Lebanon court orders ex-car boss Ghosn out of Beirut home: official
A Lebanese judge has decided to evict former Nissan boss Carlos Ghosn from his luxury home, a judicial official said Saturday, four years after an investment firm accused him of "trespassing". Ghosn, who took up residency in the Beirut property after fleeing prosecution in Japan in 2019, appealed the ruling on Friday, the official added. A spokesperson for Ghosn confirmed he had appealed. Ghosn and his wife must "vacate the property... within a month", according to a copy of the decision seen by AFP and dated 16 October. The home with pink walls in the Lebanese capital's upscale Ashrafieh neighborhood is worth some $19 million and is registered to Lebanese company Phoinos Investment, the judicial official said, requesting anonymity as they were not authorized to speak to the media. Phoinos initiated the legal action in 2019 and has accused Ghosn of "trespassing on private property and living in the home without legal basis", the official added. According to the court document, Ghosn said the company was affiliated with Nissan and that "the property was purchased... for his residence, and there is a signed agreement with Nissan that grants him the right to reside" there. Ghosn occupied the home "according to a contractual relationship linking... Ghosn and Nissan", the decision said. However, the end of that relationship and the plaintiff's wish to retake the property invalidates "the legal basis" of his occupancy, it added. In a written statement to AFP, a Ghosn spokesperson said documents that had been unavailable for prior hearings in the cast would support his appeal. "He will now be able to present all the documents held up in Japan that he was unable to secure on time," the statement said. Ghosn, the former chairman and chief executive of the Renault-Nissan-Mitsubishi alliance, was arrested in Japan in November 2018 on suspicion of financial misconduct, before being sacked by Nissan's board in a unanimous decision. He jumped bail late the following year and made a dramatic escape from Japan hidden in an audio-equipment box, landing in Beirut, where he remains an international fugitive. Ghosn has always denied the charges against him, arguing they were cooked up by Nissan executives who opposed his attempts to more closely integrate the firm with French partner Renault. Japan and France have sought his arrest, but Lebanon does not extradite its citizens, and judicial authorities have slapped a travel ban on Ghosn, who holds Lebanese, French, and Brazilian nationality. Increased threshold announced at national developers confab
The Philippine Board of Investments has announced the increase of threshold price per housing unit eligible for government tax incentives from P2 million to P3 million during the National Developers Convention in Cebu City hosted by the Subdivision and Housing Developers Association. In addition to the increased threshold, the BOI has also extended the income tax holiday period from four years to six years. The extended threshold for tax incentives and the longer ITH period will provide developers with increased financial incentives, making it more attractive for them to undertake housing projects. With this year’s theme focusing on local development, SHDA national president Arch. Leonardo Dayao Jr. emphasized the steps SHDA is taking to empower the local housing sector by collaborating with Local Government Units. “Several developers of ours here are partnering with their different LGUs. We have one in Iloilo, Novaliches, so we have several developers already. ‘Correction system is window of soul’ — Remulla
Justice Secretary Jesus Crispin Remulla said in his speech, “Correction system is the window of the soul of the country”, as the Bureau of Corrections released 949 persons deprived of liberty from its major prison facilities nationwide yesterday. "So, dapat maraming pagbabago ang magawa natin dahil hindi magiging epektibo ang correction system pag congested ang ating mga kulangan,” he added. The DOJ chief continued, “We also have to expedite the release of PDLs if they have already served their maximum sentence and our police force and prosecutors are now working hand in hand to resolve the issue of those accused being detained for so long much more than their sentence.” “Gusto natin na mapalaya sila agad kung nakapag bayad na sila sa lipunan (We want them to be released promptly in the event they already paid their sins in the society),” Remulla said. Those released were from Correctional Institution for Women (90), Davao Prison and Penal Farm (177), Iwahig Prison and Penal Farm (23), Leyte Regional Prison (69), New Bilibid Prison (486), Philippine Military Academy (2), Sablayan Prison and Penal Farm (33), and San Ramon Prison and Penal Farm (71). Of the said numbers, 556 were released due to the expiration of their maximum sentence, 213 were acquitted of the charges against them, 129 were given parole, 29 were granted probation, and two were released on cash bond. This brings to 6,322 the total number of PDLs who have been released under the administration of Director General Gregorio Pio P. Catapang Jr. Catapang has been expediting the release of PDLs as part of his reform agenda. LTFRB whistleblower cited for contempt
Whistleblower Jeffrey Tumbado, the erstwhile executive assistant of now-suspended Land Transportation Franchising and Regulatory Board chairman Teofilo Guadiz, whom he earlier accused of corruption, will be confined in the halls of Congress after he was cited in contempt. During Monday’s motu proprio of the House committee on transportation into alleged anomaly plaguing the agency, Sagip Partylist Rep. Rodante Marcoleta moved to cite Tumbado in contempt after earning the ire of the panel for providing inconsistent responses to queries posed by lawmakers. “This is the hard part in this kind of hearing, Mr. Chair. You (Tumbado) know you’re not consistent with your answers. Now you just said that you were not threatened, but in the sworn statement that you gave to the NBI, you said, ‘I am worried about my safety and that of my family,’” Marcoleta said. Contrary to his prior statement that he was “pressured” to recant his corruption allegations against his previous boss, Guadiz, Tumbado now asserts that he was not apprehensive about withdrawing his previous claims. Tumbado admitted that he did not have enough evidence to substantiate his corruption claims against Guadiz, conceding that it was solely based on his “opinion.” Nevertheless, he remained resolute in asserting that systemic corruption permeates the entire agency. “The corruption is there because I myself am approached by operators who want to speed up the processing of their papers. I no longer have direct knowledge of the chairman’s corruption… There is indeed corruption in the LTFRB, not particularly chairman Guadiz,” he said, pledging that he would submit the list of complainants to the committee. The corrupt practices plaguing the LTFRB, according to Tumbado, involved the modification of routes, special permits, trafficking and substitutions. President Ferdinand Marcos Jr. immediately suspended Guadiz, whom Tumbado said stood at the center of a “lagayan” or bribery system in the LTFRB after the issue made headlines. Manila Rep. Benny Abante, previously claimed the bribery scheme has been in operation since 2009. Before retracting his accusations, Tumbado also dragged Transportation Secretary Jaime Bautista and no less than the Office of the President into the alleged corruption in the LTFRB. Tumbado told lawmakers that he withdrew his claims against Guadiz due to his lack of firsthand evidence implicating the chairman in the purported corruption, contrary to his previous assertion that Guadiz regularly received as much as P5 million in exchange for the expeditious approval and release of special permits, franchises, and route modifications. “I don’t have direct evidence to prove that chairman Guadiz can be pinpointed in the allegations,” he told the panel. Antipolo Rep. Romeo Acop, chair of the panel, however, posits a firm conviction that Tumbado had a hand in his own accusations. “For all intention purposes, you are included here. You’re equally guilty if anyone is guilty in the LTFRB. You’re there, so you’re involved,” Acop stressed. Tumbado will be confined within the premises of Congress for a maximum of 10 days.
