Valenzuela lights ‘Tree of Hope’
Celebrities graced Valenzuela City’s “Tree of Hope” lighting ceremony over the weekend which also marked the beginning of a three-month-long celebration of the 400th Founding Anniversary of the city. The occasion was held at the Valenzuela City People’s Park with no less than popular Yuletide singer Jose Mari Chan, Patrick Quiroz and Itchyworms spicing up the rites that set the Christmas spirit of the Valenzuelanos. The “Tree of Hope” lighting ceremony is a yearly tradition focusing on a 50-foot tree, along with several decors and installations. It has been long-running since 2004. This year, the lighting ceremony is coupled with another historical commemoration — the kick-off celebration of the 400th founding anniversary of the City of Valenzuela. It is a modern Pinoy Christmas theme bridging the past and future, as a herald to 400 years of history and progress. Mayor WES Gatchalian were joined by SM Supermalls president Steven Tan and CDO Foodsphere Inc. assistant vice president Jason Ong in lighting up the “Tree of Hope” this year. Solon expects stronger SK programs
Constituents of those who would be elected in the upcoming Sangguniang Kabataan elections could expect stronger and more progressive programs from their respective leaders, according to Senator Juan Edgardo “Sonny” Angara on Sunday. Angara, who chairs the Senate Committee on Youth, said with the completion of the implementing rules and regulations of Republic Act 11768 which introduced new reforms to the SK system, the youth sector can expect better performance from their representatives. “Critics of the SK have questioned its relevance and see it as being politicized,” Angara said. “We introduced the amendments to the SK system in RA 11768 in response to these criticisms with the hope that the young members of the community who will be part of the body will do more as youth leaders and become strong partners of the government in nation-building,” he added. The lawmaker stressed that, for years, the SK has been criticized for undertaking the same activities that do little to benefit youth development such as organizing sportsfests and pageants. To address this, the law provides clear guidelines on the types of programs, projects, and activities that can be undertaken by the SK using the funds provided to them. These include the provision of student stipends, food, book and transportation allowances; sports and wellness projects; skills training, summer employment, cash-for-work, on-the-job training, and livelihood assistance; projects promoting the participation of the youth and their initiation in agricultural, fishery, and forestry enterprises; programs and activities that will locate the youth at the forefront of climate action, environmental protection and conservation efforts; capacity building for grassroots organization and leadership; and programs and activities that address context-specific and intersectional vulnerabilities of young people. “We want to ensure that the SK stays true to its mandate of providing the youth in the communities with programs that will be useful to them and help them become productive members of society,” Angara said. The new measure also addresses the waning interest of the youth in joining the SK, including the absence of honoraria for most of its members. Under the law, the SK members, secretaries and treasurers will now be entitled to allowances that will be charged against the SK funds. A cap of 25 percent on the utilization of SK funds for personnel services was included in the law to ensure that the bulk of the budget will go to programs, projects and activities that will benefit the youth. At present, only the SK chairpersons are entitled to honoraria by virtue of their status as ex-officio members of the Sangguniang Barangays. The measure also authorizes the local government units to provide additional honoraria, as well as social welfare contributions and hazard pay to the SK chairpersons and members through their own local ordinances. SK officials and members will be exempted from taking any components of the National Service Training Program. They will also be entitled to the appropriate civil service eligibility based on the years of service to the barangay, pursuant to the rules and regulations of the Civil Service Commission. China wants new rules
“Sovereignty is ours, shelve the disputes and pursue joint development.” We all, especially our political and economic leaders, better memorize and internalize the above old Chinese doctrine if we’re to confront China’s aggressive geopolitical designs, not only in the West Philippine Sea or WPS, but in the South China and East China Seas as well. Knowing what the other side truly wants helps in forging our correct responses. Anyway, as instructed by China’s then paramount leader Deng Xiaoping to his comrades in 1978, the doctrine — the original is in a 12-Chinese character form — remains the fundamental policy of China’s present leaders and guides their long game in the hotly contested seas. Deng’s doctrine generally tells us that China’s leaders inflexibly believe that China’s “sovereignty” over the contested