Musk tours site of Hamas attack with Israeli PM
Tech tycoon Elon Musk visited the site of a Hamas attack in southern Israel Monday with Israeli Prime Minister Benjamin Netanyahu and the two discussed artificial intelligence with defence chiefs, officials said. Musk and Netanyahu held a brief interview on the billionaire's online platform X, formerly Twitter, following their tour of Kfar Aza, one of the kibbutzim -- communal farms -- in southern Israel attacked by the Palestinian militant group on October 7. "We have to demilitarise Gaza after the destruction of Hamas," Netanyahu said, calling for a campaign to "deradicalise" the Palestinian territory. "Then we also have to rebuild Gaza, and I hope to have our Arab friends help in that context." Netanyahu told Musk he hoped to resume US-mediated normalisation talks with Saudi Arabia after Hamas's defeat and "expand the circle of peace beyond anything imaginable". How nations allow or restrict legal gender change
A small number of countries have made it easier for transgender people to change their legal gender, while other nations have restricted such changes, notably Russia and Pakistan. Here is a snapshot of the situation around the world. Exception, not the rule According to the International Lesbian and Gay Association (ILGA), 24 UN member states have legally allowed people to change their gender on the basis of self-identification. In about 40 other countries, the legal and administrative process can take years and may include requirements such as psychiatric diagnosis, hormone treatment, gender confirmation surgery, or even sterilization. Making it easier Argentina has led the way on transgender rights, allowing a change of gender on national ID cards with a simple declaration since 2012. Several Latin American countries have followed suit. Denmark was the first European country in 2014 to allow adults to apply for a gender change without undergoing medical or psychological assessments, with Belgium, Ireland, Malta, Norway, Portugal, and most recently Spain following suit. Since 2017, France has allowed transgender people to change their status on their ID documents without treatment, surgery, or sterilization but they must receive court approval. The issue of trans rights sparked a fierce row in 2022 in Scotland, where parliament passed a bill making it easier for people to self-identify their gender that was sensationally vetoed by London. The German cabinet in August 2023 signed off plans under which Germans will be able to change their name or legal gender by making a simple application to their local registry office. The law still has to go to parliament. Hesitating Sweden, one of the world's most liberal countries, was the first in the world to authorize physical and legal gender reassignment for adults in 1972. But last year it began restricting hormone therapy available for children diagnosed with gender dysphoria, such as puberty blockers, citing the need for caution following a strong increase in demand. It also restricted access to mastectomies for teenage girls wanting to transition. Finland in 2020 had already restricted hormone treatment for minors. Making it harder Russia adopted new legislation in July 2023 banning "medical interventions aimed at changing the sex of a person" and "the state registration of a change of gender without an operation". President Vladimir Putin has repeatedly railed against transgender rights in his speeches. Pakistan's religious judiciary ruled in May that landmark transgender legal protections from 2018 are un-Islamic and therefore void. An appeal is being sought with the Supreme Court. Pakistan continues to recognize the existence of a third gender, neither masculine nor feminine, as do India and Nepal. Restricting gender-affirming treatment, such as puberty blockers for minors, has become a major campaign of US conservatives. Arkansas in 2021 became the first US state to ban physicians and health workers from offering transition-related treatment to transgender minors. A federal judge in June overturned the ban. Around 20 states, including Florida and Texas, have passed similar laws. Anti-LGBTQ sentiment in Hungary has escalated during the rule of Viktor Orban's right-wing government. CA junks telco’s frequency plea, mandamus case vs. NTC
The Court of Appeals junked the petition for mandamus filed by NOW Telecom Company Inc. against the National Telecommunications Commission or NTC over the company's provisional authority or PA application to operate a cellular mobile telephone service within specific frequency ranges. In a 16-page decision, the appellate court's Special Ninth Division said "the court is powerless" to grant NOW Telecom's plea, especially since the company failed to show a clear legal right to the frequencies it sought. The CA said the decision, penned by Associate Justice Tita Marilyn B. Payoyo-Villordon and concurred in by Associate Justices Myra V. Garcia-Fernandez and Walter S. Ong, followed a careful examination of the case. The case began from NOW Telecom's request for NTC's automatic approval issued by the Anti-Red Tape Authority or ARTA. NOW Telecom had filed a petition for mandamus under Rule 65 of the Revised Rules of Court to compel the NTC and former Commissioner Gamaliel Asis Cordoba to stick to ARTA's resolution and OAA both dated 