Senate seeks Spanish counterpart’s aid in crafting Phl-EU free trade pact
A delegation of senators visited Spain during the celebration of the 75th year of the Philippines-European Union’s diplomatic relations. The country’s official inter-parliamentary visit was led by Senate President Juan Miguel Zubiri on Monday. He was accompanied by Senate Majority Leader Joel Villanueva and Senators Joseph Victor “JV” Estrada, Sonny Angara, Pia Cayetano, Nancy Binay, Grace Poe, and Mark Villar, along with Philippine Ambassador to Spain Philippe Lhuillier. The Philippine senators met their counterparts and discussed the enhanced trade between the Philippines and the EU. During the commemoration of the Phl-EU ties, Zubiri urged their counterparts to build stronger partnerships and solid relationships anchored in history. “Let us build on 500 years of friendship and history. The foundations of our friendship are anchored on our shared history, our shared culture, and our shared Catholic faith. Though we are proud to be our own independent Republic, we are also grateful for our heritage and our Hispanidad,” Zubiri told their counterparts in a meeting. In a statement Tuesday, Zubiri said he met with his Spanish counterpart, Pedro Rollán, and Spanish Ambassador to the Philippines Miguel Utray. During their meeting, Zubiri said he sought the assistance of Rollán as the Philippines is targeting to develop a free trade agreement with the EU. Rollán, in response, expressed his willingness to help the Philippines in crafting the pact saying that “Spain is well-positioned to offer support in the post-pandemic period as the head of the EU.” “Spain’s doors are always open for the Philippines. The visit is a welcome opportunity to reinforce the already excellent relations between the Philippines and Spain,” he added. Spain currently leads the EU for the extension of the Generalized Scheme of Preferences (GSP+), which allows about 6,000 Filipino products to enter the EU duty-free. The Senate Committee on Finance on Thursday approved the proposed P311.3 billion budget of the Department of Health for the upcoming fiscal year without the attendance of Health Secretary Teodoro “Ted” Herbosa. Herbosa skipped the DOH’s budget deliberation, normally led by the agency’s head, days after he failed to secure the approval of the Commission on Appointment. During the budget deliberation, DOH senior officials led by Undersecretary Lilibeth David, former Officer-in-Charge Maria Rosario-Vergeire and Undersecretary Gloria Balboa presented the agency’s proposed budget. Senator Francis Tolentino specifically questioned Herbosa’s absence in the budget deliberation, fearing that the agency is now in an “auto-pilot mode”. Senator Pia Cayetano, who presided over the agency’s budget deliberation, quickly clarified that the DOH is not “headless”. “Actually, all of the senior members of the team approached me a while ago and they acknowledged that, of course, it is a bit of an awkward situation,” Cayetano said. “But as you all know, Usec Dr. Vergeire was the OIC for many years and was very actively exercising her leadership not just in the past year, but even during the time of President Duterte. Dr. Usec. David is the most senior undersecretary. So I’m quite confident in the presentation today that they can answer,” she added. Tolentino explained that he is asking for Herbosa’s presence because “budget presentations would require answers concerning accountability.” “And perhaps the head of the department should be the one doing that. Cyber-attack on PhilHealth Senators also touched on the recent cyber-attack on the Philippine Health Insurance Corporation or PhilHealth. Legarda quizzed PhilHealth officials about the effect of the cyber-attack on the state-run health insurer’s operation, as well as the steps being taken by the agency to prevent similar cases in the future. Responding to the lawmaker’s query, Atty. Eli Dino D. Santos, PhilHealth’s Executive Vice President and Chief Operating Officer, said the agency has yet to restore its online system. “All transactions are offline, and we've resume operations meaning membership, employer submission, and payment over the counter,” Santos said. “Our benefits availment continues. We have already informed our partner providers that while the system is turned off, they can still submit claims or prepare the submission of claims,” he added. “At present, to confirm the statement of our President, we are set to turn on our systems today, but we are still completing the preventive measures before we turn it on. We are targeting to turn on our PhilHealth website, member portal, as well as the e-claims.” Over the weekend, PhilHealth confirmed reports that there was an “information security incident” on its online system, which prompted them to turn it off as part of its “containment measures”. The Department of Information and Communications Technology previously stated that the agency’s system was attacked by Medusa ransomware. A multinational cyber security software company, Trend Micro, defines “ransomware” as a type of malware that prevents or limits users from accessing a system, either by locking the system’s screen or by locking the users’ files until a ransom is paid. The Medusa ransomware group was demanding $300,000 from PhilHealth in exchange for access to its system. The group threatened to leak the personal information of PhilHealth members if it did not pay the ransom. Makati cries foul over Taguig’s ‘rejection’