seas is incontestable — a belief that explains why China is strenuously bent on making everyone accept its expansive “nine-dash” line. Once China’s “sovereignty” is accepted, everything else becomes a matter of negotiations. At this point, however, it must be emphasized that what China means by “sovereignty” is “distinct from China’s disputes over territorial sovereignty” issues — the question of who owns what and where. Of course, “territorial disputes” — as we have now over Ayungin Shoal, Scarborough Shoal, Reed Bank, as well as our fishing rights — attract our attention and get our nationalist fervor going. But Chinese leader Xi Jinping, who hasn’t shelved the Deng-era doctrine, will presumably brush aside all “territorial sovereignty” issues, in the same vein that Deng Xiaoping once told a Japanese Prime Minister, “We believe it is wiser to avoid the issue of (sovereignty) if we cannot agree…” How then does China enable her “sovereignty” and make her neighbors acquiesce to her “sovereignty” over the disputed areas? The short quick answer: international maritime rules. As Isaac B. Kardon, in his insightful book “China’s Law of the Sea,” persuasively argues that “potential specific rules of international maritime law are the basic substance of China’s maritime disputes.” Underlying China’s maritime disputes, therefore, is China’s subtle challenge to the rules of international order, specifically the international law of the sea. Attacking what rules should govern the ocean space within disputed areas means that China, priding herself on being a rising power, is “willing to fully leverage its interpretation of maritime rights under the United Nations Convention on the Law of the Sea (UNCLOS).” And, with China seemingly ignoring or reinterpreting UNCLOS rules that it does not like or finds inconvenient to its national interests, it means she wants her version of the rules to prevail. This is to ensure that her aggressive tactics won’t be seen as violations of the rules but more in keeping with the rules, albeit China’s version. Knowing this immediately tells us why China vehemently rejects our 2016 arbitration win against her. The arbitration victory essentially clarified our “sovereign” rights in the WPS. It is in this light, this significant challenge to the present “rules-based” international order, that we can contextualize China’s “assertiveness” — it’s meant to alter the rules. “Xi and other Chinese leaders have also dramatically augmented the attention and resources into consolidating PRC’s (People’s Republic of China) authority over the vast ‘blue territory’ — that is the maritime space — surrounding the islands,” observes Kardon. As such, the “rapidly growing presence and activities of Chinese Coast Guard cutters, fishing and militia boats, oil rigs, survey ships, and marine scientific vessels all patrolling, administering, surveilling, exploiting, or studying disputed waters” are but to “embody China’s sovereign rights and jurisdiction with a physical, practical presence.” Now, even if all of China’s recent aggressive actions apparently remain below the threshold of war, her actions observes Kardon, “have also not led to any meaningful change to the status of island sovereignty disputes.” Which only means that we’re in for the long haul in our dispute with China. MMDA lauds LGUs, SK for smoke-free parks in the metropolis
The Metropolitan Manila Development Authority (MMDA) commended the Sangguniang Kabataan (SK) and their respective local government units (LGUs) for declaring the parks under the Adopt-A-Park program as smoke- and vape-free areas. The agency, in collaboration with the Department of Interior and Local Government, National Youth Commission, The Union Against Tuberculosis and Lung Disease, Vital Strategies, and Action on Smoking and Health, recently conducted two rounds of communications planning with the SK Federation of the 17 Metro Manila LGUs. Various activities will be conducted at the Adopt-A-Park locations to promote a healthier and safer environment as a result of the said planning activity. MMDA acting chairman Atty. Romando Artes said the youth must be provided with healthy surroundings and public parks must be conducive for activities that would strengthen children’s bodies and protect them against any danger. Starting this week, dubbed as the “Linggo ng Kabataan”, LGUs and their respective SKs will conduct several activities aimed at increasing the awareness of the youth on health and safety. Dr. Madeleine Valera, senior technical adviser of the Union Against Tuberculosis and Lung Disease said that “tobacco use remains a significant public health concern, causing more than 87,000 Filipinos [to lose] their lives to tobacco-related diseases.” She added that “involving the youth in the campaign can make a lot of difference.” “The MMDA and SKs Smoke-Free Parks initiative marks a pivotal stride in creating healthier public spaces where citizens can truly flourish. Converge building 3 new data centers for $60M
