Steps gaining exporter status under RCEP outlined
Exporters wishing to avail themselves of preferential tariffs under the Regional Comprehensive Economic Partnership can apply with the Bureau of Customs to become an approved exporter, according to a customs official. Gina German, head of the Preferential Rate Unit of the BoC Port of Manila, is encouraging Filipino exporters to start leveraging the RCEP’s benefits, foremost of which is being allowed to source materials and products from the 14 other member parties of the mega free trade agreement at lower duty rates. Study and comply German also urged companies to study and comply with the RCEP’s rules of origin (ROO), a requirement to get preferential tariff treatment under the world’s biggest trade deal. Essentially, the ROO can be regarded as a passport for products, a way to determine the country of origin of a product and establish its eligibility for preferential tariff treatment. It can help businesses reduce costs and boost their competitiveness within the regional market. Under RCEP, originating goods are those falling under three categories: wholly obtained in the RCEP party or member state of the agreement; those produced in a party exclusively from originating materials from one or more of the parties; and those produced in a party using non-originating materials, provided the good satisfies the applicable requirements set out in Annex 3A (Product-Specific Rules). Documentary requirements German said applicants seeking “approved exporter” status under RCEP should submit the following documentary requirements: • Duly accomplished application form • BoC’s Certificate of Registration • Product Evaluation Report or PER, if applicable Meanwhile, traders applying for approved exporter status, should submit a producer’s declaration indicating the originating status of the good for which the trader will be completing a declaration of origin and stating the producer’s readiness to cooperate in verification. “If you are a trader, you need to know who produces the good or you still have a declaration that it is originating in the Philippines so that you will be ready during the retro verification or verification of the importing country,” said German during her talk last month at a Department of Trade and Industry webinar. In addition applicants have to submit a list of the authorized signatories of the DO and their respective specimen signatures. The application form should be submitted in both hard copy and electronic Portable Document Format to the deputy commissioner of the Assessment and Operations Coordinating Group through the Customer Care Center or CCC. The Export Coordination Division or ECD will then evaluate the application based on the following criteria: Exporter is a legitimate exporter who must have been transacting with the BOC for at least one year prior to the date of application Exporter must have been exporting products to at least one RCEP party for at least one year • Exporter must have good compliance measured by risk management of the BOC • Exporter must have a sound bookkeeping and recordkeeping system • Exporter must have responsible officers or persons authorized to sign the DO, who must have sufficient knowledge, competence in ROO application • Exporter must be willing to be subjected to regular monitoring and inspection to determine correctness of its declaration with respect to the goods exported. Written authorization After evaluation the ECD will grant the status of approved exporter to the successful applicants by issuing a written authorization with its corresponding authorization code within 14 working days. From there, the BOC will input the details of the approved exporter in its Approved Exporter Database for circulation among the RCEP parties. RCEP came into effect officially for the Philippines on June 2, 2023 after the Senate finally ratified the agreement in February this year. The Philippines was the last country to ratify RCEP, a free trade pact among the 10 members of the Association of Southeast Asian Nations — Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, Vietnam — and the five ASEAN FTA partners Australia, China, Japan, South Korea, and New Zealand. UN General Assembly calls for ‘humanitarian truce’ in Gaza
The UN General Assembly on Friday called by a large majority for an "immediate humanitarian truce" in Gaza, on the 21st day of the Israel-Hamas conflict as the Israeli army announced it was extending its ground operation into the shattered territory. The non-binding resolution, criticized by Israel and the United States for failing to mention Hamas, received 120 votes in favor, 14 against and 45 abstentions from UN members. Israel angrily dismissed the measure, and said the country would use "every means at our disposal" in confronting Hamas. "Today is a day that will go down as infamy. We have all witnessed that the UN no longer holds even one ounce of legitimacy or relevance," Israeli ambassador Gilad Erdan said, telling the assembly: "Shame on you." "Israel will continue to defend itself. We will defend our future, our very existence by ridding the world of Hamas's evil so that it can never threaten anyone else again," he said. Hamas meanwhile welcomed the call for a break in the conflict. "We demand its immediate application to allow