Escudero to BOC: File charges vs. rice smugglers, hoarders
Senator Francis Escudero challenged the Bureau of Customs to immediately file charges against traders susceptibly involved in smuggling and hoarding rice. Escudero said such illegal activities have caused an artificial shortage of food staples and rice price spikes in recent months. The senator then slammed the BOC for its failure to disclose to the public the “names of traders and operators whose warehouses were raided by government authorities for tons of suspected smuggled rice.” “Ang dami nang raids na ginawa nitong mga nakaraang linggo, bakit hanggang ngayon, wala pang kasong isinasampa sa mga taong sangkot? (You have done so many raid activities this past weeks, why is it until now you haven’t filed cases to anyone involved?),” he said. Escudero stressed the need to file charges and ‘bring these economic saboteurs to court” so it could “serve as a warning” that the Marcos administration is indeed serious in its campaign against smugglers and hoarders. He said the authorities should not stop by just conducting a series of raids, instead, the efforts should showcase strong results. The Republic Act 10845 or the Anti-Agricultural Smuggling Act of 2016 considers large-scale smuggling of agricultural products as economic sabotage, with "at least P1 million worth of sugar, corn, pork, poultry, garlic, onion, carrots, fish, and cruciferous vegetables, in their raw state, or which have undergone the simple processes of preparation and preservation for the market, or a minimum of P10 million worth of rice, as valued by Bureau of Customs." “Why haven't I heard anyone sued for economic sabotage or something? Who owns these warehouses? Who are the people involved?" Escudero asked, citing that the BoC-Port of Zamboanga seized some 42,180 sacks of rice worth P42 million in Barangay San Jose Gusu on 15 September. The local bureau inspected the warehouse on 19 May after receiving information that smuggled rice was being stored in the area. Two weeks prior, the BOC inspected three warehouses in Bulacan and found these stocked with suspected smuggled imported rice worth P505 million. It temporarily sealed and guarded these warehouses located inside the Intercity Industrial Complex in Balagtas, Bulacan. Aside from filing charges, Escudero said the government should also update the public on the development of these cases “in the spirit of transparency.” "Ito ang mga dapat nilang masagot ngayon (this what they should answer now): who oversees the disposition and how will it be disposed? Ano ang gagawin nila sa mga bigas na nakumpiska? (What will happen to confiscated rice?),“ Escudero said. In a news forum last Saturday, BOC Port of Zamboanga chief, Benito Lontok, said the agency is planning to donate the smuggled rice for the implementation of the Department of Agriculture’s Kadiwa Program and the Department of Social Welfare and Development’s assistance programs. However, Lontok said the plan is still “subject to approval” of BoC Commissioner Bienvenido Rubio and Finance Secretary Benjamin Diokno. 'DA should step up' Meanwhile, Senator Alan Peter Cayetano urged DA to take more proactive measures to address the price hike in rice. Cayetano lamented the prices of rice remain high despite the government’s implementation of a price cap on the product. President Ferdinand Marcos Jr. earlier blamed smugglers and hoarders for causing the increasing prices of rice in the country. Hence, issuing the executive Order No. 39 on 31 August, mandated price ceilings for regular-milled rice at P41 per kilogram and well-milled rice at P45 per kilogram. The EO 39 will be implemented nationwide beginning 5 September. Marcos vowed the government would continue going after the rice smugglers and hoarders, including the imposition of penalties for those found guilty of violating the mandated price cap for rice. Cayetano lauded Marcos for this effort and for being a “sincere Agriculture Secretary” with a primary intent on the country’s food situation. However, he stressed that other DA officials should not rely on the Chief Executive for solutions. “The DA to seek long-term solutions to stabilize food prices, emphasizing that temporary measures may not address the root causes of the problem,” he said. During one of the many well-publicized Senate hearings in the aftermath of the infamous Mamasapano Massacre in 2015 that led to the murder of 44 Special Action Force troopers, one Miriam Coronel-Ferrer was grilled by an irate Sen. Alan Peter Cayetano. Coronel-Ferrer was then chairman of the Aquino Government’s peace panel that had signed an accord with the Muslim rebels on the establishment of a Bangsamoro Autonomous Region, an agreement widely regarded as having signed away a lot of our Republic’s prerogatives in favor of armed Islamic insurgents. Senator Cayetano demanded to know from Coronel-Ferrer why the government dragged its feet in providing artillery support and reinforcements to the trapped policmen, to which she notoriously replied, “The policy of the government is to first negotiate with the armed groups fighting with state forces.” To this, Cayetano replied, “No government in the world negotiates with terrorists.” Coronel-Ferrer’s response