1 March 2021. These ARTA documents stated that NOW Telecom's application for a PA to operate in the frequency range 1970 Mhz-1980 Mhz paired with 2160 Mhz to 2170 Mhz and 3.6 GHz to 3.8 GHz frequency ranges was automatically approved by operation of law. It followed Republic Act 11032, otherwise known as the Ease of Doing Business and Efficient Government Service Delivery Act of 2018. However, an ARTA resolution dated 17 June 2022 reversed the previous decisions and formally recommended NOW Telecom's application for frequency assignment to the NTC. NOW Telecom's mandamus petition was notably based on its claim for the rights to specific frequency ranges, alleging that the NTC had unjustly neglected its duty to assign them. Yet, court records showed that as early as December 2005, NTC already found NOW Telecom to be non-compliant and was disqualified from the assignment of 3G frequency bands due to unpaid supervision and regulation fees or SRF and spectrum user fees or SUF amounting to P2.6 billion. NOW Telecom has a pending petition filed before the Supreme Court for this penalty imposed by the NTC. NOW Telecom received its PA in January 2006, but it was not specific to 3G and under the condition of paying its outstanding SRF and SUF obligations. In December 2017, NOW Telecom was designated the 20MHz contiguous bandwidth, 3520 to 3540 MHz, under the 3.5 GHz on the same condition that it resolved its outstanding SUF and SRF fines. NOW Telecom's Provisional Authority was extended until September 2020, but the NTC reiterated that the company failed to fulfill the conditions regarding SUF and SRF. Despite the issues hounding the company, NOW Corp. IPOPHL launches site-blocking mechanism vs piracy
The Intellectual Property of the Philippines has announced the release of rules on site blocking, the measure that disrupts access to pirated sites, seen to delist the Philippines from being third in East and Southeast Asia in having the highest piracy rate. The release of Memorandum Circular 23-025 or the Rules on Voluntary Administrative Site Blocking, signed by IPOPHL director general Atty. Rommel Barba, signals the celebration of the Philippine Creative Industries Month this September. Barba said Memorandum Circular 23-025 was signed last 20 September 2023, effective two months from publication Result of years-long work “The rules are a result of years-long work with the National Telecommunications Commission and several internet service providers who refuse to sit down and watch while our creative industry suffers. With the site blocking mechanism soon up and running, IPOPHL, as an ex-officio member of the Philippine Creative Industries Development Council, is ecstatic to say the Philippines now has an essential tool to protect the creativity that drives our economy and defines our cultural landscape,” Barba said. With site blocking to be soon in place, Barba hopes to replicate the success of Indonesia where more than 50 percent of consumers have stopped or now rarely access pirate services because of its government’s blocking measures which started in 2019. “We encourage rights holders to optimize this tool and protect the value of your creative assets,” Barba said. Under the rules, the process is initiated once a rights holder or a duly authorized representative files a written request with the IP Rights Enforcement Office or IEO followed by the payment of filing fees. The application will immediately be evaluated by an officer from the IEO who is given ten working days to submit an Evaluation Report. The report carries a recommendation on the issuance or non-issuance of a site-blocking order and is elevated to the Supervising Director or Deputy Director General for approval within five working days. Collaboration vs piracy To effectively implement the rules, IPOPHL signed on Wednesday partnership agreements with the NTC and ISPs, namely Globe Telecom Inc., Smart Communications Inc., PLDT Inc., Sky Cable Corp. and DITO Telecommunity Corp. Under the Memorandum of Understanding, ISPs commit to willingly block sites directly upon IPOPHL’s request issued after a determination of violation, thereby streamlining the current process which requires the involvement of the NTC, the agency being the primary regulator of ISPs. Meanwhile, the memorandum of agreement with the NTC widens IPOPHL’s oversight to over 300 ISPs who are not part of IPOPHL’s site blocking MOU with ISPs, obligating them to disable access to piracy sites. Also at the event were the Motion Picture Association, Asia Video Industry Association and the GMA Network Inc. as observers and partners. IPOPHL launched the new rules at a time when site blocking is gaining traction around the world as an effective anti-piracy tool. Senate to approve 17 bills up for final reading says Zubiri