The local government of Makati City on Sunday lamented the local government of Taguig’s alleged “unreasonable” rejection of Makati proposals which impedes the smooth transfer of city-owned health facilities and services. Makati City Administrator Claro Certeza said that the Makati local government proposed memorandums of agreement pertain to eight barangay health centers and the health data of their patients, and Ospital ng Makati. However, it was allegedly rejected by the local government of Taguig. “We have initiated a series of correspondence and memorandum of agreement proposals to the City of Taguig aimed to facilitate the smooth transfer of Makati-owned health facilities to its jurisdiction. However, these have been rejected outright, without valid reason. Unfortunately, Taguig seems adamant about taking over our hospital and health centers without acknowledging our ownership rights,” Certeza said. In a letter to Mayor Lani Cayetano, a MoA was proposed by Mayor Abby Binay for Ospital ng Makati, which contains an offer extending a substantial credit line to Taguig. The credit line is intended to ensure that affected residents can continue to access the essential health care services at the city-owned and managed hospital. Certeza said that as stated in the draft MoA, the credit line will “function as a financial safety net, enabling Taguig City to provide essential health care services to its residents without immediate upfront payments, particularly in cases where beneficiaries may not have the means to cover their medical costs themselves.” “Makati is even willing to allocate millions in funding for this credit line to Taguig to avoid any disruption in health care services. Yet, Mayor Cayetano refused to even consider the proposal, opting to put off any discussions regarding OsMak, purportedly in deference to the wishes of the Health secretary,” Certeza said. To recall, the Taguig City mayor said in her letter that Department of Health Secretary Teodoro Herbosa himself would take the lead in any discussions regarding Ospital ng Makati, and that both cities must defer to his wishes. In another letter to Cayetano, Binay also offered Taguig the option to lease or to purchase the land and improvement of eight health centers, subject to the appraisal of the Commission on Audit. However, Cayetano has allegedly declined the offer, again citing a supposed directive from the Health Secretary to “exclude the issue of ownership in the transition process.” “Makati is willing to let Taguig use its properties without asking them for immediate payment. Six days after taking over the management and supervision of the 14 schools affected by the dragging boundary dispute between Makati and Taguig City, the Department of Education gave Makati City the go-signal to distribute school supplies to the affected students in 10 EMBO barangays the Supreme Court had ordered transferred to Taguig City. In a letter to Makati City Mayor Abby Binay dated 22 August, DepEd Undersecretary and Chief of Staff Michael Wesley Poa said Vice President and DepEd Secretary Sara Duterte had approved the former’s request to distribute the school supplies, including the use of the school facilities. Binay earlier wrote to Vice President Duterte seeking permission to distribute school supplies in the 14 public schools to alleviate the financial burden on parents who would otherwise have to purchase new school supplies. “On behalf of the city government and all the intended beneficiaries in the 14 public schools, I would like to express our heartfelt gratitude to Vice President and DepEd Secretary Sara Duterte. We are thankful that she has the best interest of the students at heart in making a prudent and just decision,” Binay said, adding that the distribution would go on until 29 August when classes start. The 14 public schools are Fort Bonifacio Elementary School, Cembo Elementary School, South Cembo Elementary School, Pitogo Elementary School, East Rembo Elementary School, Rizal Elementary School, Comembo Elementary School, West Rembo Elementary School, Pembo Elementary School, Makati Science High School, Benigno “Ninoy” S. EMBO teachers worried over Makati-Taguig feud
While the cities of Makati and Taguig are engaged in a tug-of-war on who should exercise control and management of the 14 schools in the enlisted men’s barrio, teachers are wary about its effects on the learners. Raniel Enguancho Biala, a grade 10 teacher at the Benigno Aquino High School in Barangay Comembo, in an interview, said the opening of classes is just around the corner but the dispute between the two cities are affecting the preparation not only of the students but all the stakeholders including teaching personnel. He said there is an urgent need for the writ of execution to be released immediately because it will give them the guide. Biala is basing his observation in an interview with Mayor Abby Binay and he quote, “It is a written command authorizing the office of the said city to implement the decision that has become final and executory.” “So we are waiting for that order because it is a legal basis to the basic issue of who will manage the 14 public schools in the 10 barangays that have been the subject of the Supreme Court ruling,” said the teacher. While the WoE is yet to be issued by the court