CJ’s psych test result of 4 grade confirmed, rules call for her disqualification

Finally, after previous newspaper reports stated that then candidate for the position of Supreme Court chief justice, Lourdes Sereno, then a junior associate justice, obtained a low grade of 4, the second lowest grade, with 1 as the highest and five the lowest. This low grade was the result of her psycological and psychiatric tests, a prerequisite of the Judicial and Bar Council (JBC) for every candidate for judiciary posts.These reports have finally been confirmed by a former clerk of court in the Supreme Court Wednesday admitted before the House committee on justice that Chief Justice Sereno obtained the second lowest grade in her psychological test, which under the JBC rules, she should have been disqualified for the top position in the High Court.It has not been explained by the JBC why, despite her low marks and disqualification for the post, Sereno’s name landed in the JBC list that was submitted by then President Benigo Aquino.Aquino also appointed Sereno first from a JBC list, despite her having no bench experience.Aquino did not pick any of the senior SC justices for the top post. Instead, he picked Sereno, then already a junior associate justice who would serve in the SC for at least 20 years.It was speculated then that President Aquino wanted Sereno as Chief Justice, for him to be protected by the incumbent justice.Sereno’s voting record in the SC mainly favored Aquino’s cases while he was president.Lately, her vote still favors Aquino, although hers is always a minority vote.Vidal almost failed to testifyFormer SC clerk of court Vidal almost failed to testify as the hearing dragged until late Wednesday night.It was only after Quezon City Rep. Kit Belmonte called the attention of the panel chair that Vidal had not yet been asked any questions.At that point, panel chair, Mindoro Oriental Rep. Reynaldo Umali asked Vidal regarding the results of Sereno’s psychological test.Although pointing to Sereno as having received the second lowest grade, Vidal, who was also the ex-offico secretary of the JBC at that time being the SC clerk of court then, said there were others who also got ratings of 4.She however said she could no longer recall their identities.This only means that no other candidate for the High Court’s top post made it to the JBC list submitted to Aquino save for Sereno.It will be recalled that the JBC refused to provide the justice panel with the results of the psychological and psychiatric tests of Sereno. Impeachment complainant lawyer Larry Gadon said Vidal’s testimony was a big boost to his case against Sereno as the JBC had earlier rejected his request for copies of psych exam report of the chief justice, citing confidentiality of records under its rules.In his complaint, lawyer Lorenzo “Larry” Gadon said Sereno failed the psychological exam administered by the JBC and under the existing JBC policy, ‘an applicant to any position in the judiciary with a grade of 4 is unfit for the job,’” his complaint stated.There quickly went Sereno’s defense, with the usual claim that such does not constitute an impeachable offense.Everything to Sereno and her defense team is not an impeachable offense, whether she failed to file her Statements of Assets, Liabilities and Networth (SALNs) for 17 years or whether she hired an IT consultant with at first a P100,000 a month negotiated contract, after which, Sereno’s consultant had her pay increased which meant revisions in the contract which pay went on without passing through the usual route.Macasaet’s fees had increased from P100,000 per month during her first six-month contract to over P252,000 per month after it was renewed.The head of the SC’s Management Information Systems Office testified that the continued renewal of the contract of the IT consultant hired by Sereno raised a red flag.IT consultant Helen Macasaet’s six-month contract was renewed for over four years, which enabled her to earn roughly P11 million in total.The point in all this establishes that indeed, Sereno is unfit for the job of chief justice, as she has been found to be breaking too many rules and does things without the nod of the other justices.Sereno claims that all the charges raised by Gadon are not impeachable offenses. A reported psychologically unfit Chief Justice is to be retained in her post and for the next 15 to 20 years or so.The two doctors will be attending the next session.At the same time, Gadon lauded the House panel’s directive to the BIR to probe on Sereno’s possible tax liabilities. “The action of the Justice committee directing the BIR to investigate the tax payments and tax compliance of Sereno is living proof of the principle that the law should apply to all , even to the highest magistrate of the land,” said Gadon.Gadon also cited the case of Sereno’s IT consultant whose contract was renewed without bidding despite changes in the terms of reference and increase of the amount of more than double the original contract. “It turned out also that the legal staff of Sereno had the whim and caprices of determining the amount of the increase and the renewals in violation of procurement laws,” Gadon said.“Worse these violations and anomalies were done with the express approval of Sereno,” he stressed.“Even worse , it turned out that the IT consultant was allowed to work at some point without the contract having been signed yet!” the lawyer said.Gadon stressed that Sereno had violated all known procedures of procurement. Game 4: Cavaliers, Celtics look to finish off East sweeps

