Immigration officer convicted
The National Bureau of Investigation yesterday revealed that a Bureau of Immigration officer has been convicted for the falsification of travel records showing that former Wirecard chief operating officer Jan Marsalek was in the Philippines even if he did not arrive and leave the country in 2020. The NBI said BI officer Marcos S. Nicodemus has been found guilty by the Pasay City Regional Trial Court of violations of Republic Act 10175, the Cybercrime Prevention Act, and RA 3019, the Anti-Graft and Corrupt Practices Act. Though the RTC decision was not provided by the NBI, it said that Nicodemus “was sentenced by the court to a maximum imprisonment of nine years for each of the criminal cases with perpetual disqualification to hold public office.” Marsalek, an Austrian national, has been wanted by the German government for his involvement in the $2.2 billion Wirecard fraud. In 2020, the Philippine government joined the hunt for Marsalek due to Wirecard’s links in the country and discovered travel records that showed that the Austrian came to the Philippines in 2020. Then Department of Justice Secretary and now Solicitor General Menardo I. Guevarra ordered the NBI to conduct an investigation. In August 2020, the NBI “recommended to the DoJ the prosecution of subject Marcos Nicodemus for falsifying the travel records of an Austrian national.” “Investigation conducted by NBI-IAID (NBI-International Airport Investigation Division) revealed that based on Marsalek’s travel records, he arrived in the Philippines through NAIA Terminal 1 on 23 June 2020, processed by Immigration Officer Darren Ilagan but with a mysterious ‘canceled by user’ remark and departure on 24 June 2020 at Mactan-Cebu International Airport processed by Immigration Officer Perry Michael Pancho,” the NBI said. “However, NBI-IAID discovered thru CCTV (closed circuit television) footages that Marsalek never entered the Philippines and he did not even depart through MCIA,” the NBI said. The records of Marsalek were found to be spurious due to the following: Existing immigrations protocol as of that date disallowing passengers from entering Philippine territory due to Covid situation; absence of actual scanned data page of the passport; existing protocol that incoming flights of airlines disallowing the boarding of a passenger who will be prevented entry based on the destination country’s protocol as of flight date. MVP eyes MPTC float by next year
After the voluntary delisting of his infrastructure investment firm Metro Pacific Investments Corp. or MPIC from the local bourse, businessman Manuel V. Pangilinan is now planning to offer the shares of his tollways venture Metro Pacific Tollways Corp. or MPTC to the public by next year. “After the delisting, we will list our tollways... next year. The Maynilad has got to list by 2026. We will list our major subsidiaries,” Pangilinan said in an interview with reporters on the sidelines of the Mining Philippines 2023 International Conference and Exhibition on Wednesday. MPTC is the operator of the North Luzon Expressway, Subic-Clark-Tarlac Expressway, Cavite-Laguna Expressway, Manila-Cavite Expressway, NLEX Connector, and Cebu-Cordova Link Expressway. On the other hand, Maynilad, MPIC’s joint venture with DMCI Holdings, and Marubeni Corp., serves the west zone of the Greater Metro Manila area, covering 17 cities and municipalities. Tender offer closed Relatedly, in a separate disclosure to the stock exchange on Wednesday, MPIC confirmed that the tender offer for its shares is now closed. The company report stated that the total of tendered shares, excluded shares, and other non-public shares is equivalent to 97.22 percent of MPIC’s total issued and outstanding listed shares and has exceeded the threshold required to complete the voluntary delisting. Once tendered shares are accepted and crossed, MPIC’s public float will fall to 2.78 percent. Its total tendered shares, excluded shares, and other non-public shares, on the other hand, will be above the voluntary delisting threshold of at least 95 percent. Thus, bidders can now expect MPIC’s delisting around October. The Cross Date is scheduled for 26 September, while the Settlement Date is scheduled for 28 September. Commenting on these MPIC developments, Pangilinan said: “It’s amazing that the acceptances have been more than 99 percent. What are the implicit messages of that, the times have moved on. My theory is that conglomerates are passe.” Pangilinan noted that companies are now focusing on their ventures that are easier and simpler to analyze with only one product. “Filipinos have a natural aversion to something big, that is why our stock exchange is too small. And because it’s too small it impinges on the issue of liquidity. Investors, even foreign investors, want to go in and be able to get out whenever they want to,” he explained. SC to release results of 2023 Bar exams before Christmas
