Comelec: No extension to SoCE turnovers
The Commission on Elections on Thursday stressed that there should be no extensions in the filing of Statements of Contribution and Expenditures, which is a detailed document of all the contributions and expenditures made by certain candidates during the election campaign. This comes after the Supreme Court ruled against the poll body’s 2016 resolution that stretched the deadline on the filing of SoCEs from 8 to 30 June 2016, right after the 2016 national and local elections, saying that the poll body has committed grave abuse of discretion over the said resolution. “No extensions now on all our deadlines except in highly meritorious circumstances,” Comelec chairperson George Erwin Garcia said. Under Section 14 of the Republic Act 7166 — which was approved back in 1991 — candidates and treasurers of political parties must file their SoCEs “within 30 days after the day of the election.” The said provision barred elected officials and political parties of winning candidates to assume positions without the filing of SoCE, with penalties on the first offense between P1,000 to P30,000 and on the second offense between P2,000 to P60,000, as well as prohibition in assuming public office. The resolution in question — Resolution 10147 — said that the extension of the deadline was due to, among other things, “several requests,” as well as previous rulings that compel the poll body to extend the deadline on the filing of SoCEs both after the 2010 and 2013 elections. Comelec also argued that the extension would help in their probes on possible election overspending. “The simple expediency of not accepting the SoCE if filed beyond the deadline and just imposing a fine is in effect throwing away the evidence of any infraction of the campaign finance rules and unwittingly assisting in hiding the evidence,” the poll body said. However, the Supreme Court argued that such actions “effectively condoned erring candidates and political parties from administrative liabilities, even if the law does not provide any exempting circumstance.” Meantime, the Partido Demokratiko Pilipino Lakas ng Bayan expressed its gratitude to the Supreme Court for taking the party’s position that the Comelec committed grave abuse of authority in granting extensions on the filing of SoCEs. PDP Laban president and Palawan Representative Jose Alvarez said that the High Court’s decision vindicates the party’s decision in June 2016 to challenge Comelec resolution which granted the extension on the filing of SoCE that favored the Liberal Party and its candidates. The Comelec has recognized in a final and executory decision the PDP Laban led by Party chairman Rodrigo Duterte and Party president and Representative Alvarez as the true and legitimate PDP Laban. “We thank the Supreme Court En Banc for taking PDP Laban’s position in this landmark case and we also welcome the statement of the Comelec that it will no longer grant extensions on the filings of SoCEs in compliance with the SC’s decision,” said Alvarez. “The Supreme Court decision voiding Comelec Resolution 10147 affirms the provisions of RA 7166 that states that the Comelec is not authorized to extend the deadline for the filing of SoCE or not beyond 30 days after the polls conclude,” he added. “This decision should serve as a warning to all candidates that they should just comply with laws like RA 7166 and not seek exemptions from the Comelec. Based on the law, candidates who fail to file their SoCEs on or before the deadline cannot assume the elected position that they won,” the lawmaker said. Credibility challenge
International Criminal Court probers will continue to be barred from the Philippines because the government has a responsibility to the nation not to let them in. Assistant Solicitor General Justice Angelita Miranda said the core issue in the government’s defiance of the ICC’s effort to investigate the drug war is about defending sovereignty. “While we adhere to international laws, the Philippines has a functioning judiciary and the ICC should respect that,” Miranda said on the weekly Daily Tribune program, Straight Talk. International lawyers have said that the principle of complementarity compels the ICC not to interfere in the judicial processes of the country. Through the maneuverings of the opponents of former President Rodrigo Duterte, led by destabilizer Antonio Trillanes IV, the ICC was provided with an alibi to probe the anti-narcotics campaign. Trillanes’ henchman, Gary Alejano, filed a haphazard impeachment complaint against Duterte in 2017, shortly after the destabilizer’s pawn, lawyer Jude Sabio, filed the crimes against humanity complaint with the ICC against the then president. Alejano knew that the impeachment case would not prosper but that was part of the grand scheme of Trillanes to activate an ICC investigation. The president could only be removed through impeachment and proving that the process would not prosper gave the excuse that legal remedies to run after Duterte had been exhausted, opening an opportunity for ICC to enter the picture. Miranda said she supports Justice Secretary Jesus Crispin Remulla when he says he will personally meet the ICC prosecutor when he lands in the country and escort him back to where he came from. Sabio’s petition to the ICC was the product of figures concocted by the political foes of Duterte such as on the existence of the Davao Death Squad during his term as Davao City mayor and the alleged 20,000 deaths linked to the anti-narcotics campaign. Proof of the partisan nature of the complaint lodged with the ICC was very evident, yet the tribunal took it upon itself to still pursue the preliminary examination despite Sabio’s withdrawal of the charges after admitting it was a Trillanes operation. Sabio came out in the open after a dispute over his retainer with Trillanes. In 2019, after ICC prosecutor Fatou Bensouda started her preliminary examination of the crimes against humanity complaint, the Philippines completed its withdrawal from the 1998 Rome Statute which created the international court. Despite the country’s pullout, the prosecutor pointed out that the ICC retained jurisdiction over crimes committed in the Philippines between 2011 and 2019 when