the entry of fuel and humanitarian aid for civilians," said a Hamas statement. The rival Palestinian Authority's foreign ministry said that as Israel's campaign "reaches a new peak of brutality," there was "a solid international position rejecting Israel's unhinged aggression". The text proposed by Jordan in the name of 22 Arab countries called for "an immediate, durable and sustained humanitarian truce leading to a cessation of hostilities." An earlier version called for an "immediate ceasefire." Jordan's Ambassador Mahmoud Hmoud, just before the vote, stressed that: "It is not merely our responsibility, but a profound moral obligation to champion the cause of peace." Israel has heavily bombarded Gaza since Hamas gunmen stormed across the border on October 7, killing 1,400 people, mostly civilians, and kidnapping over 220 others, according to Israeli officials. The health ministry in the Hamas-run Gaza Strip, in an update on Friday, said the Israeli strikes had now killed 7,326 people, mainly civilians and many of them children. The resolution co-sponsored by nearly 50 other countries centered largely on the dire humanitarian situation in sealed-off Gaza as Israel presses on with its bombardment. The document urges "immediate" provision of water, food, medical supplies, fuel and electricity and unhindered access for UN and other humanitarian agencies trying to help the Palestinians. The draft condemns "all acts of violence aimed at Palestinian and Israeli civilians, including all acts of terrorism and indiscriminate attacks" but it does not mention Hamas. The resolution exposed a division within Western countries, with France voting for the measure; Germany, Italy and Britain abstaining; while Austria and the United States voted against. "It is outrageous that this resolution fails to name the perpetrators of the October 7 terrorist attack," US ambassador Linda Thomas-Greenfield said. LTO innovates responses to backlogs
The Land Transportation Office, or LTO, now under the leadership of Atty. Vigor Mendoza II, has committed to implementing innovative solutions to immediately address the piles of problems “inherited” from the previous leaderships. Mendoza, whom Transportation Secretary Jaime J. Bautista tasked to help the agency improve its current state, expressed confidence that he could turn the LTO around and make it more efficient and effective. He said this aligns with the Marcos administration’s marching orders to digitalize and bring government services closer to the people seamlessly. Mendoza has already begun to execute some changes, such as streamlining the driver’s license application process, implementing a new online vehicle registration system, and reducing the number of fixers at LTO offices, among others. Speaking in a recent interview on DAILY TRIBUNE’s Straight Talk, Mendoza disclosed that his agency is studying cost-effective ways to produce license plates. Presently, the LTO has a manufacturing plant with eight machines working to produce license plates, but as recently directed by Bautista, the agency is looking at outsourcing them instead of producing them. “We make the plates ourselves, although we are studying if maybe it is high time to review whether the LTO should produce or outsource the plates. I told Secretary Bautista that in terms of efficiency, it might be less costly and faster if we outsource it,” Mendoza said. “We are thoroughly studying those options to weigh which will be less costly to the government. Thus, finally, we could resolve all the backlogs,” he added. Million plates a month Mendoza added that the agency’s plate-making plant could produce a million monthly plates to replace all the backlogs — from the old green plates to the new white ones. He said before the end of November, the license plate backlog will hopefully be fully addressed. With production in full swing, a motorist with a newly acquired four-wheel vehicle can claim his license plates within 10 days. In the meantime, new motorcycle owners can now get their plates immediately. This significantly improved from the previous year when motorists took years to get their plates. To recall, in March, ex-LTO chief Jay Art Tugade issued a memo suspending the production of license plates due to a shortage of materials. Online portal needs full utilization Mendoza said the LTO is also working on finally utilizing the Land Transportation Management System, or LTMS, a P3.14-billion portal created to address Filipinos’ motoring concerns. He lamented that the underutilization of the online portal, which he described as just one of the many inherited problems of the agency, was a misuse of government funds. “The system design is incomplete, and you know that as much as possible, we want to be fully digital as instructed by the President. We want motorists to be able to apply for a license and register their vehicles through that platform,” Mendoza said. “We supposedly have all the facilities. There will be no need to go to LTO offices as it will also address the issues of fixers. However, we cannot do all these until we fully resolve the website’s functionalities,” he said, adding that the LTO would need the developers to provide them with some missing source and application codes. The LTMS was jointly developed by German technology firm Dermalog and its