LAWMAKER ON WHEELS — Ejercito’s love for Phl sports is one of a kind
Senator JV Ejercito’s love for cycling is hard to miss. From interviews to his social media posts, the 53-year-old lawmaker would always find a way to display his love for cycling — and sports in general. That’s why in a recent interview with Daily Tribune, Ejercito took the opportunity to preach the benefits of cycling and how he wants to spearhead the staging of more local and international tournaments that would encourage a lot of enthusiasts to take the sport seriously. “We need to have more competitions like Ronda Pilipinas. I hope somebody picks up the cudgels for it to continue because competition improves the quality of our athletes,” said Ejercito, referring to the annual professional road cycling competition that covers major cities in Luzon, Visayas and Mindanao. The prestigious bikefest started in 2011 and has drawn the interest of the best local and international riders. It, however, got canceled this year as it prepares to transition from being an annual to a biennial event. “We need competitions,” Ejercito stressed. But batting for the staging of a professional cycling competition is just a mere fraction of Ejercito’s love for the sport. In fact, during the height of the coronavirus pandemic in 2020, Ejercito took the cudgels for the cyclists when he slammed the Inter-Agency Task Force for raising the proposal of requiring cyclists to wear face shields on the road. Ejercito stressed that this proposal will put the cyclists’ lives at risk as they might suffer hypoxia or lack of oxygen. Having first-hand experience on the challenges of the sport, Ejercito asserted that the proposal might create more harm than good. “I am not in favor of requiring face shields to those who are biking and exercising. This might cause hypoxia or lack of oxygen. While breathing hard, intake of oxygen is already minimized with masks so what more if they will require them to wear face shields? This can be fatal,” Ejercito said. “Cyclists usually are away from each other. Face shields should be required in enclosed and crowded places. There is already a mask that is required anyway.” “Wearing a face shield while cycling is dangerous. The mask is enough.” But that’s not all. Ejercito also fought hard for the rights of cyclists through Senate Bill 393 that pushes for more bicycle lanes in major thoroughfares. He believes that by putting up bicycle lanes, the government would encourage the public to bike to their respective schools or offices instead of riding cars, buses or trains. The public would also get to save a lot on their transportation expenses while helping the government solve the worsening traffic situation. “This legislation is one way to help unburden commuters who are choosing to ride their bicycles and other non-motorized vehicles in order to escape the worsening traffic situation and save money on fares and fuel, especially now that prices of petroleum products have skyrocketed,” the bill’s explanatory note said. Ejercito said the government will also benefit from this proposal. “Though we admire such resilience and innovation, the government should also look into improving road conditions for alternative means of transportation,” Ejercito, the son of former President Joseph Estrada, said. “Until such a time that the government has finished its goal to provide mass transportation that is people-centered and accommodating to every walk of life, there will always be room for alternative forms of travel.” Ejercito admitted that he even considered riding his bicycle to work. “Even I couldn’t bear it each time I load up on gas. I shell out P5,000 every time. It’s hard on my pockets. Hopefully, I can save by biking to work,” Ejercito said. As of May 2023, about 546 kilometers of bike lanes were already established in Manila, Metro Cebu and Metro Davao, according to the Department of Transportation. Aside from cycling, Ejercito also plays golf and boxing. He is also an avid fan of basketball. In fact, he was at the sidelines when Gilas Pilipinas battled China in the FIBA Basketball World Cup together with other senators in Ronald “Bato” dela Rosa, Joel Villanueva and Juan Miguel Zubiri. Ejercito said if there will be a chance, he will gladly lend a helping hand to Philippine sports. After all, he is no stranger to grassroots sports after serving as chairman of the committee on youth and sports when he was still representing San Juan City in the House of Representatives. With him in charge, he was able to help the Philippine Sports Commission with its funding that led to the rise of promising athletes like Hidilyn Diaz, who went on to become the country’s first Olympic gold medalist. “There’s no specific NSA (national sports association) but if there is an opportunity, I will help. I box, I cycle and I even played basketball before,” the mild-mannered Ejercito said. Truly, sports, especially cycling, occupies a very special place in Ejercito’s heart. Bong Go aids Borongan fire victims
Senator Christopher “Bong” Go provided assistance to 22 fire-hit households in Barangay Calingatngan, Borongan City, Eastern Samar on Tuesday, 26 September. In coordination with Calingatngan Barangay Captain Edwin Anasarias, the affected families received financial assistance, grocery packs, clean drinking water, snacks, and shirts from the senator. Select recipients also received shoes, mobile phones, and balls for basketball and volleyball. Meanwhile, the Department of Trade and Industry and the National Housing Authority conducted their respective assessments wherein qualified recipients may receive necessary livelihood support and housing assistance, respectively. “Huwag po kayong mawalan ng pag-asa, ang importante ay buhay kayo. Ang gamit po ay napapalitan, ang pera ay kikitain pero ang pera ay hindi nabibili ang buhay. A lost life is a lost life forever. Kaya pangalagaan natin ang buhay na binigay sa atin ng Panginoon,” Go said in a video message. Go then highlighted Republic Act No. 11589, also known as the Bureau of Fire (BFP) Protection Modernization Act of 2021. The said law, which was authored and co-sponsored by Go, mandates