Budget season
Marathon meetings were held this week in the Senate and the House of Representatives in line with the budget season leading to the approval of the ever-increasing P5.7-trillion budget for 2024. The yearly “budget-serye” (budget series) never fails to disappoint in bringing out issues that extract the tiniest of details in our government that are given monetary figures in the form of public funds, amounting to millions and even billions of pesos. And every year, we see how the majority gets its way, especially early in the Administration, such as where we are right now. My biggest pet peeve in these sessions is the consistent usage of incompetent sponsors for specific government offices who deserve much better. These sponsors, whose mandate is to defend their sponsored government office before the increasingly knowledgeable and wise interpolators, must be technically and legally verbose and experts in the Philippine budget process. Clearly, this is all wishful thinking since we see neophyte, inarticulate, incapable, yet extremely loyal sponsors who would do anything to prove their worth to the powers that be, even if it means being humiliated and trending on social media for the wrong reasons. Indeed, this is the time for the opposition lawmakers to shine and feast on the mental shortcomings of their counterparts. The Makabayan bloc in the House of Representatives finds itself in the limelight as it engages in its own “hunting season” against willing victims, may they be Cabinet secretaries or, gasp, the Office of the Vice President, whose massive confidential and intelligence funds are being questioned repeatedly anew. Lo and behold, we have a statement from the House Appropriations Committee chairman that these OVP allocations will be realigned to more deserving government agencies, i.e., the Armed Forces of the Philippines and the Philippine Coast Guard. However, we have yet to see the indisputable evidence to prove this happened. Nevertheless, it is a fair and conclusive presumption to say that the majority will still get its way despite the awkward and unconvincing defenses and sponsorships in favor of the government agencies. Is the budget process faulty? It appears not since the correct agencies still receive what is due them. The problem, in my humble opinion, lies in the implementation of these budgets granted to them. For instance, the alleged spending by the OVP of its confidential funds amounting to P125 million in 19 days or 11 days, whichever is true, is a problem of implementation, not allocation. What prevented the OVP from spending this amount earlier? What’s likely is that the OVP rushed the spending so they would not be accused of failure in spending public funds for the right and correct reasons. The other issue on the alleged unconstitutional transfer of funds by the Office of the President to the OVP, while the GAA of 2023 was in effect, is likewise the product of faulty, inefficient implementation of the law. It is illegal for a government office, such as the Office of the President, to casually assign a portion of its fund to the OVP because this renders the budget process faulty and even useless. If there is something that may be attributed to faulty implementation, it can be its failure to set proper safeguards that would lead to the enforcement of new ones. In fact, a Supreme Court decision on the alleged unconstitutional transfer made by the OP to the OVP is in the works. As a video of two US-TSA screening officers taking things from bags in trays lined up at the x-ray machine went viral over the weekend, another episode of theft at Ninoy Aquino International Airport Terminal 1 has allegedly included the Office for Transportation Security. A press release from the OTS only came out on Monday afternoon, confirming the incident involving one of their Security Screening Officers at NAIA. But the issue began circulating in social media group chats as early as last week. Notably, the press release was also issued after a member of the Airport Press Club confirmed with the OTS public information office that such information was true. The said release did not contain vital details of the incident, referring to when, where, and how the alleged theft happened. Information revealed that the incident happened as early as 8 a.m., at Terminal 1 of NAIA. After going through the final security check, a departing passenger who is a foreign national, reportedly complained of having lost $300 in cash and was creating a commotion about the incident. The alleged theft was reportedly committed by one of the OTS SSO at that time, a female, while the passenger was passing through the final security check on the said terminal. It can be recalled that six months ago (22 February 2023), five personnel of the OTS assigned at the NAIA Terminal 2 were suspended after two videos of them went viral on social media, taking money from a