The upper chamber will approve 17 bills that are set for the third and final reading, said Senate President Juan Miguel Zubiri on Saturday. Zubiri noted that four of these bills are part of the priority legislation of the Legislative-Executive Development Advisory Council or LEDAC while 12 are local bills for the improvement of state universities and colleges. “In fact, on Monday, we will approve four measures that are part of our LEDAC commitments. And so far, we are on track to meeting our deadlines because, by the end of this year, we hope to approve all 20 LEDAC priority measures pending in the Senate,” the Senate President said. Zubiri noted that the Senate has approved a total of five bills on second reading during the previous week which includes Senate Bill 2001 or the New Philippine Passport Act; SB 1846 or the Internet Transactions Act of 2023; SB 2224 or the Ease of Paying Taxes Act; SB 2028 or An Act Recognizing the Octogenarians, Nonagenarians, and Centenarians; and SB 2233 or the Public Private Partnership Act. These bills, except for SB 2028, are LEDAC priority bills, he said. “These measures will be up for final reading on Monday. The deliberations on these bills have been exhaustive and I am confident that we did a good job of crafting these pieces of legislation, the efforts and expertise of the legislative staff in the Senate included,” he added. There are two bills pending President Ferdinand Marcos Jr.’s signature including the Trabaho Para sa Bayan Act and the Local Government Unit Income Classification Act. The Philippine Salt Industry Development Act, meanwhile, has been approved by the Senate on final reading and is on standby for bicameral committee action. Zubiri said there are 12 local bills involving SUCs that are also up for approval on final reading. After the approval of the four LEDAC measures on Monday, the Senate will set the schedule for the bicameral conference committee hearing with their counterparts in the lower house, bringing the measures closer to enactment into law. Undergoing amendments before their approval on the second reading is the Magna Carta of Filipino Seafarers while the Anti-Agricultural Economic Sabotage Act—which has been certified as urgent and has a high possibility of being approved in its third reading. Further, the Real Property Valuation and Assessment Reform Act, Waste-to-Energy Bill, Mandatory Reserve Officers’ Training Corps, and National Service Training Program, as well as the National Disease Prevention Management Authority/Center for Disease Prevention Bill are all in the interpellation and are pending approval on second reading. Zubiri assured that the Senate will meet its commitment to approve on final reading the remaining 17 of the 20 LEDAC measures before the session adjourns in December of this year. Escudero to BOC: File charges vs. rice smugglers, hoarders
Senator Francis Escudero challenged the Bureau of Customs to immediately file charges against traders susceptibly involved in smuggling and hoarding rice. Escudero said such illegal activities have caused an artificial shortage of food staples and rice price spikes in recent months. The senator then slammed the BOC for its failure to disclose to the public the “names of traders and operators whose warehouses were raided by government authorities for tons of suspected smuggled rice.” “Ang dami nang raids na ginawa nitong mga nakaraang linggo, bakit hanggang ngayon, wala pang kasong isinasampa sa mga taong sangkot? (You have done so many raid activities this past weeks, why is it until now you haven’t filed cases to anyone involved?),” he said. Escudero stressed the need to file charges and ‘bring these economic saboteurs to court” so it could “serve as a warning” that the Marcos administration is indeed serious in its campaign against smugglers and hoarders. He said the authorities should not stop by just conducting a series of raids, instead, the efforts should showcase strong results. The Republic Act 10845 or the Anti-Agricultural Smuggling Act of 2016 considers large-scale smuggling of agricultural products as economic sabotage, with "at least P1 million worth of sugar, corn, pork, poultry, garlic, onion, carrots, fish, and cruciferous vegetables, in their raw state, or which have undergone the simple processes of preparation and preservation for the market, or a minimum of P10 million worth of rice, as valued by Bureau of Customs." “Why haven't I heard anyone sued for economic sabotage or something? Who owns these warehouses? Who are the people involved?" Escudero asked, citing that the BoC-Port of Zamboanga seized some 42,180 sacks of rice worth P42 million in Barangay San Jose Gusu on 15 September. The local bureau inspected the warehouse on 19 May after receiving information that smuggled rice was being stored in the area. Two weeks prior, the BOC inspected three warehouses in Bulacan and found these stocked with suspected smuggled imported rice worth P505 million. It temporarily sealed and guarded these warehouses located inside the Intercity Industrial Complex in Balagtas, Bulacan. Aside from filing charges, Escudero said the government should also update the public on the development of these cases “in the spirit of transparency.” "Ito ang mga dapat nilang masagot ngayon (this what they should answer now): who oversees the disposition and how will it be disposed? Ano ang gagawin nila sa mga bigas na nakumpiska? (What will happen to confiscated rice?),“ Escudero said. In a news forum last Saturday, BOC Port of Zamboanga chief, Benito Lontok, said the agency is planning to donate the smuggled rice for the implementation of the Department of Agriculture’s Kadiwa Program and the Department of Social Welfare and Development’s assistance programs. However, Lontok said the plan is still “subject to approval” of BoC Commissioner Bienvenido Rubio and Finance Secretary Benjamin Diokno. 