local partners, Holy Family Printing Corp., Microgenesis, and Verzontal Builders Inc. The project went through competitive bidding in May 2018. The LTO’s online portal is a one-stop shop that will integrate all LTO services in a single contactless database system and digital platform. “We are waiting for their reply. I have been open since my first day in office, and I’ve been very open to them. There is a problem, let us talk about it. However, they have not replied to my letters on the source code and application code issue. We have to protect the government’s interest, and the government’s interest is to get the source and application codes so we can do the enhancements ourselves,” Mendoza said. According to the new LTO chief, hiring another third-party team to resolve the LTMS issues might cost the government at least another billion pesos. Mendoza asked why the government does not just find another software developer, saying: “We already paid for the contract.” “If we do it, maybe they will spend another billion just to complete everything, so the government will save a lot if we do it ourselves. We have DICT with us, and LTO is also hiring technical people for us to be able to do it ourselves. Retroactive application of Family Code
Married before the effectivity of the Family Code, and fear you cannot nullify your marriage based on the grounds provided therein? Fret not, the Supreme Court has reiterated in a recent case that the Family Code, which took effect on 03 August 1988, shall be given retroactive effect unless vested or acquired rights under relevant laws will be prejudiced or impaired. According to Arthur Candelario v. Marlene Candelario and Office of the Solicitor General (G.R. No. 222068, 25 July 2023), psychological incapacity as a ground to nullify marriage under Article 36 of the Family Code can be applied to the marriage contracted on 11 June 1984 by the parties in this case. Article 256 of the Family Code explicitly provides that the law, including its provision on psychological incapacity, shall have retroactive effect. As such, the ruling of the lower court that the marriage cannot be nullified under Article 36 of the Family Code as the law only became effective after the parties’ marriage was set aside. The Supreme Court also stressed that Republic Act No. 8533 has amended Article 39 of the Family Code, which previously distinguished between marriages solemnized before and after its effectivity. Art. 39 now provides that the action or defense for the declaration of the nullity of marriage shall not prescribe, without distinction, whether the marriage was solemnized before or after the effectivity of the Family Code. A plain reading of the law even shows that nowhere in Art. 36 is it stated that the same may not be applied to marriages celebrated prior to the effectivity of the Family Code. It is basic in statutory construction that where the law is not ambiguous, the Court may not introduce exceptions or conditions where none is provided. Likewise, deliberations of the Family Code Revision Committee show that the same issue was considered, and the retroactive application of Art. 36 was voted upon. Jurisprudence is replete with the same pronouncements, such as Chi Ming Tsoi v. Court of Appeals (1997), Republic v. Molina (1997), Republic v. Enclean (2013), and Republic v. De Gracia (2014). The Court cited the Comment of the Office of the Solicitor General in this case — that any ruling to the contrary discriminates against married couples for no reason other than having the misfortune of getting married before the enactment of the Family Code. All persons can be afflicted with a psychological disorder resulting in incapacity to perform marital obligations. As such, the issue must not focus on when the parties invoking the nullification contracted the marriage, but on whether the requirements of psychological incapacity under the law are present. In this case, while the Court agreed that Art. 36 may be applied, it negated the finding that the husband was psychologically incapacitated to comply with his essential obligations in marriage. Following the same, what is indeed essential in these cases is proving the existence of psychological incapacity, in which gravity, incurability, and juridical antecedence must be established. How nations allow or restrict legal gender change
A small number of countries have made it easier for transgender people to change their legal gender, while other nations have restricted such changes, notably Russia and Pakistan. Here is a snapshot of the situation around the world. Exception, not the rule According to the International Lesbian and Gay Association (ILGA), 24 UN member states have legally allowed people to change their gender on the basis of self-identification. In about 40 other countries, the legal and administrative process can take years and may include requirements such as psychiatric diagnosis, hormone treatment, gender confirmation surgery, or even sterilization. Making it easier Argentina has led the way on transgender rights, allowing a change of gender on national ID cards with a simple declaration since 2012. Several Latin American countries have followed suit. Denmark was the first European country in 2014 to allow adults to apply for a gender change without undergoing medical