everything is hanging and the teachers are waiting for a meeting this week so they would know what will they do when the classes open on 29 August. Bial said at present the situation is somewhat hazy and as a teacher he is receiving messages from the parents about what will happen to their children if the school supplies are not given to their children. The free school supplies were rejected by Mayor Lani Cayetano, who proposed that it be given to the victims of calamities. The problem, according to the teacher, is what will be the benefits they (teachers) will get from Taguig City that include the students since in two weeks time the classes will open but they have yet to see some development. Even if there are the so-called meetings held by officials, the needs of the teachers for their teaching chores are not highlighted and what is being tackled are the needs of the students which are also vague. “It seems they are talking always about the needs of the students but the needs of the teachers are not mentioned. I think they need to consider it also because in the case of Makati City we are provided without basic needs that we can utilize in our teaching chores,” said the teacher. The teachers of the EMBO barangays are provided with laptops and other materials and also allowances. But now the teachers feel that they will go back to the basics of using cartolinas when they teach because it is possible that the laptops issued to them by Makati City will be taken away. Makati City Mayor Abby Binay welcomed the decision of Vice President and Education Secretary Sara Duterte to take over the management and supervision of the 14 schools affected by the boundary dispute between Makati and Taguig City. “We look forward to working wholeheartedly with the transition team created by the Vice President. Makati resists Taguig City attempt to takeover 14 public schools at EMBO
Taguig City personnel's attempt to take over the 14 schools in ten enlisted men's barrio (EMBO) on Saturday, 12 August was thwarted by a barricade of combined force of residents non-government organizations, Bantay Bayan, and the police. As early as 6:00 a.m. the barricade was put up near the said schools as they get ready for the arrival of those ordered to take over the schools. In a one-page notice to proceed signed by Dr. Cynthia L. Ayles, officer-in-charge of the Schools Division Superintendent of Taguig City, Mr. Alvin I. Riberfa, the authorized representative of Joint Ventures of Best Security Agency, Inc. and Best Arms Security Agency Inc., was directed to assign and deploy the necessary number of security guard to man the public schools. The schools indicated in the notice are Fort Bonifacio Elementary School, Cembo Elementary School, South Cembo Elementary School, Pitogo Elementary School, East Rembo Elementary School, Comembo Elementary School, West Rembo Elementary School, Pembo Elementary School, Makati Science High School, Benigno S. Aquino High School, Tibagan High School, Bonifacio High School and Pitogo High School. However, Makati City General Services Officer Arnold Magpantay quickly directed Jaime M. Dimaano, authorized the representative of Greatstar Security Services Inc. to implement strict security measures and safeguard the property by not allowing the personnel from Taguig City to enter the school premises without written consent from the city government of Makati. The concerned residents, bantay bayan, NGOs, and the police of Makati City immediately deployed their personnel to prevent the apparent takeover without the necessary papers from the city government of Makati and even from the court. When the entourage from Taguig City composed of the Traffic Management Office and the supposed security guards to be deployed arrived they failed to implement the takeover because they could not show any pertinent papers for their action. Earlier, Makati City Mayor Abby Binay said the schools and other facilities at the 10 EMBO barangays are titled with the city government and said it cannot be taken by Taguig City even if they have won the jurisdictional case as per the Supreme Court ruling. Further, Makati City challenged Taguig City to show their numbers to make sure that they can give the necessary services amounting to P9 billion the city has been giving its 322,000 residents that will be under their wings now base on the court ruling. Makati to file land dispute comment at SC
Makati City administrator Atty. Claro Certeza on Tuesday disclosed that the local government of Makati City will be filing a comment in response to the petition filed by the local government of Taguig City in connection with their land dispute. Certeza said that they will file the petition on behalf of Makati Mayor Abby Binay, who is now in London to attend the London Tech Week and attend a garden reception at 10 Downing Street hosted by Prime Minister Rishi Sunak. “The city has not seen the supposed petition filed by Taguig. However, we have read a press release prepared for the mayor of Taguig. This is perhaps the first time that a petition has been brought before the Supreme Court on the basis of social media posts with dubious authorship, accuracy and credibility,” Certeza said. He also explained that the social media posts invoked by Taguig have made outrageous and irresponsible allegations against President Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos and