly received lotto winner Antonio Mendoza who visited him in his office on Wednesday (25 October) before assuring him that the winnings will be turned over once the documentary and other processes have been concluded. “I assured him that I would expedite the process of his claim. Kailangan lang may certificate of finality from SC. I will make sure that he enjoys the fruits of his winnings ASAP. I wanted to put a closure on this issue,” GM Robles declared. This was after the SC issued a 17-page ruling ordering the PCSO to release Mendoza's winnings amounting to P12,391,600.00. To recall, Mendoza, on 2 October 2014, placed three lucky pick bets for the Lotto 6/42 in an outlet in Batangas. He later found out that he won, but his granddaughter had crumpled the winning ticket. Mendoza's daughter then ironed the ticket with a piece of fabric covering it in an attempt to save it. However, this resulted in partially burning the ticket, erasing some details that the PCSO requires to award the prize. On 5 October 2014, Mendoza went to the PCSO Main Office in Mandaluyong City where he submitted a handwritten account of the incident to the legal department. However, since the damaged ticket could not be validated, he was told, on 20 October 2014, that he could not claim the prize. This was based on the PCSO's prevailing conditions on claiming/payment of winnings, "Prizes shall be paid to the holder of share/s of a winning ticket upon presentation and surrender of the same, provided that the ticket/s is/are free from any mutilation, erasure or stain, making any number/s therein illegible, and provided further that no court injunction restraining the PCSO to pay is received before payment."_ This prompted him to seek relief from the SC and after nine years of legal battle, the high court ruled that the circumstances surrounding the fact that Mendoza won the lottery were clearly established; and that the testimonial of Mendoza and his family were admissible. Thus, the PCSO is set to release Mendoza's winnings immediately once the necessary processes are finished. It is also ordered to pay legal interest of six percent per annum from the date of finality of the decision.