Conference semifinals, 2010, Boston vs. Philadelphia: Boston wins the first two games at home, then goes into Philadelphia to capture Game 3 and take a commanding 3-0 series lead. Undeterred, Philadelphia won in seven games to reach the Eastern Conference finals. One small detail to note: That was in hockey. If there’s one piece of solace for the Philadelphia 76ers and Toronto Raptors right now, it’s likely this — comebacks from 3-0 deficits are not completely unheard of in major sports. There’s been four of them in the NHL. Another happened in baseball, the Boston Red Sox rallying to oust the New York Yankees in the 2004 AL Championship Series. And even Cleveland has blown a 3-0 lead, albeit again in hockey, and that was of the minor league variety in 1960. But in the NBA, never. NBA teams staring into the 0-3 abyss have never been saved: 129 have tried, 129 have failed. On Monday (Tuesday, PHL time), the 76ers and the Raptors — both down 3-0 after down-to-the-wire defeats in their respective Game 3s of their Eastern Conference semifinal series — get their chance to be the ones who rewrite that ignominious piece of basketball history. Philadelphia plays host to Boston and Toronto is at Cleveland, with the 76ers and Raptors both trying to find ways to extend their seasons. “There’s a breaking point we all have,” Philadelphia coach Brett Brown said. “And I believe that if we can maintain our spirit, why couldn’t we be the one? And I mean that. That’s my goal with us, is to fight. That’s all I know. I can’t see any other way to approach this that makes sense to me. So that’s what we’re going to do.” The odds are obviously overwhelmingly in favor of the Celtics and Cavaliers, who seem destined to meet in the Eastern Conference finals for the second consecutive year. That’s hard to believe, given where those clubs were a week or so ago. Both needed to survive Game 7s just to get out of the first round. The narrative around the Celtics, with no Kyrie Irving for the postseason, was that they would be the East high seed ripe for a playoff upset. Oops. They’ve been unflappable. “I’ve never been around a group of guys, and I’ve been around some really special ones, that can just turn the page and they just play the next play the right way,” Celtics coach Brad Stevens said. “It’s a really unique group in that regard.” The narrative around the Cavaliers was that LeBron James was being asked to do too much and his supporting cast was capable of too little. Oops, again. And now James is five wins from an eighth consecutive trip to the NBA Finals. “We’re getting better,” Cavs forward Jeff Green said. “We’re getting better each game. Our defense is getting better. We’re playing together. Things are turning a corner for us at the right time.” A look at Monday’s (Tuesday, PHL time) games: CELTICS AT 76ERS Celtics lead 3-0. Game 4, 6 p.m. EDT, (6am, PHL time) NEED TO KNOW: The Celtics are playing for a lot of rest. A win on Monday (Tuesday, PHL time), and the Celtics wouldn’t play again until at least Sunday (next Monday, PHL time). And there’s nothing more valuable than days off to heal nagging things at this time of year. KEEP AN EYE ON: Jayson Tatum. Boston’s young standout was brilliant in Game 3 with 24 points, and the Celtics were plus-24 when he was on the floor. In the 11.5 minutes he was on the bench, Philadelphia outscored Boston 39-18. STAT QUIRK: Philadelphia set an NBA record with a 16-game winning streak to end the regular season. The 76ers topped the 15-game end-of-season run by the 1950 Rochester Royals — who exited the playoffs in a sweep. PRESSURE IS ON: Ben Simmons. The 76ers point guard made some atrocious decisions in the final moments of Game 3, like going back up with an offensive rebound late in regulation (instead of burning some clock with Philly leading) and the lazy-looking one-handed inbounds pass for a turnover in overtime that sealed Boston’s win. RAPTORS AT CAVALIERS Cavaliers lead 3-0. Game 4, 8:30 p.m. EDT (8:30am, PHL time) NEED TO KNOW: Pity the Raptors. After coming into these playoffs with title hopes, Toronto has again been unable to solve LeBron James. In the last 15 matchups where the Raptors have faced James, they’re 1-14 and are now on the brink of being ousted by the Cavs for the third straight season. KEEP ANY EYE ON: Kevin Love’s resurgence. Cleveland’s other All-Star has been revived in this series, a development that bodes well for the Cavs going forward. Love finished with 20 points and 16 rebounds in Game 3, responding to urging from Cavs