transiting Thai tourist identified as Kitja Thabthim. The amount involved was 40,000 yen. A few days later, another screening officer was caught on CCTV stealing a watch of a Chinese passenger at the NAIA Terminal 1. Passenger Sun Yuhong complained that his watch was missing in his bag after he was screened by Valeriano Ricaplaza Jr., 31. Ricaplaza was later nabbed by members of the Philippine National Police Aviation Security Group. Closed-circuit television footage at NAIA Terminal 1 reveals a female personnel from the OTS swallowing the $300 taken from a departing Chinese passenger in what appears to be an effort to get rid of the evidence after the passenger complained about losing his money shortly after his bag had passed through at the final security checkpoint. Records from the airport authorities, which identified the involved OTS personnel as a female SSO and stated that an x-ray operator and her supervisor also had a part to play in the incident, provided evidence to support this. SC junks celebrity doctor’s appeal
The Supreme Court on Tuesday disclosed that it has dismissed the appeal of celebrity doctor Joel Mendez to set aside the decision of the Court of Appeals affirming the seven-year jail term slapped against him by the Regional Trial Court of Quezon City for violating the provisions of Republic Act 8282 or the Social Security Act of 1997. In a six-page resolution dated 31 July 2023, the High Court’s First Division did not give merit to Mendez’s claim that the CA’s Former Special Eight Division — through Associate Justices Edwin Sorongon, Sesinando E. Villon and Marie Christine Azcarraga-Jacob — committed grave abuse of discretion when they outright dismissed his petition. This stemmed from the petition of Mendez before the SC invoking anew “extrinsic fraud” on the part of his lawyer in seeking reconsideration of the CA’s ruling. The doctor claimed that the failure of his former counsel to attend scheduled hearings for his presentation of evidence and his counsel’s failure to inform him of the hearings and that his presence was required during the proceedings were tantamount to “extrinsic fraud.” Extrinsic fraud refers to “fraudulent act of the prevailing party in litigation committed outside of the trial of the case, whereby the defeated party is prevented from fully exhibiting his side of the case by fraud or deception practiced on him by his opponent, such as by keeping him away from court; by giving him a false promise of a compromise; or where the defendant never had the knowledge of the suit, being kept in ignorance by the acts of plaintiff; or where an attorney fraudulently or without authority connives at his defeat.” The SC, though, held that Mendez’s contention that the failure to present his side due to his former counsel’s negligence constitutes extrinsic fraud, “is untenable.” “As a ground for the annulment of a judgment, extrinsic fraud must emanate from an act of the adverse party, and the fraud must be of such nature as to have deprived petitioner of their day in court,” said the SC. “The fraud is not extrinsic if the act was committed by petitioner’s own counsel. In this light, we have ruled in several cases that a lawyer’s mistake or gross negligence does not amount to the extrinsic fraud that would grant a petition for annulment of judgment,” it added. Also, the SC stressed that Mendez failed to comply with the 60-day period under Rule 65 of the Rules of Court within which to file the present petition questioning the CA decision, adding that Atty. Marc Anthony B. Antonio, one of Mendez’s former counsels, received a copy of the CA resolution dated 16 April 2019 on 2 May 2019. Mendez alleged that Antonio informed him about the resolution only on 19 June 2019. The court added that Mendez — instead of filing the present petition for certiorari within 60 days from 2 May 2019 — secured the services of a new lawyer and filed the petition only on 8 August 2019, or 98 days after Antonio received the CA Resolution dated 16 April 2019. “As keenly observed by the OSG (Office of the Solicitor General, Mendez blames yet again one of his former lawyers who allegedly belatedly informed him of the receipt of the CA Resolution dated 16 April 2019,” the SC said. “This is a self-serving allegation not supported by any evidence and, thus, deserves scant consideration. A party alleging a critical fact must support their allegation with substantial evidence, for any decision based on unsubstantiated allegation cannot stand without offending due process,” it added. To recall, the CA — in its August 2018 decision — denied the petition filed by Mendez seeking to annul the 18 July 2016 decision of QC RTC Branch 88 Presiding Judge Rossana Fe Romero which found her guilty of violating Republic Act 8282. It did not give weight to Mendez’s contentions, stressing that the SC has previously ruled that a lawyer’s neglect in keeping track of the case and his failure to apprise his client of the development of the case do not constitute extrinsic fraud. Mendez, who owns a chain of dermatology clinics in the country, was sentenced to a jail term ranging from six years and one day as minimum to seven years as maximum by the QC RTC. He was also ordered to pay SSS a total of P1,865,657.50 representing unpaid contributions from October 2011 to January 2013 with an interest of three percent per month from July 2015 until full payment. Remulla urges Bantag anew to surrender
