CA junks telco’s frequency plea, mandamus case vs. NTC
The Court of Appeals junked the petition for mandamus filed by NOW Telecom Company Inc. against the National Telecommunications Commission or NTC over the company's provisional authority or PA application to operate a cellular mobile telephone service within specific frequency ranges. In a 16-page decision, the appellate court's Special Ninth Division said "the court is powerless" to grant NOW Telecom's plea, especially since the company failed to show a clear legal right to the frequencies it sought. The CA said the decision, penned by Associate Justice Tita Marilyn B. Payoyo-Villordon and concurred in by Associate Justices Myra V. Garcia-Fernandez and Walter S. Ong, followed a careful examination of the case. The case began from NOW Telecom's request for NTC's automatic approval issued by the Anti-Red Tape Authority or ARTA. NOW Telecom had filed a petition for mandamus under Rule 65 of the Revised Rules of Court to compel the NTC and former Commissioner Gamaliel Asis Cordoba to stick to ARTA's resolution and OAA both dated 1 March 2021. These ARTA documents stated that NOW Telecom's application for a PA to operate in the frequency range 1970 Mhz-1980 Mhz paired with 2160 Mhz to 2170 Mhz and 3.6 GHz to 3.8 GHz frequency ranges was automatically approved by operation of law. It followed Republic Act 11032, otherwise known as the Ease of Doing Business and Efficient Government Service Delivery Act of 2018. However, an ARTA resolution dated 17 June 2022 reversed the previous decisions and formally recommended NOW Telecom's application for frequency assignment to the NTC. NOW Telecom's mandamus petition was notably based on its claim for the rights to specific frequency ranges, alleging that the NTC had unjustly neglected its duty to assign them. Yet, court records showed that as early as December 2005, NTC already found NOW Telecom to be non-compliant and was disqualified from the assignment of 3G frequency bands due to unpaid supervision and regulation fees or SRF and spectrum user fees or SUF amounting to P2.6 billion. NOW Telecom has a pending petition filed before the Supreme Court for this penalty imposed by the NTC. NOW Telecom received its PA in January 2006, but it was not specific to 3G and under the condition of paying its outstanding SRF and SUF obligations. In December 2017, NOW Telecom was designated the 20MHz contiguous bandwidth, 3520 to 3540 MHz, under the 3.5 GHz on the same condition that it resolved its outstanding SUF and SRF fines. NOW Telecom's Provisional Authority was extended until September 2020, but the NTC reiterated that the company failed to fulfill the conditions regarding SUF and SRF. DBM declares Cagayan’s 2023 budget inoperative
BAGUIO CITY — Local officials of the provincial government of Cagayan disclosed that the Department of Budget and Management has suspended the province’s programs and projects after it deemed the provincial government’s budget inoperative in its entirety. Cagayan Provincial Board Member Rodrigo de Asis said that the DBM declared inoperative the 2023 Annual Budget of Cagayan after the Sangguniang Panlalawigan cut a large chunk of it this year, adding that the DBM has seen violations committed by the Sangguniang Panlalawigan. He added that the Sangguniang Panlalawigan slashed Cagayan’s budget with P21 million from the 20 percent development fund of Cagayan contrary to the provisions of the Local Government code. Finance firm employee faces falsification raps
An employee of a motorcycle financing company is in “hot water” after being slapped with 43 counts of falsified document and for qualified theft through fake receipt. P/Maj. Edward Samonte chief of the MPD-District Special Operation Unit identified the suspect only as Rupert de Asis. It was learned De Asis was filing charges against clients who fail to pay their monthly amortizations for the motorcycle loan but was the one collecting the payment. He allegedly has not remitted to the company such payments and was issuing fake receipts to customers. Samonte, in an interview, said that suspect De Asis is bloating sum of money for the expenses for filing court cases of delinquent clients who fail to pay their monthly due. ‘Intimate Audrey:’ An up-close and personal look at a Hollywood and fashion icon
First Lady Liza Araneta-Marcos led the ribbon cutting ceremony on 31 July to formally open the first Asian stop of Intimate Audrey, the bespoke exhibition on the life of the late Hollywood and fashion icon Audrey Hepburn that was created by her son Sean Hepburn Ferrer. Ferrer himself attended the ceremony, with his daughter Emma in tow, held at The Museum at S Maison, located at the Mall of Asia complex in Pasay City, where the exhibition will run until 29 October 2023. The exhibition was brought to the Philippines through the partnership of FashX, a fashion trade and licensing company, and SM Supermalls, as represented at the opening by Hans Sy and Teresita Sy-Coson. It then made a stop in what she considered her home country, Netherlands, specifically in its capital, Amsterdam, where she spent much of her youth during the war years. The exhibition features over 800 photographs, memorabilia, fashion items, drawings, writings, movie posters and trophies that were thoughtfully curated and laid out around the 730-square meter space at The Museum at S Maison. There are also videos playing in strategic spots to highlight specific chapters in her life and at the screening room to show clips from her timeless movies Roman Holiday, Sabrina, Breakfast at Tiffany’s, to name a few. At the end of the exhibition — which covers Hepburn’s life from childhood to ballet training to conquering Hollywood, getting married, becoming a mother and finally doing humanitarian work as UNICEF ambassador — there’s a fashion tribute put up especially for the Manila stop. Titled Audrey: An Homage from Filipino Fashion, this section highlights the works of celebrated Filipino designers who got inspiration from Hepburn’s films and documentaries on her life. Data-backed weather warnings for agri workers sought