left most in the Senate gallery dumbfounded when she said, “I know of no such policy.” Yet here she is, one of this year’s Magsaysay Awardees. Ironic it is that an award founded in honor of one of the best-loved Presidents this country has ever had, would be given to an underling of someone who would become one of the most hated in Philippine history (after a string of scandals such as the Luneta hostage fiasco, “Yolanda” and Dengvaxia, among many others). Even more ironic is that she is being given the award for her supposed “transformative power of non-violent strategies,” when all that she succeeded in transforming was forty-four elite police personnel into corpses due to the appalling display of violence of a rebel movement she greatly enabled. She also almost transformed our Republic into a dismembered state; thank heavens the backlash from the massacre caused the agreement she brokered to be shelved in favor of one much less onerous to the Philippines. But what is to expected of an award-giving body co-opted by Yellowtards, as a quick look at the roster of its chairman and trustees will readily reveal. Composed of men and women with strong ties either to Mrs. Cory Aquino and/or her anointed successor, Fidel Ramos, these people either served in the Cabinet or important agencies of one or the other President; or had enjoyed — or are still enjoying — high positions in big corporations supportive of the Aquino Yellow narrative. So it should be of no wonder that these denizens of the same echo chamber would exhibit the proclivity, remarkably endemic to the Aquino clique, of giving awards and accolades to each other. As if that would somehow compensate for the fact that the narrative that has kept them in power for more than 30 years had been totally demolished. Just note the decorations given to Leni after she lost, from fellowships to doctor’s degrees honoris causa to trophies for this and that dubious achievement. Such a pity that the Magsaysay Awards should so decline in prestige. It used to be an important recognition for Asian leaders, counting among its Filipino awardees the likes of Francisca Aquino, Rosa Rosal, F. Sionil Jose, Lino Brocka, Dr. Fe del Mundo, Nick Joaquin, James Reuter, Bienvenido Lumbera and Miriam Defensor-Santiago. Yet, like many others touched by the Yellow reverse-Midas touch, what used to be gold is turning to crap, with Yellow stalwarts Jesse Robredo, Sheila Coronel, Conchita-Carpio Morales, Haydee Yorac and Hilario Davide among the list. Cringy, especially since among those who have previously received the honor were the Dalai Lama, Thai Premier Anand Panyarachun, Mochtar Lubis, Akira Kurosawa, Ravi Shankar and Mother Teresa. To use an overworn cliché, President Magsaysay would be turning in his grave to know that his eponymous award has become another way for those in the same political group to pat themselves on the back. Senator Christopher “Bong” Go said the meeting between former president Rodrigo Duterte and incumbent President Ferdinand “Bongbong” Marcos, Jr., marked a rare occasion where two leaders from different administrations come together. In an interview after his visit to Tuy, Batangas on Thursday, August 3, Go stressed the importance of the said meeting on the country's foreign relations and domestic political landscape. It can be recalled that Duterte just came back from a recent personal trip abroad, where he was given an opportunity to meet with Chinese President Xi Jinping. “Isinama lang po ako ni dating pangulong Duterte sa pulong nila ni Pangulong Bongbong Marcos. Sila naman po ang nag-usap muna. Sa pagkaalam ko ang napag-usapan nila ay tungkol doon sa pagbisita ni former president sa China kung saan po ay naimbitahan siya sa inagurasyon ng building na pinangalanan po sa kanyang yumaong nanay, si Soledad Duterte,” Go said. “Bilang dating presidente ng bansang Pilipinas at kaibigan n’ya si President Xi ng China, naimbitahan po siya sa pagpupulong. Napag-usapan nila ang kanilang pinagsamahan noon bilang parehong lider at si (dating) pangulong Duterte naman po ay pumunta kay Pangulong Bongbong Marcos para ireport po, bilang kanyang obligasyon as a citizen nitong bansa natin, na ireport po sa Pangulo kung ano ang napag-usapan nila doon at ano po ang makakatulong sa ating bansa,” he added. Go underscored the significance of such dialogues, stating that they foster a sense of continuity in governance and allow for the exchange of valuable experiences and wisdom between the two leaders. Duterte as special envoy to China: ‘Why not?’ Zubiri says