'DA should step up' Meanwhile, Senator Alan Peter Cayetano urged DA to take more proactive measures to address the price hike in rice. Cayetano lamented the prices of rice remain high despite the government’s implementation of a price cap on the product. President Ferdinand Marcos Jr. earlier blamed smugglers and hoarders for causing the increasing prices of rice in the country. Hence, issuing the executive Order No. 39 on 31 August, mandated price ceilings for regular-milled rice at P41 per kilogram and well-milled rice at P45 per kilogram. The EO 39 will be implemented nationwide beginning 5 September. Marcos vowed the government would continue going after the rice smugglers and hoarders, including the imposition of penalties for those found guilty of violating the mandated price cap for rice. Cayetano lauded Marcos for this effort and for being a “sincere Agriculture Secretary” with a primary intent on the country’s food situation. The Bureau of Customs is considering donating the confiscated 42,180 bags of imported rice to some departments implementing government assistance programs. In a news forum, BOC-Port of Zamboanga chief Benito Lontok said the plan to donate the smuggled rice for the implementation of the Department of Agriculture’s Kadiwa Program and the Department of Social Welfare and Development’s assistance programs is still “subject to approval” of BOC Commissioner Bienvenido Rubio and Finance Secretary Benjamin Diokno. “Idu-donate po yata sa (It might be donated for the implementation of a) government program, I don’t know po kung Kadiwa or sa DSWD (if it would be donated for Kadiwa or DSWD’s programs). Pero ‘yun po ay pinag-uusapan pa (It is still being discussed),” Lontok said. The smuggled rice, amounting to P42 million, was seized during a raid at a warehouse in Barangay San Jose Gusu in Zamboanga City. The local bureau inspected the warehouse on 19 May after receiving information that smuggled rice was being stored in the area. Lontok said authorities found irregularities, although the warehouse owner, BLY Agri-Venture Trading, was able to submit import documents. There were disparities between the actual seized goods and the descriptions provided in the submitted documents, he added. “The payment records submitted referred to a shipment of White Rice 15 percent Broken, while the physical examination confirmed that the confiscated rice was Jasmine Fragrant Rice,” he said. Lontok added the warehouse also lacked the necessary Sanitary and Phytosanitary Import Clearance from the Bureau of Plant Industry. “That’s why we issued a warrant of seizure and detention, and eventually na-forfeit po iyong goods (the goods were forfeited) in favor of the government,” he said. On 1 September, the BOC-POZ issued an Order of Forfeiture for violating the Customs Modernization and Tariff Act, Rice Tariffication Law, and Republic Act No. 10845, otherwise known as the Anti-Agricultural Smuggling Act of 2016. The BOC said they will conduct more inspections of warehouses following a directive from President Ferdinand Marcos Jr. “to address hoarding and illegal rice importation” in the country. QC councilor slapped anew with graft raps
The Quezon City Barangay Kaligayahan chairman who is an honorary councilor for being the League of Barangay Chairmen President is in for more trouble. One of his former employees slapped him along with the barangay (village) treasurer and a kagawad (councilor) with charges of violations of Graft and Corrupt Practices Act and Falsification of Public Documents before the Office of the Ombudsman, late afternoon Monday. Arjean Abe, of Tawid Sapa 2, Greenfield’s, Barangay Kaligayahan charged Barangay Kaligayahan Chairman and Quezon City Councilor Alfredo “Freddie” Roxas, his treasurer Hesiree Santiago, and Kagawad Arnel Gabito chairman of Appropriation Committee with charges of violations R.A. 3019 or the Anti-Graft and Corrupt Practices Act and the Revised Penal Code for faking her signature to appear that she is still a barangay employee. Abe, in her complaint, obtained by DAILY TRIBUNE, said she was hired as a teacher aide on 1 March, 2022, receiving a monthly salary of P6,000 and was detailed at the barangay day care center. She was later transferred as a clerk taking care of issuance of barangay clearance because of the pandemic and classes on face to face were suspended. Abe said on 31 January 2023 she resigned from her work with her letter of resignation received by Santiago. However, she found out that her name still appeared in the barangay payroll list, one of which was submitted by her as an evidence against the three officials. The payroll was for 1 to 31 May 2023 where her name and signature still appeared and projected that she is still an employee receiving P6,000. The payroll list, Abe presented as “Annex A”, also has the signature of Roxas, Santiago and Gabito. These documents, Abe said, are submitted to the Quezon City goverment for funding. She also submitted a copy of her Identification Card as “Annex B” bearing her true signature for the Ombudsman for vetting against the signature on the payroll list. Abe said the acts of the three officials also constitute falsification of documents which is a violation of Article 171 of the Revised Penal Code as she prays that the Ombudsman would act on her complaint and compelled Roxas and the two other Barangay Kaligayahan officials to answer to her charges and be jailed and eventually barred from holding public offices. Former Bataan gov off the hook
