DFA: 2016 arbitral ruling no longer contestable
The 2016 arbitral ruling of the Permanent Court of Arbitration that cemented the Philippines’ claims in the West Philippines is “no longer contestable,” the Department of Foreign Affairs said Friday. Responding to Beijing’s statement that the 2016 arbitral award is “illegal, null and void,” DFA spokesperson Tess Daza reiterated Manila’s position in the matter. “The Award is no longer contestable and is beyond compromise. It is now a part of international law. We firmly reject attempts to deliberately diminish or undermine the Award’s definitive legal effects in international law,” Daza said, quoting DFA Undersecretary Tess Lazaro. On Wednesday, the Philippines commemorated the seventh anniversary of the landmark decision of the Permanent Court of Arbitration in The Hague, Netherlands favored the Philippines’ claims in the West Philippine Sea with wider support from different countries. However, China through its embassy in Manila, maintained its position about the 2016 arbitral award. “China’s position on the so-called South China Sea arbitration and the award is consistent, clear, and firm. The Arbitral Tribunal gravely violated UNCLOS and general international law,” it said. “The award is illegal, null and void. China does not accept or recognize it, and will never accept any claim or action based on the award,” it added. Likewise, Beijing urged other nations outside the region to “respect China’s territorial sovereignty and maritime rights and interests in the South China Sea.” ‘Hypocrite’ The statement did not sit well with Senator Risa Hontiveros, who warned China that its continuous rejection of the Philippine victory in the West Philippine Sea arbitral ruling “further isolates itself from the international community.” “The world has spoken: the territorial claims embodied in the so-called '9-dash line' have no basis in history or international law. Despite the name, the South China Sea is not Chinese, and the Chinese government has no special authority therein, other than as provided for in the UNCLOS,” Hontiveros said in a statement. “China’s call for the rest of the world to stay out of the territorial dispute in the West Philippine Sea and respect its ‘territorial sovereignty and maritime rights and interests; is the height of hypocrisy, as the Chinese government itself all too willingly violates the sovereignty, rights, and interests of other claimant countries when it thinks it can get away with it,” she added. She also cautioned the Chinese Embassy in the Philippines to “at least show some basic courtesy to the Philippines, their host country, before deciding to release inflammatory statements on a day the Filipino people are celebrating a great victory.” “This is an affront to the Filipinos who stood up for ourselves, and had the heart, courage, and fighting spirit to take China to court,” she said. The senator said that if China continued to reject the arbitral decision, President Ferdinand Marcos Jr. should reconsider the country’s policies with China. “If China keeps ignoring the Arbitral Ruling, the Marcos administration should seriously consider reviewing our national policy toward China,” she said. Brawner: Phl has right to repair BRP Sierra Madre, China can’t tell us otherwise
The Philippines has the right to repair its commissioned navy warship, BRP Sierra Madre grounded in Ayungin in the West Philippine Sea and China cannot tell no, Armed Forces of the Philippines chief Gen. Romeo Brawner Jr. said Wednesday. In an interview during the Kapihan sa Manila Bay forum, Brawner stressed that the Philippines has the sovereign rights and jurisdiction over the waters around Ayungin shoal and so the repair of BRP Sierra Madre must be fitting. “I really believe that we have the right to repair the ship because that is a Philippine-commissioned Navy ship. Kahit andoon siya sa Ayungin Shoal, karapatan natin na ayusin (Even if it was stuck in Ayungin Shoal, it’s our right to repair that),” he said. Brawner lamented that the Philippines did not even bother China when it had gone as far as installing a missile system and even building artificial islands in the WPS. “So, for me, China has no right to tell us not to repair that while they themselves have created these artificial islands,” he said. Brawner criticized China’s audacity to block the Philippines’ legitimate actions in its territorial waters in WPS. “Hindi naman tayo nakialam. Hindi naman natin sinabi, 'Don't do that.' Hindi naman natin sinabi, 'Don't bring missile systems into these artificial islands.' Sila ngayon kinalampag. Napakalaking imbalance (We did not interfere. We didn’t say ‘don’t do that’. The AFP chief believes that China is persistent in harassing and blocking the country’s rotation and resupply mission in the