The Supreme Court disclosed that the results of the 2023 online Bar examinations will be released before Christmas while the oath-taking of new lawyers will be held before New Year. Yesterday, the three-day Bar exams started in 14 local testing centers (LTCs) nationwide. The SC said the last two days of the exams are on 20 and 24 of September. Associate Justice Ramon Paul L. Hernando, chairperson of the 2023 Bar exams committee, said: “For the longest time, Bar examinees have had to endure several months of perceived agony of waiting before the results of the professional licensure exams for future lawyers are released. “This year, however, following the examples of my recent predecessors as Bar Chair, the time spent by the examinees waiting in agony for the results of the exams will be cut short: my team and I are eyeing the release of the results of the 2023 Bar Examinations in early December before Christmas day. “Moreover, there will be simultaneous oath-taking and signing of the Roll of Attorneys in December also before Christmas day so that we will have our new batch of full-fledged lawyers before the year ends. “It will be an additional reason for those who will hurdle the Bar Exams to celebrate the Holiday Season.” Hernando added that as of 17 September, a total of 10,791, instead of 10,816 as earlier announced, will take the six-subject examinations spread over three days. The change in the number was a result of the withdrawal of 25 examinees who had earlier registered. As in previous examinations, they may still withdraw from the exams after the first day. Hernando said the conduct of the examinations by the SC will be assisted by 2,571 Bar personnel deployed in the 14 LTCs. The SC headquarters for the exams is at the San Beda College Alabang in Muntinlupa City is the appointed SC headquarters for the exams. “The 2,571-strong 2023 Bar workforce—which includes court officials; judges; numerous personnel from the Supreme Court, the Court of Appeals, the Sandiganbayan, the Court of Tax Appeals, and First-and Second-Level Courts; and volunteer lawyers in the government and private practice—are fully committed to ensuring the integrity and orderly process of this year’s Examinations,” Hernando said. Six core subjects are covered in the examinations—Political and Public International Law, 15 percent; Commercial and Taxation Laws, 20 percent; Labor Law and Social Legislation, 10 percent; Criminal Law, 10 percent; and Remedial Law, Legal and Judicial Ethics with Practical Exercises, 25 percent. The subjects yesterday were Political and Public International Law in the morning, and Commercial and Taxation Laws in the afternoon, from 8:00 a.m. to 12:00 noon and from 2:00 p.m. to 6:00 p.m. On 20 September 2023, the subjects covered are Civil Law in the morning and Labor Law and Social Legislation in the afternoon. On 24 September 2023, Criminal Law and Remedial Law will be in the morning, and Legal and Judicial Ethics with Practical Exercises in the afternoon. In the National Capital Region, the LTCs are at the San Beda University, Manila; University of Santo Tomas, Manila; SBCA; University of the Philippines, Quezon City; Manila Adventist College, Pasay City; and University of the Philippines, Bonifacio Global City. In Luzon, the LTCs are at Saint Louis University in Baguio City; Cagayan State University, Tuguegarao City; and University of Nueva Caceres, Naga City. In the Visayas, the LTCs are at the University of San Jose-Recoletos in Cebu City, University of San Carlos also in Cebu City, and Dr. V. Orestes Romualdez Educational Foundation in Tacloban City. There are two LTCs in Mindanao—one at the Ateneo de Davao University in Davao City and the other at the Xavier University in Cagayan de Oro City. Cebu’s National Museum inaugurated
President Ferdinand Marcos Jr. underscored the importance of museums in preserving and promoting a nation’s cultural heritage as he led the inauguration of the National Museum of the Philippines in Cebu City on Friday. The President stressed that museums can help people understand the past, appreciate the present, and build a better future. “Every country, a young country such as the Philippines, has to find its identity,” said Marcos. “And we need to answer the question; if we are to unite together, we need to answer the question: What does it mean to be Filipino?” He added that museums “shine a very, very strong light on where Filipinos came from, what we had done since, and what is the trend, where are we headed” as pointed out that the exhibits would attract the interest of museum-goers. Marcos also urged local and foreign visitors to include the NMP Cebu in their itinerary whenever they visit the province and encouraged his fellow government officials to support the initiatives of the NMP. “Let us persuade the local and foreign visitors alike to include the NMP Cebu in their itinerary whenever they visit our beautiful country and this vibrant, ancient province,” Marcos said. “That is