The Sandiganbayan announced on Sunday that it has cleared former Bataan Governor Leonardo Roman of a P3.66-million graft charge stemming from the anomalous construction of a mini-theater at the Bataan State College in 2004. Citing the prosecution’s failure to prove his guilt beyond a reasonable doubt, the anti-graft court’s Second Division acquitted Roman of violating the Anti-Graft and Corrupt Practices Act or RA 3019 in a 41-page ruling. “As the prosecution, in this case, failed to prove beyond reasonable doubt all the elements of Section 3(e) of RA 3019 under which the accused was charged, accused Roman should be entitled to an acquittal,” said the Sandiganbayan. To recall, the case against Roman involved the alleged awarding of a P3.66-million mini-theater project of the Bataan State College in 2004 in favor of V.F. Construction despite no allocated budget or appropriation for the project. He was also accused of colluding with his co-accused executive assistant Romeo Mendiola, treasurer Pastor Vichauco, budget officer Aurora Tiambeng, and accountant Numeriano Medina by giving unwarranted benefits to V.F. Construction for the release of the sum. Filed before the Ombudsman, the case stemmed from a complaint-affidavit dated 1 September 2004 accusing Roman and his cohorts of the crime of malversation of public funds through falsification of public documents. Roman served as the governor of Bataan from 1986 to 2004. In 2006, the Ombudsman dismissed the complaint for lack of probable cause. The Supreme Court affirmed the Ombudsman’s decision to drop the criminal charge. The Ombudsman, however, filed the case before the Sandiganbayan in 2015 following the SC’s ruling to reverse the criminal charge of graft. Based on the prosecution’s probe, Roman entered a contract with V.F. Construction to construct a mini-theater and rendered his authorizations, approvals, and certifications for the P3.66-million payment. Investigation revealed that Roman certified the project as fully completed and issued the payment to the construction firm in two installments. However, more than five months after the final payment was made to the construction company, the CoA discovered that the mini-theater, contrary to Roman’s declaration, was incomplete. The structure, it said, was only 50.7 percent complete. In clearing Roman, the Sandiganbayan stressed that it was “not convinced” by the prosecution’s theory that the erstwhile governor’s execution of a contract and approval of the payment with the V.F. Construction despite the lapses was tantamount to graft. “The evidence on record is insufficient to prove beyond reasonable doubt that there was bad faith, manifest partially, or gross inexcusable negligence on the part of the accused when he committed the questioned acts,” the Sandiganbayan said. According to the Sandiganbayan, while Roman may have committed mistakes in the performance of his duty, the fact remains that the evidence is insufficient to prove a serious breach of duty that was committed flagrantly, palpably, and with willful indifference or blatant and extremely careless manner. Austrian ex-chancellor charged in latest corruption scandal
Austrian prosecutors said Friday they have charged former chancellor Sebastian Kurz with giving false testimony, the latest in a series of wide-ranging corruption scandals that have rocked the Alpine country. Kurz -- once hailed as a "wunderkind" of Europe's conservatives -- stepped down as chancellor in 2021 following a string of graft accusations, including spending public money for favorable media coverage. It marked the spectacular fall of the charismatic hardliner, who became the world's youngest democratically elected head of government in 2017 at age 31. Prosecutors said they have charged Kurz and two other people with providing false testimony to a parliamentary committee probing numerous graft allegations. The trial has been set for 18 October and is expected to last three days, the Vienna criminal court said. Kurz, 36, has repeatedly dismissed the accusations levied against him. The investigation by the state economic crime and corruption prosecutor into the charges Kurz allegedly lied to a committee of lawmakers wrapped up in January. In statements to the parliamentary committee, Kurz downplayed his influence in appointing then-finance ministry official, Thomas Schmid, to head the state-run company OeBAG. Ahead of the indictment, Kurz said on X, formerly known as Twitter, that the "allegations are false" and his team was looking forward to them being "proven baseless in court". If found guilty, he could face up to three years in jail. Earlier this year, Kurz's lawyer Werner Suppan said that 30 witnesses so far have exonerated his client with their statements. The former chancellor is now involved in numerous private international enterprises, including launching a cybersecurity company with the ex-head of Israel's NSO Group, which makes controversial Pegasus spyware. The conservative People's Party, which Kurz headed until 2021, continues to govern in a coalition with the Greens -- but their approval ratings have plummeted.