BRP Sierra Madre because it wants to insist their claims over Ayungin Shoal, which was invalidated by the Arbitral Tribunal ruling of the Hague-based Court on 12 July 2016. China has repeatedly ignored the ruling as it constantly insists that Ren’ai Jiao (Ayungin shoal) is part of China’s Nansha Qundao and is under China’s territory. The National Security Council spokesperson Jonathan Malaya has also noted that China “has no legal authority or basis” to enforce anything in Ayungin Shoal because it is constituted “well within” the Philippines’ 200-nautical mile exclusive economic zone and continental shelf under the United Nations Convention on the Law of the Sea or UNCLOS. Key allies of the country expressed their unwavering support after a Chinese Coast Guard ship intentionally collided with a Philippine Navy boat to stop a resupply mission to the grounded BRP Sierra Madre on Ayungin Shoal. Japan said it would continue to cooperate with the international community, such as the members of the Association of Southeast Asian Nations and the United States, to “protect free, open and peaceful seas.” ‘Ironclad’ vow The United States, meanwhile, reiterated its “ironclad” commitment to the Philippines. Malaya noted that environmental degradation or coral destruction would directly impact the livelihood of the fishermen in the WPS. “Sometimes we forget the reasons why we are pushing our rights in the WPS. Attack on Phl would elicit U.S. response — State Dep’t
The United States warned on Monday that any armed attack on Philippine armed forces and Philippine Coast Guard civilian vessels could trigger its 72-year-old Mutual Defense Treaty with the Philippines. “The United States reaffirms that Article IV of the 1951 US-Philippines Mutual Defense Treaty extends to armed attacks on Philippine armed forces, public vessels, and aircraft — including those of its Coast Guard — anywhere in the South China Sea,” the US Department of State said in a statement. The statement came a day after a China Coast Guard ship collided with a Philippine resupply vessel that was conducting a routine resupply mission at Ayungin Shoal. During the same resupply mission, a Chinese maritime militia vessel also bumped the BRP Cabra, one of the PCG ships that were escorting the boat contracted by the AFP. Defense Secretary Gilbert Teodoro Jr. said the collisions, which President Ferdinand Marcos Jr. ordered investigated by the PCG, were “intentional.” For its part, the Philippines’ Department of Foreign Affairs said further study is needed to invoke the MDT due to the incident. “The matter of filing another case is something that is still being studied by the government. But, of course, all incidents like these will actually bolster the case that it is not the Philippines that is the aggressor but the other party, which is China,” DFA spokesperson Teresita Daza said. “It’s a provocation on the side of China but at this point, whether it will constitute an armed attack that would allow the invoking of the MDT is something that needs to be studied,” she added. The Philippines and the US agreed under the MDT, signed in 1951, that an armed attack on either of the parties would be considered an attack on the other, necessitating common or joint actions. Ambassador summoned The Philippines on Monday summoned China’s Ambassador to the Philippines, Huang Xilian, to explain the “blocking maneuvers” conducted by its vessels. Citing the 2016 arbitral ruling on the South China Sea, the US noted that China’s territorial claims to Ayungin Shoal, a low-tide elevation outside the territorial sea of another high tide feature, were unfounded. Unsafe moves “The unsafe maneuvers on 22 October and the PRC water cannoning of a Philippine vessel on 5 August are the latest examples of provocative PRC measures in the South China Sea to enforce its expansive and unlawful maritime claims, reflecting disregard for other states lawfully operating in the region,” the State Department stressed. Aside from the US, Japan, France, Canada, Australia and Germany also condemned China’s aggressive actions in the West Philippine Sea. In a separate statement, Canada condemned what it described as “unlawful and dangerous conduct” of the People’s Republic of China in the WPS, which “provoked two collisions with Philippine vessels engaged in routine operations inside the Philippine exclusive economic zone, in the vicinity of Ayungin Shoal.” “The PRC’s actions are unjustified. China has no lawful claim to the West Philippine Sea. Its actions are incompatible with the obligations of a signatory to the UN Convention on the Law of the Sea,” the Canadian Embassy in Manila said. “Continuing acts of intimidation and coercion undermine safety, stability, and security across the region, and increase the risk of miscalculation,” it added. France, Japan, Germany, too France expressed its “deep concern” over the dangerous maneuvers of the CCG against Philippine vessels “engaged in the Philippine exclusive economic zone.” “France calls for respect of the freedom of navigation guaranteed by international law and recalls its attachment to the United Nations Convention on the Law of the Sea and the decision rendered by the Arbitral Court on 12 July 2016,” the Embassy of France to the Philippines said. More senators condemn China’s ‘bullying’ in WPS