or psychological assessments, with Belgium, Ireland, Malta, Norway, Portugal, and most recently Spain following suit. Since 2017, France has allowed transgender people to change their status on their ID documents without treatment, surgery, or sterilization but they must receive court approval. The issue of trans rights sparked a fierce row in 2022 in Scotland, where parliament passed a bill making it easier for people to self-identify their gender that was sensationally vetoed by London. The German cabinet in August 2023 signed off plans under which Germans will be able to change their name or legal gender by making a simple application to their local registry office. The law still has to go to parliament. Hesitating Sweden, one of the world's most liberal countries, was the first in the world to authorize physical and legal gender reassignment for adults in 1972. But last year it began restricting hormone therapy available for children diagnosed with gender dysphoria, such as puberty blockers, citing the need for caution following a strong increase in demand. It also restricted access to mastectomies for teenage girls wanting to transition. Finland in 2020 had already restricted hormone treatment for minors. Making it harder Russia adopted new legislation in July 2023 banning "medical interventions aimed at changing the sex of a person" and "the state registration of a change of gender without an operation". President Vladimir Putin has repeatedly railed against transgender rights in his speeches. Pakistan's religious judiciary ruled in May that landmark transgender legal protections from 2018 are un-Islamic and therefore void. An appeal is being sought with the Supreme Court. Pakistan continues to recognize the existence of a third gender, neither masculine nor feminine, as do India and Nepal. Restricting gender-affirming treatment, such as puberty blockers for minors, has become a major campaign of US conservatives. Arkansas in 2021 became the first US state to ban physicians and health workers from offering transition-related treatment to transgender minors. A federal judge in June overturned the ban. Around 20 states, including Florida and Texas, have passed similar laws. Anti-LGBTQ sentiment in Hungary has escalated during the rule of Viktor Orban's right-wing government. PCSO ask lawmakers to toughen laws vs illegal lottery firms
The Philippine Charity Sweepstakes Office General Manager Mel Robles, called out lawmakers on Monday to toughen the law against Illegal lottery firms. Robles personally led the filing of charges at Mandaluyong Prosecutors Office against individuals behind the four firms engaged in unauthorized online lottery operations. “I am calling out the attention of the lawmakers to toughen the law. Maybe others see that they can handle the penalty but we’ll see. Even if it’s light, we will still pursue the cases against them,” Robles said. Robles added that PCSO is losing billions of pesos in revenue because of illegal operations perpetrated by the suspects. “We are serious about this. We will prosecute and imprison everyone associated with this illegal operation to stop them,” he said. The PCSO stated that PayMaya reportedly remitted billions to a company operating an illegal online lottery. “A payment platform, like PayMaya, reported that they were able to remit about P4.7 billion to a company that was operating the Illegal lotto. It is also included in the complaint affidavit,” he said. The criminal complaints were filed against four companies, Eplayment Corporation, Paymero Technologies Limited, GlobalComRCI International, and Blockchain Smart-Tech Co. I.T. Consultancy. The complaints were prompted by an investigation conducted by the National Bureau of Investigation, which revealed that the mentioned companies were responsible for the ownership, operation, and administration of Pakilotto and Surelotto. The companies reportedly misused the PCSO’s name, logo, and various lottery games, soliciting and accepting bets from the public through their unauthorized mobile application and websites. Robles said that based on their investigation, they have found out that the alleged suspects for Illegal online lottery are operating in the cities of Quezon and Cebu. “We found out one in NCR, in Quezon City, the other is in Cebu,” he said. PCSO reported that Eplayment, which operated under the now-defunct website ‘Pakilotto’, was soliciting and accepting bets from the public at an inflated price of P30 per ticket, a 50% markup compared to the standard P20 lotto ticket. Meanwhile, Surelotto, a similar mobile app, sold tickets online for P25, a 25% increase from the regular lotto price. Prizes of smaller denominations are allegedly directly deposited into the winner’s registered bank account, while jackpot prizes require winners to visit the Surelotto office in person. The complaint-affidavit states that the owners, directors, and/or officers of Paymero, Eplayment, GlobalComRMCI, and Blockchain, as owners, operators, and/or administrators of Pakilotto and Sukilotto, have committed Usurpation of Authority under Article 177 of the Revised Penal Code, a violation of R.A. No. 1169, as amended, and a violation of Presidential Decree No. 1602, as amended by Republic Act No. 9287, in connection with Executive Order No. 13, Series of 2017.