Fiber internet service provider Converge ICT Solutions, Inc. is investing $60 million to simultaneously build three new data centers in the country to serve the surge in data requirements. In an interview last week, Converge CEO and Co-Founder Dennis Anthony Uy said each site, which will likely be complete in the next two years, will have a maximum capacity of 1,000 racks. “We will build three data centers this year. We now have a site in Angeles, Pampanga, and Quezon City. Usually, they will have 600 racks per site and expandable to 1,000 and it will be within 18 to 24 months,” Uy said. Converge is currently building a P1-billion data center in Cebu with around 300 racks, which is scheduled to be complete by the third quarter of 2024. Data centers are facilities centralizing an organization's shared information technology operations and equipment to store, process, and disseminate data and applications. Since they house critical assets, data centers are important in sustaining the daily operations of a company. Despite the hefty investment needed for the new facilities, Uy said Converge is not yet planning to hold any fundraising activities. “We don’t have any new fund-raising activity, especially now interest rates are so high. We were just lucky to have secured financial support earlier,” he said. Based on the 2023 First Quarter market report by S&P Global Market Intelligence, the Philippines is poised to book a 13 percent compounded annual growth rate in data center operational space between 2020 to 2025. Appeal of Civil Service Commission (1)
Does the Civil Service Commission or CSC have a legal standing to appeal to the Supreme Court a reversal or modification of its decision by the appellate court? The Supreme Court was once again confronted with this issue in the recent case of CSC vs. Fuentes (Fuentes) [G.R. 237322, 10 January 2023]. In laying down the guidelines as to when the CSC can appeal a reversal of its decisions, the Court found it necessary to revisit the mandate of the CSC and its powers and functions, and did a survey of jurisprudence which involved the same issue. The CSC’s role as the government’s central personnel agency is at the core of its mandate. From this overarching role stems all the others — the task to establish a career service; adopt measures to promote morale, efficiency, integrity, responsiveness, progressiveness, and courtesy in the civil service; strengthen the merit and rewards system; integrate all human resources development programs; institutionalize a management climate conducive to public accountability; and report to the President and the Congress. Section 12, Chapter 3, Subtitle A, Title I, Book V of Executive Order No 292, otherwise known as the Administrative Code of 1987, enumerates the CSC’s powers and functions, which include, among others, the following: SECTION 12. Powers and Functions. The Commission shall have the following powers and functions: (6) Appoint and discipline its officials and employees in accordance with law and exercise control and supervision over the activities of the Commission; *** (11) Hear and decide administrative cases instituted by or brought before it directly or on appeal, including contested appointments, and review decisions and actions of its offices and of the agencies attached to it. *** In the Fuentes case, the Court concluded that the CSC cannot thoroughly perform its constitutional mandate of being a central personnel agency without its power to discipline its officials and employees, and held that “the Commission’s role of being a central personnel agency would be unduly crippled without its disciplinary power.” The case of CSC vs Dacoycoy, G.R. No. 135805, 29 April 1999 (Dacoycoy): Dacoycoy categorically abandoned the Supreme Court’s earlier decision ruling that the civil service law “does not contemplate a review of decisions exonerating officers or employees from administrative charges,” firmly expanded the scope of an “aggrieved party” and declared that, as a party adversely affected by the ruling of the Court of Appeals exonerating the public official or employee, the CSC may appeal the Court of Appeals’ decision to the Supreme Court. The Supreme Court elucidated that under such circumstances, the CSC becomes an aggrieved party — a party adversely affected by the ruling of the Court of Appeals, which will “seriously prejudice the civil service system.” The case of CSC vs Mathay Jr., G.R. 124374, 15 December 1999 (Mathay, Jr.): Seven months after the Court’s promulgation of Dacoycoy, it decided on Mathay Jr. In declaring that the CSC had no legal standing to bring an appeal before the Supreme Court, the latter drew a line between Mathay Jr. and Dacoycoy by ruling that, while Dacoycoy involved nepotism — an administrative case “whose deleterious effect on government cannot be overemphasized,” Mathay Jr. merely involved reinstatement, an issue that can hardly “impair the effectiveness of government.” For this reason, the Supreme Court held that its ruling in Dacoycoy did not apply to Mathay Jr. The reasoning of the Court behind Mathay Jr. stemmed from the fact that the CSC’s power to hear and decide administrative cases instituted by or brought before it directly or on appeal is judicial instead of adversarial. Hence, CSC is more of a judge than a litigant. The Court went on to explain that as a quasi-judicial body with the role of an adjudicator, the CSC should be impartial and detached; and concluded that the CSC would risk becoming an advocate if it would be allowed to appeal to the Supreme Court. ‘Koran burning’ protester gets permit