Senate President Juan Miguel “Migz” Zubiri on Thursday said he sees nothing wrong with the proposal to appoint former President Rodrigo Duterte as special envoy to China. In a television interview, Zubiri was asked about his stand on the proposal to appoint President Ferdinand Marcos Jr.’s predecessor to represent the country in its negotiation with China on the issue of the West of the Philippines. “Why not? Anyone who can help diplomacy in this part of the world, in this economic zone of ours, the exclusive economic zone would be a big help,” he said. “It could be president former President Rodrigo Roa Duterte,” he added. Aside from the former chief executive, Zubiri said that Senator Alan Peter Cayetano, who floated the idea to tap Duterte, could also represent the country in its negotiation with China. “It could also be Alan, why not Senator Alan as well to help in the backchanneling since he’s quite close to some of the officials there being the former Secretary of Foreign Affairs?” he said. On Wednesday, Zubiri and 20 other senators met with Marcos and his wife First Lady Liza Araneta-Marcos in the Malacanang Palace after the latter hosted a “casual dinner.” Prior to his dinner with senators, Marcos also met with the older Duterte, who went to China last month. Zubiri said during their meeting with the president, the latter mentioned that it was Duterte who brought up the issue of the West Philippine Sea during his meeting with Chinese President Xi Jinping. “What he mentioned to us, was during the duration of President Duterte’s meeting with Xi Jinping, the topic of the West Philippine Sea never was brought up,” he said. “Apparently, it was never, according to the President, casually saying that it was never brought up,” he added. He continued: “It was actually President Duterte to mention to Xi Jinping that on the issue of the West Philippine Sea, look kindly to the Philippines.” Duterte’s trip to China caught the national attention as the country was waiting for the decision of the International Criminal Court on the appeal of the Marcos administration to block its investigation into the former president’s controversial war on drugs which killed thousands of suspected drug personalities. Graft buster clears Cusi
Citing the presumption of regularity, the Office of the Ombudsman threw out the graft complaint of a New York-based billionaire against former Energy Secretary Alfonso Cusi, other Department of Energy officials, Davao City-based executive Dennis Uy, and several others over the sale of 90 percent of the shares of the Malampaya natural gas consortium. On 18 October 2021, US-based geologist Balgamel Domingo and Filipino-American anti-Duterte leaders Rodel Rodis and Loida Nicolas-Lewis filed charges against Cusi, Uy, and the others involved in the sale of the Malampaya stake to the Udenna group of Uy. In a copy of the ruling obtained by the Daily Tribune, the Ombudsman said it could not delve into the complaint on the legality of the transaction since “the authority to make such a determination belongs to the court.” “Seemingly, this complaint is in actuality a collateral attack on the validity of the Share Sale and Purchase Agreement,” it said. The decision declared that “matters of such tenor are not determinable in a preliminary investigation before the Ombudsman’s Office.” “Without any judicial determination decreeing the illegality of the Share Sale and Purchase Agreement, this Office is left with nothing but to acknowledge its validity,” the ruling said. The Ombudsman cited a precedent in the case of Teresita Buenaventura vs Metrobank, in a ruling that stated: “The burden of showing that a contract is simulated rests on the party impugning the contract.” “This is because of the presumed validity of the contract that has been duly executed,” the Ombudsman ruling read. “Wherefore, the criminal charges for violation of Section 3(e) and of Republic Act 3019 against the respondents are dismissed for lack of probable cause.” The ruling was signed by members of a Special Panel of Investigators composed of Ronald Allan Ramos, Josephine Mae Rosapapan, Francisco Alan Molina and Bonifacio Mandrilla. Prime takes control The operation of the Malampaya project was recently assumed by the Razon group’s Prime Energy which bought a 45-percent stake from Malampaya Energy XP, or MEXP, of the Udenna group. MEXP had bought the shares of Shell Philippines Exploration B.V., or SPEX, in the consortium. The Department of Energy had branded the complaint a political move since the two Fil-Am lawyers in the suit were prominent in the “Oust Duterte” movement in the United States. The complaint alleged that Cusi and other energy officials had granted “unwarranted benefits and advantage” to Uy’s UC Malampaya in the buyout of Chevron’s share in the consortium. Udenna, through spokesperson Raymond Zorilla, said there is “no law requiring approval of the transfer of shares of companies that have an interest in Malampaya.” Zorilla said the transfer of Chevron and Shell shares underwent strict bidding processes and due diligence by both multinational oil and gas players. “The share sales were above board and legal and had to pass scrutiny by Philippine regulators, international lenders, and the said private multinationals involved,” Zorilla added. Cusi, in an interview with Daily Tribune, had said the DoE was not involved in choosing the buyer of the shares of Shell and Chevron in the Malampaya project. “The DoE did not get involved in the sale (of shares). We don’t know that they are selling. Our question was what their standards are for choosing Udenna. Why didn’t you choose the big companies, and why Udenna?” he said. Industry experts said the sale of shares was a private transaction that the accusers, who are US lawyers, should have been very familiar with. Cusi said the DoE, during his watch, went beyond its mandate by reviewing the technical, legal, and