also ensured that our cultural institutions and establishments are accessible to Filipinos from all walks of life.” The President said that it might require around a week of going to the museum religiously before one ultimately sees all the exhibits. From being a customs building to Malacañang sa Sugbo, one of Cebu City’s architectural treasures has been transformed into a National Museum which will be open to the public for free starting 1 August 2023 from 9 a.m. to 5 p.m. and Tuesdays to Sundays. It will feature exhibitions that capture the Cebuano spirit and heritage, including the island’s rich and diverse biodiversity, geology, archeological treasures, art, and ethnographic and maritime traditions. NMP-Cebu said this would host a special exhibition featuring artworks from the Philippine Center in New York and will soon feature artworks by Cebu master Martino Abellana. Aside from the five galleries, the National Museum will be boasted a lobby and reception hall featuring arts by Cebuanos with Cebuano culture and history, a terrace, a courtyard, and the NMP’s first-ever regional Museum shop. In 1910, Architect William Parsons designed and built the Customs (Aduana) building. It served its purpose as the old Customs house for 94 years and even survived the World War II bombings. In 2004, President Gloria Macapagal-Arroyo converted it into Malacañang sa Sugbo to bring the national government closer to the people in the region. The building was closed in 2013 due to a 7.1-magnitude earthquake. In 2019, the Old Customs House was declared a National Cultural Treasure. Visayan growth
This piece is being written as I traverse the Visayan region which is carrying greater prospects for future economic growth. For the past months, I’ve written on Mindanao and Central Luzon and how these regions have experienced rapid development thanks to the nationally elected political leaders who hail from their provinces, Vice President Sara Duterte and the former president now Deputy Speaker Gloria Macapagal-Arroyo, respectively. At times neglected in the discussions is the Visayas region. This time around, I was able to spend time in Iloilo and Cebu – both highly urbanized regional growth areas outside of Metro Manila. Iloilo is a wonderful city as it exists harmoniously with its bodies of water. Esplanades and walkways allow everyone to enjoy the river, which serves as a leisure area, transportation hub, and entry for goods, which is quite uncommon in the Philippines. Usually, Philippine rivers are either for people or for goods, not both, since our rivers are easily polluted. But in Iloilo, as well as neighboring Guimaras, their rivers bring life to the province. The only eyesore in Iloilo would be the “sinking” Ungka flyover located in Pavia. This project cost the government P680 million but it was closed shortly after it opened because motorists experienced a “wavy” sensation while driving on it. It was later learned that some of its pillars were sinking at the rate of two centimeters per day. A study showed it would take an estimated P250 million to repair the flyover and make it safely usable to the public. One reason to be excited about Iloilo should be the proposed revival of the Panay Railway, which was mentioned by President Bongbong Marcos Jr. in his SoNA last year and included in the Infrastructure Flagship Projects approved by NEDA. On this trip, I learned that Panay used to have a working railway that connected Iloilo City to Roxas City, and that plans for its revival would further connect Iloilo to Caticlan thus, the resort island of Boracay. Imagine having tourists land in Boracay, spend a few days there, then take a train to Iloilo where they would further be immersed in Philippine culture in one of the oldest cities of the country. Cebu is an established gem of a city, with traffic nearing Manila levels. Walking around Cebu feels like being in Alabang or BGC. One thing missing in Cebu is tollways to connect its cities and municipalities. This may change soon with the inclusion of the Metro Cebu Expressway in the NEDA-approved IFPs. The 72-kilometer project, once completed, will connect Naga City to Danao City, cutting travel time from three hours to 50 minutes. The project was started years ago, but only a reported five kilometers of it have been finished so far due to lack of funding. At this rate of budget allocation, it will take 20 years to finish it. Now, the project will continue and be finished sooner via a PPP arrangement after Metro Pacific Tollways Corp. — the same company that built the iconic Cebu Cordova Link Expressway bridge — has expressed interest in it. Whenever I visit Cebu, it seems that a major development had taken place. This time was no different. Even in Iloilo, there are new buildings erected almost monthly. One notable building is the 14-story Stronghold Insurance Building in Mandurriao, Iloilo City, an area surrounded by Ayala, SM, Vista Land, and Megaworld developments.