coach Tyronn Lue to play faster. PRESSURE IS ON: Raptors coach Dwane Casey. His moves have been questioned throughout the first three games. Toronto ran a mind-boggling inbounds play in the final minute of Game 3 with guard Fred VanVleet hoisting and missing a 35-foot jumper before the shot clock expired. Casey also benched All-Star DeMar DeRozan for the entire fourth quarter, a bold decision given that he’s the club’s best offensive player. PRODUCT PLACEMENT: James’ choice to wear a Seagram’s 7 whiskey cap to his postgame news conference was interesting. Some suspected he might be trolling the Raptors since Seagram’s was originally a Canadian company. The logo also includes a small crown, so there’s the royal angle. US auto sales spring to life in March

The American consumer returned in force to automobile showrooms in March, lifting an industry that had been plodding along in a post-sales boom hangover. The biggest players in the North American market reported gains Tuesday --- some eye-popping---compared to March 2017. Patriots chase 7th straight AFC title berth against Titans

(AP) — Two things, among many, have been consistent for the Patriots the past decade: Tom Brady at quarterback and New England in the AFC championship game. Brady will try to lead his team to its seventh straight conference title game Saturday when it hosts the Tennessee Titans in the divisional round. It has been a challenging week off the field for the Patriots following reports of turmoil involving Brady, coach Bill Belichick and team owner Robert Kraft. But Brady says he's never doubted his team's ability to compartmentalize potential distractions. "I think we have a job to do and we know what our job is and that's to go out and play football at a high level and play well," he said. "Nothing really should get in the way of that." Tennessee hasn't been to a conference championship game since the 2002 season, but has been invigorated coming off its first playoff win in 14 years. The Titans enter as 13-point underdog, but linebacker Derrick Morgan said it's a role they happily embrace. "Nobody respects us. Nobody really expects a lot from us. That's fine," he said. "We haven't been a very successful team in the last 10 years. So it's easy for people to overlook us. So we've got to take care of business and start winning games like this to get the respect that we desire." To get it, they'll have to stop a quarterback that has been nearly unbeatable in this round of the postseason. Brady is 11-2 in 13 divisional-round games since 2002 , passing for 3,700 yards and 28 touchdowns. He also has a 6-1 career record against the Titans with 13 touchdowns and just one interception. Titans quarterback Marcus Mariota was mostly unflappable in leading his team back from an 18-point halftime deficit to beat Kansas City — the largest comeback on road in Super Bowl era. But since 2001, quarterbacks making their first or second career playoff start are 0-7 against New England. "When it comes down to it, it's all about us," Mariota said. "I think that's kind of been the mindset through this entire season. Ups and downs come and go, you just want to try and make the most of this opportunity." Some things to watch on Saturday: MOVING ON UP: It will be Bill Belichick's 37th career playoff game as a head coach, breaking a tie with Tom Landry and Don Shula for the most in NFL history. HEISMAN BROTHERS: Mariota, the 2014 Heisman winner, and Derrick Henry, the 2015 Heisman winner, combined to turn in the best rushing performance in franchise history in the wild-card round. Henry ran for a career-high 156 yards, and Mariota added 46 yards. Henry will be starting his third straight game with DeMarco Murray already out (right knee). PRESSURE: The Titans ranked fifth in the league with 43 sacks during the season and added four more against the Chiefs last week. Three-time Pro Bowl defensive lineman Jurrell Casey had six from his interior spot, while Morgan led the Titans with 7 ½ sacks. Linebackers Brian Orakpo (seven) and Wesley Woodyard (five) give the Titans a variety of options to attack Brady, not counting backup linebacker Erik Walden (four). EXPERIENCE GAP: New England has 41 players with postseason experience, most of 2017 playoff teams. Fourteen Patriots players have played at least 10 playoff games. That's more such players than 11 other playoff teams combined (13). Before the start of this postseason, the Titans had 18 players who had appeared in a playoff game. BELICHICK AND LEBEAU: There aren't too many current NFL coaches that have been around the game longer than Belichick and Titans defensive coordinator Dick LeBeau . LeBeau has an NFL-record 45 consecutive seasons as a coach, with Belichick at 43. Yet, with Belichick as head coach, he and LeBeau have faced off in the playoffs only once: the 2004 AFC championship game that New England won in Pittsburgh 41-27. The respect between the two is mutual. "Not very many coaches have the record coach Belichick's gotten. In fact he's probably closing in on the best ever," LeBeau said.