Farmers are appealing to the Department of Agriculture, headed by no less than President Ferdinand R. Marcos, Jr., to form a committee that would translate scientific weather data into proper warnings for agriculture workers. At a press briefing on Monday, Federation of Free Farmers' Cooperative Inc. National Manager Raul Montemayor said data-based warnings would save farmers from losing millions or even billions worth of produce to weather phenomena such as El Nino. “We have been warned that the country will face El Nino this year, which somehow scared farmers to continue planting. As such, the DA has to translate weather projections to site-specific projections to properly guide farmers,” Montemayor told reporters. “Hopefully, this can be done by mixing science and agriculture. The data from the state-weather bureau should be translated by the DA into something useful for the farmers. We have to have something like this soon,” he said. However, Montemayor lamented that the DA, despite numerous calls for proper dialogue, has yet to fully open its doors to consider farmers’ proposals. “We have to look at history to get an idea about the potential effects of El Nino. When we say El Nino, there will be less rain than normal, which can sometimes be good for some areas with rice plants,” he explained. Ana Solis, chief of the Climate Monitoring and Predictions Section of the Philippine Atmospheric, Geophysical and Astronomical Services Administration or PAGASA, however, said that the agency continues to get in touch with the DA. “We gave our forecasts to the DA so they can use them for their mitigation measures,” she noted. “Based on our forecasts from July to December, the possible reduction in water is around 22 to 44 percent. It will be difficult to prepare if this El Nino lasts until next year,” Solis explained. Due to fears of El Nino, some farmers in Quezon province notably stopped planting rice. As such, Tugon Kabuhayan convenor Atty. Asis Perez urged rice farmers to keep planting palay even until September —stressing that the El Niño dry weather phenomenon will still occur in October. Perez, who was a former director at the Bureau of Fisheries and Aquatic Resources, said that rice farmers must have clear information about the start of the occurrence of El Niño. "The farmers can still plant in July, August, and September, and by October that's the best time to harvest as it will be hot, no rains,” he explained. Senator Christopher “Bong” Go attended the groundbreaking of the Panay Super Health Center in Capiz last Monday, following a monitoring visit of the Malasakit Center at the Roxas Memorial Provincial Hospital in Roxas City earlier that day. The facility, through the efforts of the Department of Health and the local government of Panay, will offer basic health services to the people of the town and even neighboring areas, such as database management, out-patient, birthing, isolation, diagnostic (laboratory: X-ray and ultrasound), pharmacy and ambulatory surgical unit. Other available services are eye, ear, nose, and throat service; oncology centers; physical therapy and rehabilitation center; and telemedicine, where remote diagnosis and treatment of patients will be done. Through the collective efforts of fellow lawmakers, sufficient funds were allocated under the Health Facilities Enhancement Program of the Department of Health for 307 Super Health Centers in 2022 and 322 in 2023. The DoH, the lead implementing agency, identifies the strategic areas where they will be constructed. In his speech during the event, Go emphasized the importance of investing in healthcare infrastructure to ensure that Filipinos, especially those in rural areas, have access to quality medical care. He also praised the government’s efforts, led by Governor Fredenil Castro, Vice Governor Jaime “Mitang” Magbanua, Board Member Thea Reyes, Panay Mayor Vicente Bermejo and Vice Mayor Arminda Asis-Bermejo, among others, for their collective efforts to support the construction of the new center. Central Visayas eyes more ESL schools
Cebu is now back on the map for English as Second Language or ESL students as the Department of Tourism revealed that over 100 ESL school officials and agents visited Central Visayas. In the first quarter of 2023, Japanese, South Korean and Chinese delegations inspected various ESL schools in Cebu while agents and officials from Hanoi, Ho Chi Minh, Da Nang, Quang Ninh and Can Tho in Vietnam and major locations of Taiwan had similar missions during the last quarter of 2022. These were all coordinated with DoT-7 and the Cebu Association of Language Academy. DoT-7 chief tourism operations officer Gelena Asis-Dimpas said that the assessment trips resulted in enrolment surges in ESL programs in the region, with Cebu having the lion’s share of students. She forecasted that with the reopening of foreign students, about 3,000 to 5,000 foreign ESL students per month come to Cebu to learn English. “ESL is currently re-establishing itself as we suffered a total meltdown with the pandemic and serious lashing by Typhoon Odette. With the assertive cooperation of local ESL operators, we are fast reclaiming our position in the global marketplace,” Dimpas said.