More senators on Monday condemned China’s aggressive actions in the West Philippine Sea which resulted in a collision with Philippine vessels en route to a resupply mission to the Ayungin Shoal. For Senate Deputy Majority Leader Joseph Victor “JV” Ejercito, China “has gone too far in disrespecting the Philippines” when it performed “dangerous blocking maneuvers” that resulted in a collision with the Unaiza May 2, an indigenous boat contracted by the Armed Forces of the Philippines for a resupply mission to the BRP Sierra Madre. “I strongly condemn the recent aggression of the Chinese Coast Guard against our Philippine Coast Guard,” Ejercito said in a statement. “The reckless maneuvers executed by the CCG, which resulted in a collision with the Armed Forces of the Philippines-contracted resupply vessel, were not only provocative but also a blatant act of bullying that must be denounced, not only by us but by the international community,” he added. Ejercito said it is “essential to note that this is not the first time the CCG has engaged in such provocative actions against our coastal guards and fisherfolks.” “Moreover, it is the government's duty to ensure the safety of our waters for all Filipinos. She continued: “As we firmly assert our rights in our waters, fortifying our relations with like-minded states must continue to thwart similar belligerent actions.” On Sunday, Senate President Juan Miguel “Migz” Zubiri, Senators Risa Hontiveros, and Francis Tolentino expressed their anger over the collision that put the safety of the Filipino crew at risk. “I am one with peace-loving Filipinos in strongly condemning this latest abhorrent actions of the China Coast Guard and Chinese maritime militia that put in danger the lives of our brave countrymen who were on a routine resupply mission to our troops in Ayungin Shoal,” Zubiri said. “Let me salute our personnel from the Philippine Coast Guard (PCG) and the Armed Forces of the Philippines (AFP) for displaying courage and restraint in continuing their resupply missions despite the hostile and treacherous acts of China Coast Guard and their maritime militia,” he added. Hontiveros echoed Zubiri’s call on China to “stop” its activities in the West Philippine Sea which she said clearly violates international law. “This latest collision is squarely the China Coast Guard’s fault,” she said in a separate statement. “The 2016 Arbitral Award has resolutely invalidated China’s claims in the West Philippine Sea, making this incident a clear violation of international law,” she added. The United States on Sunday denounced China’s actions in the West Philippine Sea that led to the collision of its ships with Philippine boats en route to a resupply mission to the Ayungin Shoal. AFP: China’s ‘irresponsible actions’ in WPS leading to ‘global isolation’
China is leading itself to “global isolation” as it continues “irresponsible actions in the West Philippine Sea, Armed Forces of the Philippines spokesperson Col. Medel Aguilar said Saturday. Aguilar said China’s claims over the disputed waters have already been declared invalid as he cited the ruling of The Hague-based Permanent Court of Arbitration on 12 July 2016. “There is an arbitral award that says that their claim over it is not valid, including the activities that they are doing there,” he added, stressing that China has no claims over the territorial waters based on the rulings of the United Nations Convention on the Law of the Sea. “Several countries have already expressed openly their support for our position and not a single country is brave enough to say that they are right,” Aguilar emphasized. “So I think this should be an enlightenment on their part, a kind of information that they should know because their actions are actually leading to their own global isolation,” he added. But Satam, whose daring act was caught on video, had already made his indelible mark in one of the tensest areas in the South China Sea. “Hindi ako natatakot (I wasn’t scared),” said Satam, who told reporters he often baits the Chinese to chase him. “Pinagtatawan-tawanan ko lang sila. Inaasar ko lang sila eh (I just laugh at them. I only pique them).” Earlier that same Friday, the China Coast Guard was caught in the act of installing a 300-meter floating barrier