financial aspects of the transactions, the results of which were provided to the public. Political agenda The complaint, he said, had an underlying political agenda connected to his being the head of President Rodrigo Duterte’s Partido Demokratiko Pilipino-Lakas ng Bayan or PDP Laban. “It is not only political propaganda against me, but it also has a destabilization background… because I’m the president of the PDP.” The complaints, in turn, stemmed from the unending Senate inquiries on the Malampaya deals. The DoE said the Senate probes and the controversies that resulted from them had caused costly delays in the review process that would ultimately affect the country’s energy security. To refute a recent remark by Senator Sherwin Gatchalian, the DoE, in a statement said: “The inquiries of Senator Gatchalian are causing undue delay to the timeline of the consortium corporations, and this may eventually take its toll and put our energy security at risk.” The DoE’s approval of the sale of shares of stock of Chevron Malampaya LLC, one of the three corporations in the Malampaya Gas Field Project Consortium, had been dubbed by Gatchalian, chairman of the Senate Committee on Energy, as “lutong Macau.” It also backed the Udenna assessment that the deals were above-board. “When the sales were made, both Chevron Philippines, which owned Chevron Malampaya, and Shell Petroleum NV, owner of SPEX, followed rigorous global standards,” the DoE said. Nicolas-Lewis was part of a 25-person delegation from the US-Philippines Society, a private group comprising business executives and diplomats, who met with Duterte a week before his inauguration as president in 2016. Nicolas-Lewis was then accompanied by former Philippine Ambassador to the US Jose Cuisia, PLDT chair Manuel V. Pangilinan, retired American diplomats, and executives of Coca-Cola, SGV, JP Morgan, and other top corporations. Nicolas-Lewis is the sister of former National Anti-Poverty Commission chairperson Imelda Nicolas, who was one of the “Hyatt 10” Cabinet members who turned against then-President Gloria Macapagal-Arroyo in 2005. Imelda and most of the Hyatt 10 members ended up getting key posts in the administration of President Benigno “Noynoy” Aquino III. Imelda was made head of the Commission on Filipinos Overseas. Nicolas-Lewis plot bared In February 2018, former President Duterte bared intercepted conversations that indicated Nicolas-Lewis was behind efforts to push the International Criminal Court, or ICC, to probe his war on drugs. Duterte revealed a recorded conversation between Lewis and another political opponent whom he did not name. “I was listening to the tapes of their conversation. It was provided to me by another country, but the conversation was somewhere in the Philippines and New York,” Duterte said. He said that among the recordings was one in which Lewis allegedly told another person: “See you in the headquarters when the case is filed.” Duterte then said in a public address that he was aware of developments on the ICC case and that lawyer Jude Sabio, the main complainant in the case, was a paid hack of Magdalo Senator Antonio Trillanes IV and Rep. Gary Alejano, both failed putschists. Sabio withdrew his complaint before the ICC and revealed that the case was the handiwork of the dirty tricks factory of Trillanes. In 2016, Duterte pointed to Lewis as the financier of an alleged destabilization plot against his administration. Senate to adopt Hontiveros, Zubiri reso condemning China’s incursions in WPS
The Senate is set to adopt the resolution filed by Senator Risa Hontiveros which urges the national government, through the Department of Foreign Affairs, to elevate China’s incursions in the West Philippine Sea to the United Nations General Assembly, Senate President Juan Miguel said Monday. According to Zubiri, Hontiveros’s Senate Resolution No. 659 will be merged with Senate Resolution No. 707, which he authored, on Tuesday. “We have agreed to merge the provisions between the two resolutions and pass a resolution condemning the harassment of the Filipino fishermen and continued incursions of Chinese Coast Guard and militia vessels in the West Philippine Sea,” he said in a statement. He issued the statement after members of the Senate went into an executive session with DFA Secretary Enrique Manalo, Armed Forces of the Philippines Chief of Staff General Romeo Brawner Jr., and National Security Adviser Eduardo Año. “It was a very cordial, straightforward, and productive meeting between the senators and our key government officials dealing on the West Philippine Sea,” he said. For her part, Hontiveros welcomed the positive development with the resolution which aims to condemn China’s harassment of Philippine vessels in the WPS. “It is clear that the people’s will succeeds and not the will of China,” she said in a separate statement. During last week’s session, Hontiveros sponsored the resolution before the Senate floor, which was followed by the co-sponsorship of Zubiri. The resolution was also supported by Senators Raffy Tulfo and Jinggoy Estrada. However, Senator Alan Peter Cayetano, who once took the helm at the DFA under the Duterte administration, managed to block the Senate’s approval of the resolution.