Justice Secretary Jesus Crispin “Boying” C. Remulla yesterday renewed his call for former Bureau of Corrections Director General Gerald Bantag to surrender to face his cases in court. Murder charges have been filed against Bantag before the regional trial courts of Las Pinas City and Muntinlupa City for the slaying of radio commentator Percival “Percy Lapid” Mabasa and Cristito Villamor Palana, a person deprived of liberty and the alleged “middleman’ in the killing of the broadcaster. Despite the warrants of arrest issued by the two RTCs, Bantag has not surrendered or has been arrested. “He (Bantag) will have a fair trial, just surrender,” Remulla said, adding that he has received reports that Bantag has been spotted in Luzon. “But there were also reports that he went down to Manila for a while. I think he is back in the north now,” he said. A P2 million bounty has been offered by the DOJ to anyone who would be able to provide information leading to the arrest of Bantag, though Remulla said he prefers the surrender of Bantag. “I hope he changes his mind about being a fugitive from justice, because it will not do him any good and it is not doing our society any good. We do not want to romanticize people who want to defy the law. We want people to follow the rule of law because it is the hallmark of a stable society,” Remulla said. Remulla issued the assurance that “We will not be inventing out of the blue. We will present the evidence that we have, the legal theory that we have developed and then, if the justice system finds him innocent, then he can have his liberty. But if he is found guilty, then he has to suffer for it. Teves blasts House over Arroyo demotion
Negros Oriental Rep. Arnies Teves lashed out at the leadership of the House of Representatives anew, this time saying the chamber was rude in its decision to demote Pampanga Rep. Gloria Macapagal-Arroyo. Teves, who has been tagged by authorities for alleged involvement in the Degamo murder case and remains abroad, protested that Arroyo was "very qualified" for the role. "For me, what they did was rude. [She's a ] former president, her work is great, then you will demote her? It's not good. For me, there is no respect for fellow congressmen, especially for people of very high morale, very esteemed persons. I really felt bad about that," he said. Last week, Arroyo was demoted from senior deputy speaker to deputy speaker and was replaced in her previous post by Rep. Aurelio Gonzales Jr., amid talks that Arroyo was plotting to oust Romualdez from the Speakership. Arroyo, in a subsequent statement, said she had no intention of succeeding Romualdez and that she respects President Ferdinand Marcos Jr.'s choice to support his cousin as leader of the House. INDONESIA – House Speaker Ferdinand Martin Romualdez said the denial of Rep. Arnolfo Teves’ asylum application may be tackled in the upcoming bilateral meeting between President Ferdinand Marcos Jr. and Timor Leste Prime Minister Taur Matan Ruak in the 42nd ASEAN Summit and related meetings here. Romualdez made the statement after the Department of Justice said Teves was in Timor-Leste and had applied "for a protection visa with the intent of asylum." The Southeast Asian nation, however, has rejected his application and ordered him to leave the country in five days since Teves has been tagged as the alleged mastermind in the murder of Negros Oriental Governor Roel Degamo. In an interview with the reporters, the House Speaker believed Marcos was equally concerned about Teves' situation. "We are also interested in the developments and his current situation in Timor Leste. From what we know, he applied for political asylum, which was denied yesterday. We have confirmed this information tonight (Wednesday)," he said. However, Romualdez clarified that he was still determining if the President had conversations about this matter on the sidelines. When asked if the President will ask the head of Timor Leste to "produce" Teves or ask him to come back to the Philippines, Romualdez said: "Well, I don't know if he will ask to produce him because he's already in Timor Leste and we are aware of that." Romualdez also clarified that the President would not ask Timor Leste to bring Teves back to the Philippines because there is no extradition treaty between the two countries. Instead, Teves has less than a week to leave Timor Leste.