the BFP to undergo a ten-year modernization program that will improve the capabilities of the agency by implementing a ten-year modernization program, which includes recruiting more firefighters, acquiring new fire equipment, and developing specialized training, among others. Go, chairperson of the Senate Committee on Health and Demography, also encouraged residents with health concerns to seek the services of the Malasakit Center located at Eastern Samar Provincial Hospital in the city. Designed to assist poor and indigent Filipinos, the Malasakit Center is a one-stop shop where all relevant agencies are brought together under one roof to ensure that medical assistance programs are within the patients’ reach. The Malasakit Centers Act of 2019, principally sponsored and authored by Go, has successfully assisted more than three million Filipinos with 159 operational centers nationwide. Go, vice chairperson of the Senate Committee on Finance, supported the construction of the access road from the National Highway to Bolusao National High School in Lawaan; rehabilitation of local roads in Balangkayan, Giporlos, Jipapad, Lawaan, Maslog, Quinapondan, San Julian, Sulat, and Taft; construction of the Borongan Community Hospital; construction of a slope protection structure in Borongan City and Lawaan; construction of multipurpose buildings in Jipapad, Maydolong, and Oras; construction of a slaughterhouse in Maydolong; improvement of the drainage systems in Can-Avid; and acquisition of ambulance units for the local governments of Maslog and Quinapondan. Days after she filed a graft case against Quezon City Barangay Kaligayahan Chairman Alfredo “Freddy” Roxas, threats that something bad would happen to her flooded her mobile phone and social media account. Aljean Abe, the village’s former teaching aide went to the Office of the Ombudsman on Friday to file another Grave Coercion charge against Roxas in relation to Republic Act 3019 or the Anti-Graft and Corrupt Practices Act. Abe in her complaint furnished to DAILY TRIBUNE narrated that when she filed the graft charges last 11 September, several messages were sent to her cellular phone by supporters of Roxas threatening to do harm to her. Abe averred that the threat messages came from Mark Roldan Santiago Sedilla and Jennilyn Guiling Montefalco both employees of Barangay Kaligayahan and avid supporters of Roxas who is also an honorary councilor for being the president of League of Barangay Chairmen in the city. Fearing for her life and her family, Abe decided to transfer to a place where Roxas and his supporters could not reach her. However, the following day (12 September) she was surprised to see their barangay vehicle parked in front of her new address where Melanie Aviguetero, Jamaica Jallorica and an unidentified man tried to take photos of her. The three are also employees of Barangay Kaligayahan, according to Abe, who informed her that she needed to go to their office and talk to Roxas. Two days after (14 September) Abe said she received a text message asking why she filed a graft case against Roxas. She was also asked if she needed monetary assistance from their barangay and if she wanted to be hired again as barangay worker. If she agrees, she needs to go to their barangay to sign a contract and some documents in front of a lawyer. These things, Abe said prompted her to file the grave coercion charges against Roxas. Other charges of graft practices were also filed by Barangay Kaligayahan Kagawad laban kay Punong Barangay Allan Francisco Jr. against Roxas over a resolution passed without the proper barangay council session. Roxas meanwhile, could not be reached to comment on the charges hurled against him. SC affirms but reduces FILSCAP award
The Supreme Court has affirmed the authority of the Filipino Society of Composers, Authors and Publishers, Inc., or FILSCAP, to protect the owners and holders of copyrighted musical works. In a 32-page ruling penned by Associate Justice Ramon Paul Hernando, the court en banc junked the petition filed by Cosac Inc., which sought to set aside the 28 May 2015 decision and 14 January 2016 resolution of the Court of Appeals. The CA decision and resolution upheld the October 2012 and 22 July 2013 orders issued by the Regional Trial Court of Quezon City that ordered the petitioner to pay FILSCAP damages for unpaid license fees and royalties. However, the court modified the CA ruling by lowering the damages awarded to FILSCAP from P317,050 to P300,000. The court also imposed a 12-percent interest per year from 13 February 2006 until 30 June 2013, at the rate of six percent per year from 1 July 2013 until the date of finality of the judgment. It acknowledged that FILSCAP, by authority of the deeds/agreements, represents the owners or holders of copyrighted musical works under its catalog. As the assignee, FILSCAP is tasked to monitor and issue licenses to persons, businesses, establishments, and the like who want to play or perform musical compositions. The court also said that copyright owners are still entitled to be compensated for their creative work, even if it seems trivial or outrageous to collect fees for this purpose. “There is no question that they invested time, creativity, talent, and effort in the creation and development of their compositions,” the court said. FILSCAP is a non-stock, non-profit corporation comprised of composers, authors, and music publishers which is authorized to issue licenses and collect license fees for the public performance of copyrighted musical works under its repertoire, whether for profit or not. It is tasked to enforce and protect the performing rights of copyright owners of musical works. In the case of Cosac Inc., the court found that the restaurant played copyrighted music without obtaining a license from FILSCAP or paying the corresponding fees. The court also found that Cosac’s refusal to secure the license and its continued use of copyrighted music without the requisite performing rights constitute acts of infringement. As a result, the court ordered Cosac to pay FILSCAP the damages and attorney’s fees awarded by the trial court and the appellate court.