the Supreme Court. “No right thinking lawyer would petition the High Court on the basis of these posts. Yet, Taguig, displaying unfathomable wisdom, has chosen to do so. Regardless, if we are asked to comment by the Supreme Court, we will file our comment,” said the city administrator. On Tuesday, Taguig Mayor Lani Cayetano on Monday had asked the Supreme Court to probe the Makati mayor’s “troubling claims” on the Fort Bonifacio case as the row between Taguig and Makati over Fort Bonifacio continues to heat up. The urgent manifestation and motion was filed personally by Cayetano asking the tribunal to look into Binay’s statements and to ask her and the Makati City government to show cause on why they should not be sanctioned. She cited Binay’s media statements where she reportedly said she received an order from the Supreme Court setting the Fort Bonifacio territorial dispute for oral arguments. The Supreme Court spokesperson later denied there was such an order. The social media posts, which came out days before Binay’s interview, claimed that the Makati mayor had spoken with top officials in the country, who supposedly promised to help reopen the case. Cayetano said she has “grave concern” over the developments. In a statement in April, the SC said that it has put an end to the Fort Bonifacio case. It ruled that the military reservation, where Bonifacio Global City now stands, is within the jurisdiction of Taguig and not Makati. It also denied Makati’s motion for reconsideration with finality, as well as Makati’s motion to refer the case to the en banc. No state pension funds in MIF
President Ferdinand Marcos Jr. on Wednesday assured the public the national government will not use state pension funds Social Security System and Government Service Insurance System as “seed funds” to finance the proposed Maharlika Investment Fund. The Chief Executive made the assurance in an interview with reporters at the 86th-anniversary celebration of GSIS, hours after the Senate passed Senate Bill 2020 creating the MIF. The Senate approved the controversial sovereign fund bill, voting 19-1-1 at around 2:30 in the morning of Wednesday following 12 hours of deliberations. Marcos explained, however, that the pension funds themselves could invest in the proposed sovereign wealth fund if they believe it is a “good investment.” “We will not use it as a seed fund. However, if a pension fund decides the Maharlika Fund is a good investment, it’s up to them if they want to invest in it, not only pension funds but corporations,” Marcos said. “Those funds, that’s all they do, they grow their money so they have something to give,” Marcos added. Marcos said this is what GSIS has been doing. He said GSIS makes sure that “they are very solid (and) that they are very stable” so that they could give out all the payments (to its members). “We have to differentiate those two things,” he added. In a separate interview, GSIS president Jose Arnulfo “Wick” Veloso said they would abide by the lawmakers’ decision regarding the MIF. “I don’t have any idea about what other discussions are happening about those things. We will only do one thing, whatever the decision of the lawmakers is because they listen to our people, whatever they want, that’s what we will follow,” Veloso told reporters. “So we are just guided by the direction that is given to us,” he added. Unanimous approval During Tuesday’s plenary session which ran until early Wednesday, senators unanimously approved the fund measure shortly after it was approved on second reading. A total of 19 senators voted in favor of the passage of the Maharlika bill, while only one senator voted against it and one abstained. Senate Deputy Minority Leader Risa Hontiveros objected to the measure while Senator Nancy Binay abstained from voting. Senators Aquilino Pimentel III and Imee Marcos, who also opposed the measure, were not present. During the period of individual amendments, senators introduced several changes to the proposed Maharlika Investment Fund, including a ban on government financial institutions such as the SSS, GSIS, Philippine Health Insurance Corporation, OWWA Fund, Philippine Veterans Affairs Pension Fund, Office Pension Fund, and other government social welfare entities investing in the sovereign wealth fund. The amendment, which was introduced by Senator Raffy Tulfo, was accepted by Senator Mark Villar, the principal author, and sponsor of the measure. With the approval of the measure in the Upper Chamber, the Maharlika bill is now closer to enrollment for the President’s signature. Economic team lauds Senate Meanwhile, Marcos’ economic team lauded the Senate for passing the Maharlika Investment Fund. “The economic team commends Senate President Miguel Zubiri and Senator Mark Villar for their thorough deliberation and prioritization of the proposed Maharlika Investment Fund Act,” Finance Secretary Benjamin Diokno said. “The Senate leadership pulled out all the stops to ensure that the bill we bring to the President reflects the administration’s objective of creating a profitable and secure investment fund,” he added. The bill’s speedy approval was backed by Diokno, Executive Secretary Lucas Bersamin, Budget Secretary Amenah Pangandaman, Socioeconomic Planning Secretary Arsenio Balisacan and Bangko Sentral ng Pilipinas Governor Felipe M. Medalla, who were all present during the prolonged Senate session.