Protesters seeking the banning of the Koran in Sweden was granted by police a permit to hold a protest outside the parliament in Stockholm on Monday. Protest organizer Salwan Najem told Expressen newspaper he will burn the Muslim holy book many times until it is banned in Sweden. The protest was scheduled for 1 p.m. on Monday, according to the police permit. Najem’s protest follows similar demonstrations organized by Iraqi refugee Salwan Momika that also saw the Koran desecrated, angering Muslim countries. In late June, Momika, 37, set pages of the Koran alight outside Stockholm’s main mosque. A month later, he staged a similar protest outside the Iraqi embassy, stomping on the Koran but leaving before burning it. Both incidents led to widespread outrage and condemnations, with Iraqi protesters storming the Swedish embassy in Baghdad and setting alight its building. Swedish police have previously stressed they only grant permits for people to hold public gatherings and not for the activities conducted during the events. Last week, Sweden ordered 15 government bodies including the armed forces, several law enforcement agencies and the tax office to strengthen anti-terrorism efforts. A similar Koran- and Iraq flag-burning protest in Copenhagen, Denmark last week triggered Iraqis to march towards the Danish embassy in Baghdad. Masks no longer mandatory on AirAsia Phl flights
AirAsia Philippines said on Monday that wearing masks will no longer be required on all domestic flights. This is in response to the national government's decision to revoke the state of public health emergency under Presidential Proclamation 297, which was endorsed by Department Order 2023-017 of the Department of Transportation. Meanwhile, wearing masks for international flights shall remain subject to the existing health protocols in passengers’ country of destination. Only Malaysia, Thailand, Japan, South Korea and Taiwan have lifted the mandatory use of masks as early as Q1 2023. Despite dropping the mask policy, AirAsia PH remains committed to adhering to the highest standards of safety on all its flights. Deep cleaning AirAsia PH Country Head for Communications and Public Affairs and spokesperson Steve Dailisan said deep cleaning and aircraft sanitation will still be in effect on every flight. This way, guests will have peace of mind and confidence as air travel returns to normalcy. Dailisan stressed that there is no room for complacency in the airline business. They want their guests to feel secure when they fly with AirAsia. Although it is no longer a policy, guests and crew may still opt to wear masks whenever they deem it necessary. Police grant permit for Stockholm Koran burning protest
Swedish police said Wednesday they had granted a permit for a protest outside the Iraqi embassy in Stockholm, with media reporting the organisers planned to burn the Muslim holy book. The protest, scheduled for Thursday, comes just weeks after a man set fire to pages of the Koran outside Stockholm's main mosque -- leading to widespread outrage and condemnations around the world. Stockholm police told AFP they had granted a permit for a "public gathering" outside the Iraqi embassy, but did not wish to give further comments on what the protesters were planning. According to news agency TT, the organisers had written in their application that the protesters wanted to burn the Koran and the Iraqi flag, and told the news agency that the same two people who participated in the June protest would be staging the new one. AFP has requested a copy of the application from police, but did not immediately get a response. Swedish police have stressed that they only grant permits for people to hold public gatherings and not for the activities conducted during them. In June, Swedish police had granted a permit for 37-year-old Salwan Momika's protest where he stomped on the Koran and set several pages alight in front of Stockholm's largest mosque during Eid al-Adha, a festival celebrated by Muslims around the world. The permit was granted in line with free speech protections, but authorities later said they had opened an investigation over "agitation against an ethnic group", noting that Momika had burnt pages from the Islamic holy book very close to the mosque. In January, Swedish-Danish right-wing extremist Rasmus Paludan burned a Koran in front of Turkey's embassy in Stockholm to denounce Sweden's membership application to NATO and the negotiations with Turkey to allow Sweden to join the alliance. The two events triggered a series of condemnations in the Muslim world. Swedish police had originally blocked Momika's protest, citing security concerns raised after the January burning. But the decision was appealed and subsequently overturned by two courts which found that the security concerns cited did not have a clear enough connection to the planned event or its immediate vicinity.