it was still a member of the ICC. The inconsolable enemies of Duterte then challenged the disengagement before the Supreme Court which issued a decision siding with the then president as the chief architect of foreign policy. The filing of the ICC case in April 2017 was primarily intended to deflect a determined campaign against drug syndicates but it resulted in the probe of the drug network in the New Bilibid Prison that led to the detention of Senator Leila de Lima, who was justice secretary when the shabu factory in the maximum security prison flourished. The evidence against Duterte and various personalities that the ICC associated with the drug war relied mainly on the testimonies of Arturo Lascañas and Edgar Matobato, who were characters in Trillanes’ stable. Various probes, including Senate inquiries, proved that the revelations of both were a canard as they were drawn from the myth surrounding Duterte. Initially dug up were the supposed vigilante killings when the president was Davao City mayor. The yarn was proven to be without proof in investigations conducted by the Senate. The partisan aim of the Sabio complaint was evident after it hauled practically the entire officialdom of the Duterte administration in the insane petition. Along with the president in the complaint were then Justice Secretary Vitaliano Aguirre, Philippine National Police chief Ronald de la Rosa, House Speaker Pantaleon Alvarez, former Interior Secretary Ismael Sueño, National Bureau of Investigation Director Dante Gierran, and Solicitor General Jose Calida. Even Senator Richard Gordon was included for coming out with a Senate report that threw out the testimony of Trillanes factotum Matobato. The investigations debunked allegations that the extrajudicial killings were state-sponsored. The Palace labeled the allegations as mere vicious noises in the futile campaign to oust Duterte which was its real intention. The plot of the hypocrites now is to brand the Marcos administration as shielding Duterte from prosecution which will not find favor among Filipinos who entrust their overwhelming confidence to both leaders. In contrast, the ICC is trying to shore up its credibility by going after the Philippines. The post Credibility challenge appeared first on Daily Tribune......»»
ONE Champ Christian Lee open to fight with former titleholder Eduard Folayang
Reigning ONE Lightweight World Champion Christian “The Warrior” Lee may be young, but he’s proven throughout his career that he won’t back down from a challenge. In early 2019, the 22-year old jumped up to the lightweight division and survived an early onslaught from grappling ace and former two-time world champion Shinya Aoki to dethrone the Japanese legend and become the new lightweight king. Later that year, Lee stepped up on short notice to take on surging knockout artist Saygid Guseyn “Dagi” Arslanaliev in the finals of the ONE Lightweight World Grand Prix. Lee would stifle Dagi and end up winning the tournament. Now, Lee gets ready to take on all comers as the top dog in one of ONE Championship’s most stacked divisions. Up next for the Singaporean star is expected to be undefeated Moldovian challenger Iuri Lapicus, who took out Thai veteran Shannon Wiratchai and former featherweight world champion Marat Gafurov to earn a shot at ONE gold. For Lee however, he’s ready for anyone that steps up to him. “I will defend my belt against anyone, anytime. The lightweight division is the most stacked division in ONE Championship, so I feel like it will only be right to start with the number one contender and work my way down until my division is cleared out,” Lee told ONE Championship. While not currently in the top-5 of the lightweight division, former two-time ONE Lightweight World Champion and Filipino MMA icon Eduard “Landslide” Folayang appears to be on the radar of the champion as well. “I would love to share the ONE Circle with Eduard Folayang,” Lee shared. “I have a lot of respect for all that he’s accomplished in his career, and I think that we could put on a great show for the fans.” Folayang first captured the ONE Lightweight World Championship back in 2016, stunning the world with an upset win over Aoki, becoming the first man to dethrone the Japanese star. In late-2018, Folayang bested top lightweight contender Amir Khan for the vacant world championship. “Eduard is a very good striker, and is now rounding out his wrestling and Jiu-Jitsu,” Lee added. “However, I feel that his main strengths are his heart and his killer instinct. He’s the two-time former ONE Lightweight World Champion, so he doesn’t have many weaknesses. I think he’s a great fighter.” Another name that Lee mentioned is former UFC Lightweight World Champion Eddie Alvarez, who’s one of the biggest names on ONE’s lightweight roster. “Eddie [Alvarez] has done enough in his career to make him a legend of this sport, so I would love to share the ONE Circle with him when the time comes. I think that our styles would make for an exciting fight for the fans,” said Lee. Alvarez has split his first two outings under the ONE banner, losing to Russian star Timofey Nastyukhin in his debut before bouncing back and submitting Folayang. (READ ALSO: WHAT IF: Eduard Folayang had stopped Eddie Alvarez back in 2019?) “I think that Eddie is a very well-rounded mixed martial artist. He has great striking, wrestling, and just recently displayed great Jiu-Jitsu in his last outing against Eduard Folayang. He’s a very complete fighter who does not have too many weaknesses. It would be a big mistake to underestimate his skill set,” Lee continued. Ultimately, Lee’s plan is to clear out the lightweight division before going back down to featherweight and rekindle an old rivalry against reigning ONE Featherweight World Champion Martin “The Situ-Asian” Nguyen. Lee and Nguyen have crossed paths twice before, with Nguyen coming out on top both times. “After I successfully defend my belt, I plan on going back down to featherweight to challenge Martin Nguyen for his title,” said Lee. “I am the reigning and undisputed ONE Lightweight World Champion, and also the number one contender in the featherweight division. The only reason I go back down to featherweight will be to fight for the title.”.....»»