around Panatag’s inner lagoon by a Bureau of Fisheries and Aquatic Resources boat on routine patrol. Like Satam, Filipino coast guard divers the following Monday afternoon did the unthinkable, vividly executing a first-ever underwater operation, also dramatically captured on video, against Chinese bullying in the West Philippine Sea. Using only knives, the divers cut the rope connecting the buoys that held up the barrier and hauled up an anchor holding the floating barrier in place. Filipino fishermen said the Chinese frequently put up barriers to keep them from Panatag, a traditional rich fishing ground of fishermen mostly sailing out of Zambales. Some 50 Filipino fishing boats, in fact, were near the shoal when the Chinese installed the floating barrier. Filipino fishermen could only fish outside the shoal because Chinese vessels had blocked the inner lagoon since the 2012 standoff between the Philippines and China over the shoal. After the successful “special operation,” authorized by President Marcos himself, the PCG reported that China Coast Guard vessels, probably awed by the Filipinos’ audacity, were seen calmly picking up pieces of the torn barrier. Still, that same calm demeanor could also mean the Chinese “might still return the floating barrier,” said PCG spokesperson Jay Tarriela, particularly since last Tuesday China tersely warned the Philippines not “to provoke and cause trouble.” But the PCG and the military establishment have vowed to make the Filipino presence felt at the shoal, even permanently, with Tarriela expressly saying, “We have shown the world the Filipino people will not back down, and we’re still going to consistently carry out whatever is necessary for us to maintain our presence.” Emphasizing our “presence” at Panatag is a crucial and careful distinction. The 2016 arbitral award ruled that Chinese, Vietnamese, and Filipino fishermen had traditional fishing rights at Panatag Shoal. Our maritime authorities, therefore, are in the right insofar as asserting that Filipino fishermen have the same rights as the Chinese to safely navigate around Panatag to fish, and that China has no right whatsoever to drive them away or bar them. Frustratingly, however, some imprudent Filipinos toe China’s self-interested and false sovereignty claims despite the due care with which Filipino maritime authorities qualify their actions. Oddly enough, too, these same imprudent Filipinos quickly blame the victims of China’s abusive actions. It is as if these imprudent Filipinos are so invested in their fear of China that they are now losing their willingness to defend Filipino fishermen and their livelihood bit by bit, without even noticing. We cannot be like them. We must all finally realize that to assert ourselves in the world; we must bravely stand up to any form of bullying against fellow Filipinos. Manalo: Removal of floating barrier installed by China ‘consistent’ with Phl position
The Philippine government’s move to remove the floating barrier installed by the China Coast Guard around the southeastern portion of Scarborough Shoal is “consistent” with the country’s position, Foreign Affairs Secretary Enrique Manalo said Tuesday. “Technically, we have a right to practice our sovereignty and our sovereign rights. So, it would have been consistent with our position but we're still waiting for the full report," Manalo said in a chance interview at the Senate. He issued the remarks after the Philippine Coast Guard confirmed that the floating barrier that prevented Filipino fishermen from accessing the shore had been removed in accordance with a presidential order. Over the weekend, the PCG reported the presence of the floating barrier around Scarborough Shoal, also known as Bajo de Masinloc. On Monday night (Manila time), Chinese Foreign Ministry spokesperson Wang Wenbin defended China’s move to install the floating barrier in the southeastern portion of Scarborough Shoal, which they referred to as Huangyan Dao. “Huangyan Dao has always been China’s territory. China has indisputable sovereignty over the island and its adjacent waters and sovereign rights and jurisdiction over relevant waters,” Wang said. “On September 22, a vessel of the Bureau of Fisheries and Aquatic Resources of the Philippines, without China’s permission, intruded into the adjacent waters of Huangyan Dao and attempted to enter its lagoon,” he added. Wang noted that the CCG’s actions were “necessary.” “China Coast Guard did what was necessary to block and drive away the Philippine vessel. The steps it took were professional and restrained,” he said. Located 120 nautical miles from Zambales, Bajo de Masinloc is considered a traditional fishing ground for Filipinos in the West Philippine Sea. China claims the vast South China Sea, including the West Philippine Sea.
